(Kovacic) It was MOVED by Councilmember Margett, seconded by Councilmember Fasching and CARRIED, that ordinances and resolutions be read by title only and that the reading in full be WAIVED. The City Attorney announced that,"the City Council met in a CLOSED SESSION prior to this meeting pursuant to Government Code Section 54956.9(a) to discuss two workers' compensation matters that are in litigation; one involving Piland vs. Arcadia and the other involving Duda vs. Arcadia". PRESENTATION Tennis Coach Paul Dewhart introduced Miss Pam Trump. Miss Trump has played on the tennis team for the past four years, and is the CIF Tennis Finalist. She played 216 sets and lost only two. Mayor Ciraulo, on behalf of his colleagues on the City Council, presented the Mayor's Certificate of Commendation and Recognition of Outstanding Achievement to Miss Trump with best wishes and congratulations. AYES: Councilmembers Fasching, Harbicht, Loj eski, Margett and Ciraulo None None NOES: ABSENT: I 1/4/94 lb. SENIOR CITIZENS' COMSN. (Congregate Meals Prog. Community Center) (APPROVED) 2. PUBLIC HEARING (Com" 1 & Indust.Re- cycling Program - Service Rates) (APPROVED) 36:0004 An Ad Hoc Committee was formed by the Senior Citizens' Commission to explore the needs of older adults in Arcadia, and to create and prioritize programs that would fill those needs. It was found that there is a need in Arcadia to provide a low-cost daily meal program to senior citizens. The purpose of the Congregate Meal program is to provide a nutritionally sound meal served in strategically located congregate centers. While the Congregate Meals program has special emphasis on low- income and disadvantaged elderly, there is no means for testing eligibility and anyone 60+ may participate. Participants are encouraged to contribute toward their meals. The donation is anonymous and in the amount the senior deems appropriate. The Program would be administered and supervised under the City of Arcadia Recreation Department, and operated by the YWCA Intervale Senior Services under contract with the Los Angeles County Area Agency on Aging. The contract would be effective July 1, 1994 - June 30, 1995 and be reviewed annually. A total commitment of $6,000 by the City of Arcadia would be necessary to provide congregate meals at Arcadia Community Center. Monday -Friday. It is the' intent of the Senior Citizens' Commission to apply for Community Development Block Grant funds to offset costs for the Congregate Meal Program at the Community Center, should the City Council approve the application for congregate meals. I It was MOVED by Councilmember Harbicht, seconded by Mayor Pro tem Lojeski and CARRIED on roll call vote as follows to APPROVE the use of the Arcadia Community Center for a daily congregate meals program Monday through Friday; AUTHORIZE staff to submit a proposal for such a program operated by the YWCA Intervale Senior Services under contract with the Los Angeles County Area Agency on Aging; and APPROVE the allocation of $6,000 to provide a Congregate Meals program. Councilmember Margett stated, in part. that he is opposed to implementing this federally subsidized program because he believes that the City itself could undertake such a program to help the senior citizens in this community who truly have a need for such help. There may be people rotating from one community to another to see what is on the menu that particular day to be able to pick up a meal for $1.25. The expenditure here is not dramatic, but duplicating this in every city in the United States eventually costs a great deal of money. As long as the federal government is involved, this program will be with us forever. The country will never clear up its debts as long as the citizens subscribe to these programs. It is his recommendation that this community set up such a program, and thereby be able to maintain closer control over the cost. Councilmember Fasching noted that a very expensive kitchen is located in the Community Center which has. for the most part, never been used. He will vote for this program, and emphasized that he would like to see silverware rather than plastic utensils provided with these meals. AYES: NOES: Councilmembers Fasching, Harbicht, Lojeski and Ciraulo Councilmember Margett (He is against joining the federal program - he feels this community should set up its own program for meals for seniors.) None I ABSENT: The California Integrated Waste Management Act (AB 939) requires cities and counties to divert 24% of their waste from landfills by 1995 and 50% by the year 2000. The City adopted a Source Reduction and Recycling Element (SRRE) which identifies how the City will comply with the Act. Staff reviewed the status of the on-going single family curb-side recycling program, the pilot multiple-family recycling program, the pilot backyard composting program, and proposed used oil recycling program in conjunction with the California Integrated Waste Management Board and Chief 2 1/4/94 36:0005 Auto Parts. Also, the upcoming Newco residential contract extension recommends implementation of a City-wide multiple- family recycling program and the composting program. 