March 18, 1997 at 7:00 p,m, in the Arcadia City Hall Council Chambers,

PRESENTATIONS
Mayor Kuhn introduced the teachers and coaches of the 1997 Arcadia High School Constitution
Team: Shelley Barker. Bob Garrell, Marcia Garrell, Gary Kovacic, Craig Lucas, Ron Morris,
Jim Romo, and Steve Wilburn. Councilmember Kovacic presented a brief overview of team
preparations for competition. On behalf of the City Council, Mayor Kuhn presented a check for
$500 to teacher Ron Morris in support of their trip to the State Finals in Sacramento, The Team
of 30 students have become the California State Champions in their competition with students
from other schools, Mr, Morris introduced the Team: Jonathan Barker, Joseph Cheung, Winnie
Ching, Anna Chung, Annie Chung, Steve Chung, Karen Dickinson. Scott Esposito, Susan Fu,
Jae Vyn Gan, David Han, Tracy Huang, Nathan Flowers-Jacobs, Seoyoung Kim, Jonathan Lee,
Michael Lee, Richard Urn, Winston Un, Billy Uu, Maggie 100, Margaret Ng, Jina Noh,
Margarita Ortiz, Harvard Pan, Nikka Rapkin, Christopher Tokeshi. Alexander Trifunac, Jack
Wang, Jennie Wang, and Wing Yung, Councilmember Kovacic gave each student a City pin,
and Mayor Kuhn presented a Mayor's Certificate of Commendation to each Team member, The
Team will now go on to represent the State of California in the National Championship
competition to be held in Washington, D.C., at the end of April.
Corey Calaycay, field representative from State Assemblyman Bob Margett's office,
congratulated the Constitution Team and presented an Assembly Resolution to the Team on
behalf of Assemblyman Marget!. Bob Guthrie, President of the Arcadia Police Officers
Association, wished the Constitution Team good luck at the National Finals and presented a
donation to Mr. Morris and the Team on behalf of the Association as a token oftheir support.
Dorothy Denne, Arcadia Beautiful Commissioner, explained that three years ago, the City of
Arcadia was named Tree City, USA, by the National Arbor Foundation, Every year a tree-
planting ceremony is held; this year it was at the Arcadia Public Library. Third grade students
are invited to participate each year. This year's third graders were from Camino Grove
Elementary School. Five students who were chosen winners of an essay contest about the

importance of trees read their essays: Teri Anarni, Ingrid Liu, Yvonne Lucas, Katherine Ko, and
Sarah Mattison.

AUDIENCE PARTICIPATION
Joann Steinmeier. President of the Arcadia Board of Education. invited everyone to the Showcase
of Arcadia High School, fonnerly known as Open House, on March 20, Students will be leading
tours of the campus, and it is an opportunity to see both older buildings and rehabilitated I
buildings and the new two-story 'T' building,
Gino Roncelli. 1250 Ramona Road, spoke, in part, in reference to an item on touight's agenda
with regard to a future development proposal for the 85 acres in the south parking lot at Santa
Anita Race Track. He suggests that now is the time for Santa Anita and the City to begin a
thorough public outreach and participation program, The citizens of Arcadia have a desire to
participate in such an important development review process, Mr, Roncelli stated that he wonld
like to be included in the development of a citizens advisory group, and would like to meet and
discuss this with the City Manager, the Mayor, and representatives from Santa Anita. There are
many questions that need to be answered regarding the proposed development.
Drew Krvuicki. 321 Le Roy Avenue, spoke in part of the proposal for development at Santa Anita
as mentioned in the Pasadena Star-News. He questioned the placing of a Home Depot building
in front of the grandstand at the Race Track, and a grocery store in the east portion of the parking
lot close to Methodist Hospital. He suggested some possible solutions, such as putting Home
Depot and a grocery store in the north parking lot, or if it is felt that the two stores attract people
to the mall, it might be considered to relocate the stables and make a continuation of the mall.
He hopes that issues such as traffic, aesthetics, and appearance from Huntington Drive will be
addressed more thoroughly than they were at the time of Santa Anita' s original proposed
development.

