MINUTES CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING DECEMBER 19, 1995 The City Council and the Arcadia Redevelopment Agency met in a regular meeting at 7:00 p, m" Tuesday, December 19, 1995 in the Arcadia City Hall Council Chamber, Mr, Kim Knight. First Reader, First Church of Christ, Scientist Arcadia Police Chief, Ronnie Garner PRESENT: ABSENT: Councilmembers Chang, Kuhn, Ulrich, Young and Lojeski None (NOTE: Agenda items I - 4 are incorporated into the Adjourned Regular Meeting held this date,) SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGEND~ ITEMS - REPORTSI ANNOUNCEMENTSlST A TEMENTS The City Manager reported on the present status of the Downtown 2000 Project, This week work is being done on instaIlation of pedestrian lights, traffic signals, intersection crosswalk paving bricks at Fifth, Gateway and mid-block cross walks, The storm drain has been completed, and if everything goes on schedule, landscaping on northside Huntington Drive may be started this week. The goal is to finish all pedestrian seating, the ornamental rock work planters and landscape work by the end of Christmas week, After the first of the year, we should see more lights on First Avenue, landscaping should continue on Huntington and First Avenue, and sidewalks and curbs should be completed, In February we will start the resurfacing and re- stripping on Huntington Drive, The landscaping will be completed and the lighting will be put in place and ,at the beginning of March, we will see the sluny sealing, testing of systems and the grand opening, The downtown merchants have been very cooperative, We have been very pleased with the contractor and City staff, We are on schedule and on budget, and should officially open by the middle of March, QUESTIONS FROM CITY COUNCIUREDEVELOPMENT AGENCY REGARDING CLARIFICATION OF AGENDA ITEMS None 12/19/95 7. 8. Hosp. ) tJ13U' '1:0 ULRICH (Sergeant Randy Kirby- Officer of the Year) (Tournament of Roses Activity) 37:0372 AUDIENCE PARTICIPATION I Vincent Folev, 320 Cambridge Drive. stated, in part, that he is present tonight as Pres!dent Elect of the Arcadia Tournament of Roses Association, He invited Council and members of the viewing audience to the Float Preview Party to be held Wednesday, December 27, This is the last fund raising event of the year, This is a chance for people to meet Arcadia's queen and court; and get an up-dose view of Arcadia's float, as well as other floats being constructed, and in the final stages of flowering at the Rosemount Pavilion. next to the Rose Bowl. Also grandstand reserved seating is available for the parade on New Year's Day, Interested parties may contact the Chamber of Commerce, On behalf of the Arcadia Tournament of Roses, he wished the Council and members of the Arcadia community a most happy holiday season and prosperous new year, Mayor Lojeski noted that this Tournament of Roses infonnation will be placed on the Comunity Bulletin Board, Bartlara Ellison. 620 West Huntington Drive, stated, in part, that she is part of the group, "Neighbors for Arcadia", It is still a viable group, They have had numerous telephone calls and letters from people who are 'anxious to encourage the group to circulate the petition. so that the question of whether or not the people of Arcadia want what Santa Anita would like us to have will be on the ballot. MATIERS FROM ELECTED OFFICIALS Councilmember Chang stated in part that last Thursday Council met with the Arcadia School Board, A number of ideas were exchanged and they found areas where the City and the School District can work together, Le" the 3fter school activities, The Arcadia Police Department has developed programs, such as DARE" which are working in the schools, PAC.E, 2000 is part of the program that the City and School District have developed for the benefit of the children, Taking care of the children is not the sole responsibility of the School District; it is also the responsibility of City government. I Councilmember Chang noted reports on after school activities for the students, More than 500fo of the middle school and high school students would like to have the Library open on Sunday afternoons, Parents of this group of students agree, He would like staff to look into this matter to see if there is enough funding, Councilmembcr Chang noted an article in the STAR NEWS which indicated that the Von's Corporation pledged $300,000 to Arcadia Methodist Hospital's new patient tower, This was a nice thing for Von's to do, Councilmember Chang hoped that next year they might do something for the Arcadia Public Library Foundation, Councilmember Ulrich noted that the had attended the Christmas dinner of the Arcadia Police Officers' Association, Sergeant Randy Kirby was announced as the Officer of the Year, That is a real honor, and according to the Police Chief, if anyone deserves it, Sergeant Kirby does, The community may want to join in congratulating Sergeant Kirby, We are all very proud of our Police Department. Councilmember Ulrich noted that Mr, Foley had already announced the Arcadia Tournament of Roses activities, He added that people can have the opponunity to help decorate the float. Reviews) 'I' l'ITi; 1,- ;"", -.' 