p. m., Tuesday, July 11, 1995 In the Arcadia City Hall CouncS Chambers.

The City Clerk administered the Oath of Offlce to Incoming City CouneS Member, Peter H.
Ulrich, and presented him with a Certificate of Appointment and a copy of the Oath of OffIce,
and welcomed him to the City famUy. CouneUmember Ulrich took his seat at the CouneS
table.
On behalf of the City and City CouncS, Mayor LoJeskI expressed congratulations. and
welcomed Mr. Ulrich to the City CouneU.
CouneUmember Ulrich: "Thank you, Mr. Mayor. Now that I am a politician, I must have
something to say. I looked up the word, 'politician' In our Webster's dictionary, and the
definition I have come up with Is, 'one engaged In the science of govemment'. I guess that
makes me a scientJst of sorts. That Is the definition I like. There were some others that
were not quite as complimentary. Let me, first of all, tell all of you that this Is, Indeed, a red
letter day for me. It Is one of the most Important events In my life. It Is also, I find. a
historic day for the City of Arcadia becausa it has been forty-fIVe years, since 1950, sinee
a CouncY person was appointed. So I am the first appointee In forty-five years, and I am
very proud of that Also, at the same time, I am very much Indebted to my fellow
CouneUmembers for the fact that they voted for me. I came In unanimously with four votes.
I don't think there are many Couneilmembers who can say that they were elected
unanimously.
"' would like to Introduce. first of all, my wife, Carol, who Is In the audience. She has put up
with me for fifty years, and deserves extra applause for that Other members of my fam~y,
Unfortunately, are not able to be here. We have three chUdren, five grandchUdren and five
great grandchUdren. They are In various parts of the country - as far away as Milwaukee
and Indiana, and a couple of them are working tonight - thank God. So I am very gratefIJ
for their support. They have all called me or sent me messages of congratulations. I also
want to thank some of the folks In the audience who are here to wish me well, particularly
some of my friends from our church - Lutheran Church of the Cross - and also some other
business associates that I see out there In the audience. I am also very grateful that my

fanner Commissioners (I had to resign from the Arcadia Beautiful Commission since , can't
hold two offlcas at the same time) are here tonight In force, partly to support me and partly I
to get an award.
"Next. I would like to thank the people at City Hall. They have given me a very fast
education this past couple of weeks, starting with our Mayor who spent a couple of hours
with me, the City Manager, three ladles In the City Manager's Offfce - OIMa. Cindy and
Unda. I could hardly be here tonight without them. They have given me so mucIT support,
telling me what Is what I want to thank them particularly. I want to thank the City Attomey
and the City Clerk. I also want to say a special word of thanks to the AssIstant City
Manager and also Fire Chief Gardner and to Pat Malloy, Director of Maintenance ServIces
(he emphasized the word, 'services' - I have already been wined In that) for showing me
around the City facUlties. I spent the better part of a day accompanied by these two
gentlemen, and they gave up part of their valuable time to get me acquainted with City
facilities. I am really Impressed with what I saw. We have a well managed City. It's very
apparent when you visit the various facilities. We have a lot of knowledgeable, dedicated ...
employees. I am very happy to be part of City govemment. I will do my best for the good
of our City. And now, Mr. Mayor, I am ready to go back to work. .

AWARD
Kevin Johnson, on behalf of the National Arbor Day Foundation, California Department of
Forestry and the Los Angeles County Fire Department, presented the City of Arcadia with
Its First Annual Tree City Award. The award was accepted with appreciation by Mayor
Lojeskl who noted that Arcadia takes Its trees very much to heart; they are a part of our
environment and a very key part of our City. Mayor Lojeskllnvited the Arcadia BeautifU
Commissioners present In the audience to participate In the photograph commemorating
this award.

