The Ci'y Council and ,he Arcadia Redevelopment Agency met in a
regular meeting on Tuesday, March 1, 1994 at 7:30 p. m. in the
Arcadia City Hall Council Chambers.

PRESENTATION
On behalf of the City Council, Mayor Ciraulo presented the
Mayor's Certificate of Commendation in recogni'ion of outstanding
achievement to Arcadia resident, Todd Rosa, West Point Appointee.
On February l5, 1994, the City Council adopted Resolution No.
5772, declaring its intention to provide for the abatemen' of
noxious weeds. rubbish and refuse from certain private proper'y
in the Ci'y. Said resolution se' ,his date, March 1, 1994, as
the time and place to hear objections to the proposed removal of
such nuisance, As required by the Governmen' Code, the County
Agricultural Commissioner has mailed the appropriate notice to
all property owners involved (lis' of property owners attached
to report dated March 1, 1994).
Councilmember Margett noted ,hat a let'er has been received from
Mrs. Helen F. Vida, Trustee of the Vida Trus' advising that she
did no' wish to have Coun'y crews perform the work of clearing
the weeds on her property, She will have ,his work done as soon
as the rains are past.

County Agricul'ural Commissioner to abate ,he nuisance by having
the weeds, rubbish and refuse removed from those properties set
forth on the weed abatement list attached to staff report dated
March 1, 1994.

The Planning Commission a' i's February 8, 1994 mee'ing vo'ed 5
to 0 to adopt Resolution 1507 granting Conditional Use Permit
93 -008 to applicant, Marketplace Properties, to construct a
50.547 square foot Albertson's Market within 100 feet of
residentially zoned property, and a 2,800 square foot restaurant
with outdoor seating located within a 5.934 square foot multi-
tenant building at 232 and 300 East Live Oak Avenue. The
applicant also requested the following as part of the
application: 1) To operate a market 24 hours a day; 2) To sell
alcoholic beverages within 150 feet of residentially zoned
property; 3) To provide 266 parking spaces in lieu of 296 spaces
required; 4) To have an 8'-0. setback along Lynrose Street for
the proposed marke' in lieu of 50'-0. required per City Council
Resolution 3180.
The Planning Commission decision, findings and conditions are
set forth in Resolution No. 1507 which reflects the Planning
Commission's action of January 15, 1994. On January 31, Louise
Parker, 2500 South Third Avenue, appealed the Planning
Commission's decision. This public hearing has been scheduled
for consideration of 'h!.s appeal. The staff report was presented
which detailed general plan designation, existing land use and
zoning, surrounding land use and zoning, traffic s'udies provided,
by the applicant's traffic firm as well as Planning and Public
Works staffs, on-site circulation, congestion management,
parking, landscaping, trash collection, e'c. Staff responded to
questions from the Councilmembers regarding on-street traffic
circulation.
Mayor Ciraulo declared the hearing OPEN.
The City Attorney sta'ed, that he wished to make reference to
some allegations in writ'en form indica'ing ,ha' Mayor Pro tem
Lojeski and Mayor Ciraulo had somehow already made up their minds
on this matter. There is no basis in fact for such statemen's.
They will be glad '0 confirm ,ha'. Their decision, like ,ha' of
the rest of the City Council, will be based 'o'ally on the
evidence and arguments before ,hem this evening,

In Favor of the Aooeal
Ted Parker. 2500 S. Third Avenue. also represen'ing Louise
Parker, stated, in part, that they had concerns regarding traffic
safety on the streets immediately adjacent to the proposed new
market, in particular the left turn lane westbound on Live Oak.
Also, traffic out of the market parking lot onto the westbound
left turn lane on Live Oak. In a preliminary study, the Police
and Public Works Departments recommended ,ha' ,here not be lef,
turn lanes into or out of the parking lot. He is also concerned
about possible liabili'y on behalf of the Ci'y. The City
Attorney explained that the alleged hazard allegation has been
mitigated by the new plans. Staff is no' recommending anything
that could be deemed to be a dangerous condition of public

property. He also explained the General Discretionary Immunity
granted to cities under California law. Mr. Parker feels this
market will take business away from existing markets in the area.
Johanna Hofer, 875 Monte Verde Drive, stated, in part, that she
is concerned abou' the health and welfare of the people who will
use the marke' as well as the children who walk to and from
school on the nearby streets. Potential danger or inconvenience
should not be overlooked. Perhaps sidewalks should be
constructed. Also, additional attractions at the Santa Anita
Mall would provide revenue to build up the City's dwindling
reserves.

