The City Clerk administered the oath of office to incoming Board and Commission members:

various bOards and commissions presented the new commissioners with their credentials and City
pins, and welcomed them to the City family.
Arcadia Police Chief Ronnie Garner presented a video depicting the around-the.dock efforts of
the members of the Police Department to enhance the quality of life as well as to protect the
citizens of Arcadia, The video also served to acquaint the residents with the goals and
accomplishments of the Department's PAC.E, Program (peaceful Arcadia through Community

AUDIENCE PARTICIPATION
Dr Robert S, EIlison. 620 West Huntington Drive. stated, in part. that later in this meeting a
Certificate of Sufficiency w,Il be presented to the Council. This concerns the initiative petition
to amend the Land Use Element of the Arcadia General Plan applicable to the area of the City
designated for horse racing, More than ~.OOO signatures have been gathered from residents who
feel that the voters should participate in these decisions, It is his understanding that a Certificate
of Sufficiency presents two alternatives, One is for the Council to designate a special election. the
other is for the Council to' adopt the petition, He suggested that the Council adopt this ordinance
and thereby acknowledge the concern of their constituents,
The City Attorney interjected that the Elections Code offers three alternatives with regard to an
initiative measure, One of those alternatives before Council tonight is that, before taking any
action to adopt or introduce an ordinance or set an election, the Council ask for a report on the
effect of such a measure, This would be an informational report so that Council and the public
could be better informed at the time the Council makes a final decision regarding the imtiative
measure.
Marguerite Soencer. 1008 South Mayflower St., stated, in part. that she commended the Planning
Commission on the seven meetings conducted for consideration of the General Plan Update, In
particular she commended Chairman Daggett on his exceIlent direction of those meetings which
addressed a very complicated matter, Ms, Spencer publicly thanked Mr, Daggett and stated she
was disappointed that he had not been reappointed to the Planning Commission, She welcomed
incoming Planning Commissioner Richard Bruckner, She suggested that Mr, Bruckner. as head
of a Planning Department in the City of Anaheim. wiIl find that the situation in ArcadIa is
differen~from Anaheim in that the citizens' interests take precedence over those of any private
landholder's interests or desires,
Sandra Ham. Longanrita Avenue. stated. in part. that she is present to address the agenda item
regarding leaf blowers, Ms, Harp urged Council to adopt an ordinance banning their use, They
are extremely noisy, The leaf blowers are poIluting because they blow leaves. poIlen. dirt
and dust into the air and into the yards: they don't clean. they just move the dirt from place to

place, Banning blowers would not adversely impact the business of the gardeners because they
have other alternatives,
Gino Roncelli. 1250 Ramona Road, stated, in part, that he would like information from the City
Attorney as to when a report on the initiative measure would be available, and whether or not a
special election will be involved. The City Attorney responded that answers to such questions are
contained in the City Clerk's report which will be presented later in this meeting, There will be
no change in the election date. The Council has to take action on a November election date before
August 9, The report will come to Council within thirty days, and will coincide with the election
schedule, as authorized by the Elections Code, The Council will select the items which they
want in the report and the report will come before Council in August,
Gail Marshall. 2300 block of Lee Avenue, stated, in part, that she objected to the fact that Bob
Daggett was not reappointed to the Planning Commission, In her opinion, Me, Daggett had
done a fine job of chairing the Planning Commission through the many meetings that were held
for consideration of the General Plan Update. Ms, Marshall was also disappointed by the failure
of Council to reappoint Beth Wells-Miller to the Sister City Commission.
Methodist Hospital of Southern California, a California nonprofit public benefit corporation
(Methodist), has asked the California Statewide Communities Development Authority (CSCDA)
to act as issuer in connection with the issuance of tax-exempt obligations for the purpose of
refunding the City of Arcadia California, Hospital Revenue Bonds (Methodist Hospital of
Southern California). Series 1987, previously issued for the benefit of Methodist. In order to
proceed with the refunding of the 1987 bonds issued by the City, Methodist has requested that the
City join CSCDA, hold a public hearing and approve the proposed financing, The Tax Equity
and Fiscal Responsibility Act of 1982 requires a hearing and action by the jurisdiction of the
location of the benefited facilities and enterprise.
With respect to financial impact on the city, the city will not be directly or contingently obligated
in any manner by the proposed financing and will not be a party to the financing documents,
Only CSCDA and Methodist Hospital will be parties to the financing documents, and CSCDA'S
liability will be limited to payments made by Methodist for the purpose of paying debt service.
Additional details of this process are incorporated in the June 27. 1996 staff report.
The City Attorney presented the staff report and read the title of Resolution No, 5929: "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
AUTHORIZING AND DIRECTING EXECUTION OF AN AMENDED AND RESTATED