Councilmember Young noted that the City of Sierra Madre recently had a crowd of about 10,000
at its Wistaria Festival and street fair. and she hopes Arcadia can do the same some day.
Councilmember Kovacic also enjoyed the Wistaria Festival, The Recreation Commission is
working on some summer events for the City of Arcadia,

In reference to the Pancake Breakfast sponsored by the Arcadia Firefighters Association;
Councilmember Kovacic congratulated them for a wonderful community event. At the Breakfast,
a flier was handed out concerning Dena Kelly 1.ozar, daughter of Arcadia Firefighter Harvey
1.ozar, who has been diaguosed with leukemia and is in need of whole blood platelets and,
eventually, a bone marrow transplant. Those who wish to help may contact the American Bone
Marrow Donor Registry or the City of Hope,
The comments earlier this evening by Mr, Roncelli and Mr. Krynicki regarding development at
Santa Anita were appreciated, Councilmember Kovacic invited others to come forward at City
Council meetings to express their views.
Senate Bill 1310 would provide for I % of sales tax to cities if approved by a majority vote,
Councilmember Chang believes the bill should be supported,
Councilmember Chang recently attended a party in celebration of the reelection of Mary
Dougherty and Joann Steinmeier to the Arcadia School Board, He congratulated both of
them.
Councilmember Chang complimented the City Manager on the Economic Development Action
Plan. He suggested that the City Economic Development Team should constantly interact with
the business community and be business friendly in order to attract business to the City. Also,
development of a City Business Hot Line would help businesses and merchants to overcome
bureaucratic red tape and solve problems in a timely fashion.
Council member Chang spoke of the concept of community-oriented firefighters. For example:
Arcadia firefighters have replaced a broken fire alarm system in a home for aged deaf; donated
proceeds from the Annual Pancake Breakfast to charity; created a puppet theater for the Library,
Council member Chang believes firefighters should go into the community and interact with
residents to promote community welfare, He congratulated the Fire Department and thanked
them for their efforts,
Mayor Pro tern Harbicht commented that the Wistaria Festival in Sierra Madre is run entirely by
volunteers, as is their Fourth of July Parade, and is not a City function, The City of Arcadia
needs to recognize that and get volunteers behind some things rather than look to government to
do these things,
Mayor Pro tern Harbicht was contacted by a resident who complained that someone was hanging
a flier on his front doorknob at 6:30 on a Saturday morning. There must be some restriction as to
time for that activity. Perhaps staff can determine, through the cable company or Fox West
Sports, who was contracted with to distribute the fliers and let them know what the law is.
With reference to newsracks, there are some places where empty newsracks are taking space on
the sidewalk, and Mayor Pro tern Harbicht wondered if there were any way to have them
removed. The City Attorney commented that staff will check with the Business License Officer

lln the status of newsracks which are not being used, and will put together a report as to the I
c:utTent situation and what can be done. There was an appellate court case which sustained the
rights of cities to direct and control the aesthetics, appearance, and spacing of newsraeks,
Mayor Kuhn stated she would like to see the City become proactive in studying and investigating
a City-wide, volunteer-type program which would allow enhancement of volunteer services in
addition to those already in place, such as in the Police and Senior Citizens Departments. The
City Manager commented that staff is already working on such a program in terms of some City
services, and will contact the Chamber of Commerce for their participation.

history of the bnilding, which was acqnired by a past Councilmember for the Historical Society.

traffic control services (as defined in staff report dated March 18, 1997) for the Third Annual

Consideration of report and recommendation to renew the lease agreement with the Arcadia
Historical Society to operate a "historical museum" on City property, The City Manager
explained the history of the lease agreements over the years from 1986 to 1996. The proposed
lease agreement is for five years and reflects the existing lease terms with two exceptions, The
amount of general liability insurance coverage has been increased and the City is now legally
responsible for the maintenance and repair of the exterior structure. Since the Historical Society
has not been in a position to pay for any significant maintenance or repair, the City has been
paying for these costs as well as those for water service. The lease addresses this issue in Section
14, which provides that the City shall maintain the exterior of the structure, including the
parking lot and landscaping. The Society shall be responsible for the interior of the structure
subject to the right to request assistance from the City through the City Manager's office, The
building is aging, and it is anticipated that there will be some repair and maintenance work
needed in the next year; $3,000 will be placed in the Recreation Department budget for this
purpose.

CITY MANAGER
On February 4, 1997, staff presented a report of the Water Master PlanlFinancial Plan to the City
Council for discussion, The Water Master Plan was developed to provide the City with a long-
tenn guide for the future development of the City's water system, in addition to an analysis of
rates required to fund future system improvements, The plan presents a comprehensive capital
improvement program addressing system improvements, water quality issues, and a financial
plan and water rate structure analysis, The document was completed in concert with the City's
General Plim update to insure that efforts were relative to land use projections. An Initial
Environmental Study was prepared for the Water Master Plan under CEQA; and as a result, a
Mitigated Negative Declaration has been prepared.

