PRESENTATIONS On behalf of the Mayor and City CouneU, the Arcadia Pollee Department and the citizens of Arcadia, Mayor Pro ten Kuhn presented the Mayor'S Certificate of SeIvlce to the Community to Arthur J. Fry for his twenty years of volunteer service on the Police AdvIsory CouneU of Car Oubs. The Arcadia Police Explorer Post Is actively Involved In the police safety run which comes under the umbrella of the Counci of Car Oubs. Mayor Pro tem Kuhn expressed appreciation for the time and talent Mr. Fry has given for the betterment of the youth of the community. On behalf of the Mayor and City CouneD, Mayor Pro tem Kuhn presented the Mayor's Certificate for Outstanding Achievement 10 Roberta White, Arcadia's AssIstant Director of Recreation, Roberta White was recendy presented the Helen I. Pontius National Award of Merit by the Women in leisure Services at their Annual Meeting in Long Beach. The award Is given annuaUy to a member who exemplifies organizational goals of bringing women together who are professionally employed In the field of recreation and who promote high standards and stimulate Interest In the profession. The award also requires service wtth other professlonal and volunteer organizations, In addition to selVing on WlLS Boards at both the national and chapter level. Roberta volunteers extensively at her church In Pasadena, assists several Arcadia organizations, and Is active In the California Parl<s and Recreation Society. Mrs. White holds a B. A. PUBUC ConsIderation of Resolution No. 5872 establishing fees for BuDding and Fire Code Appeals, HEARING Appeals of Tille 24 Handicap Accessibility and fees for appeals on Orders to Abate. ~~ I APPEALS - On January 17, 1995, the CIty Council adopted Ordinance No. 2028, establishing a Building BLDG.& FIRE Code Appeals Board and Fire Code Appeals Board. Section 8040.3 of the Arcadia Municipal CODE,HANDI, Code relating to filing of building code appeals and Section 3116.2 relating to fire code CAP ACCESSI, appeals state: "Before accepting for filing any appeal, the City shall, for the purpose of BIUTY & defraying the expenditures incidental to the proceedings described herein, charge and ORDERS TO collect an appeal fee In accordance with the applicable schedule adopted by resolution of ABATE the CIty Council". Said resolution does not establish an appeal fee. In order to recover the cost 01 the appeal procedure, staff recommended thet Section 4 of Resolution No. 5814 be amended to read In part, "Before accepting for filing any appeal, the City shall, for the purpose 01 defraying the expenditures Incidental to the proceedings described herein, charge and collect an appeal fee in accordance with the applicable fee schedule adopted by resolution of the City Council, Thereafter, the Appeals Board shall set a time and place lor hearing the appeal and all persons Interested shall be heard. PUBUC Consideration at Resolution No. 5873 finding the CIty at Arcadia in conformance with the HEARING Congestion Management Program (CMP) and adopting the CMP local implementation report CONGESTION In accordance with California Government Code Section 65089. MANAGEMENT PROGRAM In November at 1992, the Los Angeles County Metropolitan Transportation Authortty (MTA) (APPROVED) adopted a Congestion Management Program (CMP) that requires local agencies to submit o b' .it).':; I annual Local Implementation Reports. The Report must be adopted at a public hearing and Is to consist at a resolution seIf-certlfylng that the City is In conformance. In order to confonn with the requirements at the CMP, the City must perfonn the following compliance actions: ~) ContInue to Implement the Transportation Demand Management (TDM) ordinance (Ordinance No. 1984) and the Umd Use Analysis (LUA) program (Resolution No. 5780); (2) Submit to the MTA, by September 1, 1995, a Local Implementation Report which Includes a seIf-cert1lled resolution at conformance; ~ development actMty report; transportation Improvements credit claims and; dellclency plan status summary. The Report must show that the CIty Is meeting Its congestion reduction responsibilities. Nonconformance with the CMP wW Jeopardize gas tax funds. I In response to questions from Councilmember Chang, staff explained the MfA formula for calculation of congestion "credits" for past transportation Improvements and the congestion "debits" as a result of new development activity. In response to further questions from Councilmember Chang, staff explained that regional transportation improvement programs are not subject to the requirements of the California Environmental Quality Act (CEQA); however, individual projects that are to be Implemented pursuant to a regional transportation program are subject to CEQA, Mayor Pro tem Kuhn declared the public hearing OPEN. No one desiring to be heard, the hearing was CLOSED on MOTION by Councilmember Ulrich seconded by CouncUmember Chang and CARRIED. AYES: NOES: ABSENT: CouncUmembers Chang, Ulrich, Young and Kuhn None Mayor Lojeskl ConsIderation of the Colorado Place Upper "Y" Landscape Improvement Project and authorize reimbursement of City expenses In an amount not the exceed $18,000. CIty and Agency staff propose to use Redevelopment Agency funds to provide landscaping Improvements to the street median located at the intersection of Colorado Place and Colorado Boulevard (Upper "Y"). This Is a funded 1995-96 Capital Improvement Project. The Upper "Y" landscaping Project Is estimated to cost $31,000. It Is proposed to fund the project with a