Jerome Jensen, 5639 Cochin Avenue, stated, in part, that he is
concerned about limited street parking, setbacks, graffi'i.
transients, shopping carts on the streets, the fact that the
market will be open twenty-four hours a day, etc.
Frances Martinez, 120 East Live Oak Avenue, stated, in part, that
she is concerned that the proposed Albertson's Market will be in
competition with ,he other restaurants and businesses in the
area. Ms. Mar,inez is employed by a pharmacy. She is concerned
that the proposed pharmacy in the Albertson's Market will take
customers from her pharmacy,
Susan Kasten, 5639 Garypark Avenue, stated, in part, that she is
concerned about the children who attend the nearby Rio Hondo
School, with regard to increased traffic and the possibility of
drivers failing to heed the stop signs in the area. She is also
concerned that the proposed height of the grocery store will
block the view of the mountains.
Dan Verstuva, 5638 Cochin Avenue, stated, in par', that his
residence is across ,he s'reet from the proposed market, and he
is concerned about parking on Lynrose Avenue for pedestrian
access to the market. He fears that he will have a difficul,
time getting in and o~l; of his driveway because of increased
traffic and delivery trucks. He is also concerned about the
height of the wall.
Pat Ames, 2222 S, Second Avenue, stated, in part, that she is
concerned about additional expense for ,he Arcadia Fire and
Police Departments for this project and also about loss of
property values,
Dale Ed~in~ton, 2413 S. Third Avenue, stated, in part, that he
is concerned about the delivery trucks coming to the marke'
having to cross the parking area and then back into the loading
docks.

Dou~ Dolan, 2311 S. Third Avenue, stated. in part, that he had
not been notified by the City or by Albertson's abou' this
proposed market. He is concerned about safety and 'raffic
problems. particularly as 'hey relate to left turns in'o or out
of the marke' complex. He noted that some of the streets in the
nearby area do no' have sidewalks.
Evelvn Richmond, 5629 N. Farna Avenue, stated, in part, that she
has lived at this address for forty-three years, and has enjoyed
the area. She is concerned about the increased traffic. She
does not think this is a good location for Albertson's and she
wishes they would reconsider.

Michael Rue, President of the Marketplace Properties, 13522
Newport Avenue, Ste. 202, Tustin, stated that (1) the industrial/
manufacturing buildings presently on the property are not
compatible with or of benefit '0 the neighborhood; (2) the
developers asked for and received community and staff input
before the project was presented to the City of Arcadia; (3) the
proposed design is compatible with the neighborhood; (4)
Albertson's s'udies indicate that this location will be
economically successful; (5) the project impact on traffic will
be insignificant; and (6) the project will bring numerous
benefits to the City and the residents. Mr, Rue presented slides
showing the existing buildings to emphasize the fact that they
are not an asset to the neighborhood. He also no'ed that the
primary access to this property is off Lynrose Avenue. One slide
showed a truck parked on the vacant property; and apparently this
is quite a common occurrence. Mr. Rue listed other permitted
uses under the zoning for this property. In response to
complaints that the project is not compatible with the
neighborhood, he noted that in the adjacent area there is a strip
commercial area with a 7-11, Domino's Pizza and a dry cleaner;
to the west is the Ace Hardware building; northeast corner is a
vacant lot; a florist and a church; northwest corner is another
retail building. Properties along the south side of Live Oak
Avenue west of the property are virtually 100' retail uses. The
north side of Live Oak Avenue shows a mix of offices and retail
uses, with a few restaurants. East is a mix of retail,
automotive, residential, etc. Every grocery store in Arcadia is
adjacent to a residential area. He presented copies of
Albertson's handout which invited the residents within a 300 foot
radius of the property (the same distance required by the City
for public notices) to a meeting with the company's
representatives. He also presen'ed a flyer which was dis'ributed
to homes and businesses within a 550-600 foo' radius. This
meeting was held on Monday October 18, 1993. They made an effort
to contact as many residents who would be impacted by this
proj ect as possible. . The questionnaires distributed at the
meeting indicated that 10' of the 500 or so attendees liked the
site plan; 78' liked the building design; and 68' were in favor
of the proj ect, He later spoke to another group from the
unincorporated area, and then submitted the project to the City -
- approximately five months later.
Sv Perkowitz, Architect, 911 Studebaker Road. Long Beach,
stated, in part, that his firm specializes in neighborhood
shopping centers, and tha't they have shown concern for the
residential area. They have provided limited access; lines of
trees will shield the neighborhood. There will be no vehicular
traffic from the shopping center onto Lynrose Avenue. The
loading operation has been located away from the residential
areas, The project has been designed with a residen'ial
appearance. He presented slides of other shopping cen'ers which
his firm designed, as well as slides showing the proposed
landscaping which far exceeds City requirements, and which will
soften the look of the buildings.
Jeff Dierck, Southern California Area Real Estate Manager for
Albertson's, 1180 W. Lambert Road, Brea, stated. in part. ,hat
85. or ,he customers to be served by this store will come from
within two miles. He presented slides ~howing a new Alber'son's
store in Walnut which is also located in a residential
neighborhood. Albertson's Markets have moved from the sixth to
the fourth largest market chain in ,he United States, and is ,he
most profitable. This shows the kind of decision makers the
Albertson's organization has. This location in Arcadia was
approved by the management team, They think Albertson's will
have a viable operation at this site.