CONTRACf Consideration of report and recommendation to award a three-year contract in the amount of
AWARD $264,566.11 to Traffic Operations, Inc" for street striping and pavement marking services, In
(fraffic Oper., November 1996 the City Council authorized sale of the City's line striping truck and authorized
Inc, - street staff to transition from partial contracting of line striping to a full service contract. In order to
striping and fully contract striping and marking services, staff recently solicited bids for street striping and
pavement pavement marking services for a three-year period, Under the three-year contract, staff
markings) will schedule the striping of City streets periodically as field conditions require, Services
() q J 0 _ qO incorporated in the contract include: line striping, legend marking, repainting stop bars, public
parking lot striping, sandblasting, and repainting of curbs within the City. The Maintenance
Services Director stated that, overall, the unit prices which were received through the multi-year
bid process were approximately 15% lower than the unit prices which were bid for the last year's
single-year contract.
Council discussed the matter and asked questions of staff, The Maintenance Services Director
explained the savings which will be realized by contracting out the street striping work.

Consideration of recommendation to approve a cost compensation agreement with Santa Anita
Realty Enterprises for environmental, land use, fiscal and legal processing; and to authorize
consultant agreements regarding a Santa Anita Realty Enterprises application, The scope and
importance of the application to be submitted by Santa Anita Realty Enterprises to commercially
develop approximately 85 acres of land in the southwest portion of the race track property
mandates significant City review and analysis to ensure a meaningful public review and decision-
making process before the Plauning Commission and City Council. It is recommended that the
City Council authorize staff to retain certain expert consultants to process Santa Anita's
application and approve a Cost Compensation Agreement between the City and Santa Anita that
calls for the reimbursement to the City of the cost of all consultant services used for this project.

The approximate cost for consultant services and City reimbursable expenses is $132,470. The
consultants proposed to be utilized by the City for analysis of the project will be:

Overall management of the project will be by the City Manager, with day-to-day administration
by Donna Butler. the Community Development Administrator. The Agreement provides that the
City retain absolute discretion with regard to all final decision making concerning the proposed
project entitlements and related environmental review process. The public hearing process will
go forward, and the City is not in any way precluded from exercising its independent discretion
with regard to the proposed project, Mr, Tom Austin, who is with Santa Anita Realty
Enterprises, was present and commented on the proposed commercial center, which is one-third
the size of the previous plan. The City Manager added that there is a common misperception
that if the City accepts an application from Santa Anita, it is an indication the City is going to
approve the project, However, State law mandates that the City accept and process every
application submitted where fees are paid, An application may only be rejected if inadequate
information is submitted.

Referring to Exhibit B of the Agreement, Project Objectives, Councilmember Kovacic suggested
adding the words "and other significant features" to one of the objectives, so that it wonld read:
"Provide view corridors through the property which preserve views of the grandstands and other
significant features from selected vantage points on the site." The City Manager suggested also
including the words, "and as suggested in the General Plan," since the General Plan is very
specific in this area, Councilmember Kovacic would like to add an additional objective:
"Provide a development that is consistent with the City's stated goals of preserving both live
horse racing and the qnality of life in Arcadia," In addition, he would like to add a phrase which
says, "Explore possible complementary civic uses such as an auditorium or other structures,"
The City Attorney noted that the Project Objectives are an exhibit to a negotiated agreement. Mr,
Austin stated he had no objection to listing that as one of the Project Objectives as far as
consideration goes, Mayor Kuhn noted that the estimated time of completion for the entire
process, to City Council approval, is December 1997,
It was MOVED by Mayor Pro tern Harbicht, seconded by Councilmember Young, and CARRIED
on roll call vote as follows to AUTHORIZE the City Manager to execute the Cost Compensation
Agreement between the City of Arcadia and Santa Anita Realty Enterprises incorporating the
modification and additions to the Project Objectives of said Agreement as suggested by
Councilmember Kovacic; and, AUTHORIZE the City Manager to execute agreements with LSA
Associates; Gobar & Associates; Freilich, Fox & Sohagi; and Kane, Ballmer and Berkman for a
total amount of $132,470 subject to finalization of the contracts and approval as to form by the
City Attorney,
