Caltrans now requires that an authorized official execute right -of -way certifications when receiving funds. In accordance with the Local Assistance Procedures Manual, a local agency may adopt a resolution giving agency officials blanket authority to execute right - of -way certifications. Therefore, it is recommended that the City Council adopt Resolutions No. 6855 authorizing the Public Works Services Director or the City Engineer to execute right -of- way certifications for Caltrans administered transportation projects. DISCUSSION The City of Arcadia has historically received state and federal funds to improve streets within the City. These funds have been administered and managed through Caltrans. When receiving state and federal funds administered through Caltrans, the City must prepare a right -of -way certification. A right -of -way certification is a written statement summarizing the status of all right -of -way related matters pertaining to a proposed construction project. It verifies that all work performed for a particular project was performed within existing right -of -ways, or that if additional right -of -ways were required, those right -of -ways were legally acquired and recorded. Right -of -way certifications must be completed and submitted even if no right -of -way is required for a project. Caltrans is now requiring that all right -of -way certifications be signed by an authorized official. A local public agency may adopt a resolution giving a responsible agency Honorable Mayor and City Council December 18, 2012 Page 2 of 2 official or officials blanket authority to execute right -of -way certifications. This procedure is intended to streamline the process and avoid the necessity of having to execute right - of -way certification and adopt a resolution for each and every individual project. It is recommended that the City Council adopt Resolution No. 6855 authorizing the Public Works Services Director or the City Engineer to execute right -of -way certifications for Caltrans administered transportation projects. FISCAL IMPACT Adoption of Resolution No. 6855 will not result in a fiscal impact to the current City budget or future City budget. RECOMMENDATIONS It is recommended that the City Council approve the following: 1. Adopt Resolution No. 6855 authorizing the Public Works Services Director or the City Engineer to execute right -of -way certifications for Caltrans administered transportation projects. APPROVED: - --� Dominic LazzaFWo City Manager RESOLUTION NO. 6855 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AUTHORIZING THE DIRECTOR OF PUBLIC WORKS SERVICES OR THE CITY ENGINEER TO EXECUTE RIGHT -OF -WAY CERTIFICATIONS FOR CALTRANS ADMINISTERED TRANSPORTATION PROJECTS WHEREAS, the City of Arcadia is eligible to receive State or Federal Funding for Transportation Projects, administered by the California Department of transportation ( Caltrans); and WHEREAS, Caltrans requires right -of -way certification to be approved regardless of the need for right -of -way acquisition prior to encumbering State or Federal funds; and WHEREAS, the City Council wishes to delegate the authority to execute the right -of -way certification to the Director of Public Works Services or the City Engineer. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Arcadia does hereby authorize the Public Works Services Director or the City Engineer to execute the right-of-way certification for Caltrans administered transportation projects.
