session on Tuesday, May 21, 1974 at 7:30 p.m. in the Council Chamber of

The Recreation Director exhibited a new addition to the John Panatier
Nature Museum in Wilderness Park - that of a Bald Eagle from Anchorage
and shipped to the City from the Bureau of Sport Fisheries and Wild
Life.
HEARING Application of D. C. Sturniolo, dba Derby Restaurant, for a Council
(Dancing) Permit to allow dancing at 233 E. Huntington Drive. Staff report indi-
APPROVED cated the establishment is a permitted use in its C-2 & D zone on a
(Derby) ~conditional use permit basis. Conditions of approval were set forth in
fiI ,l~ ~\ the report dated May 21, 1974. Mayor Scott declared the hearing open

1. A minimum dance floor area of 8% of the gross floor area, less
kitchen, restaurant and storage areas, or 100 sq. ft. whichever
is greater.

2. The dance floor area shall be required to be maintained for dancing
only when dancing is occuring, provided no required exits are
blocked or restricted by the relocation of furniture, etc., which
may be moved to permit dancing.
3. The maximum decibel level for music either live or recorded
(amplified or unamplified) shall not exceed the ambient noise
level - excluding the music itself - measured at any point on the
property line.
4. That the development shall be in accordance with the approved
plan s .
5. Compliance with all provisions of Section 6412 et. seq. of the
Municipal Code.

Time and place scheduled to hear any objection to the assessments in
connection with the installation of a street lighting system abutting
private pc0nerty known as. Rancho Road, 1007 to 1050, 12 lots. Cost to
each propertj is $97.92. It was noted in the staff report dated May 16
that seven of the property owners have already deposited' $90 each toward
their assessment. ,Mayor Scott declared the hearing open and no one
desiring to be heard the hearing was CLOSED on MOTION by Councilman Helms,
seconded by Councilman Gilb and carried unanimously.
The City Attorney then presented, explained the content and read the
title of Resolution No. 4430, entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF ARCADIA CONFIRMING THE COST OF INSTALLATION OF A
STREET LIGHTING SYSTEM AND ASSESSING THE COST AGAINST THE ADJACENT
PROPERTY PURSUANT TO THE IMPROVEMENT ACT OF 1911 (RANCHO ROAD).

carried on roll call vote as follows that the reading of the full body

The City Attorney presented, explained the content and read the title
of Resolution No. 4431, entitled: "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA DETERMINING THAT THE PAYMENT OF CERTAIN ASSESSMENTS
UNDER THE IMPROVEMENT ACT OF 191.1 MAY BE MADE IN ANNUAL INSTALLMENTS
(RANCHO ROAD).
It was MOVED by Councilman Helms, seconded by Councilman Gilb and
carried on roll call vote as follows that the reading of the full body
of the resolution be WAIVED and that the same be ADOPTED.

PERSONNEL Council received the recommendation of the Personnel Board concerning
Class \modification of class specifications for Fire Engineer and Fire Captain
Specifications (dated May 16, 1974). The modifications had been recommended to the

Walt Landor, 1654 Rodeo Road, commended the Council on its dedication to
its responsibilities to the citizens.

Paul Mnoian, 501 Arbolada Drive, owner and operator of a rubbish disposal
business, stated in psrt that in his opinion the City had acted too
hastily in its award of the residential rubbish pickup contract to the
Best Disposal Company for a period of 90 days. He asked that Council
provide adequate time for prospective bidders for the residential rubbish
pickup contract for the City. He made reference to the card which went
out to all' residences; that in his opinion it was damaging to his company
as it could be interpreted that the City had given an exclusive to this
one disposal Company for commercial as well as residential. He felt the
City should send out another card indicating there are other companies
licensed to do commercial rubbish pick up. He was advised by Mayor Scott
that he should follow procedure for answers to his questions; confer with
staff and then if not satisfied his next recourse would be to Council.

