DR.HAROLD WARD Mayor Lojeskl presented the Mayor's Certificate, of Commendation to Dr, Harok:l Ward for outstanding achievement In that he was the winner of the TransPacific Race, sailing from Los Angeles to Honolulu. At. Mayor Lojeskl's request. Dr. Ward described the difficulties encountered just prior to the end of the race when a breakdown occurred resulting In the lost of the mast. However, they managed to jerry-rig sails, and In spite of this setback, won the race. Mayor Lojeskl stated that all 50,000 Arcadians are proud of Dr, Ward and his achievement. lb. PETER DAlLY (Sister CIly Comsn,) On behalf of the CIly CouncD. Mayor Lojesld presented a CIly plaque for distinguished seIVice from 1987 to 1995 to Peter DaDy, outgoing Sister CIly Commissioner, and recounted some of Mr. DaUey's achievements during his tenure as a Commissioner. 2. PUBUC HEARING Consideration of weed abatement charges to affected private property owners within the CIly of Arcadia. On February 7, 1995, the annual weed abatement program on private property began with the adoption 01 ResolutJon No. 5835. This Resolution declared that certain properties contained weeds. brush, rubblsh and/or like material, and that they are a public nuisance. This Resolution also set fanh the CouncU's Intention to provide for the abatement 01 the properties listed If the property owners did not clear their own properties. Subsequently, a public hearing was held on February 21, 1995. At the conclusion 01 the hearing, Councl directed the County AgricultUral CommIssioner to abate the weeds and/or such on the listed properties. On JulV 17 01 this year, the Los Angeles County Agricultural Commissioner submitted a list. which the CouncDmembers have, 01 those properties within the CIty upon which the County abated the weeds. The addresses 01 the properties have been Inserted. Of the thirty-five (35) properties listed. fourtll6ll (14) properties Incurred a charge 01 $25.39 each. This amount was levied as a County charge for Inspection of the property, only, Each property on the list has been posted and noticed of the public hearing this date, which was scheduled to hear objections, If any, to the charges for abatement or Inspection. In response to a question from Mayor Lojeskl, Chester Olsen, County Agricuilural Commissioner's OffIce. replied that the $25.39 charge -was levied basically as an InspectJon charge. Either the property owner cleared the property or, for some reason, they were not In violation of the Fire Code. Mayor LoJeskl declared the public hearing to be OPEN. This project will result In substantial URBAN public Improvements being made on Huntington Drive from Santa Clara to Fifth Avenue and DESIGN First Avenue from Wheeler to Callfomla. These Improvements are scheduled for completion GUIDEUNES by the end of 1995. and are the first phase of a larger progra,,! to revitalize downtown (Urban Arcadia. The second phase of the effort Includes developing a commercial facade Design rehabUltatlon program providing Incentives to attract new and retain exJstlng downtown Studio) buslnesses. creating a marketing program, developing promotional events. and Instttutlng (APPROVED) an accessway acquisition program. The total cost for this project wtth meetings and contingencies Is $29,110. and that amount was placed within this year's Agency Operating Budget Staff recommended that the Agency approve a contract with Urban Deslgn Studio (UDS) for development of downtown design criteria. These guidelines would define standards for land uses, lot size, parking, archttectural elements, landscaping, slgnage, color. and materials for use In the downtown. Other elements of the Downtown 2000 program (accessway acquisttlon, marketing. promotions) will be brought to the Agency for consideration at a future meeting. It may not be a classic style, but w~1 be a concept 01 colors and materials that relate together harmoniously. In reply to a question from Chairman Lojeskl. the executive DIrector responded that the project tlme span wHI tentatively be six months from August 1 st to being placed before the Commission and Cound for adoption. Some parts will be completed at earlier dates. Staff has viewed the developments In which this company has partlclpaled In other nearby areas. In response 10 a question from Member Chang, staff replied that, with regard 10 the aclual cost 01 the Implementation 01 the second phase, we have to complete lhe design guidelines, to develop what needs 10 be worked on. after which a funding program with the merchants will be established to begin the actual work. Funds are available to begin the multi-year program. ClTY COUNCIL RECONVENED I AUDIENCE PARTICIPATION Edward J. Barrett, 596 L West Huntington Drive, stated, In part, that he Is present 10 complain about throw-away material received at his condominium. This Is a 90 und condominium and the throw-aways amOunt to a considerable nuisance. Sometimes !he Condominium Association has had to hire someone to clear up the mess. The address is on the IlOIW1lstrlbutlon list, so distributors are not paylng attention to this list. He wOUld 'ilee to see the City Increase the flnes to these businesses. Also, on trash day, the trash bins are left on the street by Newco for 5,5 hours. Scavengers come by and go through the bins. There Is limited parking so this Is a great Inconvenience, and In the event 01 a fire. the trucks would not be able to get through if residents park In the