INVOCAtION At the request of Mayor Helms the invocation rendered by the Rev. James W. Hagelganz of the Arcadia Presbyterian Church is herein- after a part of the proceedings. "0 God, we are grateful for the gifts of life and communities. We are a fortunate people. We have a great deal. We have more than we realize. We pause to say :~hank you, 0 God.' "We are grateful for our community leaders, and especially for the men who make up our City Council. Guide them in their deliberations. As they listen, help them to hear the plea of the people. Help them to grasp the truth; to avoid the spurious, and make decisions based on the convictions of the right, rather than convenience or popularity. "0 God, we are mindful that there are differing opinions held on almost every issue. Help us to listen, to feel and understand positions other than our own. We are grateful for the times decisions go our way. Help us to be more understanding and loving when decisions go, not only for us, but against us. Help us to try to really be a people under God indivisible. "Bless our community with the reality of your truth and grace, and help each of us to discern your will through Jesus Christ. Amen." Robert Arth ROLL CALL PRESENT: Councilmen Arth, Considine, Hage, Helms ABSENT: Councilman Butterworth MINUTE APPROVAL The Minutes of the regular meeting of September 21 and the adjourned meetings of September 16 and September 30 were APPROVED on MOTION by Councilman Considine, seconded by Councilman Hage and carried unanimously with the exception of Councilman Arth who abstained from voting as he was on an excused absence from said meetings. 1 The Minutes of the regular meeting of October 5 were APPROVED on MOTION by Councilman Considine, seconded by Mayor Helms and carried unanimously with the exception of Councilmen Arth and Hage who abstained from voting as they were on excused absences from said meeting. 10-19-71 - 1 - HEARING (Bench advertising) " ,'} // ,-A/ ""'" "!/A ' / "ZV~',~/ MorrON HEARING (Division of property) /.;?, -? '/ IN FAVOR 19:7930 Application of Glenn Warmer, dba Coast-United Advertising Company, Inc., for a Council Permit to allow advertisi ng to be placed on benches. This is a change of ownership application - the company having been licensed for this purpose by the City for a number of years. The City Manager advised that there are 85 benches and the license fee is $5 per year per each bench. Mayor Helms declared the hearing open and Mrs. Charles Beatty, Chairman of the Arcadia Beautiful Commission, referred to recent action by the Commission in recommending to Council that advertising on benches be eliminated by adopting an amendment to the City Code that public benches be replaced with a uniform park-type bench - this tn an endeavor to improve and beautify the City. She noted in part that surrounding cities (Sierra Madre, Pasadena, San Marino) do not permit 1 advertising on their city owned benches, and that there are existing sign ordinances but they do not cover the subject advertising; that bench advertising constitutes visual pollution. No one else desiring to be heard the hearing was CLOSED on MOTION by Councilman Arth, seconded by Councilman Considine and carried unanimously. Discussion ensued on replacement cost which staff estimated to be around $6,375 and maintenance at about $500. Ways of accomplishing the end were explored with the thought that it would not be economically feasible to replace all of the benches at one time or to purchase new ones at one time either; that the City could on an amortization basis replace benches as the need for replacement arises and at that time assume full ownership and eliminate advertising at that time. However, staff will draft an agreement to work out with the applicant. Whereupon, it was MOVED that staff be AUTHORIZED to draft an agreement to be executed by the City and the Coast-United Advertising Company. Appre- ciation was expressed to the Commission for its concern. APPEAL from the decision of the Planning Commission in its denial of an application to divide property at 102 - 124 E. Longden Avenue (Tract No. 24089) extension of Greenfield Avenue. It was noted that the Raycraft Construction Company originally filed an application for permission to construct a five lot subdivision. This was later changed to a four lot development and would call for an approximate 84' extension of Greenfield Avenue, a 'cul de sac which exceeds the 500' maximum length. It was submitted that the proposed development would virtually eliminate the future possibility of a link-up with Longden Avenue which the Commission felt should eventually occur. Mayor Helms declared the hearing open and Gordon Maddock, 1510 S. Baldwin Avenue, representing the owners of the subject properties, stated in part that he had met many times with city staff and finally agreed on the plan referred to by the Planning Director. He explored this plan in detail, which calls for a 4 lot subdivision and makes provision for future street extension. He noted the incapability of acqulrlng the necessary property for street extension at this time and objected to the recommended requirement if approved of paying for a water main and easement through to Longden or Lee Avenues; that the 4 lots should not have to pay to booster up the system for the existing 48 lots; that they would be willing to pay their proportionate share. They would be willing to construct a circular cul de sac at the end of the street - as it is now. He asked for favorable consideration. 