The City Council and the Arcadia Redevelopment Agency met in a Regular Meeting on Tuesday,
May 6, 1997, at 6:00 p,m, in the Conference Room of the Arcadia City Hall Council Chambers,

DISCUSSION OF URBAN FOREST MASTER PLAN

DISCUSSION AND DIRECfION REGARDING INITIATION OF ASSESSMENT DISTRICTS
INCLUDING THE RETENTION OF PROFESSIONAL SERVICES (ENGINEERING/LEGAL)

The City Manager presented information furnished by Willdan Associates. a professional
engineering consulting firm, with regard to their services to the City in formulating an
assessment district for fire suppression services, Willdan Associates has submitted a proposal for
assessment engineering services in the amount of $50,000 for formation of a Fire Suppression
Assessment District, $50.000 for formation of a Landscaping and Lighting Assessment District,
and $100,000 for formation of both Districts, The establishment of such assessment districts is
necessary to bring in revenue needed because of a $1,500,000 budget shortfall in FY 1997-98,
The City Manager emphasized that immediate action must be taken in order to move the process
forward and have time to submit the appropriate documents to the County of Los Angeles,

Angelique Lucero, Vice President of Financial Management Services, Willdan Associates, stated
that it is her firm's opinion that the City would be better off with formation of a Fire Suppression
District; a Landscaping and Lighting District would not raise enough money, Property owners

would be asked to vote by mail this summer for or against the $2,000,000 fire assessment, which
will affect 15,577 taxable parcels in the City, Ms, Lucero noted that there is a very positive I
aspect for the Fire Suppression District in that the citizens are proud of their Class 1 Fire
Department, and fire services are well regarded in the City, In order to collect a.c"""ttnents in
Fiscal Year 1997-98, a computer tape mnst be submitted to the County Auditor-Controller by
August 9, 1997, Ms, Lucero stated the process must begin immediately, and Willdan Associates
will be back to Council on June 3 with a proposed ballot, which must be mailed by June 20, A
final public hearing and tabulation of ballots will take place on August 5,
Council discussed the matter. Ms, Lucero explained the method of billing the assessments, on a
property tax bill as opposed to a water bill; and the classifications of parcels assessed, such as
residential, commercial, etc,
Richard Maullin of Fairbank, Maslin, Maullin and Associates explained that his company
conducts public opinion research for public policy questions, such as school bonds, parcel taxes,
and revenue-raising measures for local jurisdictions. They gather information to help citizens
committees and municipal governments to encourage people to vote for the measure, Since the
passage of Proposition 218, Mr, Maullin's finn bas been asked by several jurisdictions to help
with votes on special taxes and special assessments, The work Mr. Maullin' s finn does is to help
a jurisdiction understand the degree of support and opposition there may be to the basic measure,
and to test-market different articulations of the measure, which may make a significant difference
in the level of support,
The City Manager reviewed fees in addition to Willdan Associate's charge of $50,000 per district
to perfonn necessary professional services: utilizing the legal services of Brown, Diven and
Hentschke-$lO,OOO; surveying, public relations, etc,-$20,OOO; mailing of ballots- $15,000 ($1 I
per ballot); totaling $95,000 to $100,000, If the assessment district is approved, the expenses are
recovered; if it is not approved, that is just the cost of an election, The City Manager noted that
as government, the City cannot do campaigning for the measure, other than educating,
discussing, and explaining the measure to the public,
Councilmember Young commented that because of the time schedule it may be very difficult to
get a citizens group going, Mr, Maullin stated that there is a 45-{jay period during which people
may vote; the citizens group could follow up with those who do not vote early, urging them to
support the measure, Councilmember Kuhn brought up the matter of a bond issue for a new
police building, and what bearing it might have on how the citizens may feel toward it if they
have recently voted for an assessment district, Mr, Maullin stated it is more difficult to get bonds
passed for police facilities in California than to pass a fire assessment district to get the dollars ,
which pay for the actual fire personnel who protect the public. He does not believe this issue will
either help or hurt the police facility issue,
Discussion continued, Mayor Pro tern Kovacic inquired about the language of the ballot measure
with regard to impartially infonning the public, He expressed concern that the election
procedure under Proposition 218 is so new it may not be known for sure whether the Proposition
contemplates that a city send out a promotional-type ballot as opposed to a completely neutral
ballot or one which contains both pro and con arguments, The City Attorney advised that in this
type of an election, it is felt that more information can be provided, It all comes down to how
language is used, and the special counsel which the City engages, along with the City Attorney,
are always looking at the language, There is no guarantee the City will not be sued, but
everything will be done to mitigate the prospects for a successful taxpayers suit