PUBUC HEARINGS
Consideration of Arcadia Transit's Fiscal Year 1996-99 Short Range Transit Plan. The Short
Range Transit Plan (SRTP) Is a four year transit forecast prepared annually by staff, and
submitted to the Los Angeles County Metropolitan Transportation Authority (lACMT A), and
the Southern California Association of Governments (SCAG) for review and approval. The
Information In this Plan Is used to develop future state. federal and local transit funding
levels. The Plan Is required In order for the City to maintain e1lglbUIty for state and federal
transit grants which are used for funding of the City's transit system. This year's Plan
Includes justification for the purchase of two replacement paratransit vans In 1996. Also
Included Is the Arcadia Transit operating budget which Is estimated at approxlmately
$1,089,700 for FY 1996, which wUI Include federal. state and local monies. Federal
guidelines require that a public hearing be held on the SRTP before it can be approved by
the City CouncU. Notice of tonight's meeting was published In the June 29, 1995 Pasadena
Star News.
Mayor Lojeskl declared the public hearing OPEN.
No one deslring to be heard, the hearing was CLOSED on MOTION by CouncUmember
Young, seconded by Mayor Pro tem Kuhn and CARRIED.
Staff provided some clarification of several budget figures listed In the SRTP projected
financial status for FY 1996-97, In response to questions from CouncUmember Chang.

CARRIED on roll call vote as follows to APPROVE Arcadia Transit's FY 1996-1999 Short

PUBUC Consideration of assessment for City abatement of property violations at 163 Alia Street
HEARING (Thomas Morales. property owner) On June 2, 1995 Hartfleld Construction Company
NOTICE OF demolished the existing fire damaged dwelling at 163 Alia Street pursuant to the Notice to
ASSESSMENT Abate Issued to the property owner, Thomas Morales. on March 10, 1995. Cost for
(163 Alia abatement, Including staff time, was $3,952.00. Per Section 9406.5 of the Arcadia Municipal
St.) Code, the City Courd, sitting as a Board of Equalization, must approve the cost of
(APPROVED) abatement. The City CouncU may modify or correct any assessment which, In its opinion,
o ;; ..U" ,) CaulS excessive or otherwise Incorrect. If the Cltys rvlcesCouncD concurs with staff's decision, the City
ncH should direct the Administrative e Director to send a bUlto the property
owner for the amount approved by the City CouncU. If the bUlls unpaid at the end of thirty
days, this matter would be referred to the Administrative Services Director for collection.
Mayor Lojeskl noted that there were fifleen occurrences of CIty staff involvement In this
matter.

SW CORNER On October 6, 1992, the Agency awardQd a six month exclusive real estate brokerage
SITE REAL contract to Hayes and Company (Hayes) for the purpose of marketing the Southwest and
ESTATE Northwest Comer Sites (Huntington Drive at Second Avenue). This contract, through a
BROKERAGE series of extensions granted by the Agency, remains In effect Hayes has performed
SERVICES pursuant to the contract. In December 1994 the Agency directed staff to begin formal
COMSN. negotiations with Mr. Tom Shannon, Thunderbird Restaurants, Inc., concerning possible
(Hayes & Co.) development of an Outbeck Steakhouse at the Southwest Comer Site. The Development
(APPROVED) and Disposition Agreement (DDA) was approved by the Agency and City Council on June
o (; I? 0 Z If>l />,,,,20, 1995. The Agreement with Hayes contemplated a straight sala of the sites with payment
- 10 Hayes upon close of escrow. However, since the Agency DDA Is structured as a
lease/sale agreement for a total price for the site of $625,000, staff recommends payment
of half the 5% brokerage commission ($15,625) when the Outback building permits are I
Issued (approximately July 31, 1995), with the balance ($15,625) paid within 14 days of
Issuance of Certificate of Occupancy. This Is In accordance with common business
practices.