3~:0313 Councilmember Young also offered congratulations to Sergeant Kirby, She knows he is active in the new police programs, Mayor Pro tern Kuhn noted that she had been driving in downtown Arcadia on Hunungton Drive during the rain storm last week, Arcadia did very well -- the storm drains worked, Monrovia was completely flooded on Huntington Drive near the freeway on-ramp, Mayor Pro tern Kuhn noted that she had served on Congressman Dreier's Academy Board with people from other cities representing West Point. the Naval Acadcmy and the Merchant Marine The Board interviewed twenty-five candidates for Congressional appoinunents - six were from Arcadia, Serving on the Board was a wonderful experience, These quality young people really serve as an inspiration to all of us, LOJESKI Ol?n :./~or Lojeski congratulated Arcadia City Attorney. Arguments on Tonight's Agenda) //)S()- ~(? tJ.->i' CITY CLERK (Election Update) ;:_"'~;,~I.. ,(-~ fV -,j' Following questions from Mayor Lojeski, and on advice of the City Attorney, it was MOVED by Councilmember Ulrich, seconded by Councilmember Young and CARRIED on roll call vote as follows that. pursuant to Government Code Section 54954,2(b)2, the need to take action and review the arguments for Propositions B, C and 0 to be placed on the ballot for the April 9, 1996 municipal election arose after the agenda was posted. and Council was not aware of the deadline (December 26) until after the agenda was posted, AYES: NOES: ABSENT: Council members Chang, Kuhn, Ulrich, Young and Lojeski None None The City Clerk announced that election preparations are well under way, The election will be held in April of 1996, There will be two Council seats up for election, as well as the City Clerk position, and the previously mentioned amendments to the City Chaner, Nominations for the City Council and City Clerk seats opened December 18, 1995 and the nomination period will run through January 12, 1996, If the incumbent does not file. the nomination period will be extended to January 17, 1996, according to the election Code for that particular office only, The City Clerk issued nomination papers yesterday to four individuals - Mayor Dennis Lojeski, Bob Hartlicb!, Gino Roncelli and Vincent Foley, The City Clerk also drew papers yesterday, 3 12/19/95 9, ROLL CALL 9a, REDEVELOPMENT AGENCY ANNUAL REPORT FOR FY 1994-95 (APPROVED) 0610- I~-, 37:03;':' MEETING OF THE ARCADIA REDEVELOPMENT AGENCY AND CITY COUNCIL ' I PRESENT: ABSENT: CounciV Agency Members Chang, Kuhn, Ulrich, Young and Lojeski None California Redevelopment Law requires that all redevelopment agencies file an annual fiscal and housing activity repon with the Legislative Body (City Council), the State of California Department of Housing and Community Development (HCD) and State Controller with six months of the end of the fiscal year, The repon to satisfy this requirement was presented by the City Manager, Since the document is to repon on Agency status for Fiscal Year 1994-95, the information provided within it represents Agency activities as they existed as of June 30, 1995, In response to a question from Mayor/Chairman Lojeski, the City Manager explaint:d that, in the past. redevelopment agencies could make findings that they could not provide low income housing funding due to other priorities, Following changes in the law, the Agency adopted a housing prioritization program, Staff will be submitting more formal proposals for housing for low and moderate income families in the City to the Agency for consideration, The Agency has a five year period of time, which began in 1994, to initiate a housing activities program. If the Agency fails to complete the housing requirements, the City will lose those funds to the County, So it is in the Agency's best interest to provide housing. for senior citizens, first time home buyers, subsidies to various programs, etc, Once the Downtown 2000 Project is completed, more specific proposals and information will be provided, This should take place by the beginning of the next fiscal year, I In response to a question from Member Chang, staff replied that the requirement to construct