OF THE CITY OF ARCADIA SPECIAL MEETING MARCH 26, 1997 The Arcadia City Council met in a Special Meeting called by Mayor Kuhn, as authorized by City Charter Section 408, on Wednesday, March 26, 1997 at 8:00 a,m, in the Council Chambers Conference Room, PRESENT: Councilmembers Hartlich!, Kovacic, Young, and Kuhn ABSENT: Councilmember Chang (arrived at 8:04 a,m,) It was MOVED by Councilmember Young, seconded by Councilmember Kovacic and CARRIED to EXCUSE the absence of Councilmember Chang, AUDIENCE PARTICIPATION None, At 8:03 a,m, the City Council ENTERED a CLOSED SESSION. Pursuant to Government Code Section 54956,8 to confer with City negotiators concerning a potential development agreement for real property at 285 West Huntington Drive. approximately 85 acres of the southerly parking lot of Santa Anita Race Track property involving possible terms of payment pertaining to the potential purchase, sale. exchange, or related disposition of parIS' of subject property including public rights of way adjacent to said property, City negotiations would be with designated representatives of Santa Anita Realty Enterprises, At 9: 10 a,m, the Closed Session ended and the Special Meeting RECONVENED, If, ~ At the March '" 1997 meeting the City Council approved a Cost Compensation Agreement between the City and Santa Anita Realty Enterprises for environmental, land use, fiscal and legal processing of Santa Anita's application to commercially develop 85 acres of the race track parking lot. Said agreement incorporated certain amendments to Exhibit B, Project Objectives, as suggested by Councilmember Kovacic, Subsequently, relative to previous discussion of the proposed amendments, in particular, the addition to Exhibit B, Project Objectives, "Explore inclusion of possible complementary civic uses such as an auditorium or other structures," the following motion was stated: It was MOVED by Mayor Pro tern Hartlich!, seconded by Councilmember Chang and CARRIED on roll call vote as follows to FIND that the additional Project Objective, "Explore inclusion of possible complementary civic uses such as an auditorium or other structures," be REMOVED from the City's Cost Compensation Agreement with Santa Anita Realty Enterprises, and INCORPORATED into the Development Agreement; and, AUTHORIZE the City Manager to sign said Cost Compensation Agreement as revised, 3/26/97 ROLL CALL ADJOURN- MENT (April I, 1997) 39,:1008.0 In reference to the amendment to the Project Objectives, Councilmember Kovacic stated for the I record, "I prefer that it be left in, but I understand both sides, I fear that if we mention a specific use it may gain an unfair momentum one way or the other, And so, even though the objectives are basically open ended and non-binding, I would agree with Bob's comment that specific exactions or other appropriate dedications are left to the Development Agreement. And that when we talk about preserving the quality of life of Arcadia then all things remain in play, And so, I don't see the City losing anything by this deletion... so, I would agree with the motion," Councilmember Chang felt that moving this project objective from the Cost Compensation Agreement to the Development Agreement with Santa Anita is another reflection that the Council is willing to deal with this business entity to further business development in the City, And, with this particular project, Council is starting out in good faith, AYES: NOES: ABSENT: Councilmembers Chang, Hartlich!, Kovacic, Young and Kuhn None None At 10:14 a,m, the City Council Special Meeting ADJOURNED to April I, 1997 at 7:00 p,m, in the City Council Chamber for a Regular Meeting to conduct the business of the Council and any Closed Session necessary to discuss personnel, litigation matters or evaluation of properties, Barbara D, Kuhn, Mayor of the ity of Arcadia AlTEST: I ~;j.~<x J D, Alford, ~ity rk ') I 2 3126197