Sue Maddox, from the Albertson's Boise Corporate Office, further
explained Albertson's management team decision process for
building new shopping centers.
Jack GreensDan, Linscott, ,Law & Greenspan Engineers, 1580
Corporate Drive, Ste 122, Costa Mesa, CA, stated, in part. that
his firm has studied the site and the traffic according to
accepted industry standards, and found no significant traffic
impact, With respect to parking and site circula'ion. 'hey found
it to be adequate according to general industry standards. Much
of the traffic coming to the site will be local traffic. Mr.
Greenspan responded to questions from Councilmember Margett
regarding the traffic circulation.

Michael Rue, continued his presentation by stating that
Albertson's management believes tha' the project will bring
numerous benefits to the City and the area residents.
Approximately one hundred jobs will be created, most of which
will be filled from the immedia'e area. Sales tax revenue will
be created. Some shoppers who are going outside of the City will
come to Albertson's to shop, They hope to revitalize the Live
Oak area because bringing in business will help ,he o,her
businesses along the street. Albertson's will provide healthy
competition for Ralphs and Thrifty Drug. This is a seventy
million dollar investment by Albertson's in the City and they do
not take it lightly,
James Havward. owner of building at 312-314 East Live Oak which
is now occupied by an electronics manufac'uring firm, He is
concerned abou' the o,her manufacturing buildings close by
sitting empty. Such empty buildings are targets for graffiti
and vandalism. Albertson's is a vital and growing organization,
and he believes that it is in the City's bes' in'eres's to move
forward with activity and vitality. rather than continue to let
that area die on the vine,
William Birnev, stated. in part that the area is an eyesore at
the moment. He was impressed by the Planning Commission report
and thinks they have the'best interests of the community in mind.
Also, he felt ,hat the developers answered most of the objections
and questions raised by the residents,

Karen ZiEler, Daines Drive, stated, in part, that she has been
elected to the Monrovia - Arcadia - Duar'e Town Council which
was formed last June. She is representing a number of people who
have contacted her and asked that she speak for them in favor of
,he project. Many people feel this market will be a great
convenience; will provide competition for Ralphs; will be larger
store with shorter waiting lines; and for some will be within
walking distance. They are all tired of looking at the old
businesses that are there now. Albertson's showed that they are
concerned about the residents, She feels more cooperation
between the county and' ,he city is needed. Also, the residen's
would like to see that residential area annexed to the City.
Don Ralston, lives in the county area. He feels that ,he City
should be commended if this project is approved. It will show
,hat the City has a little pride in the southern part of the
City. Redevelopment has been accomplished in o,her areas, but
this area has been forgo~ten. He reels Albertson's market will
be a big plus for the area. He does not think the neighbors will
have any problem with the delivery trucks. Also he would like
to call attention to the fact that there are two markets near
each other on Foothill Blvd. This projec' will enhance the
southern sec'ion of Arcadia.
Tom Beck, resident of Arcadia and homeowner, stated, in part,
that the photographs shown do not adequately depict what an
eyesore the area is. As a prac'ical matter, the only kind of
developmen' that will go in there will be Albertson's, This