Ray Jones, independent insurance broker with offices at 509 S. First
Avenue, referred to a Broker of Record letter relative to a rate change
in the hospitalization, life insurance and income disability for city
employees. He said with this letter outstanding there would be no way
the other insurance agents could submit quotations. He asked Council
to rescind this letter and let all agents bid. He explored ways of
doing this and also other available plans for the same coverage. It
was the consensus of Council that the Broker of Record, James P. Kennedy, Jr.
be invited to confer on this matter at a Council meeting to be held on
Thursday May 23.
PICKUP Councilman Gilb submitted for the primary edification of Paul Mnoian
and others present what occurred on the rubbish matter: After en-
deavoring to contact City Refuse Service Company and after the rubbish
was piling up in the streets it became a health problem. The Council
met on Saturday morning May 11 to resolve the emergency. The main
concern was to locate a company with the proper equipment, availability
and willingness to come in and pick up on an emergency basis with the
knowledge that it would go out to bid at a later date. Some of the
\J)COmpanies did not want to come in on such a basis. Action was finally
I~/taken after a great deal of work. That the City Manager acted on the
I~ full advice and counsel of Council as to what company should pick up
the refuse. Best Disposal was able to pick up the trash on that day,
Saturday; that by 6 p.m. that date streets had been cleared. Cards
were mailed to residents at the earliest possible time because of the
money which had been paid in advance for trash pickup and residents had
to be so informed. The card had reference to residential pickup only;
that nothing underhanded was done - everything was done over and above
board and that Council tried to give everyone full consideration.
Council reviewed the proposed agreement between the City, acting on
behalf of the eleven participating cities in the West San Gabriel Valley,
snd Envicon Corporstion, physicsl, ecological snd socisl science-con-
sultants, which would csrry out the work outlined in sn amended proposal
(copies in city offices.) Some discussion held on the provision indi-
cated as No. 5 concerning arrangements and in order to conform to the
( wording in the Agreement the Planning Director will be substituted for
( /I(~ ~{;Willism Woolard. It was then MOVED by Councilwoman Lauber, seconded by

the specifications for the award of a new contract for residential
rubbish pickup will be resdy in about 3,weeks; that Council will award
the new contract some time during the next 90 days. Mr. Young asked

of the low maintenance type. In response to an inquiry by Councilman
Saelid as to what the improvement itself would cost, not the plans and
specifications, the Assistant City Manager advised that the present
basic estimate would be $35,000 which is in the Capital Account and
earmarked for Chicago Park development. He then exhibited a diagram
of the area indicating areas of interest.
Councilman Saelid observed that the 1200 lineal feet works out to about
$30 per lineal foot and asked how that figure compares with the cost of
improvements made by El Monte to the south. The Assistant City Manager
said that it would be less costly because EI Monte had used asphalt and
painted over that but that the long term maintenance and appearance
would not compare with what is proposed for Arcadia.

Council received the results of a survey compiled by the Director of
Public Works concerning alternati,ve solutions to the traffic generating
on Perkins Drive. The Department submitted 33 questionnaires and 17
have been returned and the replies incorporated in the report dated
May 21.
Bill McKenzie, 1654 Perkins Drive spoke to the situation and submitted
in part that he was opposed to the one way street solution; that to him
the basic issue is the use of the street as a short cut to avoid the
signal at Virginia Road. He felt something should be done to discourage
this as the traffic is fast and there are many children on Perkins Drive.
Grace Clark, 1621 Perkins Drive, submitted that in her opinion traffic
on Perkins Drive is not any worse now than it has been for a number of
years. The problem to her seems to be the children playing in the
street. She signed the petition asking for consideration
It was the consensus of Council that the residents should get together
and arrange for a meeting with the Director of Public Works and that the
matter be placed on the agenda for June 18. Mr. McKenzie said he would
make these arrangements and contact the Director of Public Works as to
a date when the residents could be present. It was MOVED by Councilman
Saelid, seconded by Councilwoman Lauber and carried unanimously that
this matter be back on the agenda for June 18.
On recommendation of staff it was MOVED by Councilman Gilb, seconded by
Councilwoman Lauber and carried unanimously that the plans and specifi-
cations for the slurry sealing of various city streets be APPROVED and
that the City Clerk be and she is hereby authorized to advertise for I
bids to be opened June 14 with recommendation to Council on June 18.
This project is part of the department's annual maintenance program and
will be financed from State Gas Tax Funds.
On recommendation of staff it was MOVED by Councilman Gilb, seconded by
Councilman Saelid and carried unanimously that the plans and specifi-
cations for the resurfacing of the tennis courts at the High School and
at Hugo Reid Park (Job 424) be approved and that the City Clerk be and
she is hereby authorized to advertise for bids to be returned June 14
~ith recommendation to Council on June 18. This project is funded in
the current 1973-74 Recreation Department budget in the amount of
$4,600 plus a contribution from the School District in the amount of
$2000 spread over a t~o year period. It is anticipated there will be
a deficiency of available budgeted funds, the extent of ~hich will be
determined on a receipt of bids.

