Mayor James R. Helms, Jr. PRESENT: ABSENT: Councilman Arth, Butterworth, Considine, Helms Councilman Rage On MOTION by Councilman Butterworth, seconded by Councilman Considine and carried unanimously, Councilman Rage was excused from this meeting. In order to consider matters other than the scheduled General Plan the provisions of the Procedural Ordinance were WAIVED on MOTION by Councilman Butterworth, seconded by Councilman Arth and carried unani- mously. The City Attorney presented, read Section 2 of Ordinance No. 1438 entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING SECTION 4510 OF THE ARCADIA MUNICIPAL CODE AND ADDING SECTION 4510.1 THERETO RELATING TO REGULATIONS OF THE COUNTY PARK." The full ordinance would adopt by reference Articles I, II and III of the Los Angeles County Ordinance No. 10,309 and provide regulations for the use of sound amplifiers at said location. It was recommended that Section 2 of said Ordinance be adopted as an emergency measure. Although not a public hearing the following persons spoke to the proposed regulations: Ken Jackson, 11664 Ferris, El Monte Gary Campbell, 11664 Ferris, El Monte Tim Brick, 263 Haven Park, El Monte Charles Van Dyke, 833 W. Foothill Boulevard, Monrovia Each expressed opposition to the emergency nature of the ordinance and asked that if it were to be adopted at this meeting that the emergency provision be set aside. The entire ordinance would then become effective in 30 days which would permit the group (Red Sun Tribe) to hold a scheduled rock festival at the Arcadia County Park in early September; that the group would thereafter not meet at the park but would explore other locations where youth could gather. Ways of redirecting the speakers were explored, none of which would remedy the level of noise without the proposed regulations. Chris Vance, 417 S. Second Avenue, Arcadia, favored the adoption of the ordinance but not as an emergency measure and said the noise was too loud. ' '-'" 19:7896 use of the park by persons other than those gathered for the purpose of listening to the public address system. It was noted that the regulations would apply to all groups and activities at the park and is not to be construed as an attempt to interfere with free speech or freedom of assembly, but to preserve public peace, health and safety. Section 2 of the Ordinance would have the power to reasonnbly regulate operation of public address systems and thereby prevent ne.dless injury and damage to the public and at the same time permit audible communication with large audiences. It being the consensus of Council that the regulations set forth in Section 2 are urgently needed, it was MOVED by Councilman Considine, seconded by Councilman Arth and carried on roll call vote as follows that Section 2 of Ordinance No. 1438 as read by the City Attorney be introduced and ADOPTED pursuant to the provisions of Section 415 of the Arcadia City Charter, .1 AYES: NOES: ABSENT: Councilman Arth, Butterworth, Considine, Helms None Councilman Hage j The City Manager explained that staff has reviewed a Federal Program aimed at eliminating unemployment and explored its implementation in a report dated September 1, 1971. It was noted that no cash outlay would be required but such costs as training, employment services and adminis- trative overhead incurred by the City would be used to fulfill the grant obligations, Nineteen positions were proposed amounting to $148,440 and fringe benefits of $27,291.77 for a total of $175,731.77 which would be the amount of federal funds requested. The City's contribution would be listed as $17,575. for a grand total program cost of $193,306.77. Discussion ensued on the merit of such a program and the thought was submitted that perhaps the monies should be devoted to cities where the need is the greatest. Councilman Considine indicated he would oppose the filing of the application as he questioned the basic need for the 19 positions and that he felt the monies were urgently needed elsewhere, Council was inclined to agree but felt that inasmuch as the monies have been made available to the 65 cities in Los Angeles County under 75,000 population and that the p;ogram is to provide training in public oriented positions it gives the City an opportunity to employ and train some of the unemployed and at the same time provide service to the community. It was the consensus of a majority of the Council members that the application be filed officially. Whereupon the City Attorney presented, explained the content and read the title of Resolution No. 4215, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA AUTHORIZING THE CITY'S PARTICIPATION IN THE PUBLIC EMPLOYMENT PROGRAM OF THE EMERGENCY EMPLOYMENT ACT OF 1971." It was MOVED by Councilman Arth, seconded by Councilman Butterworth the full reading of Resolution No. 4215 be waived and that same be ADOPTED on roll call vote as follows: I that AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Helms Councilman Considine Councilman Hage Karl A. Lowry, 501 San Luis Rey Road, submitted a petition signed by residents