PRESENTATIONS
Mayor Lojeskl presented and read a proclamation: 'WHEREAS on May 20th we will observe
Armed Forces Day which honors all military men and women for their contributions In the
defense of our great nation; WHEREAS on May 29th we will observe Memorial Day and pay
homage to those men and women who have given their lives for our country; and
WHEREAS ~ is acknowledged that the freedom we enjoy was not gained w~hout great
sacrifice; and WHEREAS Americans awe a great debt to the military men and women who
have given so much to ensure our safety and security. NOW THEREFORE, I, Dennis A.
Lojeskl, Mayor of the City of Arcadia do hereby PROCLAIM May 29th to be HONOR OUR
MIUT ARY DAY in recogn~lon of Anned Forces Day and Memorial Day; to urge all Arcadians
to reflect upon the importance of these two occasions that have contributed to our history,
as well as our dally lives..
ARCADIA BEAUTIFUL AWARDS
Mayor Lojeski announced that the Arcadia Beautiful Awards are to be presented this
evening. He then introduced the Arcadia Beautiful Commission Chairwoman and fonner
C~izen of the Year, Mary Hansen.
"
Chairwoman Hansen thanked the Council for inv~ing the Arcadia Beautiful Commission to
present the awards at this Council meeting. Chairwoman Hansen further stated, In part,
that the Commission is dedicated to keeping Arcadia beautiful, and reviewed some of the

goals, projects and accomplishments of the Commission In the last 25 years since the
Commission was formed. Last year the City Council also designated the Arcadia Beautiful
Commission as the Tree Commission. The Council proclaimed March 7, 1995 as Arbor Day I
In the City, and Chairman Hansen reviewed the Arbor Day activities planned and carried out
by the Commissioners at Fire Station No.2.
Chairwoman Hansen Introduced past Arcadia Beautiful Commissioners present this evening:
Jane Bellin, Lorraine Fricke, and Jim Green. Commissioner Hansen acknowledged and
thanked Gary Rogers, Human Resources Manager and City Photographer and Melissa
Ornelas, Public Works Department, who does the Commission's secretarial work; Arcadia
Coffee Brewing Company on First Avenue for furnishing and donating the coffee this
evening; Allan Yak of Ralph's Florists for the floral centerpiece for the reception; TCl who
took all the video pictures of the award winning homes; Foulger Ford for providing a van
for the Commissioners' use to judge the homes; and Dale Vertz. the van driver for the last
two years; Mayor Dennis Lojeskl, the Commission's City Council liaison for being so helpful.
Chairwoman Hansen then introduced the Arcadia Beautiful Commissioners: Gloria Vertz
and Rosa Schram, Co-Chalrwomen of the awards presentation; Peter Ulrich, Publicity;
Roland Kelly, Historian; Pat Elcherly, liaison with the City; and Helen Dahlstrom, Recording
Secretary.
The 1995 Awards Co-Chalrwoman, Gloria Vertz then explained the Commission's procedures
for selecting the winners. The following awards were presented:

text amendment to establish a Density Bonus Ordinance. which Is Intended to comply wtth
the State Density Bonus Law. Govemment Code Section 659t 5. and to be In accordance
wtth the goals set forth In the 1990 General Plan Housing Element. The ordinance will
provide provisions for the City to grant a density bonus and an addttlonal concession to
developers who agree to construct multiple family projects wtth a specific
percentage of housing to be provided for lower-Income and very low-Income households,
or senior cttlzens. Spec~lcally, housing developments consisting of five untts or more would
be eligible for a density bonus and an addttlonaJ concession or Incentive, provided that the
project meets one or more of the criteria that Is set forth In the proposed ordinance. Also.
residential condominium conversion projects consisting of five apartment untts or more
would be eligible for a density bonus under the provisions of this ordinance. The proposed
regulations provide for a formal density bonus application procedure that follows the review
process as set forth for text amendments. Following a public hearing, the Planning
Commission at tts April 25. 1995 meeting voted to recommend approval of text amendment
95-002 to the City CouncU.
Mayor Lojeskl declared the public hearing OPEN.
No one desiring to be heard, the hearing was CLOSED on MOTION by CouncUmember
Young, seconded by Councilmember Chang and CARRIED.
In response to a question from CouncUmember Chang, staff replied that the standards for
maximum rents or selling prices for affordable units would be established by the current
market and would be provided by the applicant. Rental rates would be established
according to the State Houslng Authority.

that the text amendment wUI not have a significant effect on the environment and DIRECT

In response to a request for report from CouncUmember Young. the City Attomey reported
that the house owned by Mrs. Mary Card which had been the subject of CouncU discussion
and direction because of maintenance problems. Is no longer occupied by Mrs. Canl. The
house Is now being well maintained, an Inoperable vehicle has been removed and the
property Is currendy listed for sale by Coldwell Banker of Arcadia. The City Manager
exercised some discretion which had been given to him by the CouncU under the Resolution
of Nulsence and Compliance Agreement and continued the deadline pending the sale. His
office Is working on a further continuance subject to certain requirements. In summary.
substantial progress has been made toward accomplishing CouncU's Inttlal goal of bringing
this property Into compliance wtth City codes.