Mayor Kuhn declared the public hearing to be OPEN,
Dennis Lee, President, Methodist Hospital of Southern California, thanked the Council for
considering these resolutions which will assist the hospital in refinancing its 1987 debt, and take
advantage of some very favorable interest rates at this time which will lower the cost to the
hospital, Council had received a SIlIIlIIlaI)' of past actions related to the 1987 Hospital bonds with
opportunity to review before the meeting this date,
No one else desiring to be heard, the hearing was CLOSED on MOTION by Mayor Pro tern

MATTERS FROM ELECTED OFFICIALS
CounciImember Chang commented that during his two years as a Council member, Fire Chief
Gerald Gardner has done an excellent job as Assistant City Manager/Fire Chief, and also
Manager for the Library Expansion Project, Upon his retirement, Fire Chief Gardner will be
greatly missed. Council member Chang hoped Chief Gardner will feel free to continue to present
suggestions and wished him good luck,
Councilmember Young also stated that Chief Gardner will be greatly missed, the city will not
seem the same,
Councilmember Young requested infonnation about an inquiry received from the Historical
Society, The City Manager responded that the Historical Society has suggested that historical
properties be surveyed. Staff has advised the Society that a report will be prepared to be presented
to the City Council in September,
Mayor Pro tern Harbicht stated that with regard to City commission appointments, it is surprising
that someone would come before Council and read from an article which was clearly opinion, not
fact, There is a certain element in the community that is taking every opportunity to denigrate the
City, Mayor Pro tern reviewed the establishment of. appointments to and purposes of the City
commissions, The commissioners essentially are deputies for the Councilmembers, and help them
run the City. These commissioners are appointed to four year terms, not eight year terms, just
as coun~ilmembers are elected for four years, not eight years. If he is being accused of tIying to
appoint persons to the commissions who will do the best possible job for the City, then he pleads
guilty,
Mayor Pro tern Harbicht addressed what he considers to be a cacophony of negativeness that has
been heard by Council time and again. Mr. Harbichttook issue with Ms, Colleen Doan, who was
hired by Gino Roncelli for her expertise as a planning consultant, in particular, to oppose the
Santa Anita project, He believes Ms, Doan has gone far beyond her professional purpose. It is

important that the public recognize that she is not an attorney and is in no position to give lege'\!
advice, This in reference to Ms. Doan's remarks to the City Attorney at a previous meeting. It is
his opinion that Ms, Doan has no positive purpose other than to try and disrupt what is going on
in this community,
Mayor Pro tern Harbicht suggested that some clarification as to the policy for use of City
stationery and City Council personal stationery would be helpful, He understands that there WlI1;
concern that the Mayor should speak for the City with the consent of Council, and that if
individual councilmembers want to take an individual position they could use their personal
stationery, Mayor Kuhn agreed that is her understanding also,
Mayor Pro tern Harbicht commented that the hiring freeze which was imposed as a result of the
budgetary process dictates that City positions that come open shall remain open until the matter
is brought before Council and hiring authorization is given, He suggested that a standard agenda
item be established for consideration of openings in City positions which would avoid delays in
filling those positions, Council concurred.
Mayor Pro tern Harbicht commented that he is sorry to see Chief Gerald Gardner leave the City,
He has been an outstanding Fire Chief and a good friend, He wished Chief Gardner all the best
in his retirement.
Mayor Kuhn briefly addressed the issues raised by Ms, Marshall and Ms, Spencer because of her
concern about their remarks. and this needs to be explored, Freedom of speech is a wonderful
thing - it doesn't mean that speakers have to have their facts straight or tell the truth, It simply
means that people have the right to speak in public forums, However, this public forum is not
always the right place to debate certain issues,
Mayor Kuhn said it has been a pleasure to have worked with Fire Chief Gerald Gardner and
wished him the best ofluck on his retirement.
City Clerk June Alford announced that there will be a grave-side memorial service for fonner
City Clerk, Christine Van Maanen, on Saturday, July 6, 19% at 11:00 a, m. at Live Oak Memorial
Park in Monrovia. Christine's son, John Van Maanen, suggested that in lieu of flowers, donations
be made to the Arcadia Historical Society,

The Agency Counsel announced that the Brown Act allows for the consideration of items where
the need to take immediate action arose after the agenda was posted. and the Agency determines
that such action is necessat)', Concerning the Northwest comer of Second Avenue and
Huntington Drive. and based upon a response to the Agency's counter~ffer on that property and
some timing reqnirements which where faxed to the ARA by way of Peter Kinnahan after the
agenda for this meeting was posted. there is a need to respond shortly. Accordingly, if the Agency
moves to concur that the need for immediate action exists, the Agency will meet in a Closed
Session this evening to discuss with the Agency negotiator, Peter Kinnahan, the potential sale of
the Northwest property with the Promus Corporation and their negotiator, Bob Robinson,