CARRIED on roll call vote as follows that the Agency AUTHORIZE payment to Hayes and
Company In the amount of $15,625.00 within 14 days of Issuance of building permits for Ihe

MATTERS FROM ELECTED OFACIALS
CouncUmember. Ulrich would like CouncU to conslder as a future agenda Item. a resolution
of congratulation to the City of Monrovia which received recognition by being named an
All American City. One of only ten in the country. The other CouncUmembers agreed.
CouncUmember Ulrich congratulated Unda Garcia In the Manager's Offlce on an excellent
lob in compiling the citizen satisfaction reports. He would like to see CouncU discuss those
results at a futur8 CouncI meeting. with some of the Informatlon and results being made
available to the citizens at that meeting. The results of the survey were complimentary. The
other CouncUmembers agreed.
CouncUmember Ulrich attended a meeting of the local chapter of the Heart Association
where Dennis Lee. President, Methodist Hospital was elected as chair of the group. Special
recognition was given to Mary Hansen as the outgoing president and also as the Volunteer
of the Year. .
CouncUmember Ulrich called attention to the recently opened tropical forest at the
Arboretum. This Is a beautJful nature walk which has just been developed, and he strongly
recommends that It be visited, particularly by the young people,
CouncUmember Ulrich called attention to the Arcadia Pops Concert to be held at the
Community Center W8dnesday evening, July 12 at 7:00.
CouncUmember Young noted that she wur be speaking at a forum for candidates to the
Water Quality Authority Board. This to be held at the City of Azusa Ught & Water
Administration FacUlty, Wednesday evening, July 12 She requests the support of the
CouncU at the time of the nominations.
CouncUmember Chang noted that he recendy attended a conference of the Independent
Cities Association at Rancho Bernardo which was very informative.

CouncUmember Chang noted that he agrees with CouncImember Ulrich that the results at
the citizen survey should be placed on the CouncI agendL The surveys indicate many
positive feelings about the CIty, Councl and City staff. There was only about a 5%
household response - 54% males; 46% females; 58% age 55 01' older. 96% rated Arcadia
as an excellent to good place to live; 90% rated employee courtesy as excellent to good.
95% rated Police Department service as very satlslted to satisfied; 99'l(, rated Fire
Department sarvlce as satisfied to very satisfied. 3 t % said City services could be Improved.
Staff can study this.
MayOI' Pro tem Kuhn welcomed CouncUmember Ulrich to the CIty Counci.
MayOI' Pro tem Kuhn noted that last month the Police Department held a luncheon to
recognize and thank their volunteers. On behalf 01 the City CouncU she also thanks the
more than 80 volunteers who give many. many hours to our Police Department. This Is
greatly appreciated.
Mayor Pro tem Kuhn received Information from City resldents who play sotlbaII at the
County park. that the County Is planning to dose da.vn those facUlties at the Park due to
budgetary restraints. Other facUlties may be Impaded. also. The City has not been notlfled
about this. The City Manager will be In contad with County oIfIclala to obtain further
Infonnatlon. Mayor Loleskl and CouncUmember Young said they had heard from some of
the seniors that the senJor facUlty at the County park Is also to be dosed.
Mayor Pro tem Kuhn referred to the,CIty Attorney's report regarding the Mart Card property
on Valldo Road. The CIty Attorney briefly outlined the history of this property which had
been In serious disrepair far years. constltullng . health probIerri far the nelghbcn and
necessitating long on-golng legaJ adlon on the part of the CIty to abate the problem. At
this time the property has been sold to another party.. The CIty Is about to receive an
agreement from the new owner that the house Is scheduled to be demolished so a new
structure can be built, and the property Is being maintained In a satlsfadory manner In the
Interim. A full report wUI be provided to the CouncU 101' delivery to the public since It was
an Item 01 some Interest In the community.

Mayor Lojeskl noted that, whDe drlvlng east from Pasadena today, he counted twenty-two
shopping carta abandoned within a half a block along Huntington Drive alone. He
admonished those listening on the cable TV not to remove the shopping carts from the
market premises. Many of the carts were parked In front of other businesses. He does not
know how to solve this problem, other than to continually keep bringing It to everyone's
attention. Also. he requested that when City employees are about the City and note such
violations, that there Is some method of recording vfoIal/ons, nolifylng supeMsors. ate. The
City Manager replied employees do have forms available fOl' such reporting, and they wlll
be reminded and re-educated to do so.
MayOI' Lojeskl noted that there Is an empty lot on the NE comer of Huntington Drive and
Sunset Blvd., and last Sunday there were fifteen cars. parked three deep with '101' sale' sJgns
on them. This Is not a licensed used cat lot, so this Is a vtoIatlon. The City Attorney
resporded that If the property owner cooperates and allows the proper signing. such
automobUes can be towed. He wW Investigate the matter.

