The City Council and Ihe Arcadia Redevelopment Agency mel in a Regular Meeting on Tuesday,
December 17. 1996, at 7:00 p,m, in the Arcadia City Hall Council Chambers,

CARRIED to EXCUSE the absence of Mayor Kuhn,
Closed Session - Pursuant to Government Code Section 54956,9(a) to confer with legal counsel
regarding the case of Sully-Miller vs, Arcadia and cross complaint Arcadia vs, Sully-Miller and.
pursuant to Code Section 54954,2(b)2 to brief the City Council regarding the litigation ofEl
Monte vs. Arcadia (Adjourned Regular Meeting at 6:00 p,m. this date).
PRESENTATIONS
Mayor Pro tern Harbicht introduced Coach Marty Garcia. who presented award certificates to the
Arcadia Junior All-American Arroyo League Junior Pee-Wee Football Team, winners of the
League Championship. The directors, players, coaches. cheerleaders, and mascots were
introduced and thanked for their contribution to a great season.
Councilmember Kovacic introduced Marko Aguilar, a fonner Arcadia resident who moved to
the City of Sahuarita, Arizona, He helped with incorporation of the City, became a council.
member, and Sahuarita is now in the process of developing a general plan and municipal code,
Councilmember Kovacic presented Mr, Aguilar with a City pin and offered best wishes on behalf
of the Council.

that ordinances and resolutions be read by title only and that the reading in full be WAIVED,
PUBLIC HEARINGS
On July 25, 1996, Mr. Chinnaporn Korprapun, owner of the commercial property at 130 East
Foothill Boulevard, requested that the City Council consider vacation of the alley south of
Foothill Boulevard and west of Wigwam Avenue which is adjacent to his property in order to
include the alley as part of his parking lot. The Planning Commission, at its September 24,
1996, meeting, dctermined that vacation of the subject alley is consistent with the General Plan,
The alley is accessed from Wigwam Avenue and dead-ends at the Santa Anita Wash, The alley
provides vehicular access to the parking lot behind the existing commercial building on Foothill
Boulevard only, There is no vehicular access from the alley to any of the homes on Wigwam
Avenue, At its November 5, 1996, meeting the City Council adopted Resolution No. 5958
declaring the City's intention to vacate and abandon said alley, Further details are set forth in
the December 17, 1996 staff report.
Mr. Anthony Urquidi, owner of the property at 1009 Wigwam Avenue, has expressed concern
about the alley vacation and submitted comments on December 5, 1996, His garage is located at
the back of his lot, and he has pedestrian access to the alley through a wooden gale at the back of
the property, The vacation of the alley would eliminate existing access to his sewer connection,
which is underneath the alley, Further. he currently places his trash cans outside of the wooden'
gate on his property, and uses the alley to roll out his trash cans to the street curb on Wigwam
Avenue, As a convenience. he occasionally uses the alley to load and unload items into his
garage through the wooden gate, The staff report noted if Council finds that the vacation of the
alley causes a significant burden to the property owner at 1009 Wigwam Avenue, Council may
consider adding conditions to the alley vacation that the applicant, Mr. Korprapun, shall execute
an instrument(s) deemed appropriate to the City Attorney for incidental vehicular and non-
vehicular access over the alley within which no permanent structure is allowed, The sixteen-
foot-wide alley was dedicated for public use in 1923 through recorded Tract Map 7723, which
created the lots located at 130 East Foothill Boulevard, This dedication was in the form of an
easement, and the City was not given fee title to the alley.

Tonv Urauidi, owner of the property at 1009 Wigwam Avenue, stated in part that if he is not
allowed to access the alley to bring his trash cans to the street, he will have to use his narrow
driveway, which means first removing his cars early in the morning, Mr., Korprapun has
recognized Mr, Urquidi's need for access 10 the alley and does not have a problem with it.