In response to a question from Councilmember Young with regard to the Orange Grove
Avenue reconstruction project, staff replied that contracts with the county are being finalized,
and work on this project should commence with the ground breaking taking place this
following week. Councilmembers will be provided with a construction schedule.
Mayor Lojeskl noted that two cities and the county are cooperating to accomplish this
project, which will Increase safety for pedestrians and automobiles on Orange Grove
Avenue.
Councllmember Margett referred to a PASADENA STAR NEWS editorial concerning truancy
in the schools. He would like this brought to Dr. Towner's attention. Arcadia may not have
this problem, but In other school districts I. e. Monrovia and La Mlrada, when truants are
picked up they are fined $50, and do public service within the community to offset the fines.
If the School Board Is Interested In that type of ordinance, perhaps the Council couid
indicate that It'ls supportive.
Councilmember Margett referred to an Information packet Item regarding a proposed review
of the California State Constitution. This review wUI address modifications In education,
recommendations as to how to Interface more with the state through local government, as
well as other Interesting Issues. He suggested scheduling a study session so that Council
could have some Input.
Councllmember Margett noted that he had seen Councilmember Chang on a Chinese TV
channel, and thought perhaps It would be beneficial to Arcadia residents if there could be
English sub-titles on such programs.
Councllmember Chang agreed. He will call the TV directors and ask them
to rebroadcast the Interview with an English translation.
Councllmember Chang requested a follow up on the stray shopping cart situation. The City
Manager responded that staff had a meeting with all the major food stores In the City, and
the stores have been cooperative. Public announcements have been made on cable TV
and are being placed In the City News Letter. The stores all did their part to get the word
out. Staff Is stili trying to coordinate with other stores that have not been as active. The
fact that all the stores are aware of the problem has been helpful In reducing It. All the
stores are now using one large retrieval company. Also public education Is helping to
reduce the problem.
Mayor Lojeskl noted that this afternoon the Arcadia Rotary Oub had hosted a luncheon for
the Senior Citizens at which time they honored Peggy Leatherman - the Arcadia Senior
Citizen of the Year for this year.
Mayor Lojeskl noted that the Fourth of July holiday falls on the first Tuesday of the month
this year. He requested a discussion regarding an alternative Council meeting date. The
City Manager said that at this time there are no public hearings or major agenda Items
scheduled for that date. Council member Young said that because there Is so much Council

business, it would be difficult to miss a meeting altogether, and suggested scheduling it the
following week on July t1. Mayor Lojeskl suggested scheduling the meeting for I
Wednesday, July 5, since Councllmember Margett may be leaving the Council, and the
Council may need that time. Mayor Lajeskl said there are no commission or league
meetings scheduled for July 5. Councllmember Chang suggested that the meeting be
cancelled and they plan for a heavier agenda on the third Tuesday of July. Councllmember
Margett agreed with Councilmember Young that CouncU should not break the rhythm of the
meetings by cancelling the first meeting In July. After further discussion, it was
unanimously decided to schedule the first CouncU meeting in July for July II.
Mayor Lajeskl announced that on May 23 at 5:30 p. m. the City CouncU will be conducting
the first budget study session. . City employees and public are invited to attend.
Mayor Lajeskl also announced that on the morning of June 1 the Council will be meeting
with County Supervisor Antonovlch. If any CouncUmembers have items to be added to that
agenda, please communicate with the City Manager's office.
Mayor Lajeskl also announced that at 7:00 p. m., Wednesday evening, May 17 the Arcadia
Development Services Department will conduct a General Plan Update Community
Workshop at the Community Center. Anyone who may be Interested Is invited to attend.
Mayor Lajeskl also announced that the City has officially opened a Streetscape 2000 project
offlce on Huntington Drive. A staff member/engineer from ASL Engineering will be
there full time. The plans and Information are there for anyone who wishes to take the
opportunity to ask questions and gather Information. At 9:00 a. m., Friday, May 19, there
will be a ground breaking ceremony on the southwest comer of Second Avenue and
Huntington Drive. The public Is encouraged to attend. OIIlciafly, construction will begin on
May 22, 1995.