protesting sidewalk construction on Colorado Boulevard between the Santa Fe overcrossing and the upper "Y" at Colorado Place. During f1" his presentation Mr. Lowry stated in part that it app,ears the city is endeavoring to accomplish too much in one project at the expense of the beauty and environment of the neighborhood; that flowering shrubs and trees will have to be removed and replaced by concrete; homes will be 9-1-71 - 2 - I HEARING GENERAL PLAN (continued) .p (/50 AREAS EXPLORED I 19:7897 exposed to the street whereas they are currently protected by the wndscaping; that Some bedrooms will be 12' or less from the sidewalks depending on the particular setback of the indivi,dual home. It was noted also that the children in the area use the school bus and that traffic is virtually nil since the opening of the freeway. Pictures' and diagram drawings were exhibited by Mr. Lowry in connection with his request for the deletion of the sidewalks in the subject area, He indicated the curbs and gutters are acceptable, Staff explained that the contract has been awarded for the work to be funded with Gas Tax monies; that the large deodar trees on Colorado Boulevard was a prime cons'ideration in the design of the improvements; that shrubs and other landscaping would be lost but that many properties on the north side have block walls at the property line. It was felt, however, that there is some flexibility in the contract for the work to be started September 20. Hugh Meyers, 624 San Luis Rey Road, felt the contract could be cancelled as far as this particular segment is concerned. In order to arrive at some solution prior to the start of construction, it was MOVED by Councilman Butterworth, seconded by Councilman Arth and carried unanimously that the matter be referred to staff for study and recommendation to Council at its next regular meeting (September 7,) Council continued its deliberations on the General Plan and reviewed the Land Use Inventory Map in connection with the General Plan Legend. The Acting Planning Director and the Consultant, Stan Eisner, participated in the proceedings, answering questions and submitting recommendations. It was noted that the land pattern has already been established with density as follows: ZONE R-O 30,000 sq. ft. 1.5 dwelling units per acre R-O 15,000 " " 2,9 " " " " (R-O 12,500 " " 3.5) (R-l 12,500 " " 3.5) " " " " R-l 10,000 II " 4.4 " " " " R-l 7,500 " " 5.8 " " " " R-2 11.6 " " " " R-3 21.8 " " " " Counc il reiterated its concern that the General Plan should reflect the direction in which the City should progress. Council reviewed the following areas which are indicated in the General Plan as more intensive land uses than are permitted by the current zoning. 1. Area north of the upper "yll indicated as medium density; the existing zone is R-l and the area is predominantly developed with low density housing. Consensus: The area north of Colorado be maintained at a density comparable to R-l and a more suitable classification be suggested for the area south of Colorado. 2. Area west of Santa Anita south of the freeway, Forestry Service Yard indicated as high density residential and is currently zoned R-l, Consensus: That the Forestry Service Yard be designated as Public Use as that area is not suitable for R-l; the adjoining land be designated as R-3. 9-1-71 - 3,- PETITION / SUBMITTED LAND ACQUISITION Y /) /! / , ADJOURNMENT 19:71398 3. Area north of the lower "Y" near the Flood Control Channel is shown as highway related commercial. It is zoned R-3 and developed with professional offices and hotel/motel uses. Consensus: An appropriate classification to be explored. 4. Area north and south of Duarte Road approximately between Lovell and Holly - shown as high density residential and currently zoned R-l with existing church property zoned R-2 and the development is mixed residential. Consensus: To remain as shown. ~: 5. 'I Area south of shown as high and developed density, Camino Real both east and west of Baldwin Avenue density residential currently zoned R-l, R-2 and with mixed residential predominantly at a medium is R-3 Consensus: Not determined, Will be under review at the next meeting on the General Plan. Council will resume its deliberations on Thursday September 16 at 7:30 p.m., in the Council Chamber. The meeting will be devoted entirely to the General Plan, Councilman Considine referred to a petition submitted to the City Clerk concerning violations which have not been corrected at 400 N. First Avenue, 330 N. First Avenue and 110 La Porte Street.. Violations include parking hours; cars parked on the wrong side of the street, double parking, driveway condition from the automobile service business, water flowing on the south side of La Porte and noise from the business after 11 p,m, Staff will investigate and report back. The City Manager 'advised of the avai lability of land which could be used as a public park and with Council concurrence will proceed with the necessary steps, the first of which will be the presentation of an appropriate resolution at the next regular meeting.