The City Anorney commented that if Council decides there is a level of concern, a condition may
be added to the resolution that the propeny owner at 130 East Foothill Boulevard file a reserva-
tion of access right document. which the City Attorney would prepare, to preserve Mr, Urquidi's
access 10 the alley, Staff was concerned over such a condition because it is unusual in this kind
of a situation; however, the staff report does present that option to Council.
Chinnaoorn Kororaoun, owner of the commercial propeny at 130 East Foothill Boulevard, Slated
in part that he has no objection to allowing Mr. Urquidi to use the alley for access, The only
concern he has is that Mr, Urquidi has said he sometimes uses the alley to train his dog, and if
someone should gel hurt, Me. Korprapun would be liable,
No one else desiring to be heard, the public hearing was CLOSED on MOTION by
Councilmember Kovacic, seconded by Councilmember Young, and CARRIED,
Council discussed the matter and asked questions of stafT, Councilmember Young suggested
there should be an agreement between the propeny owners for access to the alley rather than
putting the condition in a resolution, which would set a precedent. Councilmember Chang
agreed. The City Attorney clarified that public policy is to make such vacation resolutions if
there is no use for public purposes, There is very little public policy by way of statute accorded 10
potential private use, Mayor Pro tern Harbicht stated that in 1923 it was determined that there
was a legitimate public use for the alley, and the City has an easement over the propeny. He felt
that since there is no legitimate public use for the propeny at this time and the alley is the
propeny of the owner of 130 East Foothill Boulevard. it should revert back to the propeny owner,
Mr, Urquidi's use of the alley is the only private use, and Mayor Pro tern Harbicht is not willing
to attach a condition to a piece of private propeny that another propeny owner can use it.
Perhaps Me. Urquidi can put his trash cans in another location. Council members Kovacic and
Young agreed,
It was MOVED by Councilmember Young. seconded by Councilmember Chang and CARRIED
on roll call vote as follows to FIND that there is no substantial evidence that the alley vacation
will have a significant effect on the environment; APPROVE the Negative Declaration; DIRECT
statrto file the Notice of Determination with the Los Angeles County Clerk's Office; FIND from
all the evidence submitted that the subject alley is unnecessary for present or prospective public
use; and ADOPT Resolution No, 5970, entitled,: "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING THE VACATION OF THE
ALLEY. SOUTH OF FOOTHILL BOULEVARD AND WEST OF WIGW AM AVENUE,"

Approximately six months ago, the California Legislature passed Assembly Bill 3229, entitled
the Citizens Option for Public Safety, which disbursed $100 million to counties and cities
throughout the state for the purpose of front-line law enforcement services, Arcadia's share is
$121,149, The Police Department proposes to use the funds in three areas: (I) To establish a
Crime Analysis Unit consisting of a Crime Analyst, who would be a temporary part-time
employee ($50,000), and software and hardware for that position ($20,000); (2) to fund a new
position, Civilian Court Officer Cadet ($15,000), which would free a sworn officer to be used as a
much needed investigator; (3) for the conversion of a jail transportation vehicle into a S. W,A. T.
logistics vehicle ($36.149), which would reduce response time to S,W.A.T, call-<luts. The Police
Chief noted that this is a one-time allocation of funds, and must be used for short-term needs.
The Police Chief answered questions from Council.

No one desiring to be heard. the public hearing was CLOSED on MOTION by Councilmember
Young, seconded by Councilmember Kovacic, and CARRIED,
Mayor Pro tem Harbicht questioned the need for a Crime Analyst. and Ihe computer software and
hardware for such a position -- that it is worth the expenditure of $70,000. Such a crime analysis
program has achieved a 38% reduction in crime in New York City, but Arcadia is a much
smaller city. The Police Chief stated that a Crime Analyst, in addition to tracking crime, will
track incoming calls and complaints. and problems in general, in order to deploy patrol officers
in those areas where they are most needed, It is hoped that officers will become more aware of
the locations of complaints and will focus their arrests in those areas. Mayor Pro tem Harbicht
asked if a tele-track system for vehicles was considered, The Police Chief responded that such a
system was attempted a few years ago but the results were not good due to poor technology at that
time, He believes good scientific analysis of where crimes and complaints are coming from and
when they are occurring will be of more benefit. In response to Councilmember Kovacic, the
Police Chief stated there is a long list of other items which were considered for the expenditure of
AB 3229 funds, However, many were items that would have to be followed up in future years
without a guarantee of funds for them.
Mayor Pro tem Harbicht said he was not convinced that the City will see any significant benefit
from a Crime Analyst position, He would like to see the other possibilities which were
considered and rejected before he authorizes the expenditure of $70,000 for this item. The City
Manager suggested if Council would like to approve the Civilian Court Officer Cadet position
and the S, WA T. vehicle, he and the Police Chief will prepare a report on alternatives for the
Crime Analyst position for Council's review, Councilmember Kovacic suggested a more detailed I
explanation for the Crime Analyst position,
It was MOVED by Councilmember Kovacic, seconded by Council member Young and CARRIED
on roll call vote as follows to ADOPT, with amendments to Section 2, Resolution No, 5955,
entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, AUTHORIZING THE ARCADIA POLiCE DEPARTMENT TO USE FUNDS
ALLOCATED FROM ASSEMBLY BILL 3229 FOR THE PURPOSE OF 'FRONT LINE
POLiCE SERVICES'" approving the hiring ofa Civilian Court Officer Cadet and the conversion
ofajail van into a S,WAT, logistics vehicle; DIRECT staJIto return to Council with
recommenclations for the $70.000 expenditure; CONTINUE the public hearing to January 7,
1997,

Mr, Schavoni, 2225 South Sixth Avenue, appealed to the Council to remove a parkway tree in
front of his home, He stated, in part, that each year he must pay for plumbers and roto-rooter
service to take care of problems caused by the tree roots, including flooding in his home, The
cones and debris from the magnolia tree make it hazardous for him and his wife to walk to the
mailbox. Mr, Schavoni and his wife are elderly and are concerned for their safety. Calls to the
Maintenance Services Department have not resulted in a settlement of the problem,

prepare a report for Council's review and decision.