1 A commercial/industrial recycling program is one of the programs outlined in the City's SRRE. Currently, the City of Arcadia diverts 13% of its total refuse stream from landfills. The introduction of a commercial/industrial recycling program should increase the City's diversion rate by an additional 16%. Representatives from the City Councils. Chambers of Commerce and staff of Arcadia, Duarte and Monrovia selected Zakaroff Recycling Services from the five vendors who submitted proposals. The proposed agreement with this firm is for an initial five year period. The contract would automatically renew every two years provided that Zakaroff Recycling Services meets the performance standard of at least _a 40% diversion rate of the commercial/industrial waste stream for each City by the end of the second anniversary of this contract and every year thereafter. The proposed monthly fee structure for the commercial/industrial recycling program is listed in Resolution No. 5762. By implementation of all these programs, it is anticipated that the City will achieve a 23% diversion rate by 1995. ORDINANCE Staff presented for introduction and read the title of Ordinance NO. 2000 No. 2000: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF (INTRODUCED) ARCADIA, CALIFORNIA,AMENDING THE ARCADIA MUNICIPAL CODE BY ADDING PART 3 TO CHAPTER 1 OF ARTICLE V TO IMPLEMENT AND PROVIDE REGULATIONS FOR A COMMERCIAL AND INDUSTRIAL RECYCLING PROGRAM". RESOLUTION NO. 5762 (ADOPTED) Staff also presented and read the title of Resolution No. 5762: "A RESOLUTION OF THE CITY OF ARCADIA, CALIFORNIA, SETTING SERVICE RATES FOR THE COMMERCIAL AND INDUSTRIAL RECYCLING PROGRAM WITHIN THE CITY OF ARCADIA". In response to questions from Councilmembers, staff said it will be possible for two business to share one recycling container if it is determined that they do not generate enough waste to warrant two containers. Also, Zakaroff is willing to amend the agreement to define the green waste pickup requirement as a full 33 gallon container per pickup. Mayor Ciraulo declared the public hearing OPEN. No one desiring to be heard, the public hearing was CLOSED on MOTION by Mayor Pro tem Lojeski, seconded by Councilmember Fasching and CARRIED. I Councilmember Harbicht commented that he will vote for this measure because there is no alternative. This will amount to an annual cost of over $300,000 to the businesses of Arcadia, with a minimal effect on the waste stream. This is another example of short-sighted law adoption by the State which passes on to the taxpayer the cost of a program which is of minor benefit to society as a whole. It was MOVED by Councilmember Fasching, seconded by Mayor Pro tem Lojeski and CARRIED on roll call vote as follows that Ordinance No. 2000 be and it is hereby INTRODUCED. with Section 5l30(a) of said ordinance to read, "a full 33 gallon container of green waste. . ."; and that Resolution No. 5762 be and it is hereby ADOPTED. NOES: ABSENT: Councilmembers Fasching, Harbicht, Loj eski, Margett and Ciraulo None None AYES: 3 1/4/94 3. PUBLIC HEARING TENT.PARCEL MAP 93-004 (2020 S. Santa Anita AVe. - Chris Const., Inc:.) (APPROVED) 36:0006 Public Hearing for consideration of Tentative Parcel Map 93-004 (No. 21709), to subdivide the existing lot into two lots at 2020 S. Santa Anita Avenue (Chris Construction. Inc., applicant). One lot will front on Santa Anita Avenue and the second lot will front on Las Flores Avenue. The Planning Commission at its November 23, 1993 meeting voted 2 to 2 to approve the parcel map. The tie vote resulted in "no action". and TPM 93-004 was automatically brought before the City Council. Mayor Ciraulo declared the public hearing OPEN. Gordon Maddock, Baldwin Realty, 900 South First Avenue, stated, in part, that staff has recommended denial based upon the interpretation of the goals of the General Plan. The General Plan was revised in 1990. but the underlying zoning has never been brought into compliance with the goals of the General Plan. '1 There is a disparity between the General Plan and the zoning ordinance. However, the proposed lot split does comply with some elements of the General Plan. Both of the proposed lots exceed the minimum lot size of 7,500 square feet, in one case by 62%, and in the other case by 33%; however, they are significantly smaller than the lots in the surrounding area. There are no other modifications required. He feels it to be unfair to have an interpretation of the General Plan come up with something that is so dramatically different. The zoning ordinances and the Code should be brought into compliance. It is his opinion that the proposal is in conformity with the other