A~CADIA ,,' ,.J I i and the ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING DECEMBER 2,1997 The City Council and the Arcadia Redevelopment Agency met in a Regular Meeting on Tuesday, December 2, 1997, at 6:00 p,m, in the Conference Room of the Arcadia City Hall Council Chambers, ROLL CALL: PRESENT: Councilmembers Chang, Kovacic, Kuhn, Young, and Harbicht ABSENT: None 1, AUDIENCE PARTICIPATION None, 2, CLOSED SESSION 2a, 0110. </0 Pursuant to Government Code Section 54956,9(c) concerning the potential initiation of litigation (one case), At 6:04 p,m, the City Council RECESSED to the Closed Session which concluded at 7:00 p,m, The Regular Meeting RECONVENED in the Council Chambers at 7:03 p,m, INVOCATION Rev, Sheila Kane, Church of the Good Shepherd PLEDGE OF ALLEGIANCE Jerome Collins, Director of Parks and Recreation ROLL CALL PRESENT: ABSENT: Council members Chang, Kovacic, Kuhn, Young and Harbicht None 3, PRESENTATIONS Mayor Harbicht presented a proclamation to the American Lung Association declaring (American December Christmas Seal Month in the City of Arcadia, Enrique Chiock, PresidentiCEO Lung Assoc,) of the Los Angeles County American Lung Association, accepted the proclamation, Mr, Chiock expressed appreciation for the proclamation and the City's support of the Christmas Seal drive, and presented an American Lung Association scarf to Mayor Harbicht. (Arcadia The Mayor presented to each member of the Arcadia Planning Commission the Mayor's Plan, Comsn,), Certificate of Commendation in appreciation for their work in advising Council on mailers O''.:ll) _, I \ . of zoning, condilion~1 use permits, etcetera, Planning Commission members receiving these awards were Carolyn Bell, Richard Bruckner, Edward Huang, Paul Kalemkiarian, John Sleeter, and John Murphy, Chairperson, 1212/97 39:0294 (Oak Tree Racing Ass'n) In appreciation for a donation of $8,773,01 for the purchase of a three-horse trailer for the Arcadia Mounted Enforcement Team Program, Police Chief Ronnie Gamer presented a plaque of appreciation to the Oak Tree Racing Association, Agent Bruce Smith donated use of horses, at one dollar ($1) a year for this program, and volunteer Dorothy Denne facilitated the donation from, the Oak Tree Racing Association, Mr, ShelWood Chillingsworth accepted the plaque and presented the donation to Chief Gamer, Mayor Harbicht also presented the Assocliltion with the Mayor's Certificate of Commendation and expressed appreciation on behalf of the City, Agent Bruce Smith announced the Arcadia Mounted Enforcement Team's Christmas holiday special assignment at Santa Anita Fashion Park where they will be providing mounted patrol of the parking lots, 5, SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS None 6, QUESTIONS FROM CITY COUNCIUREDEVELOPMENT AGENCY REGARDING AGENDA ITEMS None ORD, & RES, READ BY TITLE It was MOVED by Councilmember Young, seconded by Councilmember Kuhn and ONLY CARRIED that ordinances and resolutions be read by title only and that the reading in full be WAIVED, 7, AUDIENCE PARTICIPATION Fred Jahnke, Hacienda Drive, commented in part about audience participation at the City Council meetings, Council's encouragement, appreciation and occasional reaction to the participation, Mr, Jahnke expressed his concern to the reference of audience participants as 'gadflies' at a recent Council meeting; such comments were perceived as demeaning and he felt an apology for such comments was ~ecessary, Mr, Jahnke also reviewed a chart of City of Arcadia Employee Salaries and Benefits for the calendar year 1996, and commented on the salaries and benefits of over $100,000 per year for certain City employees, He urged the Council to employ a private firm to conduct a full wage and benefit survey of City employees and ensure the study contain only cities within Los Angeles and Orange County areas, He also suggested the survey be completed and the .results published to the community prior to the vote on the Utility Tax increase, Gail Marshall, 2300 Block Lee Avenue, responded to comments about "gadflies' at the November 18, 1996 City Council meeting, stating in part, she felt community attendance and speakers at the Council meetings has diminished due to intimidation, although some Councilmembers have thanked the citizens for their concern and time, and she will continue addressing City issues of concern to her. I I Lvle Wilson, Arcadia resident, agreed with the opinions of the two previous speakers and : stated that issues at the Council meetings should not be personalized, this is a forum where citizens can address public issues, Mr. Wilson then addressed his concern regarding budget cuts and managing the budget shortfall, stating in part that he felt the I Council was not approaching it properly, He felt the filling of positions authorized at a recent Council meeting at the same time budget cuts were enacted, should be reconsidered by the Council. 