In addition to previously named persons from the Arcadia Chinese-American Association who
each made a SI,OOO pledge to the Arcadia Public Library Foundation, Councilmember Chang
announced that Te Hung Chung and Min Mey Chang have also pledged SIO,OOO to the
Methodist Hospital Patient Tower Fund, Mr, and Mrs, Mike Cheng. members of the Arcadia
Chinese-American Association, have donated 500 educational and entertainment video tapes
with a retail value of S5,000 to the Arcadia Public Library, Fifty-six board members and friends
of the Arcadia Chinese-American Association have joined the Arcadia Tournament of Roses
Association, Checks and cash for these memberships will be presented to the president of the
Arcadia Tournament of Roses, Mr, Foley, on December 18,
Council member Chang complimented the City Manager for sending letters to several businesses
encouraging them to look into relocating in the City of Arcadia, Councilmember Chang
promoted the idea of an Economic Development Committee with horizontal and vertical sections,
of civic, community. and commercial groups and organizations to be represented in the
committee, He believes it will be very helpful to the City's economy as a whole and to the
various business sections of the City specifically. Other cities have used their firemen to be part
of their economic developmem efforts wilh impressive resulls, and Councilmember Chang feels
Arcadia should do the same in order to help the existing business code requirement for the
business community. and to sen'e as a bridge between the City and the business community.
Council member Kovacic enjoyed the Tree Lighting Program--a fantastic community event--and
congratulated those from City staff who put it together.
In response to Councilmember Kovacic, the City Manager stated there are still some legal
issues to be dealt with, but the plan is to have a Metro-Link train stop in Arcadia to pick up
people and take them to the Pasadena Rose Parade,
Council member Kovacic mentioned he saw a store in San Diego which sells old street signs and
it seemed to be doing a very good business, He asked if the City had looked into something like
that The City Manager replied that the issue had been analyzed about two years ago, but
because of the small volume of items available for sale, the City gets more money putting old
equipmenl oul to auction,
Councilmember Young noted the Christmas Tree Lighting Program was great, and thanked
staff for putting it together.
Council member Young reported that she attended a Metropolitan Water District meeting last
week, which reviewed regional and local water issues,

Mayor Pro tern Harbicht reported that the Christmas Tree Lighting Program was a very
successful event. Over 600 people attended, The First Avenue Spartan Band and the Church of
the Good Shepherd Choir provided musical entertainment, Santa Claus arrived in a horse-drawn
carriage, and seven tons of snow were delivered to the front lawn of City Hall for the children to
play in. It was a nice community event that will probably be continued in the future.
Mayor Pro tern Harbicht commented that approximately $680,000 has been donated to the
Arcadia Public Library Foundation by the people of Arcadia to purchase furniture for the newly
remodeled Library,

Memorial Park, the Dennis A. Lojeski Field, At the November 19, 1996, City Council meeting,

Consideration of recommendation to purchase a ProLog Recorder from the Dictaphone
Corporation for $24,853.50 using Asset Seizure Funds, The ProLog recorder is a 20-track
recording device to record all incoming telephone conversations and all radio communication,
The existing recording system, purchased in 1990, is used 24 hours every day and has exceeded
its life expectancy, To replace the worn heads on the tape recorder and replace the reels of tape
would cost over $20,000.

Consideration of recommendation to authorize the Administrative SelVices Department to fill the
position of Risk Control Officer. In May 1995 the City retained a Risk Control Officer, who put
in place programs which reduced employee injuries and liability exposure, and helped put in
place policies and procedures in order to comply with State and Federal mandates, Conse-
quently, there was a reduction in the number of claims and improved management in the
Workers Compensation process, Continued relemion of a Risk Control Officer will reduce the

Consideration of recommendation to authorize the Maintenance SelVices Department to fill one
vacancy within the Department. At the July 16, 1996, City Council meeting. the Council
authorized the Department to fill four vacancies and leave two division head management
positions vacant, Field SelVices Manager and General SelVices Manager. During the past five
months, staff has evaluated the effectiveness of the department without these two positions, and
has concluded Ihal in order for Ihe Department to operate effectively, one of the positions musl be
filled. Staff recommends that the General Services Manager position be filled in early spring,
and the Field SelVices Manager be left vacant, resulting in a savings of $102,609 in Fiscal Year
1996-97, At this time the Maintenance SelVices Director is fulfilling the responsibilities of his
position, and the Field Services Manager and General SelVices Manager positions, Funds for the
position of General SelVices Manager are included in this year's and next year's budget.