corners on Santa Anita Avenue. This will be an attractive development with 3,000 square foot houses. This will not result in overcrowded lots. Mr. Maddock also submitted a letter to the Council from a homeowner. David Olsen, Chris Construction, Inc., 115 E. La Porte Street, stated, in part, that when this parcel map was heard before the Planning Commission in November, he spoke on several issues as to why he thought this would be an excellent development for the City. The two houses they have designed will fit without any modifications within the required special setbacks of the two new proposed lots. Mr. Olsen distributed an analysis of the lot sizes in the general area, and called attention to the color renderings of the elevations of the proposed houses. 65% of the lots in this area are equal to or smaller than those proposed. and this lot split does meet the goals set out in the General Plan. Milt Bade, Chris Construction, Inc.. 115 E. La Porte Street, stated, in part, that this company has done a lot of subdivisions and tracts in the City, and have always met the criteria that Arcadia wants for homes and tracts. Renderings and plans were shown of the houses planned to be constructed on these lots. The homes will be compatible to the area and an asset to the City of Arcadia. Jan Gerhardt. 135 East Las Flores, stated, in part, that she has seen many changes take place in the area during the thirty years I she has lived there and they have all been improvements. She has noted that the rear yard of the property that faces on Santa Anita Avenue is a eyesore when one drives down Las Flores Avenue. Also she would rather see two 3200 square foot houses than one 8500 square foot house on that property. A new home on that location would be a definite improvement. Chris Construction has built houses that are the most compatible with the homes that are in Arcadia. Mia Kim, 2016 South Santa Anita, stated, in part, that she disagrees with this planned construction because she lives on the next property and it will disturb her privacy. No one else desiring to be heard, the public hearing was CLOSED on MOTION by Councilmember Fasching, seconded by Mayor Pro tem Lojeski and CARRIED. 4 1/4/94 1 1 4. PUBLIC HEARING (Backflow Prevention Devices Screening) (APPROVED) 30:0007 Considerable discussion ensued among Councilmembers. It was agreed that this proposal is consistent with the surrounding properties and is not in conflict with the General Plan. It was MOVED by Councilmember Harbicht, seconded by Mayor Pro tem Loj eski, and CARRIED on roll call vote as follows to APPROVE Tentative Parcel Map 93-004 (No. 21709); FIND that the project together with the provision for its design and improvement is consistent with the Arcadia General Plan; APPROVE and FILE the Negative Declaration and FIND that the project will not have a significant effect on the environment; and APPROVE the proposed project. subject to the conditions of approval outlined in staff report dated January 4, 1994. AYES: Councilmembers Fasching, Harbicht, Lojeski, Margett and Ciraulo None None NOES: ABSENT: The City Council, at a study session on June 8, 1993, approved a policy to screen backflow prevention devices for all new multiple-family, commercial and industrial projects. Specifically, on backflow devices with piping sizes of 3 inches or larger, screening is required by either a masonry wall or planter box. Devices with piping sizes of 2 1/2 inches and smaller must be screened by either planting or a masonry wall. It was the consensus of the City Council that such a policy was necessary because the unscreened devices have not been aesthetically pleasing to see within the City's existing development. In addition, the Council requested staff to review the possibility of requiring the screening of backflow prevention devices to be retroactive. In response to this request, staff met with the City Attorney and was advised that a text amendment would be necessary, which would incorporate the "screening policy" into an ordinance with enforceable provisions for making the required screening retroactive. Concerning "retroactivity" the City Attorney advised that legality was dependent on reasonableness of the requirement and a prescribed time period for conformance. This public hearing is for consideration of Text Amendment 93-005, to add regulations that require backflow prevention devices to be screened when such devices are installed in any commercial, industrial or multiple-family zone. Mayor Ciraulo declared the public hearing OPEN. Jerrv Whon, 330 El Dorado, stated, in part, that he is not speaking against the text amendment, however. he thinks Council should correspond to the owners of the seventy-nine properties involved and explain the situation to them and let them do some cost assessment. Perhaps City assistance could be available. This would be preferable to the City asking for comments after