1 Richard McNiel, 120 E. Longden Avenue, spoke of increasing property taxes, the burden of maintaining the large lots and asked for con- sideration on their behalf. Ray Moser, 17 W. Woodruff Avenue, representing the Raycraft Construction Company (applicant), noted the reduction from five to four lots, the willingness to dedicate the end of the street for future street extension and the desire to cooperate with the city; that the Police 10-19-71 - 2 - IN OPPOSITION 1 1 . , 19:7931 and Fire Departments have indicated a desire to see the street go through to Longden Avenue. He asked for favorable action on the appeal. Donald Stiver, 110 E. Longden Avenue, noted the endeavor through the years to develop the property. He said in part that it is a burden to maintain due to its size on which he is paying 25 percent of his taxes on the rear part he does not use. He asked for approval of the lot split. Frank Gwynn, 115 E. Longden Avenue submitted a petition signed by property owners at 115, 121 and 139 E. Longden Avenue, setting forth the number of accidents occurring at the intersection of Longden and Santa Anita Avenues between 1966 and October 1971. These were obtained from the Police Department records. He lodged opposition to the extension of Greenfield Avenue. Jack Thoss, 2317 Greenfield Avenue, spoke in opposition and stated in part that during the last seven years he has not observed a fire truck except on routine inspections. He submitted that if Greenfield becomes a through street there will be a need for street lights and other services; that one property would have to be acquired and he asked by whom? He objected to the lot split as he felt it would only be a question of time before the street would go through. R. E. McCreary, 2226 Greenfield Avenue, objected to the development especially the making of a new cul de sac at the end of the street and the cost to the taxpayers in services. Russell Allen, 2334 Greenfield Avenue, noted in part that Greenfield Avenue was selected by most of its residents because it is not a through street and was opposed to any step that would bring that about. Andrew Yerkes, 2231 Greenfield Avenue, expressed a desire that the street remain as it is. Paul Young, 2500 Greenfield Avenue, noted that children are accustomed to playing in the Greenfield Avenue street due to the fact that it is not a through street and was opposed to taking any action to open up the street to through traffic. No one else desiring to speak the hearing was CLOSED on MOTION by Councilman Considine, seconded by Councilman Arth and carried unani- mously. Councilman Considine spoke to maps of the area in which two long cut de sac streets are shown - El Capitan and Greenfield. He noted the amount of expenditure which would be necessary to extend Greenfield including pavement, sidewalks, water mains, ete: He felt the City should not undertake such a development for the benefit of a developer and felt the subdivider had been given alternatives; that he would like to see the property owners involved in the application have the full development of their land however he would be inclined to support the Planning Commission and deny the appeal. Councilman Hage concurred and submitted the alternative that the developer may eventually come in off of Lee Avenue and run parallel to Longden Avenue with a short street - this would however make sub- standard lots but is worthy of some consideration in the future and would permit Greenfield to remain a cul de sac. He would uphold the Commission in its denial. Councilman Arth referred to the petition which was in opposition to the extension of Greenfield to Longden and noted that the subject appli- cation does not call for an extension; that it proposes to construct four homes on a cuI de sac such as is the case with Greenfield at present; He felt the cul de sac is desirable and realizes that from the police, fire and planning viewpoints all streets would be laid 10-19-71 - 3 - TRACT NO. 29869 (FINAL MAP APPROVED) .:f" /.-/)//, TRUCK ROUTE DUARTE ROAD (continued) .-- TOWNE CENTRE (Annexed to Parking District) /I /:'7// X PARKING (Shoppers) r ( 'I J;' / 19: 7932 out so they would go straight through, but charm is lost that way and he could not see where four additional homes at the cul de sac would do any harm to the existing homes. On that basis he favored the alternate plan. Mayor Helms then called for the motion. Sierra Madre Boulevard, is in substantial compliance with the tentative tract map and recommended approval subject to continued compliance. Discussion ensued on conditions of the approval of the tentative map to which the subdivider had previously agreed. However, for the protection of prospective buyers the developer was asked to record a covenant on each parcel indicating restrictions thereon. 