combination of Gas Tax funds ($13,000) and Redevelopment Agency Tax Increment funds ($18,000). Currently, the ralsecl median is an unimproved asphalt surface. This project will Involve removal 01 the asphalt surface, Installation of water and electric service and Improving the area with Irrigated landscaping, In Fiscal Year 1993-94, the City Maintenance ServIces Department constructed landscaping Improvements In the Lower' yo median located at Huntington Drive and Colorado Place. These Improvements have substantially Improved the appearance 01 the median and complement the heavUy landscaped and well malntalned Santa AnJta 1M and Race Track properties to the west and south. MakIng similar Improvements In the Upper' yo median Is a loglcel extension 01 this beautification program, Redevelopment Law (Health and Safety Code Sectlon 33679) requires a CIty CounclI public hearing whenever redevelopment funds are proposed lor use to finance public Improvements. CouncUmember Ulrich commented that, as a former Arcadia Beautiful Commissioner, he Is pleased to see these efforts to beautify the CIty and commends the staff. In response to questions from CouncUmember Chang, staff gave the dimensions of the site to be improved, and explained that the project Is being funded with a combination of Redevelopment Agency funds and gas tax funds because the Redevelopment Agency does not have sufflclent funds avaUable for the project. Mayor Pro tem Kuhn declared the public hearing OPEN. No one desiring to be heard, the hearing was ClOSED on MOTION by CouncUmember Young, seconded by CouncUmember Ulrich and CARRIED. Arcadia Section. Victor Pan, 32 North Street. Arcadia, stated, In part. thai he Is present 10 support the proposed travel to Taiwan by the Arcadia Police Chief. The trip will help to establish a relationship between police systems In Taiwan and In Arcadia. Also, it will ensure support from the Chinese community. II Is his understanding lhat the Arcadia Chinese America Association will sponsor the air fares for two persons; the Taiwanese government will pay the room and board In Taiwan. He urges Councllo approve this trip. MATTERS FROM ELECTED OFFICIALS CouncImember Chang noted thai the Pasadena Star News sometimes prints the wrong picture with the article of an individual about whom they are reporting. This happened last AprI when they erroneously substituted his wile's photograph for his photograph. He suggests the Star News Improve the editing of the photographs. Counclmember Chang wishes to keep In constant contact wlth his constituents. Since he has a busy medical practice, and a lot of conference meetings to allend, as well as social obligations, he plans to appoint community liaison persons to help him with communications 8/15/95 5 CHANG (Sen. Currently these are Rose MIaII, Mike Ash and Mike De Oria. CouncUmember Chang requested that cttizens interested In helping by becoming community I liaisons, please call him or wrtte. CouncUmember Chang attended State Senator Mountjoy's annual fund raising party at the Monrovia museum one week ago. About 300 persons attended this event. He met State Assemblyman Bob Margett there. The special speaker of the night was BUI Jones. Secretary of State, who spoke about elections. It was a very Informative meeting and he enjoyed tt very much. CouncUmember Chang received a fax from Camomia State Treasurer, Matt Fang. Since his victory in the campaign for CalWomla State Treasurer, Mr. Fang has been working very hard to implement his taxpayer protection plan, and be an advocate for CalWomia taxpayers. He was recently appointed to the National Tax Reform Commlsslon, a blue ribbon panel of national leaders and tax experts. This Is really a very helpful step In Matt's plan to help taxpayers. Matt had been asked by Republican leader, Bob Dole; House Speaker, Newt Gingrich and tax reform advocate, Jack Kemp to serve on this Commission. This Commission wUI explore ways to reform the Federal tax system to make tt more efficient, simple and fair for taxpayers. Mr. Fong Is promoting much needed changes In our tax system, so that tt rewards, not punishes, taxpayers, whUe producing for society. Matt Fang wants to remove Federal govemment obstacles to the American economic engine through a simpler tax system that lowers tax rates to spur economic activity, whOe Increasing tax deductions for working famOies and smaU businesses. The Commission plans a report by the end of the year, so Matt Fang said W CouncUmember Chang has any tax reform Ideas to call him. By the same token, CooncUmember Chang would like to hear from the clllzens of Arcadia about anything they think should be done to reform our tax system. He and Matt Fang can be contacted by telephone. CooncUmember Chang stated there had been a scoping meeting on August 9, regarding the preparation of an Envlronmentallmpact Report for the proposed entertainment complex project on the race track property. SOO-alO people attended the meeting, and the residents had an opportunity to express thelr concerns about the project. He wants to notify the cttizens of Arcadia that he has heard their voice, and tt has gone into his right ear and stayed In his brain to be digested, so when time comes for decision an the project, he won't forget these cttizens, I ULRICH CounclImember Ulrich also was In attendance at last week's public scoping meet1ng (Santa Anita regarding the proposed entertainment center. He commended Rick Gomez, Deputy CIty Entertainment Manager /Developrnenl ServIces Director for