the decision has been made to pass the text amendment. He lives in units that will be affected and has a home owners' association to deal with. The City Manager/Community Development Director suggested that if an ordinance were adopted to be effective immediately, the retroactive compliance could be deferred for six months to allow notification. Staff could then report to the Council regarding the implications and impact of the ordinance, and the appropriate time to require improvements could then be determined. No one else desiring to be heard the public hearing was CLOSED on MOTION by Councilmember Harbicht, seconded by Mayor Pro tem Lojeski and CARRIED. Councilmember Harbicht stated, in part, with the screening requirements for new have a problem with the retroactive that he has no problem construction. He does feature of this text 5 1/4/94 36:0008 amendment. It seems to him that if we are only talking about seventy-nine of these installations. it can't be that much of an eyesore for the community. Normally when we pass a new ordinance and have new restrictions or requirements for building, we don't go back to the buildings that are already built and make them comply wi.th different setbacks or whatever it might be. He thinks it is unfair. He will support the screening requirements for new developments, but is not going to support the retroactive part of the ordinance. He asked the Council to remove that portion. With regard to the retroactive portion, Councilmember Fasching concurred that Council should not go back when people have built these devices, and now we are making changes. However, he is interested in beautification and thinking of the future of the City." He felt that in those instances where screening can be 1 done with some landscaping or bushes without costing a lot of money, it could be feasible. He agreed that in most instances of new or changed ordinances, the City does not go back and make owners change things. Councilmember Fasching would like to go along with the suggestion of looking at the seventy-nine properties mentioned and advise the people of Council's concerns for beautification. Perhaps we can get their cooperation. Staff can bring this back to Council and a decision made at that time. If a backflow device requires more than just landscaping, perhaps there could be some participation on the part of the City. Mayor Ciraulo agreed. It was MOVED by Councilmember Harbicht, seconded by Councilmember Fasching and CARRIED on roll call vote as follows to APPROVE Text Amendment 93-005, with the deletion of the retroactive requirement; DIRECT staff to do some research into the existing backflow prevention devices and come back to Council with the results; APPROVE and FILE the Negative Declaration; FIND that the text amendment will not have a significant effect on the environment; and DIRECT staff to prepare the appropriate ordinance. Staff noted that landscaping or hedges of some sort had been looked at to provide screening. Masonry screening could be very expensive. When these devices were originally installed, the builders could not build walls because of Fire Department regulations. A lot of them were installed after the fact. There was no architectural review on a lot of the older projects. In response to a question from Councilmember Fasching, staff said that the Fire Department regulations at the time stated that the builders could not obstruct any portion of the backflow prevention devices. AUDIENCE PARTICIPATION 1 Johanna Hofer, 875 Monte Verde Drive, stated, in part. that she appreciated comments by Councilmember Margett about the congregate meals program for senior citizens. She agrees it is time to take a closer look at these programs from a cost effective standpoint. Mrs. Hofer also stated that, since the Pasadena Tournament of Roses Queen this year was from the City of Arcadia, it would be a nice gesture for the Council to present her with a commendation of some sort. Margett) HARBICHT (Christmas Party) 36:0009 Richard McGrath, 1832 Anita Crest, representing the Arcadia High School Music Club, stated, in part, that he is extending an invitation to the 27th Annual Spaghetti Dinner, Saturday, January 22, taking place at the High School. There will be also be two performances by the Arcadia High School Band. CITY COUNCIL RECESSED IN ORDER TO ACT AS THE ARCADIA REDEVELOPMENT AGENCY PRESENT: Agency Members Fasching, Harbicht, Lojeski, Margett and Ciraulo ABSENT: None On MOTION by Agency Member Margett, seconded by Agency Member Harbicht and CARRIED, the minutes of the meeting of December 21, 1993 were APPROVED. The meeting ADJOURNED to 5:30 p. m., January 11, 1994. CITY COUNCIL RECONVENED MATTERS FROM ELECTED OFFICIALS Councilmember Margett asked for an update regarding the burned- out home on the corner of Michillinda and Foothill Boulevard. He understands that an arson investigation may be involved. Fire Chief Gardner