2 12/2/97 I I I 8, YOUNG (Explorer Post applications) (Fire Dept Brochures) 39:0295 Mr, Wilson also remarked on the proposed Utility Tax increase, the effects of electrical service deregulation, compared and contrasted it to telephone service deregulation, the forthcoming electrical rate decreases, and its effect on City revenues, He felt the public needs to be educated about the pros and cons of the proposed Utility Tax increase; what will it do for the City and will it accomplish the desired goal. Mr. Wilson commented that if the City's fiscal house is in order the citiiens.woflld be willing to pay the additional tax if they perceive City funds are well spent. He (elt Council should ask hard questions and make the hard decisions, He also questioned City staffing levels, benefit packages, and salary levels, ' MATTERS FROM ELECTED OFFICIALS Councilmember Young announced that the Arcadia Police Department Explorer Post #101 is currently accepting applications from youths 14-18 years of age interested in a career in law enforcement. This program provides exposure, training and participation in law enforcement issues such as traffic control, security, the ride along program; etcetera, Mrs, Young stated the City has a Winter Weather and Flood Preparedness brochure, free of charge to the community, which is available through the Fire Department and the City Manager's office, She encouraged citizens to be prepared for EI Nino, KUHN Council member Kuhn presented information about a meeting she had with Carolyn (Live Oak Zigler, a member of the Monrovia/ArcadialDuarte Town Council, regarding concerns Business Strip) about the Live Oak business strip, They drove through the area observing the entire strip, It was decided to hold a meeting with concerned businesspersons and residents to discuss their concerns, She will bring additional information at a future Council meeting, (Police Dept, Mrs, Kuhn announced the Arcadia Police Department's change of color scheme for their Patrol vehicles) patrol vehicles from white to the traditional black and white. which will take place in the next 30-60 days, She stated that the public identifies more readily with black and white for police vehicles, and this will take advantage of that identity to increase their profile and visibility within the community, thus discouraging criminal conduct, The new vehicle painting also includes a new motto for the Police Department, 'Serving Our Community With P.R.I.D,E: The acronym stands for: Professipnalism, Respect, Integrity, Dedication and Enthusiasm which was developed by an internal committee of police officers and supervisors, CHANG (Trans, Occup, Tax) (Downtown Lighting Proj,) Council member Chang reported that the Transient Occupancy Tax for 1996 was a little over $1,000,000, and should exceed that amount in 1997 if income continues as it has, and with the additional hotels coming on line, Dr, Chang also reported on the status of the joint effort between the City Redevelopment Agency and the Arcadia Business Association Downtown Lighting Project, , This weekend. barring rain, City employees and volunteers will be installing lights on First Avenue and Huntington Drive, One-third (1/3) of the lights will be installed this year, the first year of the planned three (3) year project, This project will make the downtown area look more festive and beautiful. Dr. Chang expressed his pleasure and appreciation that the merchants are actively working together with the City to create a business district that encourages customers to stop and take a look, and will also encourage new merchants to come to the City, (Band Review) Councilmember Chang participated in the 44th Annual Arcadia Festival of Bands Saturday, November 22, 1997, He congratulated Jim and Margaret Barrows, the band directors and volunteers for a very successful event in which forty-one (41) Southern California high school bands participated; their hard work is appreciated, Dr. Chang expressed his appreciation to the driver of his parade vehicle for her careful driving 3 12/2/97 39:0296 skills, He also encouraged City Manager Kelly to participate next year to see first hsnd the hard work of the Arcadia Police Department. (Arcadia Dr, Chang announced that on Tuesday, Chinese Chinese American Association brought American appreciation of their hard work, Assoc, B'fast,) November 25, 1997 members of the Arcadia bre~kfast to the City Hall employees in 'I, I .'~' (ARA 5-Year Implementation Plan Update) KOVACIC (Wage/Benefit Survey) Council member Chang commended Economic Development Administrator, Peter Kinnahan and his staff on the updated draft of the ARA Five-Year Implementation Plan and thanked them for an excellent job, Mayor Pro tem Kovacic responded to some of the public comments made during the audience participation portion of the meeting, In response to Mr, Jahnke's comments regarding a wage and benefit survey, Mr, Kovacic stated in part that the Human Resources Commission has been instructed by Council to be more pro-active in this area and Council is anxiously expecting a report from them in the near future, I Mayor Pro tem Kovacic clarified previous comments regarding tDe Fire Suppression Assessment District, explaining that the City was bound by Proposition 218 procedures for that vote, The proposed Utility Tax increase will be on a ballot at a traditional election, Mr, Kovacic acknowledged Lyle Wilson's comments about electrical deregulation, and expressed the importance that any figures given have and will factor in the deregulation situation, (Arcadia H,S,) Mr. Kovacic announced that Arcadia High School's football team is currently in the C,I.F, I semi-final playoffs, playing Arroyo Grande at Arcadia High School on Friday, December 5, 1997 at 7:30 p,m, and encouraged all to attend the game, (Fire Assess.! Utility Tax) (Cal-Western Survey) HARBICHT (Utility Tax) (Christmas Tree Ll'g, Ceremony) He also announced, the Arcadia High School Constitution Team (which he helps coach), will be in their first round of competition on Saturday, December 13, 1997 at the Court of Appeals in Pasadena, There