Council concurred that a Fire Suppression District would be the most salable and would raise the
amount of money needed, Mayor Harbicht did not think there is enough time to have a srudy
done by the public information services consultant and receive results on whether or not the

measure might be approved by the property owners. Council discussed in length the option of
having a public opinion survey done,
It was MOVED by Councilmember Young, seconded by Councilmember Kuhn and CARRIED
on roll call vote as follows to APPROVE an agreement in an amount not to exceed $50,000 with
WilIdan Associates to perform the necessary professional services to formulate an assessment
district for fire suppression services; and, AUTIfORIZE the City Manager to execute the
agreement subject to approval as to fonn by the City Attorney,

The subject site has been a property maintenance problem for the past few years and is
inharmonious with the level of maintenance and appearance of the surrounding properties, In
1993 the property owner, Phillip Whitlatch, participated in the City's housing rehabilitation
program, at which time several code violations were brought into confonnance and a new roof I
was installed, In April 1996 a misdemeanor criminal case was dismissed against Mr, Whitlatch
based upon the fact that the property had been brought into minimal compliance, At that time it .

- was noted that if further legal action was needed to gain compliance with regard to the property,
there would be no disposition of the case and the City would seek reimbursement of costs, In
August 1996 another complaint was received and Mr, Whitlatch was sent a letter advising he had
until September 4, 1996, to bring the property into compliance, As a result of this notice there
was some minor cleanup; however, in January the property was once again in violation of the
Arcadia Municipal Code, and in addition to other violations Mr, Whitlatch was cited for having
at least three inoperable vehicles on the property,
On March 11, 1997, the City Attorney advised Mr, Whitlatch that a Misdemeanor Criminal
Complaint had been filed against him in the Santa Anita Municipal Court and he was ordered to
appear for arraignment on April 3, 1997, Mr, Whitlatch failed to appear for arraignment, and a
bench warrant was issued in the amount of $500, A Notice of Public Nuisance and Order to
Abate was sent by certified mail, as well as regular mail, to Mr, Whitlatch, and a Notice was
posted on the property as required by City Code, As of April 28, Mr, Whitlatch had not
contacted the City or acknowledged receipt of this notice, In addition to general property
maintenance issues related to overgrown weeds, grass, bushes, and trees the applicant has been
notified regarding additional violations as cited in the staff report,

Staff recommends that the applicant be giveu a maximum of 10 days to clean up the property, If
it is not cleaned up by May 16, the City Attorney will seek a court order to allow the City to abate
the public nuisance, Recent cost estimates for cleanup are as high as $9,500, The City has
$6,000 set aside in the nuisance abatement fund, Upon final uuisance abatement, it may be
necessary for the City Council to allocate additional money in the Nuisance Abatement Fund,
The total cost for abatement, including staff's time, will be assessed against the property and
charged to the property owner for reimbursement to the City, If the property owner does not pay
the invoice, the charges are then added to the property tax bill for reimbursement through the
County Tax Collector.
Mayor Harbicht declared the public hearing to be OPEN,
Phillio Whitlatch. 1106 South Mayflower Avenue. explained he has tried to comply with the
City's nuisance abatement orders, His wife had a stroke last October, and he was not home much
of the time, It was not until the 2nd of this month that he picked up the Notice of Public
Nuisance and Order to Abate, He stated he has removed inoperable cars from his property. and
he is in the process of having the house painted and that is the reason for the compressor in the
front yard, He is doing the best he can in cleaning up the property, and asked for a time
extension to 20 days from 10 days,
No one else desiring to be heard, the public hearing was CLOSED on MOTION by Mayor Pro
tern Kovacic. seconded by Council member Kuhn, and CARRIED,
Council discussed the matter and asked questions of staff,

Consideration of report and recommendation to introduce Ordinance No, 2070, entitled: "AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
ADDING SECTION 7211.1 ESTABLISHING PARKWAY REQUIREMENTS IN THE PUBLIC
WORKS SECTION OF THE ARCADIA MUNICIPAL CODE AND AUTHORIZING
MODIFICATIONS BY THE CITY ENGINEER" The purpose of parkways is to provide an area
to accommodate such improvements as sidewalks, utilities, traffic signals, and signs, Existing
parkway widths vary throughout the City, and although the City has "established policies" for
minimum parkway widths, these standards are not specifically set forth in the Municipal Code,
Because the City is predominantly built out, this has not presented a significant problem in the
past. However, as new development takes place, especially on commercial properties, specific
standards set forth in the Code will enable staff to better assist developers in designing their
projects,

The average parkway in Arcadia varies from eight feet to twelve feet, The concept of offering a
variable parkway width was developed in order to provide flexibility in parkway design and
right-<lf-way improvements, The eight-foot width presents difficulties with the construCtion of
Americans with Disabilities Act (ADA) ramps and driveways which need to provide suitable
access to private properties while maintaining ADA access requirements, A twelve-foot parkway
is better able to accommodate ADA ramps and allows driveways to be built with improved
rideability and better compliance with ADA standards, The new Code section provides flexibility
by allowing the City Engineer to approve parkway widths either less than eight feet or more than
twelve feet as deemed necessary for development where unique situations exist,
Council discussed the matter and asked questions of staff,

suggestions on ways to cut expenses, Ms, Marshall suggested hiring an outside expert to study
employees' salaries and insurance benefits, making budget cuts as she listed. and reviewing
benefits and "perks" before raising taxes,