1 It was MOVED by Councilman Hage, seconded by Councilman Arth and carried unanimously that the final map of Tract No. 29869 be APPROVED subject to continued compliance with all stipulated conditions and that the subdivider have a covenant recorded on each of the parcels indicating restrictions on each parcel. Council received the recommendation of the Arcadia Beautiful Commission that Duarte Road, in both easterly and westerly directions, be open only to trucks making local pickups and deliveries and shall no longer be designated a through truck route within the city. It was noted for the record that a petition in favor had been received from property owners in the immediate vicinity. Following some discussion on the problem of noise and speed of the traffic, it was the consensus of Council that a study be made and its findings be brought to Council at its regular meeting of December 7. At the meeting of October 15 Council received a request from Union Realco to annex that portion of the Towne Centre property located between the vacated alley and Santa Clara Street to Vehicle.Parking District 112. 'Annexation of this property was a condition of the sale of the property by the City to Union Realco. At that time the request was referred to the Parking Place Commission for its approval pursuant to the Parking District Law of 1943. On October 12 the Commission unanimously approved the annexation request. Upon receiving the advice that $11,750.91 had been received by the City to cover the subject property's pro-rated cost of the original land acquisition and improvements, and for all subsequent tax levies 1 to date for the maintenance, operation, improvement and acquisition of additional parking spaces for the District, it was MOVED by Councilman Considine, seconded by Councilman Rage and carried on roll call vote as follows that the entire transaction be APPROVED and that the annexation be formalized. AYES: NOES: ABSENT: Councilmen Arth, Considine, Rage, Helms None Councilman Butterworth At the September 21 Council meeting a request was received from the Parking Place Commission for a 2 hour time limit on a row of parking spaces abutting the alley north of Huntington Drive between Santa 10-19-71 - 4 - .' . 19:7933 Anita and First Avenues. The matter was continued pending study of the situation. The Commission now recommends that bumper stops be marked "for shoppers onIyf! or Some similar marking. This would include 9 parking spaces which are part of the City owned land but not within the District lot - as wkll as 21 spaces within the District lot. Cost for the marking would be paid out of the District #2 Maintenance and Operating Fund. It was MOVED by Councilman Hage, seconded by Councilman Considine and carried unanimously that the recommendation be ACCEPTED and that steps be taken to implement the designation. AUDIENCE PARTICIPATION 1 BUILDING PERMITS /J~/~ SALARIES (Firemen) !J.( aJ;f~ /l /J /1- j II FREEWAY NOISE J- :? ;'I-.F 1 Robert G. Kortje, 612 N. First Avenue, spoke of legal technicalities he had encountered in an endeavor to improve his property. Staff was requested to submit a written report to Council encompassing all data, and to ascertain what can be done to alleviate the situation. William Zeutzius, 340 W. LeRoy Avenue, attorney for the Arcadia Firemen Relief Association) spoke at length concerning what he termed a possible mathematical error in connection with the salary of firemen. He referred to specific minutes and asked Council to review same to ascertain if in fact such an error had been made. Council requested staff to prepare a full report and advised Mr. Zeutzius that th~ matter will be on the agenda for November 2. (NOTE: Communication in this regard was submitted on Octooer 5;'1971.' Mayor Helms advised that he had received many complaints concerning excessive freeway noise from residents in the immediate vicinity. It was felt that the complaints are significant and that the City should do what it can to alleviate the problem. It was suggested by Mayor Helms that Council consider retaining a sound engineer to m~ke a study and recommendations. Councilman Arth submitted the availability of a comprehensive study prepared by the University of Nebraska and the U.. S. Department of Agriculture (Forestry Service) on the use of trees ,and shrubbery for noise abatement purposes ... planted as close as possible to the source of the noise.. in this case adjacent to the freeway. He suggested that the City obtain sufficient copies for residents. J. Lyle Cunningham, 475 Oxford Drive, commended the Council on its awareness of the problem and its concern to