COMMISSION
Council received a report from staff indicating that the work performed
by Barron & Eckhart in the improvement of the Industrial Park Assessment
District 72-1 has been satisfactorily completed and acceptance thereof
was recommended. It was MOVED by Councilman Gilb, seconded by Council-
woman Lauber and carried on roll call vote as follows that the work be
accepted and that final payment be authorized pursuant to the terms of
the contract.

Staff reported that the City Corporation Yard was constructed in 1967 to
include a facility for a paint spray booth as well as an adjoining
paint storage room. At the time it did not include an automatic fire
control sprinkler system and that the City's insurance carrier has
recommended that the City install such a protection system. It has been
the staff's intention to have this installed and it received quotations
from two companies:

be sccepted; that $3800 be appropriated from the General Contingency
Account and that the Director of Public Works be instructed to proceed
with this installation.

Staff reported on the bids received for the furnishing of uniforms for
var!.ous city personnel and made recommendation for the award of contract.

Uniform Service for a period of two years. Funds are in the 1974-75
depsrtmental operating budgets. (See report dated May 15).

Council received the financial report for the month of April. Areas of
concern were pointed out by Councilman Helms and it was felt by Council
that a more complete report would be in order. Staff noted each item
questioned and will check into them and report back to Council.
Council received s copy of the Bicentennial Commission's goals as
approved by the County Bosrd of Supervisors. 'Its purpose is to stress
the importance of individual celebrations to be planned and carried out
, in every part of the country. It was noted that Councilman Helms hsd

Council received the request of the Foothill Free Clinic for financial
assisrance in the amount of $5000 from General Revenue Sharing Funds.
The City Ma~ager submirted that the program is sufficiently similar to
the locaL HOY program in which the City assists financially when needed
and it does not seem appropriate to part icipate in another agency"
Council acknowledged the fine work the Foothill Free Clinic is doing
and it is one that is geographically Limited to Pasadena but Arcadia has
its own serviceo
Rev. Bob Boyer, Sr. Edmonds Episcopal Church of San Marino, Chairman of
the Board of the Free Clinic. stated in part that they were faced with
financial drain in 1973 and because it had helped over 300 members of
this community is why the letter of request was sent to this city. It
was noted by staff thar Lt is true many seekLng help quite often go
outside of the city, and many come here from other cities, however
there just aren't funds to finance such agencies out of the immediate
area~ It was brought out that funds are not budgeted and that monies
as needed are met from the Contingency Account.

carried unanimously that Council accept the recommendation of staff in
this matter, The City Manager will so norify the Clinic.

Council received a communication from Ai Coke) Meeker Development
Company, suggesting that the present City policy concerning sewer
connections t,o the main sewer line is unreasonabl,e. At the present
time it is the responsibility of the property owner and in rno3t cases
if there is a blockage the owner calls in and pays for the services of
a Sewer contractor who ha,s the necessary specialized equipment.
Al Coke, 2081 Carolwood Drive, spoke ar lengrh staring Ln parr that in
his opinion the existing ordinance~ are ambiguous and unfair when they
make the property owner responsible for the maintenance of the lateral
portion of the sewer sY3tem in a dedicated street between the main line
in the center of the street and the owner's property. It fa asking the
owner to be responsible for something not on his property and over
which he ha5 no control. He noted other areas which have assumed this
responsibility, He noted the subject case has been resolved however he
felt rhe building ordinances shQuld be surveyed and offered his services
in assisting in such a study.
In a reporr dated May 21 the Director of Public Works stated that rhe
Couney Sanication DistrlcL felt it would be very unusual for any public
agency to accepr such responsibility and submitted criteria therefor.
He fele the exisring ordinances clearly make the property owner re-
sponsible for the maintenance of (he house connection lateral serving
his property and thar thus far that i. the intent of the Ciry. He also
noted rhat in 14 years he can recall only two or three instances where
thi.s has been a problem. In exploring the situation which brought this
instance about he advised that it was an unusual case where the property
owner had to repair damage to a house connecrion lateral and the extent I
to which the City has assisted rhe property owner is by the issuance of
a "no fee street cut permit" and that city forces had done t.he pavement
reconstruction ae no cOSt t.o the owner,
Councilwoman Lauber rec~lled rhat some years ago rhe City had a Technical
Study Committee composed of persons in various fields - contractors,
electricians and rhe like, She MOVED thar such a committee be re-
activated and that Mr. Coke might like to serve on same. This morion
did not receive a second as Council desired furrher i.nput and the
suggestion was referred to staff for background information on the
committee along with advantages. It was noted that the entire subject
was brought about because of some lack of communication with the end
result that staff and persons involved in the construction trade within
the Ciry had resolved the problem.

