The City Council of the City of Arcadia, California, met in regular
session on Tuesday August 6, 1974 at 7:30 p.m. in the Council Chamber
of the Arcadia City Hall.

HEARING Mayor Pro Tem Gilb declared the hearing open to hear objections concerning
Weed the charges levied for the removal of weeds, rubbish, etc" which has been
Abatement done. Battalion Fire Chief Dick and Captain Gardner were present to answer
1974-75 questions. No one wishing to be heard Councilman Sae1id MOVED and Council-

Planning Director William Woolard was excused. The City Manager explained
Planning Commission Resolution No. 858 granting a conditional use permit to
operate a gymnastics school at 142 W, Live Oak, Planning Commission recom-
mended the permit be approved subject to conditions set forth in said reSo-
lution.
Councilman Helms MOVED, seconded by Councilwoman Lauber and carried unani-
mously to APPROVE Planning Commission Resolution No, 858 and instructed
the City Attorney to prepare the necessary resolution,
Liz Pendo, 886 Fallen Leaf Road, Foothill Jr, High Vice Chairman for the
Youth Commission read a communication requesting the approval by the Council
to develop and implement a Youth in Government Day during the 1974-75 school
year for students attending Arcadia High School. She continued students
would gain valuable experience working with various City officials and De-
partment heads for one day. She stated Dan Anderson, Assistant Principal
at the Arcadia High School indicated a willingness to permit students in
civic classes to participate.

Mayor Pro Tern Gilb, Liaison for Youth Commission feels it is a very worth-
while project and expressed hope that staff will work closely with the
Youth Commission.
It was MOVED by Councilwoman Lauber, seconded by Councilman Saelid and
carried unanimously to approve the Youth in Government Day Project.
Mayor Pro Tern Gilb explained the request from the Youth Commission to donate
$l50. to H.O.Y.; that it is a formality for Council to approve. The funds
will be taken from Trust Account No, l4-400.35.

call vote as follows to approve the donation of $l50 to H.O.Y. from the
Youth Commission.

Mrs. Johanna Hofer, 875 Monte Verde'Drive spoke negatively to the proposed
construction of tennis courts on Baldwin Avenue Reservoir and suggested the
monies be utilized to concrete the courts at Foothill Jr. High School. She
also requested the Council packets be placed in the Library.
The City Manager spoke of the studies made with the Consultant Engineers
and the Director of the Water Department relative to the location of the
pumping ,plant, Environmental consideration was discussed as was the
feasibility for park usage of the grounds, The City Manager recommended
that Council authorize Lampman & Associates to proceed with the offer they
have made on the four alternates and an additional authorization of $3,000
for design for ongrade location at site #l.
It was MOVED by Councilman Helms, seconded by Councilwoman Lauber and
carried on roll call vote as follows to APPROVE the recommendation of the
City Manager,

The City Manager submitted a report on bids received for carpeting portions
of City Hall and Police Station, He recommended the contract be awarded to
Vacco Rug Company of Arcadia with the lowest bid of $lO,900. He further
recommended the appropriation of $950 for temporary employment of four (4)
employees for moving and replacing furniture plus $675 for masonite chair
pads, He stated carpeting would save fuel comsumption and be a low mainten-
ance expenditure.
It was MOVED by Councilman Helms, seconded by Councilwoman Lauber and carried
on roll call vote as follows that the recommendation be ACCEPTED; that all
informalities or irregularities in the bids and bidding process be waived
and the Mayor and City Clerk be and they are hereby authorized to execute
the contract in the form approved by the City Attorney.

The City Manager explained the system recommended by the Director of Public
Works for lighting the Arcadia High School swimming pool area consisting of
20 quartz lite lamps with six circuits to permit selective lighting for var-
ious needs and levels of illumination; that it is a budgeted item and funds
will be from Capital Improvement Program, He further recommended that plans
and specifications be approved and the City Clerk be authorized to advertise
for bids.

Ben Smith, 980 Orange Grove Avenue stated in part that individuals, various
groups and organizations have donated $1150 towards tre costs,
Councilwoman Lauber MOVED, seconded by Councilman Saelid and carried unani-
mously that plans and specifications be ,APPROVED and the City Clerk be auth-
orized to advertise for bids.
The City Manager stated the Camino Grove tennis court lighting project has
been completed and read the recommendation of the Director of Public Works
that Council accept Job. #421 and authorize payment in accordance with the
contract.