Mayor Lojesld agreed with Counclmember Ulrich that the tropical rain forest which has been
developed at the Arboretum Is an outstanding display. and everyone should be encouraged
to vlsit It. He also noted that all the plants have been donated. The Arboretum has a
program of transplanting canaln plants from residents' yards 10 the Arboretum if such plants
are those they need or can use.

The City Manager presented and read the title of Resolution No. 5868: "A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CAUFORNIA, ESTABUSHING AN
APPROPRIATIONS UMIT FOR FISCAL YEAR 1995-96 PURSUANT TO ARTICLE XIIIB OF
THE CAUFORNIA CONSTITUTION".
I n November 1979 the voters of the State of Callfomla approved Proposition 4 (the"Gann
UmJt") which created Artlde XIJI-B of the State ConstJtutlon placing IImJts on the amount of
revenue which can be spent by city govemment Proposition 4 became effective for the
1980-al fiscal year, but the formula for calculating the limit was based on the 1978-79 "base
year" revenues. In June 1990, the voters of Callfomla approved Proposition 111 which.
among other things, provides new adjustment formulas which make the Appropriation Umit
more responsive to local growth Issues. Proposltlon 111 also Implemented a requirement "
for an annual review of the Umlt calculation. In response to questions from CouncUmember
Chang, the Administrative Services Director explained several items listed In the "Calculation
of Proceeds of Taxes" report. including homeowners' exemption and sale of property.

CITY MANAGER
At the June 20, 1995 City CouncU meeting. the City CouncU directed staff to schedule
Interviews for the following applicants for Planning Commission: Eric HeikkUa. WUllam
Marcussen and John Sleeter. Subsequent to the June 20 meetIng. staff was Informed that
Erick Heikkila Is not a U. S. citizen and is. therefore. unable to serve on a City board or
commission. Both Mr. Marcussen and Mr. Sleeter have expressed iheir desire to be
interviewed, and are able to attend the July 18 City Council meetIng.
On June 26, 1995, CouncUmember Chang submitted a citizen service resume for Cheung
T sing Chang and is requesting that City CouncU interview him. Because Mr. Chang has only
lived In the CIty for four years, has no prior community Involvement and had faUed to
complete the resume submitted. Mayor Lojeskl called for a vote of the Council with regard
to the scheduling of an Interview with Mr. Chang:

Consldenltlon of the report on the status of the effOl1S of the Ubrary Foundation. When the
CouneR adopted the 1995-97 Work Program, under the category of RscaJ ResponslbUlty,
they requested that the Ubrary Foundation submit to them, on a quarterly basis, repons on
the activities of the Foundation relative to the Ubrary Expanslon/Renovation Project. This
request was to ensure that the Coune. and the community at large were aware of the fund
raising actlvllles relative to the fumlshlngs, fixtures and equipment not Included In the
renovation project budget The City CouncI has received a document from the Ubrary
Foundation which provtdes Information on the Ubrary project. and a mission statement for
the Foundation Qncludlng By-Laws). The document also provides a financial and
development chapter and Issues relative to officers of the Foundallon.
Jesse Vanlandlnaham, 460 Harvard Drive, President of the Ubrary Foundation presented
a comprehensive report on the organization and the activities of the Foundation thus far.
Mr. Vanlandingham stated, In part, that experts In the ftek:t of fund raising found that people
wUI give to a tax_empt foundation, but wUI not give to a city, county, state or federal
government because their donation wRI end up In the general fund. Also, people wUI not give
to a foundation when most of the money goes for expenses. The Arcadia Public
Ubrary Foundation wlII be a 100% volunteer foundation: there will be no paid staff. The
Foundation was formed In February, and has obtained IRS tax_empt status while waiting
for the approval of the funding of the expansion and renovation project. With this done
a little more than slxty days ago, they have now elected a Board of Directors. They hired
one of the best, If not the best, professlonal experleneed fund raiser In the field, who wUI
be the foundation's consultant. His assistance wUI be donated free of charge to the
Foundation. They are In the middle of producing a brochure, and a professional graphics
person Is doing the writing and graphics, and his talents are also donated free of charge.
On Thursday. August 24, 1995 the Foundation will sponsor the Chamber of Commerce
mixer, and the caters, Simply Unique Caterlng, Peacock Cafe at the Arboretum wUI cater
the hors d'oeuvres free. The Foundation has over $15,000 In the bank, and an additional
$49,000 In pledges; two grant requests to two foundallons for over $100.000; and a planned
giving bequest for between $40,000 and $50,000. In addition to the Board of Directors of
the Foundation and the Board of Trustees to the Ubrary. a number of other volunteers have
joined. Mr. Vanlandingham also described the proposed Foundation sign to be constructed
for the Ubrary property, and to be placed adjacent to the City project sign at the northeast

