Mayor Edward L. Butterworth PRESENT: ABSENT: Councilmen Arth, Considine, Hage, Helms, Butterworth None Council was in session to continue its deliberations on the contents of the proposed resolution and ordinance concerning development of a regional shopping center on a portion of the race track property. Prior to resuming discussion Councilman Helms stated for the record that a letter sent to all councilmen from the attorney for the Rpplicant had nothing to do with what he (Helms) had in mind when at a previous meeting he referred to alterations made in the proposed resolution. Each section of the tentative resolution was then reviewed with changes to be made as follows. (Conditions 1 through 4 were reviewed January 27, 1971.) Extensive discussion held on factors which could arise to delay commencement or continued construction such as acts of war, labor strikes and disputes, and litigation testing or affecting the validity of the ordinance or reSO- lution. The City Attorney will incorporate this thinking and also provide for the Council at its sole discretion to extend the time should unusual delays be caused by city administrative procedure. To read as set forth in Planning Commission Resolution No. 712, Condition 10. Richard Volpert, attorney for Santa Anita Consolidated, Inc., spoke to this condition. Accepted as drafted. Deleted the words, "after recommendations of the City Traffic Engineer based on accepted traffic engineering standards.. ,II Add to last sentence, "and between Colorado Boulevard and Huntington Drive." Accepted as drafted. Refers to curb and gutter along Colorado Place - to be expanded. Added, "Plans for traffic shall be submitted to and approved by the City Council at the same time preliminary plans are submitted," Accepted as drafted. Self Service Laundries and Cleaners. 1 Delete To include a provLsLon indicating that if the electorate approves the proposition the developer will execute a written agreement and irrevocable offer to dedicate footage for the widening of Baldwin Avenue. All words after, "Section 3 above" deleted. This proposed ordinance was also explored section by section and the City Attorney will henceforth redraft the resolution and ordinance in accordance with the Council determinations. 2-1-71 - 2 - PLANNING COMMISSION COMMENDED ADJOURNMENT 1 1 19: 777 4-B On MOTION by Councilman Helms, seconded by Councilman Arth and carried unanimously the Planning Commission will be commended, by formal resolution, on its efforts and accomplishments to the Fashion Park matter.