project will enhance the nei,ghborhood. The benefits will
outwe igh ,he burdens, He is sure the same arguments were
presented against Ralphs and Vons on Foothill Blvd. Those
markets were approved, constructed and serve the neighborhood
with few or no problems.
Alan Black, 3243 Hempstead, stated, in part, that he sells real
estate in the area. From a residential real estate point of
view, this would be a good project. Ilha' is there now is
definitely an eyesore. A new Albertson's market would be a shot
in the arm for that area. A lot of stores in the area are
rundown. The real estate buyers he has contac'ed gave a
favorable response. Perhaps this won't increase property values
in the area, but it definitely won't decrease them,
Marv Hansen, 900 Hugo Reid Drive, is speaking in favor of ,he I
Albertson's project. This project will enhance the beauty of this
part of Arcadia, The unoccupied buildings have been freshly
painted, but they were built many years ago and weeds are growing
'around them: they could be kept looking better, She would like
to see this project approved because it would help beautify a
part of southern Arcadia where it is badly needed. The increased
tax revenue will benefit the Ci'y. Also, she noted. the Hughes
market on Huntington Drive is open twenty-four hours a day.
Bruce Brenner, 2519 Lee Avenue, stated, in part, that he is the
owner of Ace Hardware at 250 East Live Oak Avenue. He has talked
with some of his customers about this proposed project. About
60% did not even know about it. Of those who did, abou' 85% were
in favor. Also he noted that there is a crossing guard for the
school children at the intersection of Daines and Tyler.
Patsv Lv. 1905 Holly Avenue, s'ated, in part, that an additional
grocery s'ore will mean more choices for the customers. She
,hinks ,his projec' will aid the struggling small businesses
along the Live Oak corridor. Also, it will benefit the City of
Arcadia.
No one else desiring to be heard, the hearing was CLOSED on
MOTION by Councilmember Fasching, seconded by Mayor Pro tem
Lojeski and CARRIED.
Councilmember Harbicht commented, in part, that with regard '0
the increased revenue to the City, food is not taxed, so a
supermarket is a relatively minor sales tax generator. One of
the points presented was that of the prospects for success of the
proposed supermarke'. It is not Council's role to decide whether
or not an enterprise will or will not be successful, Ve have a
free enterprise system. As far as its possible effect on other
business in the area, it is not the role of government to protect
already establis~ed businesses, Councilmember Harbicht does not
feel ,hat placing a supermarket on that site will have major
influence on the traffic circulation. The City has complied with
the laws governing the publication and notifica,ion of residents
regarding such proposals. He does no' see any compelling reason
for not permitting this project to be constructed.
Councilmember Fasching commented, in part, that he agrees with
Councilmember Harbicht. He feels that the area in south Arcadia
from Second 5creec ease needs at:cention. Live Oak A"."enue from
Santa Anita Avenue to Second Avenue is at,rac'ive; beyond Second
Avenue is a problem area, Councilmember Fasching thinks there
will be some traffic circulation impact. particularly on Third
Avenue. He favors improving this property. Perhaps some
thought should be given to changing the zoning in this area to
permit townhouses or condominiums.

Councilmember Margett commented, in par', that he checked
comparable areas and found tha' vir'ually every marke' is in a
residential district, and has ,he same issues '0 con'end with,

The owner of this property has a right '0 develop it. This
project is consistent with the General Plan and zoning. He will
support this proposal, but feels tha' some improvement in the
traffic circulation and control may be necessary