COUNCIL Counc" entered a discussion regarding the CouncD vacancy appointment process, In vlew
VACANCY of the probability of a CouncD vacancy sometime In June when Councllmember Margett Is
APPOINT-elected to the State Assembly. In response to a question from CouncDmember Chang, the
MENT City Attomey explained the appointive/elective process. A vacancy may be filled by
PROCESS nomination of candidates from the seated City CouncY, and a majority
vote of the remaining councllmembers (I. e. three votes). If Council falls to fill the vacancy
w~hln a thirty day period of vacation of that CouncY pos~Ion, ~ shall call an election for the
earliest possible date to fill the vacancy. At this time ~ would appear that such an election
would be held sometime In November, 1995. This is based upon the following hypothetical
premises:
1) CouncU vacancy occurs by July I. 2) Thirty days pass w~hout an appointment by
August 1, 1995. 3) A special election Is called for by resolution of the CouncY August 1,
1995. 4) The elections code requires the election to be held a certain number of days after
the calling to allow time for nominations, the campaign, etc. 5) The election would take
place In November 1995..
Mayor Lojeskl said that It Is his understanding that such a vacancy occurs at the time the
departing CouncYmember takes the oath of office In Sacramento. In response to a question
from CouncUmember Chang, the City Attomey replied, just as a general guideline, In
appointing someone to fill what Is normally an elective position, there Is no established
requirement that does not already apply to those running for a seat on the City CouncD; the
process Is to be as unWorm as possible In terms of what the applicants must do and
questions they may be asked by the CouncU.
Mayor Lojesld noted that CouncDrnember Margett's normal term would expire AprU 1996.
It Is reasonable that this CoWlCil ~ seriousllI consider the situation, and agree that

Council can make an appointment w~hln that thirty day period. If a special election has to
be called, the cost estimated by the City Clerk would be of the order of $65,000. If an
appointment Is not made by August 1, 1995, an election would be called for by Council
resolution. Since the Election Code requires the election to be held a certain number of
days after that date, the special election would occur In November, t 995. By the time the
election results were certified and the new CouncUmember seated, ~ would be December.
Also, In December, the filing period opens for the next City election to be held In April,
1996. This will Involve another $65,000 cost. Mayor Lojeskl said he thinks reasonable minds
must prevail. He emphasized that it Is Council's duty w~h regard to fiscal conservatism to
make that Council appointment w~hln the thirty day time period.
Councilmember Young said that, In falmess to possible candidates for the April 1996
election, it would be well to find a candidate who Is not interested in running for Council,
but would be willing to fill In for the Interim., This would give fNery candidate In the April
election a fair chance. Councllmember Margett agreed w~h Councllmember Young that It
would be well W CouneY could appoint a candidate who Is not pol~IcaI, but who would be
willing to serve for that brief period 01 time.
Mayor Lojeskl stated that he would like to see who would be Interested In this appointment,
knowing that the appointment will be for a specified period of time. That person should have
knowledge of how the CouneY operates, what projects the City Is currently Involved w~h,
ete. Mayor Lojeskl suggested nominations be sollc~ed by notices on TV and In the
!WO newspapers In the City. CouncJJmember Margett suggested that each councllmembar
also make personal Inquiries.
It was the consensus of Council that staff prepare an announcement flier and application
fann for CouneY's consideration at the next meeting.
Councllmember Chang stated that the selection process will need to proceed In !wo or three
steps to narrow the number 01 applicants, and that can be accomplished through the
Interview process. In response to a question, the City Attorney replied that the selection
process Is not eligible for closed session discussion.

time friend of the City of Arcadia and the Planning Oepartment. Irving I. livingston, at age
S9Venty.four, passed away May 6. 1995 In his home In OallVille, California. Mr. livingston
was born AprlI3, 1921 In Chicago, and was raised In WInnetka, Ill1nols, graduating from New
Tyre High School In 1938, graduated from the University of California at Berl<eley In 1942.
He served during World War II with the U. S. Army In Europe. In 1947 he married Jean
louise SchwaI1z In Chicago. As a FInancial Admlnlslrato( for Owens illinois Corporation,
he was a ploneer In the use of ccimputer technology for buslness planning. He was an avid
bridge player and served as Chalnnan of the Arcadia -California Planning Commission. In
fact. IIV served for a total of two terms . eight y.... Whle he and his wife were living here
In Arcadia, his wife, Jean, also became Arcadia's Cltlzen of the Year. In fact It was the first
year that there were dual reclplenl8 of that particular award. He and his family lived In
Chk:ago and Morton Grove. Ill1nols; Sylvania. Ohio, and Arcadia and Oanville, California.
IIV Is survived by his wife, Jean of Oanvlle and sons. Tom of Jenklntown, Pennsylvania;
John of Wapato. Washington; as well as five grandchildren; and a sister Julie Balr of
Glencoe, IUlnoIs. SeMces were held privately and any memorials may be sent to lhe City
of Hope National Medical Center, 1500 East Oualte Road, Dualte, California, 91010. I would
like to adjourn tonight's meeting In mem<lIY of a long-time advocate and supporter of the