Consideration of revised sign regulations concerning temporary election or political signs in
residential areas, and commercial signs on vacant lots including private property. Confusion has
occurred in enforcing the sign regulations which prohibit the posting of temporary election signs
in the public parkway area of private property, Parkway area adjacent to residential property may
appear to be private property, as it is maintained by the property owner. The City Attorney
advised that Council may wish to enact an ordinance which allows election signs to be placed in
the parkway area adjacent to private property as long as there is no safety problem, such as
significant view obstruction, Regarding commercial signs posted on vacant private property,
usually advenising commercial shows and expositions, such signs are prohibited under current
City regulations,

Considerable discussion ensued, By general consent Council concurred to direct staff to prepare
a Municipal Code amendment allowing election signs in the parkway areas adjacent to
residential propenies, and including the prohibition of the sign extending over any public paved
area or those causing safety problems,
With regard to commercial signs on vacant property. it is very difficult to locate the persons who
post the signs, The signs are removed by City workers and stored for a shon period of time to
avoid a potential claim, Mayor Pro tern Harbicht suggested that any temporary sign which is put
up by someone who is paid to do so must have the identification of the company on the sign, The
penalty for noncompliance would be $10,000, In addition, perhaps a fine could be imposed if the
company did not have an Arcadia business license. The City Attorney commented that illegally
posting signs and operating without a business license are misdemeanors. currently subject to
fines of up to $1.000 per incident or per every day of the violation, A civil penalty could be
formulated in an ordinance to impose a fine of $10,000; however, it would require some minimal
due process of allowing reasonable time for removal of the sign. Councilmember Kovacic
suggested that staff do some research as to what other cities are doing, and see what can be done
to send a message that the City will not tolerate the illegal posting of signs, while avoiding
violation of due process, Mayor Pro tern Harbicht noted that the object is to make it enough of a
hassle for those who post these signs, that maybe they will stay o!lt of Arcadia,
The City Attorney stated that an ordinance can be drafted which will cover the fines and impose I
alternative remedies of civil and criminal penalties, and then the City can get the word out about
the law, Councilmember Kovacic suggested putting the burden on the event manager to prove
that he did not authorize the placement of signs; that person may. in turn, put pressure on the

the Fairgrounds, the City Manager proposed the idca of collecting those signs from every city and
taking them to the Fairgrounds and dumping them there, The City Manager offered to bring this
idea to the Council of Governments and the City Managers Association for their input.
Mayor Pro tern Harbicht adjourned the meeting in memory of John Widener. "John Widener is
the father of Mayor Barbara Kuhn, and he passed away last Tuesday in Knox-ville, Tennessee.
Barbara is back there now, and that's her reason for not being here this evening. And so we
express our sympathies to Barbara on her loss,"
"Student athletes at Arcadia High School recently lost one of their most ardent supporters,
Allan Jaynes, who passed away in November. For the last forty years Allan was a fixture at
sporting events, always sitting close to the sidelines, cheering on the athletes, As a young man
Allan played football for Pasadena Junior College in the Rose Bowl, then graduated to the
Forty-fifth Infantry, serving honorably during World War II, He returned home to operate the
Arcadia Tribune Newspaper, of which he was part owner, Allan originated the Key Club at
Arcadia High School, and since 1954 has bcen closcly connected with the school, either as a
parent of two graduates, publisher of uncounted articles about the school, or as the Number One
fan of each student nthlete, He is survived by his wife of fifty years, Jean, two sons, Peter and
Allan, and grandchildren Kevin and Carolyn, Donations in Allan's name can be given to the
Arcadia High School Booster Club for Womcn's Soccer in care of Arcadia High School, 180
Campus Drive, Arcadia, California."
"I will mention, Barbara Kuhn's fathcr passing away..,Jim and Barbara had recently visited
Barbara's parents, and that was the reason Mrs. Kuhn was not at the last Council meeting, And
it was the day after they rcturncd from that visit that he was stricken with a stroke and passed
away a few days later. As I mentioncd, Barbara is back there, Jim is here in town, So we will
adjourn tonight's meeting in memory of John Widener and Allan Jaynes to January 7, 1997..,at
6:00 p.m."