Mayor Pro tem Lojeski commented, in part, that residents in the
southern area of the City frequently ask Councilmembers what can
be done '0 improve that area, remove the eyesores, etc. This is
not a project that the City brought to the people in the
community, it is a project that the developer presented to the
City. It is Council's responsibility to conduct a hearing during
the decision making process. He was present at the Planning
Commission hearing and sat through a very courteous process; the
uncourteous members were those in the audience, who become
abusive. Some of the comments presented this evening in regard
to the Planning Commissioners were uncalled for. He agrees with
Councilmember Harbicht that it is not Council's responsibility
to address the economic viability of a projec'. This project
will remove an eyesore, and will improve the entire business area
in the southern part of the City. There will probably be an
increase in 'raffic. Ac'ually, the only market in the City that
is unique is Hughes Market on Huntington Drive which has no
adjacent residential areas, He will uphold the decision of the
Planning Commission. He would like '0 see the entrance from
Lynrose Avenue closed for pedestrians. He is not in favor of
painting the curbs red.
Councilmember Fasching reiterated that Live Oak Avenue needs
Council's attention and suggests this be considered la'er this
year. He is also concerned about traffic on Third Avenue.
Mayor Ciraulo commented, in part, tha' he lives one block away
from a supermarket, that is open twenty-four hours a day, and
that there are two markets near each other. This has not created
any significant traffic problem. He will vote to sustain ,he
Planning Commission decision,
It was then MOVED by C~uncilmember Harbicht, seconded by Mayor
Pro 'em Lojeski, and CARRIED on roll call vote as follows to
SUSTAIN the decision of the Planning Commission as set forth in
Planning Commission Resolution no. 1507, with the exception of
Conditions 10 and 15 which have been modified to reflect the
recommendation of staff, as stated in the March 1, 1994 staff
report; DENY the appeal; MOVE to APPROVE and FILE the Negative
Declaration and FIND that the project will not have a significant
effect on the environment; and DIRECT staff to prepare the
appropriate resolution incorporating ,he specific findings and
conditions of approval set forth in the staff report.

Some discussion ensued among Councilmembers, and it was decided
that the condition not to allow a pedestrian exit onto Lynrose
Avenue was unnecessary. I' was also reiterated by Mr. Rue ,ha'
the discussed new treatment of the south wall will be included.
Councilmember Margett addressed the alternative of future left
turn signalization at mid-block, and suggested a condition that
the cost of such signalization. if it should prove necessary, be
borne by the developer. It was ,he consensus of Council 'hat,
since this is not a staff recommendation and Council does not
know at this time if such a problem will develop, that it would

AUDIENCE PARTICIPATION
Johanna Hofer, 875 Monte Verde Drive, distributed an ar'icle
addressing the problem of Southern California's wild fires to
Council with the suggestion that it be forwarded to the Fire
Department. She objected to political advertising distributed
by Dr. Chang at the Community Center on the occasion of the
Chinese New Year luncheon for 300 seniors, She suggested that
Dr. Change reimburse the City for the use of the Community Center
for this purpose. The City Council should make it clear that
this type of political usage will not be tolerated, and fix a
stiff fine for refusal to comply. She noted that during the
February 15, 1994 Council meeting a retired police chief from
Taiwan was introduced,~ and spoke for at leas' ten to fifteen I
minutes in Chinese, translated by his son-in-law. Citizens have
a five minute time limit at audience participation. Also, this
ex-police chief invited our Police Chief Johnson '0 Taiwan. She
wonders who will pay these expenses. Also, she understands that
Mayor Pro tem Lojeski and his son visited China this past year
when Mayor Ciraulo was unable '0 make the trip. She would like
to know who paid for that trip. She wonders how much county tax
money is received for the palatial mansions which have been built
in ,his City, and how much of this money comes back '0 Arcadia.
Also mentioned was a letter written by Mrs. Hofer to the District
Attorney. She will make this public when she is sure tha' the
District Attorney has read it.
Cliff Goodrich, President and Chief Operating Officer, Los
Angeles Turf Club, operators of Santa Anita Race Track, s'a'ed,
in part, since that there is no local newspaper, he would like
an opportunity to dispel the rumors of a card club to be
established at Santa Anita race track. He has recen'ly been
informed about a surveyor perhaps two surveys whereby some
person or some group is referring to a race track plan for a card
club. He is present to 'ell the Council, staff, the audience
present and on television that there are no plans for a card
club. The survey being conducted is not that of Santa Anita.
They have no idea who is'doing this, and they are very disturbed
about it. If and when they have plans to do something, they will
come to the Council and the community and use the process in a
proper manner.
Councilmember Fasching noted that the Turf Club is ,he latest to
be subjected to this sort of thing. These surveys have been
going on in the City, and no one knows who is doing them or for
what purpose.
The City Attorney noted that by law, a card club can not be
established without being submit'ed to a vote of the electorate
of the City.

