The City Council and the Arcadia Redevelopment Agency met in a Regular Meeting on Tuesday,
October 21, 1997, at 6:00 p.m.. in the Conference Room of the Arcadia City Hall Council
Chambers.

Mayor Harbichl read and presented a proclamation to Jim and Margaret Barrows proclaiming
the forty-fourth year of the Arcadia Festival of Bands which will take place on November 22,
1997: and proclaiming the month of November as Arcadia Festival of Bands Month. Mayor
Harbicht encouraged all Arcadians to attend this spectacular event. Jim Barrows, representing
the Festival, ex 'Pressed appreciation to the City Council for their support and, in particular, the
City's allocalion of $5,000 for this event.
Mayor Harbicht and Mayor Pro tem Kovacic, Council liaison to the Arcadia Beautiful
Commission, presented a plaque commemorating the dislinguished service of oulgoing Arcadia
Beautiful Commissioner, Don Gathers, and ex 'Pressed the Council's appreciation for his years of
service 10 lhe community.
The City Clerk administered the Oath of Office 10 Janice Torrington, newly appointed 10 the
Arcadia Beautiful Commission. Mayor Pro tem Kovacic welcomed Commissioner Torrington to
the City family and presented her with credentials and a City pin.

PUBLIC HEARING
Consideration of Text Amendment 97-004, prohibiting the hanging of laundry on clotheslines or
on any other struclure within the required fronl and streel side yard areas.
In response to a citizen complainl, the City Council requested that staff investigate prohibiting
clotheslines or laundry being hung within fronl yards or on the street side of a comer lot. The
citizen complaint concerned clothes which were hung on a balcony in a multiple-family zone. At .
its Seplember 23, 1997 meeting the Planning Commission voted to approve T A 97-004 as
worded.
Council member Young felt this text amendment should prohibit clotheslines in streel side yard
areas and also unfenced side yard areas. Staff advised this would be very difficult to enforce,
however, Ms. Butler. the Community Development Administrator, said staff could add this to the
municipal code if it becomes a problem in the future.
Mayor Harbichl OPENED the public hearing.
No one came forward to address lhe Cily Council, and it was MOVED by Couneilmember
Young. seconded by Council member Chang and CARRIED to CLOSE lhe public hearing.

AUDIENCE PARTICIPATION
Lvle Wilson, 1701 Soulh Sixth Avenue, stated he was mystified as to why Council agreed to
spend $430,000 to fill the vacant positions on the agenda at the last Council meeting when they
know the City will be facing another budgel shortfall nex1 year. Mr. Wilson noted that the
amount of City funds paid for atlorney litigalion fees and damages has escalated for various
reasons since 1993. A large amounl of the budget shortfall last year was due in part to the
settlemenl of a law suit. Council should address those areas in City government that are
generating lhese problems and seek 10 avoid such litigation. Mr. Wilson again mentioned the
costs involved in the reclassification of secretaries 10 management analyst. He feels Council is
not paying atlention to what City staff has been doing in these situations. Mr. Wilson ex "pressed
his opinion that the Chief of Police illegally terminated an employee who was reactivated by his
military unit to serve in Bosnia. then told the employee he was welcome to come back to the City
of Arcadia later. The law stipulates the job exists for the employee upon return from active
military duty. This situation happened in the Arcadia Police Department and is a huge potential
for a law suit to the City, as well as an embarrassment.
Gail Marshall, 2300 block of Lee A venue. took issue with certain Council actions at the last
Council meeting. The $10,000 Council allocaled to the Greater San Gabriel Valley Community
Development Corporation could be spent in Arcadia rather than given to this small business loan
program thaI loans money to high risk businesses. She doubts there will be any beneficial return
on this investment.
In reference 10 loss of the lnline Developmenl project, Ms. Marshall felt the developmenl ability
of this group was subject 10 insults by one member of the City Council. Ms. Marshall agreed
"ith Mr. Wilson regarding his objection to the reclassification of City secretaries to management
analyst al an increase of $17,000 a year in base salary. ln reference to the $430,000 Council
agreed to spend for new employees, if Council made budget cuts first these new employees might
not be needed. Iffunds for the positions are included in the budget this does not mean that hiring
should occur. Funds could be reallocated next year if the positions are needed. These are tax
payer monies thaI are being spent. It is her opinion lhat everyone on this Council is guilty of
needless spending. At the rate Council is spending the City "ill be in the red forever.
MA TIERS FROM ELECTED OFFICIALS
Councilmember Young commented thaI the City should marketlhe fact thaI Santa Anita Fashion
Park Mall is one of the safes! malls in Southern California. There is a police station al the mall
during the holiday season; ham operalors survey the parking lots; and a mounted police patrol.
Mall officials and the Cily should joint venture a markeling program and start immedialely.
Council member Kuhn agreed.