stated that this is a crime scene and, due to the ongoing arson investigation, the property cannot be disturbed at this time. Councilmember Margett reported that councilmembers from the City of Temple City have asked if Arcadia would like to join with the City of Temple City in placing a new monument at the boundary between the two cities on Baldwin Avenue. Staff has met with the City Manager of Temple City, who will submit designs for Council's approval. It was reported by Councilmember Margett that Mr. Pokrajac has entered into an agreement with Mr. Bluth to sell his property to Mr. Bluth for development. One of the considerations in the contract is the removal of the water tanks on the hillside. Councilmember Margett would like staff to contact the seller and have some positive input with regard to relocation of the tanks legally, so that the transaction will go smoothly. The City Manager informed Council that a letter has just been received from one of the principals in the transaction, and the Water Manager is working to develop some options for Council's consideration. Mayor Ciraulo congratulated Councilmember Margett on being named Chairman of the Water Quality Authority representing the City of Arcadia. Councilmember Harbicht wanted staff to know that his absence from the traditional holiday party for the staff and Council given by the Mayor to show appreciation to department heads and other staff, was due to the fact that he was not invited. He took this opportunity to thank staff for their help throughout the year. recognizing he could not do the job he was elected to do without their support. 7 1/4/94 CITY ATTORNEY (AQMD Board Candidates) COUNCIL (AQMD Board Candidate Support) LOJESKI (Renovation of Tennis Courts & Softball Field - AHS) 36:0010 On advice of the City Attorney, it was MOVED by Councilmember Harbicht, seconded by Mayor Pro tem Lojeski and CARRIED on roll call vote as follows that the need to take action on the following item arose after the January 4, 1994 agenda was posted. AYES: Councilmembers Fasching, Harbicht, Lojeski, Margett and Ciraulo None None NOES: ABSENT: Councilmember Fasching announced that this Thursday night there will be a meeting of the City Selection Committee to fill the seat on the Air Quality Management District Board. Nell Soto and Christina Madrid, the two runoff candidates for the position. have both appeared before Council requesting Council's support. Councilmember Fasching asked Council to consider supporting Nell So to again as was done in the initial election. He believes her experience, associations, and background qualify her for this job. Councilmember Harbicht expressed support for Christina Madrid. He feels she, also, is well qualified for the position. Mr. Harbicht stated he leans more towards supporting Christina Madrid because in her presentation she seemed to be a little more concerned about the economic effect of the various rules that might be proposed by the AQMD. Mayor Pro tern Lojeski voted for Ms. Soto. Councilmember Margett after considering the taxing policies of the group in City of Pomona voted for Ms. Madrid. Mayor Ciraulo said he would cast his vote for Ms. Madrid. It was agreed that it is difficult to make a choice based upon a five minute presentation, but the consensus was 3 . 2 in favor of Council support for Ms. Madrid for a position on the AQMD Board. 1 In response to questions from Mayor Pro tern Lojeski regarding the present status of the tennis courts and softball field at Arcadia High School, staff replied that six new tennis courts are being built on the south side of the football field. The Recreation Department will possibly have to move some of the adult tennis classes for a couple of months. The softball field is also being moved. This will make room for a building to provide space the school will need for a four year high school. These renovations will be of benefit to the City Recreation programs more than they will hurt them. FASCHING In response to questions from Councilmember Fasching, staff (BFI - Office responded that a total of four complaints have been received Conference) regarding contractual matters involving BFI. The City Attorney noted that although the City may not have a direct interest, he has proposed an informal office conference with BF! representatives. CITY CLERK ALFORD (Election Update) 10. The City Clerk provided an update on eleven candidates who have drawn nomination papers for election to three seats on the City Council at the April 12, 1994 election. To this date, Mayor Joseph Ciraulo and Dr. Sheng Chang have filed their papers. Nominations will be open until January 14, 1994 or, if an incumbent does not file. to January 19, 1994, for candidates other than incumbents. 