At its February 10, 1994 meeting, the Human Resources Commission
approved the revision of the Fire Captain and Fire Engineer
classifications, and forwarded their recommendation for approval
'0 ,he City Council.

MATTERS FROM ELECTED OFFICIALS
Councilmember Margett said that he understands that there is a
tremendous request for absentee ballots, and wonders if there is
a larger number of requests than usual. The City Clerk replied
that absentee ballot requests have increased with every election.
Some applications have been taken to ,he Registrar of Voters for
signature verification today. She does not know at this time how
many requests for absentee ballo's will come in. The City Clerk
quoted the Election Code that if a person signs under penalty of
perjury that he or she is a citizen of the United States, that
is acceptable for voting. Should there be a challenge '0 an
individual's registration, that would be presented to ,he
District Attorney.
Councilmember Harbicht stated that he will be out of 'own on a
business trip at the time of the March 15. 1994 Council meeting.

FASCHING Councilmember Fasching inquired of staff if anything has been

Councilmember Fasching inquired about the current status of the
improvement of Orange Grove Avenue. Staff responded that they
hope to have a request for authorization for bids on the April
5, 1994 Council agenda. There are negotiations with Sierra Madre
and the County regarding their share of the cost. The project
is still on "go", subject to Sierra Madre having financial
problems.
Councilmember Fasching inquired about the repair of the handball
courts at Newcastle Park, and the possibility of ob'aining FEMA
or County money for this purpose. Staff responded that prior to
any work being done even if there is FEMA money, the matter will
be brought back to Council for consideration of the long-term
impact of usabili'y. functionabili'y and cost. Staff has fenced
the cour's off to secure them.
Councilmember Fasching inquired about Police Chief Johnson's
repor' regarding utilizing some of ,he retired police vehicles
for use on volunteer reserve officer patrols. Six vehicles are
being retired: two are to be retained for this purpose. Staff
responded that this is the start of a new program and they hope

to start with the two vehicles initially, and perhaps expand in
the future, Chief Johnson agreed that two vehicles would provide
a good start. If more vehicles were to be used, it would be
necessary to purchase more radios. and equipment which would be
very expensive. Also they think that they will be doing very
well to fill two vehicles with volunteers. In response to
questions, Chief Johnson responded that reserve officers ride in
the regular marked cars with a law enforcement officer; they
cannot ride out on their own and do general law enforcement
duties as a sworn peace officer. The volunteers will drive a
vehicle clearly marked "volunteer".
In response to questions from Councilmember Harbicht, Chief
Johnson replied that the volunteers will be a senior pa'rol that
will do security checks on emp'y houses, etc, They will not be
dressed as police officers and their vehicles will be clearly
marked "volunteer". If they encounter suspicious circumstances.
they will radio the Police Department.

Mayor Ciraulo commended Jim Dale, Finance Director and Jerry
Parker, Treasurer and the Finance Department for the award they
received for the 1993 operating budget, This is not the first
time they have won such an award, He also thanked Jo Anne
Miller. Business License Department. He received a letter from
a citizen commending her for her assistance.
Ci'y Clerk June Alford announced ,hat on April 12, 1994 ,he City
will hold a general municipal election for three Ci'y Council
members. Voter registration for the April 12 City election will
be open 'hrough March 14. Residents of Arcadia who are United
States citizens and at least eighteen years of age at the time
of the election date may obtain registration forms from the City
Clerk's office at City Hall or any post office. Also. if an
eligible person telephones City Hall, the City Ccerk's staff will
be happy to mail a registration form '0 them.

Acting City Manager Bill Kelly noted that a formal complaint has
been sent to the Los Angeles County with regard to the trucks
hauling mud and debris from the catch basins in Pasadena and
Altadena through Arcadia streets to the Arcadia wash following
the recent rains and mud slides. Mayor Ciraulo gave ,he
teiephone number of Lo'9 Angeles County Supervisor An'onovich
for any person who might wish to add to the comp laint.
Councilmember Harbich, felt ,his had been an emergency situation
in that it was imperative to clear the catch basins to prevent
severe flooding, and that Arcadia should not be making such
complaints. Staff responded that if such a situation should re-
occur, some advance notification should be given so that the
residents would know what to expect,