KUHN Councilmember Kuhn attended a Council of Governments (COG) meeting recently. Several
(Youth Al Risk) regional issues were discussed. The Los Angeles County bond measure was discussed, in I
particular the use of Proposition A Funds to fund the Youth At Risk employmenl program. This
program would require cities to spend a minimum of 10% of their Parks Fund monies received
from 1992-1996 for this program. This would amount to $4.8 million for the San Gabriel Valley,
which would be taken away from parks, as lhe voters intended. Councilmember Kuhn requested
a letter Over the Mayor's signature be sent in support of COG's efforts. Council concurred.

CouncilmemberKuhn announced lhe Santa Anita Family YMCA 1997 Champion of Youth
Awards will be presenled to Dr. Walker Dorsell, Arcadia; Mr. Marshall Jackman, Duarte; and,
Monrovia Police Chief Joe Santoro. The program will be held on November 6, 1997 at the
Wyndham Garden Hotel in Monrovia.
Mayor Pro lem Kovacic reported thaI the Sludent Government Day held on Oclober 17th, was a
great event. Twenty-two sludents participated. They toured City departments and held a mock
City Council meeting in lhe Council Chamber. Councilmembers Kuhn and Chang were in
attendance as well as School Board members. Dr. Sutro, Superintende!,! Towner, and other
school personnel. Mr. Kovacic expressed apprecialion to Cindy Rowe, Community Relations
Officer, for arranging this program.
Mayor Pro tem Kovacic complimented lhe Arcadia Chamber of Commerce for its successful
County Faire held this last weekend.
Mr. Kovacic announced that Arcadia residenl Purdy Tran was selected as the 1998 Rose Queen
of the Pasadena Tournament of Roses, and recommended that Ms. Tran be recognized at a future
Council Meeting.

Mayor Pro tern Kovacic noted a recenl L.A. County Assessor's' Office news release announcing
public meetings to assist property owners who believe their property taxes should be lowered due
to a decline in property values. The intent of the meetings is to help tID"!)ayers better understand
the assessment appeals process. There will be twenty-four such meetings held in the Southern
California area, two of which will be held in EI Monle and Glendale.
Mr. Kovacic took exception to an article in lhe Pasadena Star News stating that the City Council
was "fractured". This in reference to several votes taken for lhe filling of vacant Cily positions.
Mayor Pro tern Kovacic commented thaI he is proud to serve on a City Council that has five
independent minds that sometimes disagree...this is healthy. Councilmember Chang agreed.
Councilmember Chang announced the National Red Ribbon Week celebration October 21
through OClober 31, which is supported by the Arcadia Police Department. This program is
againsl drug abuse.
Councilmember Chang congratulated the Arcadia Chamber of Commerce and Cily merchants for
a successful County Faire which was enjoyed by many.
Dr. Chang felt that the Student Government Day was a memorable evenl for the Arcadia High
School students who played roles of City government officials and staff. Council member Chang
commended all the people involved for bringing this day together.
Council member Chang pointed out errors in a Pasadena Star News article stating the Cit),
Council had rejected a merger with Count)' Fire Services. Dr. Chang commented that the article
was 100% wrong. Council vOled against forming a committee to examine the Count)' Fire
services survey, which was requested by lhe City Council. The Council will decide whether or

Councilmember Chang noled the recent economic development aclion plan update of October
1997, listing the business promotion plan thaI is scheduled for implementation. Dr. Chang
believes that economic developmenl activity is moving along as planned and commended the
City Manager for this action.
Dr. Chang reported lIie Arcadia Chinese-American Association provided breakfast to the
Maintenance Services Departmenl in apprecialion of the work performed by this department for
the City.
In reference to Council action on October 21st. Dr. Chang noted that City positions were filled in
order to provide City services to Arcadia citizens as e~-pected. Filling these positions did nol
increase the budget deficit.
Mayor Harbichl announced the second annual Holiday Feslival and Chrislmas Tree Lighting
Ceremony will be held on December 3, 1997, from 4:30 p.m. to 6:30 p.m. This community event
was instiluted by former Mayor Barbara Kuhn and was a big success and enjoyed by many
Arcadia residents.

AWARD Consideration of the report and recommendation to award a contract to United Pumping Service,
CONTRACT Inc., in the amount of $42,980 for sanitary sewer line collection inspection services. Staff is
SEWER LINE preparing to inspect approximately ten (10) miles of the City's one-hundred forty-eight (148)
INSP. SVCS. miles of sanitary sewer collection lines as part of a new sewer maintenance program. To
(United Pwnping) accomplish this task, closed-circuil television (CCTV) and video taping inspections will be used
(APPROVED) to provide positive and reliable information regarding the slatus of the city's sewer syslem. Over