comer 01 Duarte Road and Santa Anila. The sign Is Intended to make the citizenry aware
of the need for funds by the Foundation.
Mr. Vanlandingham said to fNery citizen of Arcadia - volunteer your services and your time;
get a pledge card; make a commitment, gift or pledge; and ask a friend or co-worker to do
the same. If we do this, we wUI have a library unequaled In Southern Califomla and the
State.
Considerable dlscusslon ensued between the CouneUmembers, Mr. Vanlandingham, and
Ubrarlan, Kent Ross, and Assistant City Manager/Fire Chief /Ubrary Renovation Coordinator
Gerald Gardner regarding the renovation, as well as the fund raising efforts and the Inter-
action between the CouneU/CIty Staff/Ubrary Staff and the Ubrary Foundation, as well as
estimated cost 01 the required computers. Mayor Lojeskl expressed concern that all
equipment purchaslng be handled through the City Purchasing Agent In accordance with
all CIty requirements and speclflcatlons. CouneUmemberYoung discussed the Foundation's
positJon on accepting non-monetary gifts, I. e., furniture, piano, etc., and felt that, In general,

such donstJons should not be encouraged.
The City Council RECEIVED and FILED the Arcadia Public Ubrary Foundation's Report and
scheduled a study session with Mr. Vanlandingham and the Ubrary Foundation Board of
Directors at 5:30"p. m, August 1, 1995, for further discussion of the fund raising activities
for the library.

order to place Charter Revisions on the ballot for the AprU. 1996 Municipal election. Counel
action on the Charter revisions would be necessary by January 12. 1996. Accordingly, the
work of the Commission should be completed In time for adequate CouneU review.

Many of you may have known Bill's wife, Glenna, who for many, many years taught In the
Arcadia School District WRliam Klrkhuff Rasmussen, Attorney and a resident 01 Arcadia
since 1953, passed away June 22, 1995 of cancer. He was born in Provo, Utah. December
5, 1920. After graduating from Brigham Young University, he joined the Navy Air Corps

during World War II. When the war ended, he attended Stanford University where he
received his law degree In 1947. He pracllced law for lorty-four years as a Los Angelas
County Public Defender, In private practice, and on the Federal Indigent Panel. A long term
member of the Santa Anita Private Turf Oub, he was an avid reader and loved to study
history, and enjoyed traveling. He was a beloved husband, father and a special grandfather.
He Is survived by his wife of fifty-two years of marriage Glenna; two sisters, Crystal Price
of Redlands and Gloria Asher of Salt Lake City. three sons, Curt Glenn of Provo, Utah;
Thomas WUllam of Los Angeles; and Scott David of Pasadena; and a daughter. Polly Ann
Oldman of Monrovia; and eight grandchildren. A memorial service was held on Tuesday,
June 27 at 2:00 p. m. at the Methodist Church of the Good Shepherd In Arcadia. In lieu of
flowers, any donations can be made In Bill's name to the Hospice of East San Gabriel Valley,
820 North Phillips Avenue, West CovIna. CA 91791. Again I would like to adjoum tonight's
meeting In memory of William K1rkhoff Rasmussen. Arcadia, again, has lost a flne citizen
and outstanding contributor to our fine City.'
