CLOSED SESSION Pursuant to Government Code Section 54957 and 54954.5(e), at 6:35 p. m. the City Council entered a CLOSED SESSION for discussion of public employee performance evaluation and appointment of City Manager. The CLOSED SESSION ended and the City Council Regular Meeting RECONVENED at 7:00 p.m. INVOCATION Chaplain Brenda Peterson, Arcadia Methodist Hospital PLEDGE OF ALLEGIANCE Police Chief Neal Johnson PRESENTATIONS 1. Mayor Young stated: "Recently a man with a stun gun shot two DALE teen age girls who were walking down a street in Arcadia, but as RAINE he tried to kidnap one of the girls, his plans were ruined (Commendation)because a neighbor dared to get involved. That neighbor is Dale Raine, and the Council would like to recognize him for his heroic actions. When Dale heard the girls scream, he yelled at the attacker and then chased him down the street. While the suspect was not apprehended, both girls were spared further harm because of Dale's involvement." On behalf of the City Council and the citizens of Arcadia, Mayor Young presented a Certificate of Commendation in recognition and appreciation for service to the community. Mayor Young stated that she is pleased to present this certificate, and to thank Dale Raine for his quick action and willingness to come to the aid of the young girls. Police Chief Johnson also presented a Certificate of Commendation to Dale Raine on behalf of the Police Department. BOARDS & COMMISSIONS 1. INCOMING BD. & COMSN. (APPROVED) SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS I The City Manager reported that a further list of candidates for the Planning Commission has been compiled for Council's consideration at a study session at 5:15 p. m.. Tuesday, August 9, 1994. It was the consensus of Council that the top five candidates would be interviewed. QUESTIONS FROM CITY COUNCIL REGARDING CLARIFICATION OF AGENDA ITEMS None It was MOVED by Councilmember Lojeski, seconded by Councilmember Margett and CARRIED by general consent that all ordinances and resolutions be read by title only and that the reading in full be WAIVED. AUDIENCE PARTICIPATION Gail Marshall, 2320 Lee Avenue, part owner, Action Arcade, stated, in part, that a number of years ago, the then Council gave approval for a video arcade to have seven machines without necessity for a conditional use permit. At that time two persons played at one machine; new technology has produced video machines that can accommodate four players. The seven machine limit allows these video machines in businesses which do not have to comply with C. U. P. requirements regarding fire safety, i. e. sprinklers, two exits, etc. She thinks the Council and the Fire Department should study this matter because it would be very difficult for people to be able to exit in an emergency such as fire or earthquake. By general consent Council agreed to DIRECT staff to investigate this matter and return to Council with an informational report and recommendation in sixty days. I John Kirages, 400 Oxford Drive, stated, in part, that he represents residents in the college streets area north of Santa Anita Race Track. He reiterated the concerns of these residents about noise, traffic, parking difficulties, etc. which they feel will result if the Outdoor Entertainment Permit for Santa Anita Race Track is approved this evening. PUBLIC HEARINGS -I a- Consideration of establishing procedures for a Title-24 State Disabled Access Regulations Appeals Board. The Community Development Dep'!rtment is recommending that the City Council approve a procedure creating an appeals board pertaining to 2 8/2/94 I I 36: 0270 access to public accommodations by physically handicapped persons. The California Health and Safety Code allows the Community Development Department, in cases of practical difficulty, unnecessary hardship or extreme differences, to grant exceptions from the literal requirements of the standards and specifications of the California Disabled Access Regulations when it is clearly evident that equivalent facilitation and protection are secured. The Code also sets forth methods to appeal an action taken by the Community Development Department. Section 19957.5 establishes procedures for creating a local appeals board to consider written appeal by any person regarding any action taken by the Community Development Department in enforcing the State law pertaining to access to public accommodations by physically handicapped persons. Mayor Young declared the public hearing OPEN. No one desiring to be heard, the hearing was CLOSED on MOTION by Counilmember Lojeski, seconded by Mayor Pro tem Chang and CARRIED. It was the consensus that these appeals board appointments should be made by the Council, and the board members should be Arcadia residents. It was then MOVED by Councilmember Lojeski, seconded