The City Manager explained the 90-day temporary refuse collection agreement
with Best Disposal-Company would expire August 8, 1974 and recommended
Council approve an additional 60-day extension agreement with the refuse
company. He stated staff held the opening of proposals from ten interested
contractors and that time is needed to properly analyze and investigate
those making the proposals, Extension would be under same terms, condi-
tions and rates as current agreement, except the City could terminate the
t.agreement by seven (7) days prior written notice to Best Disposal Company.
Councilwoman Lauber MOVED, seconded by Councilman Saelid and
roll call vote as follows to APPROVE the agreement with Best
Company for sixty (60) days effective August 6, 1974.

The City Manager asked that Council establish formal appointment of alter-
nate to the County Sanitation Districts, He state Mayor Scott has been
the delegate to the two districts in which Arcadia is located and Mayor
Pro Tem Gi1b has been the alternate. He asked for a MOTION to firm the
appointments, for recordation purposes,
It was MOVED by Councilman Helms, seconded by Councilman Saelid and
carried unanimously that Mayor Scott be appointed delegate and Mayor Pro
Tem Gilb be appointed as alternate effective with their terms of office.

The City Manager referred to the expiration date of the dancing permit
issued Westerner Restaurant and recommended same be extended thru December
31, 1974 with the same conditions formulated by Council on other dancing
permits. He further stated said permits are issued on an annual basis.
It was MOVED by Councilwoman Lauber, seconded by Councilman Saelid and
carried unanimously to ACCEPT the recommendation of the City Manager.
AMBULANCE The City Manager referred to a request from Fire Chief Eugene Mahoney for
Purchase of the purchase of a new, larger ambulance and equipment therein, He ex-
~ () p1ained the Capital Improvement Budget provides funding for same, and the

It was MOVED by Councilman Helms, seconded by Councilwoman Lauber and
carried unanimously to concur with Fire Chief Mahoney's request and author-
ization granted to advertise for bids,
Council received a communication from the United States Conference of
Mayors advising membership dues will be increased by about 20% for the 1974-
1975 fiscal year, The City Manager advised no action is needed at this
time.
Council received a request for financial assistance from Arcadia H.O,Y.
(Help Our Youth) organization in the amount of $l2,755.
Letters were received from the following citizens urging support of the
request: Priscilla M. Sibson"President, League of Women Voters;
Kenneth E, Kirkpatrick, Chief Probation Officer, County of Los Angeles;
Richard E, Miller, President, Arcadia Community Coordinating Council and
-President, Arcadia Kiwanis Club; and Barry Rumbles, Counselor, Dana Jr.
High Schoo 1.
Harold Roach, Chairman of H.O.Y. spoke in favor of the proposal noting
that the organization which began two years ago has grown rapidly and is
still growing; that a budget for an organization that is growing so fast I
has to be a tentative thing - the organization does not know how much
money it will need and how much money it can raise; that a group of women
in the community have set up an auxiliary to raise funds,
Mrs. Frances Meehan, representing the League of Women Voters of Arcadia
stressed the need for preventative meas~es that encourage good mental
health and support of both private and public facilities that provide care
for persons having mental health problems. Under the objectives of this
position, Mrs. Meehan urged that continued financial support be extended
to H.O.Y, by the City Council.