driveway whUe !he trash bins are In the street. ' , - . . - - -- Mayor Lojeski announced some up-coming events including the Annual Senior CttiZens' Volunteer Luncheon at the Community Center; the Arcadia Chamber of Commerce Mixer to be held at the Arcadia Public Ubrary on Thursday, August 24, This wUf give cttiZens an opportunity to see what Is going on at the Ubrary, as well as to provide an opportunity to talk with Mr, Vanlandingham concerning the Arcadia Public Ubrary Foundation; the official ground breaking ceremony for the Orange Grove Avenue improvements which will be held at the Baldwin Avenue resefVoir on Friday, August 25th, I CONSENT ITEMS APPROVED minutes of the July 11 and July 18, 1995 regular meetings and July 19, 1995 adjourned regular meeting, AUTHORIZED staff to renew the existing contract with the Arcadia Unified School District to provide meals for senior citizens at the Arcadia Community Center, In response to questions from Coundmembers, staff said that the meals program at the Community Center averages 30 meals a day for seniors, Mayor Young suggested that utensils of heavier plastic be obtained to solve the problem of the lighter weight utensUs breaking whUe being used to cut food, The Recreation Director replied to a question from CouncUmember Chang that. although at the beginning of the program, they did not average 30 meals a day (30 meals Is the minimum number supplied by the School District); at this point In time, there Is no problem In achieving that average, I THE ABOVE CONSENT ITEMS WERE APPROVED ON MOTION BY COUNCILMEMBER YOUNG SECONDED BV MAVOR PRO TEM KUHN AND CARRIED ON ROLL CALL VOTE AS FOLLOWS: AVES: NOES: ABSENT: Councnmembers Chang, Kuhn, Voung and Lojeski None CouncUmember Ulrich CITY MANAGER This report and recommendation regarding the proposed trip to Taiwan by Police Chief Garner was placed before the CIty CouncJ so that CouncQ could define CIty policy regarding traVel outside the country by appointed officials, As part of the budget procedure, the City Manager reviews and authorizes expenditures of funds for travel by City employees, Trips are always within the continental United States. and are carefully reviewed before they are approved, Recently a request was recelved for Police Chief Gamer to travel to Taiwan to confer with his counterparts. Given that this Is not a budgeted trip; It is out of the country; and it has been proposed that donations be solicited to pay for the trip, this matter was placed before the City Counc" to evaluate: 1) whether or not Counc" chOoses to authorize appointed City officials to travel out of the country on City business; 2) how would CouncU 8/1/95 I . .~ ~ 37:0223 I prefer that the trip be funded; and 3) whether 01 not Councl wantS to authorize that CIty. otllclals be paid tor thelr time whUe traveling. It was noted that an Arcadia Police Department detectllle would accompany Chief Gamer to Talwan. I There are three main purposes for vlsttlng Taiwan: 1) Networking - the Police Department feels that tt needs contacts within the Taiwan law enfOlcemant community to identify illegal activities and suspects which Impact local events; 2) Education - the Peace OffIcers' Standards and Training (P.O.S.T.) views the proposed trip as a potential 'exemplary project' and would credit each sworn person attending with training hours. P,O.S.T, recognizes the need fOl California law enforcement to update Itself with regard to Chinese immigration and the challenges tt presents to communlty-orlanted policing. P.O,S,T. anticipates that the Police Chief would write a thesis describing the Impacts of Chinese Immigration on California law enforcement. and suggesting methodologies fOl serving our Impacted communttles more effectively. 3) Symbolic Commitment. an offlclal visit to Taiwan Is a sign of good faith to our ChInese residents that they are valued and respected. This visit wUl symbolize otllclal acceptance of the local Chinese population as a legitimate part of the community. It Is proposed that the police chiefs of several other San Gabriel Valley cttles would attend as a group, accompanied by selected officers from a few agencies. T entatJvely, the trip would take place the third week of October, 1995. Donations for travel expenses are being accepted by the local Chinese associations; these funds then to be collected by the Taiwanese govemment, who would sponsor the trip. Hotels and meals would be provided by the Republic of Taiwan. In the August 1, 1995 staff report the City Attorney addressed the legallssuas: 1) The proposed trip Is consistent with a public purpose. Accordingly, maintenance 01 the Chiefs on-pay statue tor this work-related trip Is legal. 