Council received the request of the Boy S couts of America (San Gabriel
Valley Council) for permission to hold its annual Scout-O-Rama in the
infield area of the Santa Anita Race Track on the weekend of June 1,
1974. Frank McIntosh"Director of Support Services, explored the event
and answered inquiries propounded by Council. It was MOVED by
Councilman Gilb, seconded by Councilwoman Lauber and carried unanimously
that the request be and it is hereby granted. During this discussion
Neal Johnson of the Police Department was commended for the excellent
work he is doing in this regard. The City will be named as an ad-
ditional insured. '
The City Attorney presented for the first time, explained the content
and read the title of Ordinance No. 1507, entitled: "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING THE SIGN AREA REGU-
LATIONS OF THE ARCADIA MUNICIPAL CODE."
It was MOVED by Councilman Helms, seconded by Councilwoman Lauber and
carried on roll call vote as follows that the reading of the full body
of Ordinance No. 1507 be WAIVED and that the same be INTRODUCED.

The City Attorney presented, explained the content and read the title
of Resolution No. 4425, entitled: "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARCADIA DETERMINING THAT THE PUBLIC INTEREST,
CONVENIENCE, AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL
PROPERTY (143 WEST COLORADO BOULEVARD) FOR PUBLIC PARK PURPOSES AND
ORDERING THE ACQUISITION THEREOF."
Hugh Hamilton, 335 E. Newman, spoke in opposition to additonal parks
and felt there would be a parking problem if this park becomes s
reslity. He noted parking at other areas and some discussion ensued.
Tennis courts were also briefly explored. - Mr. Hamilton suggested
using city property at Wheeler and First Avenue for such purposes.
Staff will check to ascertain if rules are posted for use of the tennis
courts at various locations especially st the Csmlno Real and Second
Avenue Park.

The business community will be informed that theCity has taken action
to support this Bill which would abolish the Business Inventory Tax.
The City Attorney advised that he had reviewed and investigated the
claims of Ronald S. Williams and Olga B, Isaacs and recommended denial
thereof. It was MOVED by Councilman Helms, seconded by Councilman

On MOTION by Councilwoman Lauber, seconded by Councilman SaeUd and
carried unanimously the provisions of the Procedural Ordinance were
waived.
The City Attorney expIained that as of noon May 18 the I iabiUty and
property insurance had expired on the commercial license of the City
Refuse Service Company, Inc, He noted the provision in the Business
License Ordinance where if there is a breach of the conditions which
is considered to be urgent the Chief of Police may temporarily suspend
the permit by posting a notice of such temporary suspension of busi-
ness and the permit is then suspended. This has been done. He recom-
mended a hearing be scheduled for Council to consider whether the
suspension should be continued with a subsequent determination as to
whether or not the permit should be permanently revoked. To date the
insurance has not been reinstated. It was MOVED by Councilman Helms,
seconded by Councilwoman Lauber and carried on roll call vote as
follows that the permit suspension be continued and that a public
hearing be and it is hereby scheduled for June 4,

On MOTION by Councilman Saelid, seconded by Councilwoman Lauber and
carried unanimously the provisions of the Procedural Ordinance were
waived.
The City Attorney explained that the legal description in a covenant
executed by a property owner concerning developmett of property in
which there was a community driveway had been incorrect; that it is, now I
necessary to release the covenant in order to correct the situation.
It was MOVED by Councilman Saelid, seconded by Councilwoman Lauber and
carried unanimously that the Mayor and Ci.ty Clerk be authorized to
execute said release of Lots 29 and 30, T,act 101, Block 2, Map Book 13,
Page 52 of County Records for the purpose of correcting an inaccurate

In response to an inquiry by Councilwoman Lauber concerning cards
notifying residents about the change in rubbish collectors, the City
Manager stated in part that the cards specified residential and not
commercial and that he had not heard of a specific instance where it
was received by the business community. The City Attorney said in
part that he had approved the card and felt it would be very difficult
to be misled by the wording.