spoke in favor of stressing the need for assistance in solving problems

that need to be solved now and the outreach program of turning to preven-
tative programs which take money, time and cooperation.
Mrs. Chris Hardwick, 280 Arbolada Drive emphasized the value of physical
and mental health and the pressing need of the services of H.O.Y.
Miss Janelle Hardwick, 280 Arbolada Drive favored the program and the
guidance and help that has been extended to her personally.
Mrs, Johanna Hofer, 875 Monte Verde Drive stated she was aware of the
work the organization is doing; that she was neither for nor against the
requests but expressed concern about the growing need of such services; that
all must work together to raise the values of society.
B. E. Norlin, Executive Director of H.O.Y. explained further the work that
is being done; that the organization is trying to move into the community to
do prevention outreach, to identify problems early and work toward solving
them,
Mayor Pro Tem Gi1b inquired about the five counselors that are to be paid,
B. E. Norlin explained that four presently volunteer counselors would be
paid; that a majority of them are working on degrees and would need part time
jobs to continue their education; that the need is for counselors to work 15
to 20 hours per week at $3,50 per hour, and a licensed counselor at $12 per
hour. The' hope is that in two years there will not be so-called paid counse-
lors but trained voluntary paraprofessionals, subsequently the budget in the
future should decrease, Re added that the services are now tripled but the
budget only doubled,
Councilman Helms having been a member of the Board of Directors of R.O.Y.
since it was instituted expressed his understanding of the problems that the
organization has dealt with; that the solution was conceived by the people
and implemented by the people. There are 3,000 or more young people who have
been served,
He stated further that the expertise, the experience, the background of the
Board members is very diverse, very wide ranging and represents a great
cross section of the community; that this Board of Directors fortunately
through the present president, Harold Roach and the other members have been
able to secure the services of B. E.Norlin who is highly competent and highly
informed; that this is the kind of program that deserves the support of the'
City through the City Council serving the people of the city.
Councilman Sae1id expressed appreciation for the accomplishments of H.O,Y.
but stated he believes the organization should be self supporting and in no
way dependent on City tax revenues; that if the City of Arcadia does not have
a social welfare provision within the budget or any allocation for R.O.Y. per
se to continue to expend city funds for this purpose, however, laudable, is
inconsistent with his interpretation of his elected responsibility; that if
such welfare expenditures ,are to be made they should be budgeted as such and
made available for public scrutiny and discussion prior to the budget adoption.
Mayor Pro Tem Gilb stated it is a difficult problem of handling public funds
and more important it is difficult handling public funds of people who are
not 'represented here tonight who are taxpayers of the city who donate money
to various organizations. He could not approve of the full amount of the
request being aware of all the other organizations of the city who are as
needy.
Councilman Helms observed that he could not find any criteria that would
give him the great light to make the kind of a judgmental decision that
$5,000 is justified but $l2,000 is not; that dollar for dollar the money
is returned to the community in full amount. He then MOVED to appropriate
the sum of $l2,755 to H,O.Y. for the current fiscal year to be appropriated
from the General Revenue Sharing Fund. Motion died for lack of a ,second.

Mayor Pro Tem Gilb responded by stating in part there is no rationalization
just by saying that one amount of money is any more important than any
other if you are talking about a principle here; that Harold Roach pointed
out the exact projected amount of money needed is not known; the community
support may double; the Auxiliary may add another $lO,OOO,
Councilman Helms stated that if H.O.Y. is able to develop that kind of
support from the community the organization would make the appropriate ad-
justments with respect to the City.
Mrs. Edward Passmore, ll09 Columbia Road suggested that in deciding what
organization to contribute funds to the question should be asked what or-
ganization will be the most benefit to people; that H.O.Y, seems like a
worthwhile program. If the organization grows and if an agency is formed,
what kind of an agency would it be and should it have a liaison from the counCI
Councilman Helms added that there is a clear distinction between the kind
of agencies being discussed. H.O.Y. is generated by a local need and is
operated by a contribution of local people as opposed to something that is
really nationwide; this is something that pertains only to the City of
Arcadia and something that deserves a little more attention.
Mrs. Frances Meehan addressed the Council stating that for every young
person who does not get proper counseling for any problem the costs will
skyrocket. Whether eventually the County or the State or whoever picks up
these costs the citizens will pay and the costs will be infinitely greater
than if a largely volunteer organization in the community takes care of
the problem while it is small. In thinking about cost accounting the money
could probably not be put in a better place because the mental health coun-
seling and the other types of counseling are very, very worthwhile.
In answer to Mayor Pro Tern Gilb's question about payment of a part time
secretary, Harold Roach answered that with a budget of this size it needs
someone constant day to day.
Mrs. Johanna Hofer, 875 Monte Verde observed that when money is expended
people in the City and other organizations should know what is being done,
Walter Landor, l654 Rodeo Road urged people to write letters to foundations
and philosphophic organizations for donations,
Councilwoman Lauber stated she did not have difficulty within her own judg-
ment of setting a precedent. There is no question of the good that this
organization is doing and the necessity, unfortunately, and stated that she
does not feel that it compares in any way with other national organizations;
that this is a very personal helping hand that has been extended to the
young people of Arcadia and the immediate surrounding area, however in the
future it should be a budgeted item. Council gave $3000 last year, the
quantity of patients has increased three times and therefore suggested donat-
ing appropriately $9,000,
Councilman Sae1id stated that the only answer is to establish within the
City's budget an amount which can be designated to specific organizations I
that qualify but to take it out of Council Contingency Fund is not reasonable.
He added that he is very pleased with the results that H.O.Y, has had, but
concerned more about the outreach program than any aspect of it because this
is a new venture for H.O.Y. and how much of the total budget of the organi-
zation is going to be devoted to the community outreach program which may
or may not even receive the approval of the School Board.
Councilman Helms answered that it is difficult to visualize a budget such
as this - all sources being problematical,
MOTION was then made by Councilman Helms that the Council indicate that it
will to some extent fund H.O.Y. out of the Federal Sharing Revenue Program

