Army Retired, 1807 South Baldwin Ave" stated, in part, that all veterans should be honored for their deeds, from the shores of Tripoli, to the sands of Iwo Jima, to the beaches of Normandy, to the landing in Inchon, to the jungles of Vietnam and to the sands of Desert Storm. This month there are two days of observance - Armed Forces Day, May 20 and Memorial Day, May 29. Armed Forces day honors every man and woman in uniform, active and retired. It is a day set aside to honor their contributions to the defense of this great nation, Memorial Day is a day set aside to pay homage to those men and women who have given their lives for this country. That this great nation has endured unconquered for more than two centuries is a tribute to its fighting forces. This freedom was not gained without sacrifice - In cemeteries around the wond and within holy ground our heroes are burled. Therefore as we mark the passage of the month of May we say "thank you" to those who gave their lives. We should share the spirit of those young I men and women and battle hardened veterans who stand together to deter aggression, In observing these holidays, we must reflect upon the sacrifices of those who fought the good fight which makes the observance of these occasions possible, God bless America, Ya Mav Christie, 219 East Newman Avenue, stated, in part, that she has recently purchased a foreclosure property In Arcadia which had been a neglected property for a period of time, and was in need of a considerable amount of repair, This came to the attention of the Community Development Department Code Enforcement representatives who contacted her w~h regard to repair and maintenance problems. Eventually she received correspondence from the City Attorney requesting her presence at an office conference to discuss these problems. She left that meeting feeling very badly. She felt she had been treated unfairly, since she had been trying to upgrade the property she purchased, and bring ~ into compliance with City codes, The house was in a horrible state when she purchased ~, and she has been working very hard to repair~. With IIm~ed means ~ Is hard to get a house back into shape after it has been neglected for many years. The City Attorney responded that when Code Enforcement problems arise that cannot be resolved by the Code Enforcement personnel, office conferences with the City Attorney are conducted, These are routine conferences scheduled with the property owner in an attempt to work out problems, and eventually bring the property under question into compliance with City codes. The City Attorney will provide a report on this procedure to the Council and, in particular, the case of Ms. Christie. MATTERS FROM ELECTED OFFICIALS Council member Lojeski commented that with Council member Margett's recent victory in the primary election for the State Assembly, the potential outcome of the runoff election will be Arcadia's losing a council member. Today he received some preliminary Information from the City Attorney and City Clerk with regard to stipulations for and appointment to the Council. He would like to see Council open discussions on this matter, and requested that this item be placed on the next Council agenda. These discussions should center on how Council should proceed with an appointment of a new council member, Perhaps staff could help by providing further information regarding procedure. Mayor Young and Council member Kuhn agreed. I REORGANIZATION OF THE CITY COUNCIL FOR 1995-1996 The City Clerk stated that, consistent with Section 404 of the Arcadia City Charter, the Council at ~s April 18, 1995 meeting held the annual reorganization election for the office of Mayor for the 1995-1996 mayoral term. Council members Kuhn and Lojeskl and Mayor Pro tem Chang were each nominated for the office of Mayor. Mayor Pro tem Chang received one vote; Councilmembers Kuhn and Lojeskl received two votes each. Therefore, the majority vote required by the City Charter was not attained by any of the three nominees and the Council determined, by a unanimous vote, to place the nominations for the office of Mayor on the May 2, 1995 Council agenda, Further, at the April 18, 1995 meeting the City Council voted to continue the nominations for Mayor Pro tem for the 1995-1996 Council year to this date also. The City Clerk then called for nominations for the office of Mayor for the 1995-1996 Council year. Hearing no other nominations, the City Clerk polled the Council for the vote for Nominee Dennis Lojeski. NOMINEE VOTES Council member Dennis Lojeskl Councilmembers Chang, Kuhn, Lojeski, Margett and Young Following the unanimous vote, Mayor Lojeski assumed the Mayor's seat at the Council table. Mayor Lojesklthen called for nominations for the Office of Mayor Pro tem for the ensuing year. Mayor Lojeskl placed In nomination the name of Council member Barbara Kuhn to serve as Mayor Pro tem for the ensuing year. Hearing no other nominations, Mayor Lojeskl called for the roll call vote of the City Council. NOMINEE VOTES Council member Barbara Kuhn Council members Chang, Kuhn, Lojeski, Margett and Young Council member Barbara Kuhn was unanimously elected Mayor Pro tem forthe ensuing year. REMARKS BY MAYOR LOJESKI '1 wish to thank the Council. I wish to thank the staff. And I wish to thank all the citizens of this fine City of Arcadia. Barbara, congratulations. I think we are in for a