office buildings on two propenies within the Nonhside project on Santa Clara is subject to a 1987 DDA and can be changed to other types of construction if the Agency wishes, Member Ulrich noted that the repon contains an audit by a CPA firm showing that the books were audited and everything is in good order, It was MOVED by CounciVAgency Member Kuhn, seconded by CounciVAgency Member Young and CARRIED on roll call vote as follows to APPROVE the Redevelopment Agency Annual Repon for FY 1994-95 and DIRECT staff to transmit the repon to the State of California Department of Housing and Community Development and the State Controller, AYES: NOES: ABSENT: CounciV Agency Members Chang, Kuhn, Ulrich, Young and Lojeski None None 9b. 06 Ja - ~v . I ,I PARTIAL LOAN The Arcadia Redevelopment Agency Tax Increment Fund exists for the re-payment of PAYMENT TO interest and principal on long term debt. The source of funds for these payments is tax CITY & CITY increment revenue and each year the Agency repays the City any loans outstanding RE- LOAN TO between the City and the Agency to the extent that fimds are available in the tax ARA & EXTEND increment fund at June 30, The annual repayment of existing debt between the TERMS Agency and the City is recorded in order to utilize tax increment funds for their FY 1995-96 (APPROVED) I 4 12/19/95 I I I ADJOURNMENT 10. lOa. CHAPMAN WELL - W.O. 566 (APPROVED) IJ 7 )-CJ - 1;'0 3;:03~5 intended use and to formally recognize and document the loans between the City and the Agency annually, The lax increment fund at June 30, 1995, will have an estimated cash balance of Sl,109,474, Staff recommends that the Agency Board take formal action to remit these monies to the City in partial payment of existing loans, and for the City to re- loan these funds to the Arcadia Redevelopment Agency Project Fund for the Agency to use to further pay expenses and acquire property according to the directives of the Agency Board, In addition, the Agency and the City should roll~ver or extend the repayment of the balance of all remaining loans to June 30, 1996, It was MOVED by Council/Agency Member Young, seconded by CounciUAgency Member Ulrich and CARRIED on roll call vote as follows to DIRECT the Agency to pay SI,109.474 of loans outstanding at June 30, 1995 to the City of Arcadia, and that the City ACCEPT said payment; and, that the Agency re-borrow SI,109,474 and the City of Arcadia re-loan said monies for deposit into the Agency Project Fund; and, that the City EXTEND the time frame for the re-payment of all debt between the Agency and the City, and the Agency ACCEPT, said extension to be due and payable on June 30, 1996, In response to a question from Member Chang. the Administrative Services Director said that the funds will come from the Capilal Outlay Fund and the Facility Construction Fund, The money will eventually be repaid to those funds, and since they are non-restricted funds, the money can then be transferred into the General Fund if Council so wishes, AYES: NOES: ABSENT: CounciU Agency Member Chang, Kuhn, Ulrich, Young and Lojeski None None The Arcadia Redevelopment Agency ADJOURNED to January 2, 1996 at 5:30 p, m, CONSENT ITEMS AUTHORIZED the City Clerk to advertise for bids for the rehabilitation of Chapman Well - Worlc Order 566, Funds are available for this project in the amount of S115,OOO in the Capital Improvement Budget FY 1995-96, to cover the cost of engineering, installation and contingencies, THE ABOVE CONSENT ITEM WAS APPROVED ON MOTION BY COUNCILMEMBER CHANG, SECONDED BY MAYOR PRO TEM KUHN AND CARRIED ON ROLL CALL VOTE AS FOLLOWS: AYES: NOES: ABSENT: Councilmembers Chang, Kuhn, Ulrich, Young and Lojeski None None 5 12/19/95 11. lla, USE POLICY ARCADIA COMMUNITY CENTER (CURRENT USE POLICY RETAINED) c/7JO-oU!) 37:0376 CITY MANAGER I Pursuant to a request from a group knO\m as "Neighbors for Arcadia" for use of the Com,munity Center facilities for meetings regarding the proposed Santa Anita Entertainment Center project, as well as the possibilities of other requests for political gatherings prior to the April 1996 election, the City Attorney and Recreation Director have reconunended a review of the Conununity Center Use Policy, The current Use Policy adopted in 1993 precludes "political gatherings" except for public candidate forums, According to the City Attorney, insofar as the prohibition pertains to prospective office holders, it is consistent with Section 90S of the City Charter which provides that "no person shall use the '" facilities of the City for the purpose of furthering a campaign for public office", The City's Use Policy is clearly candidate-<lffice holder focused, It is not