by Councilmember Kuhn and CARRIED on roll call vote as follows to APPROVE the creation of an appeals board pertaining to access to public accommodations by physically handicapped persons, and DIRECT staff to prepare the appropriate resolution, including recommendations, for adoption by the City Council at a future meeting and initiate the activities to find the appropriate persons for City Council appointment to the Appeals Board. PUBLIC The Community Development Department is recommending that the HEARING City Council direct staff to initiate the appropriate text change RETROFITTING to amend Chapter 9 of the City's Building Code relating to TILT-UP "Earthquake Hazard Reduction in Existing Buildings", in order to CONCRETE WALL require retrofitting of tilt-up concrete wall buildings BLDGS. CONST. constructed prior to January 1, 1976. The purpose of the PRIOR 1976 regulation is to promote public safety and welfare by reducing (Initiate the risk of death or injury that could result from the effects Text.Amend. of earthquakes on tilt-up concrete wall buildings designed under (APPROVED) the building codes in effect prior to January 1, 1976. Buildings 0'>':>0- Oi: subject to these regulations could not be added to or structurally altered or remodeled without first complying with the provision of the new regulations unless the building official determines that the alteration is minor in nature. Tilt-up concrete wall construction is primarily used on industrial buildings. An initial study of the Chicago Park area indicated 12 tilt.up concrete wall buildings constructed prior to 1976. If the City Council authorizes staff to proceed with this text change, staff will conduct a complete survey of the commercial and industrial areas in the City to determine the location of all tilt-up buildings constructed prior to 1976. The requirements and procedures are set forth in staff report dated August 2, 1994. Mayor Young declared the public hearing OPEN. These parties will have full involvement. and will be apprised of conditions and time frames. Margett and Young None None I Consideration of Text Amendment 94.003 to prohibit projects having more than a single-story directly above any proposed below grade or subterranean garage in the R.O and R.l single-family residential zones. On September 7. 1993. Ralph Bicker. Chairman of the Highland Oaks Homeowners' Association. Archi tee tural Review Board. submitted petitions to the previous City Council. "'hich contained signatures from 472 of the 650 homes in the Highlands area. The petitions conveyed the Association's disappointment in the Council's approval of a proposed two-story house over a subterranean garage at 1863 Oakwood Avenue. Furthermore. they requested that the City Council consider options to prevent further construction of such homes that appear to exceed the building height requirements for their area. Sections 9251.1.12 and 9252.2.21 of the Municipal Code prohibit below grade or subterranean parking within the R-O and R.l zones because of the potential impact on adjoining properties relating to excavation. first floor building height. etc. However. the Code also provides for an "exception". such as in hillside areas, "'here this type of parking may be allowed through the modification process. Mayor Young declared the public hearing OPEN. Raloh Bicker. 101 White Oak Drive. Chairman of the ARB for Highland Oaks Association, stated. in part. that he is present to urge Council to adopt this text amendment. Owners of 72% of the properties in the Highlands area are in favor of the text amendment. They do not want to see any three story residences. or those that give the appearance of three stories, with a garage and two stories above, and are in favor of the solution proposed by staff. The City Manager stated, in response to comments that some of the costs for the weed abatement are extremely low, that these costs will be analyzed by the Fire Department. AYES: NOES: ABSENT: Councilmembers Chang, Kuhn, Lojeski, Margett and Young None None MATTERS FROM ELECTED OFFICIALS Councilmember Lojeski had previously proposed the possibility of extended use of some of the Police Department automobiles by being manned by volunteers to provide increased visibility in the City. -The City Manager replied that a report had been compiled by the Police Chief and submitted to Council some time ago. A copy will be provided. Mayor Pro tem Chang attended a conference in Monterey and commented that it was very beneficial. Mayor Young also attended the conference in Monterey. She it was beneficial, particularly the interplay between different cities and the knowledge gained from this. said the Councilmember Kuhn feels that communication is the key to solving a lot of problems and avoiding misunderstandings. She thanked the people in