busy year. The challenges ahead for this coming year are absolutely formidable. Serving on the Council for eleven years, I don't think the challenges are any greater than they were, or at least the ones that are in front of us. It is time that as Council people, we need to put our work clothes on; we need to roll up our sleeves; and we have got to go back to work. We have to work on such things as declining revenues, a budget full of all kinds of constraints and questions; labor negotiations today with five organized labor groups. Our Downtown 2000 program has started, but that Is only the beginning. This Council will, hopefully, see ns completion; ns completion on time, n not a little earlier; and within budget. We are In the process of starting a new library, and a new library expansion. Orange Grove Boulevard Is finally going to be finished this year, I hope. Our redevelopment issues are still out there. We have vacated land that has been off the tax rolls. It Is Council's duty to put those properties back on the tax rolls n we can. We also have to address in this coming year a very crnical housing need that is part of the redevelopment law. We also have a project that can be very exciting, It can be very frustrating and n can be very overwhelming, And this Is when we have a local entity In the community; a local company who wants to Invest a hundred million plus dollars of their own money right back into the community. And this Council will be part of this entire process; the cnizens will be part of this entire process. 3 5/2/95 37:0123 'Again, ~ can be very exciting, but there is going to be some frustration moments also, I am sure. So, this year is a big year, I think it is time that we all now put our personal agendas I aside, and truly realize that we, each of us, were voted as Council people on this Council. I was a Councilman yesterday; I was a Councilman today; and I will be a Councilman tomorrow, I think that is a very important concept to retain. We were elected to represent your best interests; you. the citizens of this community, and the best interests of all the people of Arcadia. I think it is time to leave back room politics, back room decisions right there, in the back room. If you've got a concern, if we've got questions, if we've got things to discuss, decisions to make, this is where the decision should be made. The people in Arcadia have been short changed long enough, and they deserve better. I feel this year this Council can pull together. I would like to see us pull together in some degree of harmony, We are nol going 10 agree on every ~em Ihal is in fronl of us, but leI's Iry 10 pulllhe cart at least in the same direction, I am personally looking forward 10 a challenging coming year and look forward to giving you strong leadership, and a courteous dignity and a respectful manner as your Mayor this coming year, I thank each and every one of you.' REMARKS BY MAYOR PRO TEM KUHN "First of all I would like to acknowledge and introduce my husband, Jim. He is my staunchest supporter, of course, and he has certainly had a change of life style this past year, I don't think we have sat down for dinner together in months. Jim and I also work together, so he has had to accept a lot more responsibility, so ~ frees my time, and I appreciate that. Thank you, Jim, 'Ufe is like a box of chocolates; you never know what you are going to get: Ilhlnk we can all relate to that movie line. I am certainly not going 10 repeat the laundry list of accomplishments this past year. I think my colleagues have done that very nicely, I would like instead to give an overview from my perspective of our political arena, poking fun at the system a little along the way. Our local political scene has been touched by change and controversy as never before. For me, it began a year ago with an unusually tough campaign. After surviving that, I found myself a member of a non-cohesive team that got off to a rocky start. Dealing with a brand new City Manager, after the false start of another; employees' morale at an all time low, with rather interesting contract negotiations; budgetary struggles this City has not experienced before; and a recent State election created even further division. Our usually calm School Board election heated up this year. And then, to top ~ off, deadlock over this election of a Mayor, I felt like ~ was campaign time all over again, complete with media., How much excitement can one take? Or how many chocolates can one swallow? Under Mary's capable leadership, we have come a long way in the past year. The campaign is finally over, even though It still creeps into conversation now and then. While we, as a Council, do not always agree with each other, we can and we do reach consensus on issues. Our City Manager Is doing a great job, especially considering the circumstances under which he started. I am not sure all of our employees would agree, but every effort Is being made to improve employee morale. Our employees are one of the most important key elements to the success of this community, and their welfare is of utmost concern to me. Contract negotiations are still on the agenda and seem to be continual, but are an a more friendly basis. Our budget constraints are a headache, and need to be taken seriously, but are mild as compared to most cities. And you can rest assured that we will do what we can to keep it that