will be a preview to this competition at a mock hearing held at 7:00 p,m, on Wednesday December 3, 1997 at the Arcadia City Council Chambers, all were invited to attend, Mayor Pro tem Kovacic received a number of telephone calls from citizens who received calls from Cal-Western Survey; asking what they thought about the City Council, City Manager, Police Department, Chamber of Commerce and a proposed Utility Tax; and aSking whether the City had commissioned the survey, The City has not commissioned the survey, it was commissioned by the Arcadia Firefighters Association, Mayor Harbicht stated that the expected reductions in utility rates have been included in the City's projections of revenues for the Utility Tax increase, He also reminded the citizens that with the passage of Proposition 218, the Council cannot increase taxes such as the proposed increase in the Utility Tax, the citizens must approve such an increase by a traditional balloting method, The Mayor announced the Annual Christmas Tree Lighting Ceremony on the west lawn :of City Hall scheduled for Wednesday, December 3, 1997 from 4:30 - 6:30 p,m, The two (2) fourth-grade winners of the Christmas Poster Contest will be present to throw the switch to light the tree, Again, this year there will be snow brought in for the enjoyment of the young children, He encouraged all to attend, bring a food item and/or an unwrapped toy or sporting item to donate to the Arcadia Board of Realtors Can Tree Food Drive and Friends of Foster Children Holiday Gift Drive, 4 12/2/97 I I I I (Arcadia Beautiful Commission) (State of the City Address) (Election Workshop Jan, 8, 1998) ---,.-;.-,'-. - lel J tJ -,;)(J 9, 39:0297 Mayor Harbicht announced that the Arcadia Beautiful Commission is now presenting awards to homes for holiday decorations, Members of the Commission will be touring the City on December 15 and 16, 1997 noting particularly remarkable home decorations, This year they will also be giving an award to the best decorated business, He encouraged citizens to make sure their Iig~ts ilnd decorations are turned on for the two tour dates to be considered for one of the"i~arp~, The Mayor announced that the Arcadia Beautiful Commission members are: Gary' Brewer, Helen Dahlstrom, Dorothy Denne, Patricia Eicherly, Janice Torrington, Gloria Vertz, and Sandy Wu and expressed his appreciation for their efforts, Mayor Harbicht announced a program he has been working on and plans to Institute in late January or early February, a State of the City Address, This will be a vehicle in which to Improve communication with the community by providing the opportunity for the City to talk about where the City Is, where it's going and how It Is planning to get there, This will keep the residents informed by the elected representatives, No date has been set as yet; the program will take place in the City Council Chambers and will be televised live with rebroadcasts on cable television, Publicity will occur as plans become firm, The next City Council election is scheduled to take place in April 1998 with three (3) seats up for election (four-year terms each), and one (1) seat to complete the final .two (2) years of the term originally held by the late Dr, Lojeski, currently held by appointee, Mayor Pro tern Kovacic, Mayor Harbicht announced a City-hosted Council Candidate Workshop scheduled for January 8, 1998 from 7:45 a,m, to 5:00 p,m, The workshop will focus on City operational information and consist of presentations by all City departments with opportunities for attendees to ask questions, This workshop will be limited to thirty (30) attendees; each potential candidate is welcome to attend and bring one (1) additional person, Reservations will be on a "first come, first served' basis through Linda Garcia in the City Manager's office, CITY CLERK 9a, RESOLUTION The City Clerk presented a report and read the title of Resolution No, 6017: "A NO, 6017 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, (Calling a CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL Gen, Muni. If a candidate wants the translation printed in the pamphlet, adoption of this resolution would require the candidate to bear the costs (approximately another $350 for each translation) for such printing of the translation(s) in the sample ballot pamphlet. This project was reviewed by the Planning Commission on November 25, 1997; the Commission approved the Conditional Use Penn it for the project, Economic Development Administrator Peter Kinnahan provided additional infonnation from the staff report for the design review, Approval of this project will provide for rehabilitation of the property previously housing the Beller Homes & Garden's Nursery at 143 E. Huntington Drive, This building consists of 5,852 square feet, with the proposal for 204 seats in the restaurant. The renderings for this renovation were on display for the Agency's review and consideration, -' In response to Agency members questions, it was stated in part that to date this project has not received financial assistance from the Agency but will take advantage of the Agency's facade rehabilitation program which will provide a rebate for work which is done and could be as much as $35,000; the exact cost to the Agency is unknown at this time, This rebate program is one of the reasons this applicant came to the City of Arcadia, The revenue the City generally realizes from a restaurant of this size is I 6 12/2/97 I I I 39:0299 approximately $35,000 - $40,000 per year.