Councilmember Kuhn advised that Dena Kelly Lozar, daughter of Fire Captain Harvey Lozar,
lost her battle with leukemia on April 21 at the City of Hope,
Council member Young attended the City's disaster preparedness practice on April 17, which was
very interesting, Staff did a good job at the training exercise-a simulation of a rainstorm which
caused mud slides, dam backups, and flooding,
A letter has been sent to residents by Newco regarding recycling, Councilmember Young asked
the City Manager to announce infonnation about recycling trash cans, He stated negotiations are
being finalized with Newco; acceptance of the containers should be at the end of July or early
August.
As liaison to the Sister City Commission, Councilmember Young announced that the Arcadia
Friendship Club is having a tour of Greece, September 22 through October 8, 1997, with two
days in Tripolis, Arcadia's Sister City, All City residents are welcome,
Mayor Harbicht reminded everyone that the City of Arcadia has a cable television show called
"Speaking of Arcadia," which brings information to the citizens, It is shown on Mondays and
Fridays at 7 p,m, and on Saturdays at 3 p,m, The current program gives an explanation of the
City budget
CITY CLERK
Consideration of report and recommendation for authorization to fill the secretarial position in
the office of the City Clerk. As part of the 1996-97 budget deliberations, a full-time Deputy City
Clerk position was eliminated from the City Clerk's department budget At that time the City
Council directed that prior to filling any position the request be brought to the Council for
consideration. The City Clerk's secretary has submitted her resignation (retirement), with the
final date in the office of May 30,1997,
The secretarial position in the Clerk's office provides the Clerk with professional secretarial
skills and assists in management of a variety of responsibilities conducive to the office, as listed
in the staff report. The Fiscal Year 1996-97 Annual Operating Budget and the proposed Fiscal
Year 1997-98 budget include funding for this position, and it should be filled as soon as possible
to maintain staff level in order to comply with legal responsibilities of the Office of the City
Clerk,

The last major change to the Motion Picture Ordinance was adopted in July 1984. The proposed
ordinance revises the City's film permit process. It features a centralized applicationfmstruction
packet with updated filming requirements. The goal of tltis new process is to continue the "film
friendlyn attitude of the City of Arcadia by making the process more understandable and
efficient. A small increase in revenue may be realized through higher filming fees. The existing
. fee is $90 per location; the proposed fee is $250 for the first day and $75 for each additiooal day
for each location where filming will be conducted. The City issued 53 permits last year for a
total of $4,770 in fees collected. With the implementation of new fees, the City would collect an
additional $10,000.

Council member Kuhn adjourned the meeting in memory of Dena Kelly Lozar. "Dena Lozar, the
daughter of Fire Captain Harvey Lozar, as I said before, lost her battle with leukemia on April
21,1997, at the City of Hope. Dena was born in the City of Arcadia at Methodist Hospital on
October 4, 1970. Dena grew up among the people, places, and principles of the fire service. She
loved, and was loved, by firefighters and their families alike. Dena was gutsy and giving
throughout her life. A resident of Arcadia, she worked as a Certified Nursing Assistant at
Wellington Court Retirement Community and was enrolled in nursing school at Pasadena City
College. Dena would have graduated from nursing school on May 22, 1997. That graduation
has been dedicated to her memory. Unfortunately, Dena was never a recipient of a bone marrow
transplant that potentially could have saved her life. I encourage you to consider becoming part
of the National Bone Marrow Registry through the City of Hope and possibly become a life saver
to others in similar situations. To Harvey L07.ar and his wife, we express our sympathy."

ASSESSMENT At 8:08 p.m. the City Council RECESSED the Regular Meeting and RECONVENED at 8:15
DISTRICT p.m. in the Council Chamber Conference Room to further discuss Agenda Item 4, initiation of I
CONSULTANTS assessment districts including retention of professional engineering and legal services. Council
(Agenda resumed discussion of retention of a public relations consultant for public information services
Item No.4) and wording of the mailed ballot and authorization of funds. It was agreed, because of time

Council discussed the amount of money which should be raised from a fire suppression
assessment district. The City Manager noted the entire budget for the Fire Department is $8
million and the General Fund shortfall is $1.5 million; a $2 million total assessment would
provide a margin to deal with and would avoid increases for two or three years. Mayor Harbicht
suggested $2.2 million. That amount would balance the budget and also provide for raises for
those employees who have not had a raise in three years. In addition, the City has been
borrowing from reserves for the last five years, and needs to start paying that money back. It was
noted that in comparison to other cities, Arcadia is charging its citizens less for services as far as
assessments go. The City Manager commented that the citizens should know that if the vote
passes, the Fire Department will be kept intact; if it does not pass, they should know what the
impact will be to the budget Police. and Fire Departments account for 60 percent of the City's,
General Fund budget.
