MARCH 1, 1994
The City Council and the Arcadia Redevelopment Agency met in an
Adjourned Regular Mee'ing on Tuesday, March 1, 1994, at 7:00 p.m.
in the Conference Room of the City Hall Council Chambers,
PRESENT: Councilmembers Fasching, Harbicht, Lojeski, Margett,
and Ciraulo
The Acting City Manager provided a revised last page to the staff
report regarding the proposed Albertson's Market project which
is on tonight's agenda. Included were several letters from
residents expressing their opinions about the proposed project.
In view of the possibility of a lengthy public hearing to
consider an appeal of the Planning Commission's approval to
construct an Alberuon's Market, Mayor Ciraulo suggested that the
time reserved for those in the audience to address Council be
moved up on the agenda ahead of the first public hearing. On
MOTION by Councilmember Margett, seconded by Councilmember
Harbicht and CARRIED, it was so agreed. Mayor Pro tem Lojeski
requested the City Attorney give a legal comment before the
public hearing begins regarding inaccurate statements which were
attributed to Mayor Pro tem Lojeski and Mayor Ciraulo.
Councilmember Faschin!~oCommented that there are approximately
twenty newspaper vending racks in front of ,he Post Office
on Wheeler Avenue, which seems to be an excessive amount of
news racks in one place. The City Attorney explained that the
City has an ordinance which regulates the placement, location,
and dimensions of newspaper vending racks. It can be reviewed
in terms of how it can be made more res'rictive. The content of
newsracks is not under City control unless it is obscene
material. The City Attorney and Business License Officer have
found that on occasion there are too many news racks and they are
not placed properly,
Councilmember Harbicht asked about news racks on the curb line at
the McDonald's Restaurant on Foothill Boulevard, They block his
view of oncoming traffic when exiting the driveway. The City
Attorney replied that the ordinance specifies protection of line
of sight. He recommended the Acting City Manager direct
inspection of all newsracks. If they are in violation of the
Municipal Code, they must be brought into compliance, If there
is not a viola'ion of the Code but there is still a problem,
perhaps the Code should be amended. The Business License Officer
is currently conducting a survey of o~her cities to see if they
are receiving any license fees from newsracks.
Councilmember Fasching would like to see the number of newsracks
limited, perhaps basing the number on an establishment's front
footage. The City A"orney noted that ,he City of Glendale was
recently involved in a court case regarding such limitation. and
he can look into what happened in that case. Mayor Pro tem
Loj eski suggested contacting the City of San Marino, which
doesn't seem to have a problem with a proliferation of newsracks,

Councilmember Fasching referred to a letter from the local cable
television company with regard '0 sales 'ax which has been added
,his month '0 cable bills in the City of Arcadia, According to
research, there is no other city in California that is charged
sales tax by a cable television company. Councilmember Fasching
has asked staff to investigate whether or not ,his tax is
required by the State of California, and if it is dropped after
the tax collected has reached the total amount of tax which would
be charged on the retail value of the item.