way. In June when Bob Margett is elected to the State Assembly, we will be faced with the task of filling a vacancy in our own ranks. How lucky we are to have the prospects of one of our own in Sacramento. I am sure Bob will not forget where his roots are when this City needs his attention. The School Board election is over, and the dust has settled. I look , forward to working with Ihem on relaled Issues. We have now selected a new Mayor, and 4 5/2/95 I I 37:0124 I "have come full circle. To some, the selection of Mayor appeared to be the most important ~em of business on the agenda, I found the community at large to be either very passionate abolJt ~, or simply don't care who the Mayor is. There are as many opinions as there are people. I 'Why would I, a first year freshman, challenge a twelve year experienced veteran? I was elected to serve the people of this community, as was my colleague. During the election, just one year ago, the message was loud and clear that a change in direction of leadership was desired. Unlike most politicians, you will find me soft spoken, and I am not ego driven. But, I have a strong sense of duty and loyalty to my commitments, no matter how difficult that duty may be. Pressure, intimidation and deals play no part in my decision making, for I always follow the rules of three R's: reason, respect and responsibility. I truly believe that decisions based on these principles stand up to the test of tnue representation, whether one agrees with the decision or not. And ~ is guaranteed that someone is going to be unhappy, no matter what the issue, or what the decision. That goes with the territory, It has been said - ~ is only for a year, and that is true n everything is equal. But a year can be a lifetime in the heart of City Hall. We will feel the effects In many years to come of the activities conducted during a period of a few short months. There was a suggestion to 'remove politics from the process', and I adm~ my reaction last year when I had to make the difficuit decision was n we could only remove the politics how much easier ~ would be to do the job, I have since come to the realization that removing politics from this body would be like taking the apples out of apple pie. Politics is the substance of government. Politics is the power of the people, Otherwise, what you have Is dictatorship and dictatorship Is always easier for the dictator. Politics are a given, but private agendas and personal power plays are the real culpr~s and should not be tolerated from anyone in public service. It is important that we move forward; and compromise is in order. We have more important things to do than to debate on who should or should not be Mayor. Dennis and I tend to agree on most Issues. But our style of leadership Is the basic difference. I can live with that n Dennis can. Dennis, I will support you and this Council in every way possible during your term. I do have three more years to serve and will serve in whatever capacity will be best for this City. In the meantime. ~ seems there is a great deal more to Council meetings than the hours of preparation and study of the issues and conducting business. With the advent of television, there is an element of anticipated entertainment. What will ~ be this week - drama, suspense, or comedy? We are all but players on the stage and we pass this way but once. Lne Is too short and too precious to take It too seriously. But, I promise to use my remaining time wisely in perfecting the art of a crafty politician and showman. We have many opportunities and exciting challenges on the agenda for this coming year, with some heavy duty choices that will require strong leadership on the part of each of us. You are well aware of what some of those challenges are and we can probably count on some surprises along the way, or a different set of chocolates. We have a difficult job to do and we need to do ~ as a team. I will support the team, and hope that personal disappointments and ambitions will be set aside for the good of this City. Thank you, Mary, for your strong support. It Is a privilege and an honor to serve with my colleagues, and to work w~h our wonderful staff, Most of all, thanks to each of you for your trust and your confidence. I REMARKS BY COUNCILMEMBER MARGETT "I have to laud personally what Mayor Pro tem Kuhn had to say, I thought your words were very articulate, and I think you focused in precisely on what some of the issues were that we had this last year; and very eloquently, too. I want to congratulate Dennis for being Mayor this year, Before I go any further, I want to introduce my wife. Beverly. I think that Barbara focused in on many of the issues that we had to confront ourselves with this last year, And I am delighted to think that we did not deny Dennis the opportunity to become Mayor his last year on the City Council. He brings to us eleven years of experience. He has been down the road many times and many of the same Issues. We have selected an outstanding leader to be able to lead us this mixt year. Many things that were done by City Council this last year did not set a good tone for the people within the community. The people within the community don't like this stress; they do not like to see the dissention that is there; they don't like to see power plays. It takes away from a cohesiveness within the communtty, And I think tonight I see that