the community who have been communicating with her by telephone, letters, postcards, etc. She urges them to continue this because direct communication is the only way she can know about the concerns of the residents. Councilmember Kuhn said she thinks that the Council has turned the corner in its efforts to serve better as a governing body. "We no longer agree 100% on every issue, but we have demonstrated that we can and do reach consensus. This can be accomplished only when each of us is focused on the larger picture. The larger picture covers the entire city of 49,000 plus citizens including issues regarding the safety of those citizens, the quality of life, the economic development and the physical requirements needed to meet those needs. The intent of the entire Council is to represent each and everyone of you in a fair way. based upon the facts as we perceive them at the time." Councilmember Kuhn attended the two day conference in Monterey. and the workshop that impressed her the most was entitled: "Creating a User Friendly City Hall" While she thinks our City Hall is user friendly, there were some new fresh ideas presented to improve communications between city hall and the citizens it serves, as well as creative ideas to market products and services offered by city hall. Councilmember Margett stated that San Gabriel Basin Water Master Lynn McLaughlin is retiring soon. He requested the Mayor to prepare a proclamation or commendation to show Arcadia's appreciation for his representation and assistance over the years. Councilmember Margett noted that he had his wife have had occasion to attend performances at both the San Gabriel Civic Auditorium and the Pasadena Playhouse. He would like to recommend these theatres to everyone and hope that residents in Arcadia and the San Gabriel Valley area will support those cultural efforts. Councilmember Margett inquired about his request for information about limits on election campaign spending. The City Attorney has completed gathering ordinances from other communities. The City can provide limits over and above what is provided by the FPPC. A report is under preparation. A pre. report will be provided within the next fifteen to thirty days. Mayor Pro tem Chang congratulated William Kelly on his appointment as City Manager. He said we have the right person; Mr. Kelly is a very intelligent, diligent, responsive and responsible person, and the City will be in better and best shape under his management. He appreciated that during the closed session earlier, Mr. Kelly had made salary concessions because of the City's budget problems. Councilmember Lojeski congratulated Mr. Kelly. As the new City Manager, he will create a lot of stability; the City has been through a lot of unstable times. He thought it important that there had been an unanimous vote. Mr. Kelly has the confidence of the entire Council. Councilmember Margett congratulated Mr. Kelly. Councilmember Margett wants to see Mr. Kelly analyze this City and its functions department by department. He wants to see an evaluation of the funds the City has and their adequacy as well as the funds in various restricted accounts. He wants to see more cost accounting, and the City run on a more business-like basis; amortization of City buildings; a multi.year budget. He 7 8/2/94 4. ACCEPT PUBLIC IMPROVEMENTS TR. Councilmember Kuhn congratulated Mr. Kelly and stated that she is really excited for him and for the City, and knows that we're going to move forward. Tract 42936, Whispering Pines Estates, Phase II, is a 23 lot extension of the Whispering Pines Estates, Phase I, subdivision developed by Charles Bluth/Bluth Development. The public improvements associated with the tract have been completed in accordance with City requirements as established by the Planning Commission and the City Council. The public improvements constructed by Mr. Bluth include storm drains, sewers, water mains, two water storage reservoirs, and a water pump station. I Councilmember Margett inquired if accepting the public improvements will have any effect on the ongoing negotiations concerning the relocation of the water tanks. Staff responded that the subdivision agreement mandated these tanks in this location under these conditions, and 'under the State Map Act, the City is required to accept and record these public improvements as they exist. Staff will continue to negotiate with Mr. Bluth, Mr. Pokrajac and the City of Monrovia on tank relocation. The City Attorney does not believe the City will be losing any leverage by this approval. AYES: NOES: ABSENT: Councilmembers Chang, Kuhn, Lojeski, Margett and Young None None CITY MANAGER Report and recommendation considering the Commendation/Presentation Policy. This policy was developed in order to clarify the types of presentations made to the