Rev. Walton Doering, Our Savior Lutheran Church Mayor Pro Tempore Don W. Hage PRESENT: ABSENT: Councilmen Arth, Butterworth, Considine, Rage, Helms None On MOTION by Councilman Hage, seconded by Councilman Considine and carried unanimously the minutes of the regular meeting of May 18, 1971 were APPROVED. This proposed subdivision for 120 W. Sierra Madre Boulevard was before Council originally on April 6, 1971 and a Motion by Councilman Considine, seconded by Councilman Hage to approve the tract subject to stipulated conditions was tabled. The Planning Commission then reviewed the zoning and reported back that it was an appropriate classification. The matter was before Council again on May 18, 1971 at which time it was noted by the developer that the number of lots had been reduced from 15 to 14 and that he would not construct any 2 story homes except on one odd shaped lot; that the large oak trees would be preserved. Following this another 'MOTION was made by Councilman Considine, seconded by Councilman Hage, and the original MOTION was MODIFIED to reflect changes made in the tentative map as reported by the subdivider. Considerable discussion ensued at that time during which objections were lodged by Councilmen Arth and Butterworth, as well as neighbors. Mr. Arth was concerned about the shallowness of the lots and Mr. Butterworth stated in part that the subdivider had made great strides in the right direction but that he was not satisfied that the proposed tract is the best develop- ment for the property in question. Mayor Helms indicated his inability to vote on the matter due to a legal involvement 'with a member of the sub- divider's firm. The matter was then put over until this date. During the interim the subdivider and others interested attended an adjourned session on May 27 at which an endeavor was made to arrive at definitive guidelines which the developer could rely upon and to bring the matter to a conclusion. At this time Mayor Helms summarized the situation and Councilman Arth reiterated his concern for maintaining the integrity of the residential areas, but indicated his willingness to go along with the subdivision which will now have 14 lots instead of 15 with a 90' frontage, as long as the maximum rear yards would be maintained, trees preserved and two story construction limited to one lot (No. 14). He felt the proposed tract is not as compatible as it should be to the immediate area and indicated he would vote in opposition. Whereupon Mayor Helms called for the vote on the TABLED MOTION to APPROVE subject to all conditions which were part of the original approval and those imposed during the Council procedures all of which will be incorpo- rated into a resolution by the City Attorney. AYES: NOES: ABSTAIN: Councilmen Arth; Considine, Hage Councilman Butterworth Mayor Helms, due to his business affiliation with a member of the developer's firm. ABSENT: None I A public hearing on the General Plan as approved by the Planning Commission was scheduled for July 20 at 7:30 p.m. A study session will be held on June 29 at 7 p.m. in the Conference Room. (Resolution No. 731) A public hearing was scheduled for June 15 at 7:30 p.m., on Planning Commission recommendation on a zone change from R-3 to PR-3 for property at 855 S. Baldwin Avenue. (Resolution No. 732) It was MOVED by Councilman Considine, seconded by Councilman Hage and carried unanimously that the following two actions by the Planning Commission be and they are hereby RATIFIED: Resolution No. 734 - denying a conditional use permit for a photography kiosk at 645 W. Duarte Road. Resolution No. 735 - denying a zone change from R-l and'D at 530 - 644 W. Foothill Boulevard. The following two actions of the Planning Commission were scheduled for public hearings on July 6. In both instances the applicants have requested a hearing before Council. Resolution No. 736 - denying a zone change from R-l to R-3 at 870-1050 W. Foothill Boulevard. Resolution No. 737 - denying a zone change from R-l to C-2 at 1110 - 1150 W. Foothill Boulevard. On recommendation of the Planning Commission Council approved the final map of Tract No. 29693 subject to conditions on MOTION by Councilman Rage, seconded by Councilman Butterworth and carried unanimously. Property is located at 1136 Arcadia Avenue and is a 38-unit condominium. I On MOTION by Councilman Considine, seconded by Councilman Butterworth and carried unanimously the Model City Ordinance was ADOPTED with one stipulation - that Section 5 thereof designate the City Manager as the director of emergency services. The State of California Office of Emergency Services, submitted the ordinance which will become part of the California Emergency Plan. The City Attorney will prepare the appropriate document. Council acknowledged a communication from Mrs. Albert Swanson urging purchase of property to be used for park purposes. Although the subject location may not be ideal for such purpose it was conceded it is the only available parcel and there aren't any parks or other recreational facilities in the par- ticular area. It was then MOVED by Councilman Butterworth, seconded by Councilman Arth and carried unanimously that the City 'Manager look into the feasibility of acquiring land for a public park in the subject area; the problems involved and cost thereof. Council received with appreciation the communication from.the American Water Works Association concerning the award of merit presented to the City Water Department for its injury-free year (1970). The request of the West Arcadia Business and Professional Association for permission to install permanent cable standards was carried over until this date. During the interim some of the Councilmen viewed the poles in Temple City. Councilman Considine stated in part that he favored the concept but felt the poles should be more attractive than ~those he viewed. Discussion ensued on some decorative attachment to the t~p of the poles and the painting of the poles which would be con- sistent in height with those on 'Baldwin Avenue (30'). It was MOVED by Councilman Arth, seconded by Councilman Butterworth and carried on roll call vote as follows that permission be granted to install nine perma- nent standards, locations to be approved by the Director of Public Works; that they be epoxy paint and decorated in a manner approved by the City Manager, and in accordance with the recommendation of the Director of Public Works in his report of May 14 and per the contents of a letter dated April 28 .from Donald G. Ehr, President of the Asso- ciation. AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Considine, Hage, Helms None None Upon advice of the City Manager and Water Manager that Vido Samarzich has satisfactorily completed the modification of water distribution lines requir.ed.. for Foothill Freeway Construction Phase IV, it was:MOVED, by. Councilman Hage, seconded by Councilman Butterworth and carried on roll call vote as follows that the work be accepted and that final payment be AUTHORIZED in accordance with the terms of the contract. The City 'Manager recommended Marion J. Varner & Associates, currently pre- paring drawings for the police annex and the multi-purpose recreation building, and submitted a proposal from Mr. Varner in the amount of $750 for a preliminary design. It was MOVED by Councilman Butterworth, seconded by Councilman Hage and carried on roll call vote as follows that said architect be retained at $750 for the preliminary work. Funds are in the Capital Projects Account. AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Considine, Rage, Helms None None Pursuant tothe provlslons of Section 3, Condition 6 of Planning Com- mission Resolution No. 708, the City 'Manager reported that there have not been any unresolved problems during the last six months and re- commended the continuance for six months more of the conditional use 6-1-71 - 3 - ORDINANCE NO. 1431 V INTRODUCED APPOINTMENT _ WATERSHED COMMISSION LITIGATION r- REPORT CONFERENCE -- ATTENDANCE ADJOURNMENT v 19 :7832 permit granted to Path for a Teen Center at 909 S. Santa Anita Avenue. It was so MOVED by Councilman Arth, seconded by Councilman Considine and carried unanimously. The City Attorney presented for the first time, explained the content and read the title of Ordinance No. 1431, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA ADDING SECTION 3221.9 TO THE ARCADIA MUNICIPAL CODE, ESTABLISHING A THIRTY-FIVE (35) MILE PER HOUR SPEED LIMIT ON BALDWIN AVENUE BETWEEN HAMPTON ROAD AND ORANGE GROVE AVENUE." It was MOVED by Councilman Butterworth, seconded by Councilman Arth and carried on roll call vote as follows, that the reading of the full body of Ordinance No. 1431 be WAIVED and that the same be INTRODUCED.