on a quarterly basis with a quarterly report and justification by H.O.Y.
to the City Manager and if the City Manager feels there is anything impro-
per in what the organization is asking then the matter will be brought
before the Council; the quarterly information to be submitted to the Council
and als~ to be a matter of record for the public; that this will be a
budgeted item next year. Funds wi11'be appropriated from Federal Reserve

The City Attorney presented, explained the content and read the title of

LATING TO PERMIT AND INSPECTION FEES."

The City Attorney submitted a letter and proposed ordinance to Council for
consideration restricting noise emanating from any property in the city to
a maximum decibel level depending on zone and time of day with corrections
and adjustments for certain types of noises. Councilman Helms asked if it
were possible to establish a type of violation similar to tffivehicle code
infractions which would eliminate any possible element of misdemeanor. The
City Attorney concurred this could be done, Proposal to be on September l7
agenda.
The City Attorney presented a proposed ordinance for Council's consideration
relative to patio, garage and back yard sales. Mayor Pro Tem Gi1b asked the
matter be placed on the October 1st agenda.

The City Attorney advised he had reviewed and investigated the claim of
Mary Jane Strong and recommended denial of same,
Councilwoman Lauber was excused at lO:35 p.m.
It was MOVED by Councilman Helms, seconded by Councilman Saelid and
carried unanimously to deny the claim of Mary Jane Strong,
The City Attorney presented the claim of Thomas Micheil on behalf of his
son Stephen and explained there has been an investigation by the City and
recommended claim be denied.
It was MOVED by Councilman Saelid, seconded by Councilman Helms and
carried unanimously to deny claim.

The City Attorney explained the fatal accident claim submitted by Mr.
Richard Mauch involving Patrick M. Mauch. The City Attorney stated an
investigation was made, that no liability was found on behalf of the
City and recommended denial.
Councilman Helms MOVED, seconded by Councilman Sae1id and carried
,unanimously to accept the recommendation of the City Attorney to deny
the claim.
The City Attorney advised that on May 9, 1974 request from Mr. Vartanian
for a 50-day extension of lease to store aircraft parts on city premises
at 25 N. 4th Av. was granted; said extension terminated July 4th. Mr.
Vartanian has not vacated the premises and the City Attorney advised the
next step to be taken would be an unlawful detainer action. Council
supported and the City Attorney is to go ahead with said action.
The City Manager brought attention to a letter received from the Commis-
sioner of Highway Patrol reporting the City of Arcadia had fewer fatal
and injury traffic accidents in 1973 than in 1972. The Commissioner
asked the City to accept his congratulations and best wishes for con-
tinued success in traffic safety in 1974. The City Manager stated com-
bined with the reduction of burglaries and certain major crimes is some-
thing the public should feel good about.
A short discussion was held regarding the shortening of the agenda.
The City Manager requested the approval of Council for an appropriation,
not to exceed $500 to finance a weekend discussion for management person-
nel to study ways for improving services to the public.