public and to employees, and to provide formal guidelines which will ensure consistency. The proposed policy is outlined in the attachment to staff report dated August 2, 1994. This policy is a procedural guideline and may be modified at any time as the City Council deems appropriate. I AYES: NOES: ABSENT: Councilmembers Chang, Kuhn, Lojeski, Margett and Young None None The City Council recently enacted Ordinance 2013 establishing a pilot program for outdoor entertainment permits at Santa Anita Race Track (SART). Per City Council direction. the Council added a public participation element to the permit process and a City Council review element regarding conditions. Santa Anita applied for an Outdoor Entertainment Event Permit (OEP) to conduct a three day cultural festival on September 3, 4 and 5, 1994. Under Ordinance 2013, a specific process is prescribed which includes a thorough review of the application, and an extensive public notification and participation process. Use) (APPROVED) 10fO-.;).\- 36:0276 or deny an OEP application rests with the City Manager, and approval may include conditions deemed reasonably necessary to protect health, safety and welfare. The purpose of the report this date was to present to the Council the result of the public meeting and the City Manager's decision regarding the entertainment permit for the crack. The SART application has been reviewed by the various City departments for purposes of analyzing impacts and establishing appropriate conditions. Additionally, staff has retained the services of a noise consultant and a project consultant to assist in the review and processing of the application. Santa Anita has paid its application fee and also deposited the required funds to pay for all City incurred consultant expenses. A public meeting was conducted on Wednesday, July 20 at 6:30 p.m. in the Arcadia City Council Chambers. An extensive public notification process was undertaken in accordance with the OEP process; 27 notices were posted in the residential areas northeast and northwest of the Race Track: over 900 notices were mailed to res idents wi thin a 1,000 foot radius of the SART boundaries; and a notice was published in the local newspaper. Approximately 50 persons attended the meeting and there were 19 speakers. The primary and most frequent issues raised by the speakers were trafficlsecuri ty, noise and sale of alcoholic beverages. The following additional conditions have been added to the OEP. Sales of alcoholic beverages shall be discontinued one hour before the event closes each day. SART shall reimburse the City for any costs incurred for any off-site litter clean-up caused by the event. In response to a question from Councilmember Margett, Police Chief Johnson replied that the surrounding streets will be posted one hour or two hours limited parking. The Police Department does not anticipate problems. In response to a question from Mayor Pro tem Chang, staff replied that Santa Anita will pay for any trash cleanup on surrounding areas and for on-site and off-site police officers. A sound consultant will monitor noise volume over the three days. The City Attorney advised that, in the absence of any changes or modifications to the existing conditions, the permit is deemed to be approved. At the July 26, 1994 meeting, Council considered a proposal from the School District relative to their utilization of City property for the temporary placement of modular classrooms (which was continued to 8-2-94). The School District is refurbishing the existing classrooms at Hugo Reid Primary School which is located at De Anza Place, adjacent to Hugo Reid Park. In order to facilitate the construction, the District is proposing to use portable buildings for classroom purposes during the construction phase. Staff mailed notices to neighbors in a 300 foot radius; the School District furnished the appropriate insurance and liability documents to the City Attorney; and all other matters have been resolved between City staff and the School District. The request for use of the portable structures has been reviewed by the Fire Department, Recreation Department, Community Development Department and the Public Works Department. I Councilmember Margett adjourned the meeting in memory of "Elmer Benson who passed away recently. He was eighty-seven years old. Elmer was born in Denmark and immigrated to the United States in 1922. Elmer resided in Arcadia for thirty-nine years with his wife and companion of sixty-two years, Esther Benson. Elmer was a general contractor of custom homes and churches within the community and Southern California. He retired in 1978 in Fresno, California. He is survived by his wife and sons, Donald and Richard: daughter, Ingrid: eight grandchildren; five great grandchildren; and his brother, Axel of Covina.