the way In which he conducted the meet1ng. Complex It was extremely well organized and every speaker had an opportunity to express opinions. Scoping Mtg.) He also commended the citizens for particlpating In this meeting and noted that It will be a long time unt1I decisions are made regarding this project. More public hearings are to come with opportunities for cltizan participation. (Downtown 2000 Work Stoppage) 06 5'(1-0 :~<" CounclImember Ulrich asked the City Manager for the Iatesl Information on the work stoppage on the Downtown 2000 Project. The CIty Manager responded that things are changing In that area from day to day. There Is an operating engineers strike at the batch plants that Is affecting the operating engineers for Sully-MUler. As of the middle of last week, there are no construction workers on the project for Sully MUler. Non-unlon people - landscape people, Irrtgatlon people. etc. are still working there. but the majorlty of the work 8/15/95 I 6 I ULRICH (Changes in Property Ownerships) YOUNG (Santa Anita Entertainment Complex Scoping Mtg.) KUHN (County Sanitation Dlst.Ocean Trip) 37:0233 has stopped. City staff, consulting engineers and special outslde counsel are reviewing the City's alternatives to see what can be done to get the project back on track. There is to be a meeting the following day to consider options, from an engineering and legal point of view. CouncKmember Ulrich noted some recent changes of property ownership in the City - the Sizzler property on Baldwin Avenue is being purchased. It is a valuable property, and he is glad to see that ~ wKI be an active business again. The Broadway Department stores are to be taken aver by Federated. That will have an Impact on Arcadia. He hopes that it wUI work to the City's advantage by possibly getting one of their flagship stores In Arcadia. The City should encourage this W there is anything that can be done. CouncUmember Young also commented on the recent seoping meeting. Rick Gomez should be congratulated - - he kept the meeting on the topic. He did ~ very nicely. When meetings are held at the Community Center, a more affic/ent arrangement of chairs can be accomplished W they are set up In a theater style, especially on occasions when the little stage is not to be used. The room wUI hold approximately 600 people, maximum. All the chairs could have been used for the August 9th meeting. Mayor Pro tern Kuhn went on the County Sanitation District ocean trip on August 5. This is an Informative trip leaving from San Pedro and saYing up the coast to the Palos Verdes area to a 300-500 foot depth where they send out nets and bring in fish and wDdlWe, and monitor the levels of mercury and DDT, etc. The trip was very informative and worth while. L A. County Supervisor Gloria Molina was also on the ocean trip. Mayor Pro tern Kuhn attended a three day Edison High Sierra Workshop, August 9-11, sponsored by the Southem CalWomla Edison Company, thanks to Vincent Haydel, Regional Manager of the Southem CalWomla Edison Company. The workshop reviewed the history and Inspections of the Big Creek Hydroelectric Power development. It Is a fantastic education. This engineering feat was envisioned a long time ago by engineer John Eastwood; built and flnanced by Mr. Huntington. This may be one of the last such trips, so she was pleased to be able to go. Also, attending on that trip was Michael De Wees, Publisher of the SIemi Madre News. August 24. She also reminded residents of the ground breaking C8lemony for Orange Grove Impravement on Friday, August 25, 10:00 a m. at the Baldwin Avenue Reservoir at comer of BaIdwln and Orange Grove Avenue. COUNClL- MEMBER CHANG (Police Work Schedule) I ADJOURN- MENT (Sept.5,1995 7:00 p.m.) ATTEST: 37:0237 Mayor Pro tem Kuhn read a press release dated August' 5, 1995: "On August 1, 1995, the City of Arcadia and the Police Relief Association reached agreement on a two year labor contract which wUI be in effect untU June 30, 1997. As part of this contract, each member of the Assoclallon will receive a one-time payment of $200. on December 1, 1995. Beginning in January. 1996. a 3/12 work schedule wUI be implemented on a trial basis. This schedule will be monitored and analyzed by Police Chief Ronnie Gamer to assess its effectiveness. If CIty revenue sources increase, and W the State of CalWomia does not take back, reduce or relocale current City revenues, unit members will receive a guaranteed 2% salary Increase in July, 1996, and a conditional 2% salary Increase in January, 1997. The City Council is pleased that the negotiations were successful, and expressed appreciation to the Arcadia Police Relief Association for their cooperation in working with City staff to resolve outstanding issues." Councilmember Chang commented: "'just want to mention something about this 3/12 working schedule. I want to thank the Police Chief for his willingness to try this new work schedule, which has been used In many other cities, such as South Pasadena. Beverly Hills, Monrovia, Palos Verdes, Los Angeles, etc. I would also thank my colleagues who approve this work schedule on a trial basis. I have been a believer and advocate for this 3/12 work schedule because increased time that policemen stay with the families Increases morale. it also decreases the sick leave and does increase the patrol force on the street, and Increase the safely of lhe street subsequently. "may also save lhe CIty costs. "was fatigue and communication - these are minor problems. I wish this program success."