APPROP. Consideration of the report and recommendalion to appropriale $140,000 from the Water
FUNDS FRM. Facilities Replacement Fund for Arcadia's portion oflhe malching funds for the design of water
WTR. FACIL. system infrastructure seismic improvements. On October 7.1997, staff presented a report 10 the
REPLCMT. Council on the Water Infrastructure Restoration Special Study with the Army Corps of
FUND Engineers. This study was compleled as part oflhe City and the Corps evaluation of the City's
(Wtr. System water production and dislribution syslem. The study was intended to evaluate the syslem's ability
seismic impvr.) 10 withstand a 7.2 magnitude earthquake along the Sierra Madre fault. At the Oclober 7th meel-
(APPROVED) ing the City Council direcled staff to bring back a report and recommendation for Council's
o 7<;(J. p.l approval to appropriate funds from the Waler Facilities Replacement Fund to continue
participation through the design phase of this project.
In 1995 the cities of Arcadia and Sierra Madre applied for and received a $600,000 federal grant
through the Energy and Water Appropriation Bill to conduct a sludy on the reliability of both
cities' water systems and ground water supply. Estimated costs to design infrastructure seismic
improvements were $700,000 for the first phase or alternative of the study.
Upon completion of the studies, the cities applied for $525,000 in funding for technical and
design assistance for the recommended improvements in the 1998 budgel under the Energy and
Waler Appropriation Bill. To qualifY for the federal funding, the cities were required to rnalch
these funds with 25% of the design cost ($175,000) with non-federal funds. The City of
Arcadia's portion of the matching funds is $140,000 toward the design of the project. Additional
details are se!forth in the Oelober 2 I. 1997 staff report.

FY 1997-98 The City Council at prcvious meetings held on August 5. t9 and 26, 1997. received input from I
FINAL BUDGET staff and the public conccrning lhe FY 1997-98 budget and the projected deficit in the General
ADJUSTMENTS Fund. After considcrable discussion. the City Council directed staff to amend the adopted 1997-

At the request of the CIty Council. staff previously reviewed revenue and e~l"'nditure data
through the quarter ending September 30, 1997. This information was presented to the City
Council this date to keep the Council abreast of current financial information and to assess the
budget and projections to the end of the fiscal year.
James Dale, Administrative Services Director, presented a brief overview of the FY 1997-98
budget process, noting that the City Council adopted the budget in June of 1997. This budgel
was adopted with the understanding that if a mail-in-ballol vole for a Fire Suppression
Assessment District (FSD) failed Council would revisit the FY 1997-98 budget and adjustments
would be made accordingly. Subsequently, on August 5th the ballots for the FSD were tallied
and the Dislrict failed to receive majority approval. On August 19 and 26 the Council considered
various alternative expenditure reductions and reduced the deficit by approximately $699,715.
Mr. Dale further explained a misallocation In sales tax revenue and other incorrect data from the
State which reduced projected revenues by approximately $600,000.

Mr. Dale presented and e""plained the Quarterly Revenue and E~l"'nditure Update for the First
Quarter Ending Seplember 30, 1997. Based upon new revenue and e"-penditure information the
$1.3 million transfer of reserve funds to the General Fund to balance the FY 1997-98 budget has
been reduced 10 $1 million for FY 1997-98. The budget deficit for FY 1998-99 is projected 10 be
$500,00.
Considerable discussion followed Mr. Dale's presentation. Revisiling budget e"l"'nditure
reductions was supported by several Councilmembers. Agendizing a discussion of a utility tax
increase, and opening such a discussion for public comment was favored. Regarding the Fire
Suppression Assessment District mail-in-ballot it was stated that voters were distuIbed by this
procedure, which was mandated by State law; perceived government waste; questioning of an
actual budget crisis; and the twenty (20) year term of the Assessment. The hearings served a
great purpose by educating the volers about the budgel shortfall, and educating the Council aboul
voter attitudes. The citizens should be given an opportunity to talk about a utility tax increase,
and if there is enough support, place it on lhe April, 1998 ballot. Limiting the duration of a
utility tax increase was mentioned also.
Councilmember Chang noted that further cuts in City e~l"'nditures may compromise City
services. The survey results for outsourcing Fire Services to Los Angeles County \\ill be
available in January: perhaps discussion regarding budget cuts could occur at that time.
It was then MOVED by Mayor Harbicht. seconded by Councilmember Young, that the discussion
of budget cuts in the FY 1997-98 Operating Budget be TABLED to the November 4, 1997
meeting: and. thaI a discussion of the potential for putting a utility tax increase question before I
the voters be agendlzed for the November 4th meeting also.

Carl Frahm passed away October I, 1997 al the age of 75. He was a long time residenl, born in
Idaho. Attended USC. Interrupted his education to join the Air Force and served in Italy; after
the war came back and compleled his education as an engineer. He wenl to. work for the
Sanitation District as an engineer. In 1961 moved to the Reed Valve Company where he began
work on developing a plastic to replace the heavy bottles used for water distribution. In 1973 he
was successful with a 5 gallon polycaroonnaled bottle. This revolulionized the bottled waler
industry. In 1991 both Carl and his wife Shirley were recognized and named 10 the Beverage
World Hall of Fame. He is survived by his wife, three daughters and their families. I adjourn the
meeting in memory of Carl Frahm.
The other person is Irene Souders. Irene was the wife of Elbert Souders who was a former
member of our school family. She passed away on October 13, 1997 at her home in Arcadia.
She is survived by her husband, two sons and lheir families, and four grandchildren. She died of
cancer. Services were held last Friday at the Good Shepherd Church. Contributions may be
made to the Methodist Hospital Auxiliary or the City of Hope. I adjourn the meeting in memory
of these two people."
