CITY COUNCIL OF THE CITY OF ARCADIA
SPECIAL MEETING
MAY 6, 1974
The City Council met in a Special Session on May 6, 1974 at 7:30 p.m.
in the Council Chamber for the purpose of considering bids received for
the purchase of police cars and to, receive a progress report from the
City Manager concerning the present status of the City Refuse Service
Company.

Councilman Helms. Mr. Helms had previously signed a waiver
in connection with the holding of this Special Meeting.
The City Manager reparted on the bids received for the purchase of
eleven police cars. He recommended the award of contract with the City
retaining the old cars to be sold at public auction. He asked per-
mission to keep two of the old 11 cars - one for a reserve for the
police department and one for replacement of a pool car which is in
very poor condition. It was MOVED by Councilman Gilb, seconded by
Councilwoman Lauber and carried on roll call vote as follows that the
City accept the bid of Mission Chrysler-Plymouth in the amount of
~$4l,278.45 for the new cars; that two cars be retained as recommended
and the balance of the old cars to be sold at public auction. Funds in
the 1973-74 Budget.

The City Manager reported on the current status of the City Refuse
Company and the problems which are being encountered due to pickups
running a full day late. The City Attorney outlined the procedure
which could be followed if the"situation conI'Lnues.' He explained in
part that the Company has been notified that it has 10 days in which
to correct the situation. Concern was expressed on the possibility
that the company's liability insurance may be cancelled and the company
could not operate under such circumstances.
The City Attorney continued ~n part that .should Council find there is
a material breach of contract or that the contractor is unable to
fulfill his obligation the Council could, under an emergency declaration,
retain another firm for a period of perhaps 60 or 90 days to carryon
the pickup as close to the conditions of the contract as possible.
Various sections of the contract were explored and in order to apprise
the new members of Council of the history of this matter the City
Manager will put together some background material and hand deliver it
to Council posthaste.
Notices have gone to the parties involved to be present at the regular
meeting of May 7 at which time Council will receive testimony. Where-
upon it was MOVED by Councilwoman Lauber, seconded by Councilman Gilb
and carried unanimously that this item be placed on the agenda for
May 7 just prior to City Manager's item No.1.
At 7:55 p.m., Council adjourned to the Conference Room for an executive
session.
At 11:15 p.m., Council reconvened and adjourned immediately thereafter
to Tuesday May 7 at 7 p.m. in the Conference Room;_