the extent that steps are being taken to reduce the noise level. Helen Dillon, 131 W. Forest Avenue, stated in part that the freeway noise has changed her way of life to such an extent that she is asking for a property tax reduction. Vernon Spaulding, 230 Renoak Way, recited the submission of a petition, to Sacramento officials requesting that a concrete wall be constructed along the entire length of the freeway. He expressed appreciation to Council for its efforts in this problem. Joseph Lassanvi, Jr., 640 Santa Maria Road, expressed appreciation to Council fo~ endeavoring to ease the noise problem and told of several possible sound absorption methods. He will submit same to staff. George Lewis, 240 Oakhurst Lane, agreed it is a difficult problem to resolve and expressed appreciation to Council. It was the consensus of Council that every effort should be made to improve the situation, whereupon it was MOVED by Councilman Considine, seconded by Councilman Hage and carried unanimously that staff prepare a complete rep~rt including discussions with officials of the State 10-19-71 - 5 - LIGHTING DISTRICT /,1/1.' 1 SIDEWALK PROGRAM (Advertise for bids) -7 / / ~/ , . 19:7934 Highway Division and other engineering sources for the elimination of the problem along the entire length and on both sides of the freeway; that staff be authorized to recommend the retention of an engineering consultant' to.assise in this regard. The City Clerk advised that the Engineer's Report on Annexation No. 1 to the Consolidated Lighting District had been filed in the office of the City Clerk on October 14, 1971. Date of public hearing was scheduled for November 16, 1971. (Resolution No. 4220 adopted later in this meeting.) The request for authority to advertise for bids for sidewalk 1 construction under the Phase VI program was continued from October 5 to this date. Numerous communications in favor and against have been received. Wayne Butterfield, attorney, spoke on behalf of property owners on the east side of Santa Anita Avenue between Sierra Madre Boulevard and Grandview..Avenue., He submitted a petition with 47 signatures representing 35 homes on both sides of the street in that specific area. He also submitted a communication from Mrs. ponald "E. Glenn 1764 North Santa Anita Avenue setting forth reasons for obJecting to the sidewalk construction. Mr. Butterfield then summarized as follows: that the median strip is now used by pedestrians which is a safety measure in that one only has to cross one lane of traffic to reach it. He noted the number of driveways in the area and felt pedestrians would be in danger as they crossed the driveways; he felt the flood periods would add to the hazard due to the grade; that the existing landscaping in the parkways which has helped to hold the soil would be lost as the sidewalks would be constructed on that land. Mr. Butterfield referred to Ordinance No. 878 subsection 4C which provided for a front yard to be no less than 25 percent of the depth of the lot and submitted that if that ordinance is still in effect there may be a violation involved. He felt cutting the front yard depth by the construction of sidewalks would invite problems for the police department both from increased foot and vehicular traffic. Reference was then made to the Council minutes of November 1965 when a similar proposal to construct sidewalks on the west side of Santa Anita in the same block was before Council.. Objections were then lodged and that Council deleted the area from the project with the observation that if and when the residents desired sidewalks the matter would again be considered. He asked that Council consider deleting the subject portion from the sidewalk program. Arlene Des Jardins, 1812 Oakwood Avenue, representing the Highland Oaks and Foothill PIA, spoke in favor of the sidewalks, stating in part that from a survey there are about 25 children on the east and 43 on the west who would use the sidewalk. She asked that the project proceed primarily for the safety of the children. 1 Resident at 1832 N. Santa Anita Avenue, spoke in favor of the program. Howard Holtz, 1746 N. Santa Anita Avenue, stated in part that he has never seen anyone walking in the street when he goes to work in the mornings. Thomas Mitchell, 1758 N. Santa Anita Avenue, felt that although he has three small children sidewalks would do more harm than good - and wondered at what point would the children cross the street - that in his opinio~ the sidewalks, if at all, should be on the west side. Joseph F. Brown, 1770 N. Cortez Road, suggested Council consider the construction of sidewalks on only one side of Balboa whereas they are proposed for both sides. George C. Clinger, 524 Columbia Road, referred to a hazardous curve in the subject vicinity and asked for deletion of sidewalks on the north side of Balboa from Cortez to Columbia. The Director of Public Works explored in detail how a determination is made for the installation of sidewalks at a