1 CONSENT ITEMS lOa. ARCADIA SCHOOL DISTRICT (Armory Buildings) (APPROVED) 36:0011 APPROVED Agreement between the cities of Arcadia, Duarte, Monrovia and Zakaroff Recycling Services for an initial five year period beginning May, 1994 for the collection of recyclable materials from commercial and industrial properti.es, per cost schedule outlined in staff report dated January 4, 1994; AUTHORIZED the Mayor to sign the Agreement, upon approval as to form by the City Attorney. THE ABOVE CONSENT ITEMS lOa AND lOb WERE APPROVED ON MOTION BY MAYOR PRO TEM LOJESKI. SECONDED BY COUNCILMEMBER FASCHING AND CARRIED ON ROLL CALL VOTE AS FOLLOWS; AYES: Councilmembers Fasching, Harbicht, Lojeski, Margett and Ciraulo None None NOES: ABSENT: Discussion of proposed lease between the City of Arcadia and the Arcadia Unified School District for the Armory Building (16,000 square feet) and Butler Building (2,880 square feet) for a thirty-one month period in the amount of $.04 a square foot which equals $755.20 a month. The basic terms of the proposed agreement are set forth in staff report dated January 4, 1994. In response to a question from Councilmember Margett, staff said that the City paid the State $1,400,000 in cash plus $460,000 in free rent for five years, for a total of $1,860,000. The last appraisal was done in 1986 or 1987. The appraisal could be 25% or 30% less at the present, given the general decline in values in the area. David Powell, the Redevelopment Agency exclusive real estate broker, advised that the City could expect to receive 1 cent to 2 cents per square feet per gross area of the property (92.000 square feet), or $900 to $1800/month in rent. At the September 28, 1993 meeting, Council determined that it would make the main Armory building and the Butler building on the north of the property available for outside lease, while the Police Department would make use of the southern buildings. Mr. Powell was contacted again regarding an estimated lease amount just for the buildings, and his estimate was 10 to 15 cents per square foot. However, Mr. Powell also said it would be very difficult to get that price in the going industrial market at this time because there is a three year restriction on the lease, the location is not good for industrial use, and the real estate market in this area is very poor. He indicated the City might try, but results would be doubtful. Mr. Powell was willing to serve as the exclusive broker, but when told of the agreement with the School District, it was his opinion that the City was lucky to get it. Before the property was marketed, the School District made an offer of $.04/square foot and it was accepted. Considerable discussion ensued among Councilmembers. Councilmembers Fasching and Margett expressed concern that the market was not canvassed for the possibility of obtaining a lessee for the Armory and Butler buildings who would pay a higher rental. They did not consider this to be good business. It is certainly not a good return on investment. Based on his experience, Councilmember Margett believes these buildings should lease for approximately 30 35 cents a square foot. Councilmember Fasching felt that staff had proceeded with this lease agreement without Council's direction or approval. This is not a market rate lease, but one of benefit to the School District. Councilmembers Margett and Fasching felt that some effort should be made to canvass the market in an effort to lease the property at a higher rate before agreeing to the School District proposal. 9 1/4/94 11. lla. Arcadia School District.. stated, in part, that the School District is in need of storage areas during the period of renovation of the schools. The School District would be unable to pay a higher rental for the property. He and the members of the School Board were hopeful of obtaining this assistance from the City. They need to have storage space available very soon, and have not sought other facilities, since they had anticipated Council approval of this proposed lease. If this lease is denied, it will have a tremendous impact upon the School District. The discussion continued, and Mayor Ciraulo agreed that this is an opportunity for the City Council to assist the School District. Councilmember Fasching said if a commitment had been made to the School District, he would not want them to be placed in a precarious position by having to quickly seek other storage 1 facilities. However, City staff did not follow the direction of Council to begin with. and this disturbs him very much. Council did not allow the use of these buildings to the Police Department because Council wanted to see how much income could be derived from leasing this facility. Councilmember Harbicht said these negotiations had been going on for three months. but Council just learned about it, and he resents the position Council has been placed in. However, he said the School District has worked hard to get the bond issue passed and begin renovations on the buildings and he does not want to place the School District in a difficult position.