that has been eliminated, and I see that we have made some commitment here to be able to take care of some differences and move ahead and tt will be a very profitable year for this new structured Council. The City deserves a Council that will serve the citizens within the community and not get immersed in this petty showmanship that Barbara alluded to earlier, And, I hope this Council has learned from tts mistakes and that the citizens will have excellent representation. You are certainly well deserving of that. And that you can move ahead In this community with an exctting year that everybody has with the anticipations that they have for this great community. Thank you." I REMARKS FROM OUTGOING MAYOR YOUNG "I have a few comments to give. but most of my comments were given In the last meeting, so I'll not repeat myself. My husband is not here tonight, but he certainly is one of my strong, supporters. and he Is a Council supporter also. I am certain that for this next year that the whole Council will work together, and we will move ahead. It Is going to be an extremely busy year. During this next year there will be many challenges for us, and many decisions to make. As a whole, the Council will face them head-on and. as a Council, they will be resolved. I want to congratulate the new Mayor and the Mayor Pro tem, and to tell you both that you have my support. Congratulations" AFTER A 5 MINUTE RECESS. TIME Councilmember Margett commented that this situation points out the exercise that EXTENSION businesses have to go through to be able to do what govemment maintains they have to CONDITIONAL do, He is alluding, in this instance, to the Rodeffer quarry pit in Arcadia. This Is an USE PERMIT abandoned gravel pit. The law says that the p~ must be filled. We went through the proper 92-003 hearings in this Council Chamber a year ago to be able to make sure that the City was (Rodeffer conforming and that they could do the Environmental Impact Report, and all the various Inert Land- requirements for liiling that pit were passed. Today Rodeffer is asking for an extension fill) because they still have not been able to get all the permits that are required. For example, (APPROVED) in order to operate an inert landfill, the applicant must obtain discretionary perm~s from the Califomia Regional Water Quality Control Board, Los Angeles Region; the Los Angeles 0<;", ,- ..,) County Department of Health Services, with concurrence by the Califomla Integrated Waste ()): ' rO Management Board; and a permit to operate from the South Coast Air Quality Management District and several other agencies. Council member Margett hopes that there Is something that can be done in the California legislature to minimize these excruciating things that businesses have to do to conform to a law that the State of California has passed. Councilmember Margett hopes corrections can be made. 5. a, APPOINT- MENTS The City Attorney commented that this consent calendar item is a routine maner. For the record, he stated that, "this particular ~em relates to a Conditional Use Perm~ for which there was an Environmental Impact Report and is and was the subject of litigation in the Superior Court. Although a decision has been rendered, a final judgement and final decision has not as yet been served on the City, When ~ is, the City will act in response to that particular action. There is no need not to proceed with this maner tonight". It was MOVED by Council member Margen, seconded by Councilmember Young and CARRIED on roll call vote as follows to APPROVE a one year time extension for Conditional Use Perm~ 92-003 -the proposed Rodeffer Inert Landfill at 12321 lower Azusa Road, Arcadia. CITY ATTORNEY 01 F:; - -1'0 a. b, 37:0129 At the April 11, 1995 meeting Council continued this matter for several questions to be answered. 1) Do appointees need to be registered voters? The answer is 'yes', and the City Clerk has verified that ail the candidates for consideration are registered voters. 2) May a person sit on more than one board? The City Attorney reviewed the City Charter and City Code and there is no prohibition on advisory boards of the two we are suggesting. Therefore, there are no problems with the suggested appointments. 3) Council asked staff to notify three additional people of the availability of these positions. Notifications were sent to those people, Only one individual - Mr. Frank Forbes - submitted an application. The roles of these appeals boards are set forth in the May 2, 1995 staff report. I It was MOVED by Councilmember Young, seconded by Council member Margett and CARRIED on roil cail vote as foilows that James Dorr, Gerry Busse, Gina Jalbert, Leonard Henkey and Anthony Costanza be APPOINTED to the Handicap Accessibility Appeals Board for four year terms; and that James Dorr, Gerry Busse, Wiiliam Mililgan, John Chan and Frank Forbes be APPOINTED to the Building and Fire Code Appeals Board for four year terms; and that the appointees be sworn In at the City Council meeting of May 16, 1995. Pursuant to Government Code Section 54956.8 to discuss negotiations with regard to the potential acquisition or lease of property at the Northwest Corner site (21-125 N. Second Avenue and 152.156 E. Santa Clara Street) with Metropolitan Development. Meta Housing Corporation Alexander/Catania, Greenwood Properties, Inc.. and Marriott International (Arcadia Redevelopment Agency).