given point - regarding the North Santa Anita area he advised that the School District as well,as the various PTAs had requested them; that with the completion of Phase VI sidewalks would be continuous throughout the entire length of Santa Anita with the exception of the area under discussion tonight. That as for'the sidewalks proposed for Balboa D~ive, the same applies.; that he had worked for the safest place for pedestrian crossing. Councilman Arth submitted a conviction that is beco~ing quite firm in his mind that Council does not have to move ahead on project~ it is convinced are for the best when residents are so opposed. He would be in favor of sidewalks in front of his home, but that he probably stands alone on his street in that co~cept; that where they are ac- ceptable and meet the requirements from a safety standpoint they should go in, however, when a majority of the residents do not want them they should not go in - and on that basis he favored deleting the portion on Santa Anita between Sierra Madre and Grandview. Councilman Considine then cited an instance where if sidewalks had been installed a loss of a student's life might not have occurred and noted the request of the School District for such installation. He favored moving ahead. Councilman Hage felt that sidewalks should not be installed where they are not really needed and that tjJ.is has not been done thus far in the sidewalk program. However in the subject instance he favored the ,installation for the safety of the children and MOVED to authorize the City Clerk to,advertise,for bids for the sidewalk program as presented. Motion seconded, by Councilman Considine. Mayor Helms stated in part that governrqeni is and must be concerned ,about the rights of the indi- vidual, but ':the requests of the School District, the various school organizabi~ns "and. from residents must be 'col1sidered when the safety of a cn.il'd,'is in question. He felt'Santa Anita is hazardous for walking as it is ~-- and noted that the land to be utilized for sidewalks is city owned~' 'He ,felt under the circumstances only one decision could be made'~ to proceed with the program. He noted that left turn pockets are provided at all major intersections on Duarte Road with the exception of El Monte Avenue, which situation may be improved by channelizing and creating a left turn lane with adequate storage for turning vehicles. The recommendation by staff is to install about 240' of red curb east and west of the intersection and the installation of turn pockets for east and west traffic desiring to make a left turn at the intersection. The Director of Public Works explained the pattern in detail, Mayor Helms felt there would be some inconvenience created for the residents on the south side of Duarte going west because of the no parking restriction and questioned the expenditure necessary for channelization at this time. 1 It was the consensus of a majority of the Council that the situation must be improved - the congestion relieved - and the installation of the turn pockets may be the answer, whereupon it was MOVED by Councilman Hage, seconded by Councilman Arth and carried on roll call vote as follows that staff proceed with the channelization as outlined. AYES: NOES: ABSENT: Councilmen Arth, Considine, Mayor He lms Councilman Butterworth Hage The City Manager and the Director of Public Works reported on the following bids received for lighting the west parking lot at the city library and made recommendation for the award of contract to the low bidder: Total Bid Beling Electric Company Edward F, Lindemann Robert W, Elliott AEC, Eagle Rock C, T, & F., Inc, Sherwin Electric Service Seco Electric Co. Power Line Erectors, Inc. $15,512.00 12,700,00 11,445.00 9,950,00 9,900.00 9,657.00 9,448,00 9,120.00 It was MOVED by Councilman Arth, seconded by Councilman Hage and carried on roll call vote as follows that the contract be awarded to POWER LINE ERECTORS, INC. in the amount of $9,120; that all other bids be rejected; that any informalities or irregularities in the bids or bidding process be waived and that the Mayor and City Clerk be and they are hereby AUTHORIZED to execute the contract in form approved by the City Attorney. It was further recommended in said motion that an additional $6,000 be appropriated from the Capital Improvement Program budget to Capital Improvement Project No. 513 which will cover the contract, engineering and inspection costs. 