2) Private funding would constttute gifts that are reportable pursuant to the Political Reform Act and regulations of the Fair Political Prectlces Commission (FPPC). Private donatlons would be subject to the gift limitation of $280 per donOl. The Fundlng-Oonor-Umltatlon Issues wouJd have to be handled In a manner consistent with FPPC requirements. The only expense to the City would be one week's OlHluty time for the Pollee Chief and the asslgned detectllle. Pollee Chief Ron Gamer reviewed the proposal and defined the o~lectllles In considerable detail. In his opinion, this Is a worthwhile endeavOl. He defined the proposal as travel of a small group 01 San Gabriel Valley law enforcement officials to visit Talwari fOl the purpose of establishing police liaisons and studying the Impacts of AsIan culture on police services and demonstrating coIlectIIIe respect and concern for the growing Asian community In the San Gabriel Valley. This Is a legitimate opportunity to establish ties with a foreign pollee agencywhlch can assist the Arcadia Police Department significantly In Its efforts to malntsln a sefe environment In Arcadia. It Is a P,O,S,T. approved study of Police Department ability to provide police seMces In a repldly changing demographic environment. It Is an honest effoo to understand and relate to the Asian element In our community. Chief Gamer believes that It Is Important to do this, and that It serves a legitimate government Interest as well as the long-term best Interest of the City. He believes that Asian crime In the community Is under reported because there Is no bond of trust with the Police Department by the Asian community. I Arcadia Reserve Pollee OffIcer Emmanuel Chan. a twenty year veteran of the reserve program and liaison officer to the AsIan community stated, In part, that It Is his opinion that this personal visit would promote understanding. Exchange of Ideas can create a more 8/1/95 '1 ~~ 37:0224 advantageous sltuatlon for both the Taiwan police force as well as Arcadia's because of Immigrants coming to this COUntry and having problems for law enforcement. In his opinion, I It will enhance sensitivity on both sides. create good wUI. give a better undlll1ltandlng of the Taiwanese culture and minimize a lot of unnecessary dlfflcultles. ConsIderable discussion ensued among CouncUIl1Ql1lbers. CouncUmember Young stated that she has had telephone calls from two Asian residents who thought the money could be better spent by the Pollee OepartrT18nt working here In Arcadia with the Asian community, assuring them of protection from Aslan gangs. CouncUmember Chang said he planned to accompany the group as translator, medical consultant, ete. He Ia very enthusiastic about this proposal and feels that It Is Important that the Arcadia Police Chief establish some rapport with hla counterparts In Taiwan. He stated there are two local AsIan groups that would be Interested In funding the trip -the Arcadia AmerIcan Chinese Association and the Arcadia Chinese Association, with the expenses In Taiwan supported by the Taiwanese government, so no taxpayer funds would be spent. Mayor Pro tem Kuhn expressed concern that there Ia no formal agenda; she would like to know who Ia committed to go, I. e" just Arcadia pollee, other police personnel, City officials, and If so, which ones. Also she has a concern with private citizens paying for trips out of the country for appointed officials. If the benefits are there, she would prefer to consider the trip as a budgeted Item, so that there Is control, accountabUity, and elimination of any perception of Impropriety. Mayor Lojesld noted that he has the same concerns. He would have to justify the trip as a benefit for all 50,000 Arcadia residents, not lust for a small percentage of residents. Mayor Lojesld Inquired If Chief Gamer felt Arcadia would be a safer place as a result of this trip. Chief Gamer responded that he would like to think so, but couldn't guarantee It. CouncUrnember Young noted that there Ia a large Italian population In the City and Councl has to first decide If It wishes to make a decision to allow trips out of the country because I there could be other requests for travel to Italy or other countries for the same reasons. Mayor Lojeskl felt that such trips should be evaluated on a case by case basis. However, he Is not In favor of expending City funds for this purpose, particularly In light of the City's present financial condition. CouncUmember Young felt that donations can lead to a political aspect, and this should not be a political trip. It was MOVED by CouncUmember Young, seconded by CouncUmember Chang that the proposed vlslt to Taiwan be APPROVED, provided the trip Is consistent with the Fair Political Practices Commission guidelines and legal requirements. Mayor Lojeskl said he would prefer that there be a contingency on the vlslt that If this Is a benefit for Arcadia, he would like to see It also be a benefit for the neighboring communities. Crime does not have any boundaries. Chief Gamer has stated that four other police chiefs have been Invited. Mayor Lojeskl said the trip should only happen If a group goes. CouncUrnember Young and Mayor Pro tem Kuhn agreed. CouncUmember Chang felt that It would be unfair to contingent Chief Gamer's travel to Taiwan upon group participation. CouncUrnember Young added en addendum to her MOTION that the trip be composed of a group of police chiefs from nearby cities. CouncUmember Chang did not think this to be reasonable. Mayor Lo/eskl suggested an addendum to the MOTION regarding endorsement of the trip by the Taiwanese government. The City Manager suggested the requirement of a formal written Invitation from the Taiwanese government, including providing hotels and meals. If there Is an offIclallnvltatJon, an official agenda with an official group, then Council wUI know what they are approvlng. She would like to be sure lhat the maximum benefllls going to be gained from such a lrip. MOTION TO CONTINUE, ITEM lOa TO 9-5-95 MTG. It was the consensus of CouncUmembere Kuhn, Lojeskl and Young that a great deal of additJonallnformatlon Is required, Including recommendations from the City Attorney with regard to the FPPC requirements and regulallone.