On May 16. 1996, the petition circulated within the City by the citizen's group "Neighbors For
Arcadia" was filed with the City Clerk by the proponent of the initiative measure, DI. Robert
Ellison, Subsequent to that date all signatures on the petition were compared to the voter's
affidavits of registration, Of the 5.095 signatures examined, 4,018 signatures were found
sufficient, which qualifies the proposed initiative ordinance attached to the July 2, 1996 report for
a special election or for immediate adoption by the City Council,
The City Clerk's Certification of Sufficiency states the following: That the Initiative Petition
circulated within the City of Arcadia to enact an Initiative Ordinance to Amend the Land Use
Element of the City's General Plan pertaining to the area of the City designated for horse racing
has been Found Sufficient, and, I) 255 petition sections were filed; 2) 254 petition sections
qualified; 3) The total number of valid signatures reqnired by the Elections Code was 3,893 (15%
of25,951 Arcadia registered voters); 4) The total number of signatures on the petition was 5,095;
5) The total number of petition signatures disqualified was 1,077; and, 6) The total number of
petition signatures qualified and Found Sufficient was 4,018,
The next procedural step in the initiative process reqnires that the City Council; (a) Introduce the
ordinance, without alteration, at the regular meeting at which it is presented and adopt the
ordinance within 10 days after introduction; or (b) Immediately order a special election, at which
time the ordinance, without alteration, shall be submitted to the voters of the City; or (c) The
legislative body may refer the proposed initiative measure to staff for a report on any or all of the
following: (I) Its fiscal impact; (2) Its effect on the internal consistency of the City's general
plan and specific plans, including the housing element, the consistency between planning and
zoning, and the limitations on City actions; and (3) any other matters the Council requests to be in
the report,
Following discussion. it was MOVED by Mayor Pro tern H3Ibicht, seconded by Councilmember
Young and CARRIED on roll call vote as follows to APPROVE the, City Clerk's recommendation
to RECEIVE and FILE the Certificate of Sufficiency regarding voter signatures; and DIRECT
staff to prepare a report on the impact of this initiative ballot measure, if passed; and specify that
the report be prepared by staff and that there be no allocation of funds for consultants, The report
is to address; (I) the fiscal impact if the initiative ordinance were to become part of the law of the
City of Arcadia; (2) its effect on the internal consistency of the City's General Plan and specific
plans including the housing element,' the consistency between planning and zoning, the
limitations on city actions under section 65008, of the Government Code, and Chapters 4,2 and
4,3 of Division I of Title 7 of the Government Code; and (3) an opinion of the City Attorney with
regard to the City's liability exposure if this were to be judged a taking of property by the City;
and, said report to be due July 30, 1996,
As part of the MOTION Councilmember Chang requested that the staff report include the matter
of whether or not the result of the initiative will have any limitations on City Council actions, and
if so, what are such limitations, This addition to the motion was accepted by Mayor Pro tern
Hartlicht and Councilmember Young.

unrestricted reserve funds to be used only if necessary to complete this purchase of the furnishing
for the Library public area, The Arcadia Public Library Foundation will transfer $200,000 to the

balance when the City is invoiced.

Consideration of staff recommendation to award a contract for water meters to Schlumberger
Industries, Inc. Mayor Pro tern Harbicht inquired of the Maintenance Services Director if it
would be possible to have Schlumberger Industries, deliver the water meters monthly over the
period of one year, Between 400 to 500 water meters will be purchased and are to be installed
over that period of time and it would be more efficient to take delivery and pay for the meters on
a monthly basis. StalJ will contact Schlumberger Industries, with regard to this change in
delivery and revised delivery schedule.

The City Council in response to concerns regarding the noise problems created by gas powered
leaf blowers requested the Development Services Department to prepare a repon on ponable
gasoline powered blowers. The rcpon deals with the typical problems caused by leaf blowers:
noise at cenain hours of the day; disposal of the debris in an improper manner into stonn drains,

probably most homeowners would like to see the leaf blowers banned. but this would pose a
problem for areas such as the public parks. the race track. maiL hospitals. schools. and other City
propenies, Mayor Pro tern Harbicht said he has a problem with government passing laws" hich
affect the cItizens. but exempts the government Itself, It is more efficient to use a leaf blower to
clean the tennis couns than it is to have a government employee use a push broom, One of the
reasons to ban leaf blowers is the noise, But he does not know that leaf blowers are noisier than
power lawn mowers, Another reason is dust and pollen going Into the air If such a ban is to be
implemented. he thinks It should include the City government as well as the reSIdents, Mayor
Kuhn said she detests the leaf blowers. but she agrees with Mayor Pro tern Harb,cht in that she
cannot see penalizing residents by taking away their cost efficient removal of leaves "h.k