1 AYES: NOES: ABSENT: Councilmen Arth, Considine, Rage, Helms None Councilman Butterworth On recommendation of the City Manager and the Director of Public Works it was MOVED by Councilman Considine, seconded by Councilman Arth and carried on roll call vote as follows that the work completed by the Calnor Construction Company at the Wilderness Park Nature Center be ACCEPTED and that final payment pursuant to the terms of the contract be and it is hereby AUTHORIZED. It 'was noted that there is approximately $2000 remaining in the account for the completion of the entire project. AYES: NOES: ABSENT: Councilmen Arth, Considine, Hage, Helms None Councilman Butterworth DiscLJssion was held during the abOJ e deliberations on the need for security at the subject site. Staff to study methods therefor. The City Manager and Director of Public Works reported on the status of the negotiations with the contractor (Rub-R-Gard) in alleviating the unstable condition of the seal co~t applied to Santa Anita Avenue (Huntington Drive to Camino Real)'under Job #365. ,Report dated October 15 and on file in the office of the City Clerk. Based on the experience it was staff's recommendation that the application of a slurry seal (to be performed by the A.P.S. Co.) would accomplish th7 following: The total roadway surface would have a uniform appearance. Lane striping, crosswalks and pavement legend will not be damaged due to the movement of the seal coat or obliterated due to tracking of asphalt. Existing rough pavement sections would be retreated with slurry prior to a uniform application of a slurry seal which would result in a smooth riding roadway. It was MOVED by Councilman Hage, seconded by Councilman Considine and carried unanimously that staff be authorized to have the slurry seal coat applied with the stipulation that final approval would be subject to all work being executed in a workmanlike manner in conformance with applicable specifications to produce a uniform and stable roadway surface. Council received a petition signed by all property owners on Volante Drive between Altura Road and Michillinda Avenue in which it was requested that Volante be closed at Michillinda. Staff recommended against such closing as it would tend to increase traffic on adjacent streets; that petitions might be filed for closure of other streets and possibly result in the Rancho area becoming a residential enclave with a few highly congested points of ingress and egress, Reports from the Director of Public Works and the Police Chief are herein made a part of the record. Mrs. Edward Berry, 1167 Volante Drive, noted reasons for the closing other than increased traffic on Volante Drive. She noted the vacant lot at the west end across Michillinda (in County territory) and the nuisance therefrom including motorcycles driving on the lot creating noise and dust. She referred to the freeway billboards and advertising symbols which can be seen from her residence; that any residential atmosphere has been removed. She felt if the so-called Eaton property at the southeast corner of Michillinda and Colorado were improved with homes the problem would be resolved. She urged consideration of the closure. Councilman Arth spoke to the matter stating in part that the problem does increase during the racing season; that he had pointed out to the, proponents that the closure just might tranfer the traffic to another street, however, it just might deter them enough that they would seek another route and suggested as a trial basis only that a J~o thru street" sign and some type of temporary landscaping at Michillinda be installed. ,He also suggested those interested to attend a forthcoming meeting on the General Plan where the future of the Eaton property 10-19-71 - 9- EQUIPMENT PURCHASE (staff cars) p: READING ROOM REMODELING (Library) .--' .//~'?I-L ,7~~ NEIGHBORHOOD PARKS (Deferred) ~ ORDINANCE NO. 1441 INTRODUCED 19:7938 will be discussed. Councilman Considine felt that the construction of a 6' wall with some landscaping would 'not help with the problem in the vacant lot, or the view described, nor with the noise level and thought that some very dense and high landscaping at the rear of the properties involved would help more .. perhaps simply a barricade of the' street would be the answer. Some discussion ensued on the estimated cost of closing the street and it was the consensus of Council that the matter be continued until the November 2 regular meeting -' Mayor Helms pointed out that the outcome of the October 20 adjourned meeting on the General Plan 1 would be of assistance in the final determination. On recommendation of the City Manager and the Finance Director it was MOVED by Councilman Considine, seconded by Councilman Arth and carried on roll call vote as follows that three (3) staff cars (one for the Public Works Department and two for the Police Department) be purchased from Mackaig & Sons in the amounts as listed on the report dated October 12, and one (1) station wagon (for the Fire Department) from Bob Hicks of Ontario in the amount listed on same report. It was noted that the total of the low bids is $11,533.49 and $12,950 is budgeted for the purchases. The Library Board recommended proceeding with the remodelling of the adult reading room which would bring the periodical area up to the level of the remainder of the reading room and would greatly facilitate improved service, surveillance and convenience adding to the capacity of the area. The work would be performed in the Spring by city crews.