clear as to whether there was any intent or interest in extending the use prohibition to .political type gatherings" that pertain to ballot measures and are not designed to promote candidates, The City Attorney has opined that a narrowly drawn allowance for this type of activity would be permissible under the City Charter, For example, it equid be worded to allow "Political gatherings, not pertaining to campaigns for public office, but for the purpose of discussing or promoting potential initiative ballot' measures directly applicable to the City of Arcadia", Such use for a fee and open to the public is analogous to Priority II uses in the current Policy, The City Manager noted that this has been a very restrictive policy and was so intended at that time, Since that time the questions have arisen of defining "political gatherings" and should or should not the Conununity Center be used for these activities? The Use Policy drafted in 1993 was drafted to ensure that the Conununity Center be used by priority and that the priority-<lne users are City events, Senior Citizen events, School events, Historical events, etc, Only if those groups were not using the facility, could it then be made available, on a payment basis, for other activities, I It was MOVED by Councilmember Ulrich, seconded by Councilmember Chang to broaden the policy to include ballot measure discussions as a valid use for the Conununity Center, Considerable discussion ensued among Councilmembers as to whether or not to change the current Use Policy, Mayor Lojeslti and Councilmember Young felt that the Use Policy in the present fonn has been working very well, Councilmember Young felt a lot of perimeters were needed. Mayor Lojeslti agreed, Councilmember Young felt more study was needed. Mayor Pro tern Kuhn agreed, Councilmember Chang felt that the Community Center facilities should be available to some of the politically oriented requests, Councilmember Chang said the policy should be focused on the definition of .political gathering", Councilmember Ulrich, in view of points raised during' the discussion, agreed that the issue required more study and wished to withdraw his motion, on consent of withdrawal of the second by Councilmember Chang, Councilmember Chang disagreed, so the motion was put .to the vote, AYES: NOES: ABSENT: Councilmember Chang Council member Kuhn, Ulrich, Young and Lojeslti None I 6 I2I19/9S I I I !lb. CONSIDERATION OF BALLOT ARGUMENTS FROM COUNCIL FOR MUNICIPAL ELECTION APRIL 9, 1996 IO.3f) -;;0 ";SP ADJOURNMENT (Jao,2,1996 5:30 p.m.) ATTEST: 37:03i7 The MOTION failed to pass, Councilmember Ulrich suggested that the matter be brought back to Council for funher study in JanU3l)', The City Manager said this could be scheduled for the second Council meeting in JanU3l)', After further discussion, it was the consensus of Council that the present Use Policy for the Comunity Center has been working very well since 1993 and did not see a need to change it. It was MOVED by Councilmember Young, seconded by Mayor Lojeski and CARRIED on roll call vote as follows to leave the Arcadia Community Center Use Policy in place as it is today, AYES: NOES: ABSENT: Councilmembers Kuhn, Young and Lojeski Councilmember Chang and Ulrich None The MOTION carried, Consideration of Ballot Arguments penaining to Propositions B, C and D to be considered in the municipal election on April 9, 1995, Councilmembers will be listed as authors on Propositions B and C, Councilmember Chang will not be listed as an author on Proposition 0, Proposition B contains general clean-up provisions with regard to the City Charter, Proposition C involves changes in the City Clerk office from elected to appointed, Proposition D involves changes in the Library organization and the status of the Library employees, Considerable discussion ensued among Council members, A number of changes were requested to be made in wording of the various propositions, The City Attorney will make the required changes in order to meet the December 26, 1995 deadline for filing the arguments, In response to a question from Concilmember Chang, the City Attorney said that the deadline for filing arguments regarding the Propositions had been publicized, The City Attorney will return the arguments with the changes to Councilmembers for review, At 8:20 p, rn., Council ADJOURNED to Tuesday, JanU3l)' 2, 19% at 5:30 p, m, in the City Council Conference Room for an Adjourned Regular Meeting to conduct the business of the City Council and the Arcadia Redevelopment Agency and any Closed Session necessary to discuss personnel, litigation matters, and evaluation of properties, or of the City of Arcadia ~~<,.~/~~~ J D.
