The Arcadia City Council and the Arcadia Redevelopment Agency met
in a regular meeting at 7:00 p. m., Tuesday, September 20, 1994
in the City Hall Council Chamber.

It was MOVED by Councilmember Lojeski, seconded by Mayor Pro tem
Chang and CARRIED that ordinances and resolutions be read by

PRESENTATIONS
Mayor Young presented the Mayor's Certificate of Commendation to
Ms. Diane Naftzer in recognition and appreciation of outstanding
service to the community. Ms. Naftzer is retiring from the
position of Manager of Santa Anita Fashion Park so that she can
be with her children.
Mayor Young presented the Mayor's Certificate of Commendation in
recognition of achievements to Meagan McCellan, Miss Junior
America City Queen.
Mayor Young read a proclamation: "WHEREAS the Arcadia Welfare
and Thrift Shop is celebrating sixty-two years of service to the
conununity, and WHERZAS it wa~ created during the depression to
furnish clothes for needy school children; and WHEREAS this
welfare organization provides temporary emergency assistance for
the financially distressed; and WHEREAS this fine group of
volunteers also coordinates the White Christmas project each year
which provides holiday cheer for families in need, I, Mary Young,
Mayor of the City of Arcadia, do hereby PROCLAIM September 28,
1994 to be Arcadia Welfare and Thrift Shop Day, and do commend
this organization for the unselfish support that they provide to
our community".

AUDIENCE PARTICIPATION
John Wuo, 135 East Alta Street, stated, in part, that he wanted
to thank all past and present councilmembers for their efforts
in bringing Nordstrom to Arcadia. It is the best thing that has
happened to our community. He has never seen a department store
so involved with the community. Nordstrom has helped raise good
sums of money for both the Rotary Club and the Chamber of
Commerce. He is present on behalf of the Arcadia Education
Foundation to announce that this coming Saturday, September 24,
1994 at 8:00 p. m. Nordstrom is putting on a great "rock-the-
block" party for our school children. Tickets are $7.00 per
person, and they will provide refreshments, professional dancing,
professional modeling and lots of prizes. Also Mr. Dan Cortez
of MTV will be present to sign autographs. Mr. Wuo is present
to encourage the children and their friends to attend. "Please
support your Arcadia Education Foundation."

MATTERS FROM ELECTED OFFICIALS
Mayor Young stated that last Saturday night, the Elks Club
generously gave $1,000 to the Arcadia Police Department, and
$1,000 to the Fire Department as a donation for further projects.
This is a wonderful gift and is much appreciated.
Councilmember Margett stated that he had received a letter from
the President of the Rancho Santa Anita Property Owners'
Association urging the City Council to continue contact with
Caltrans in an effort to complete construction of sound walls in
Arcadia along the 210 Freeway.
Councilmember Margett attended the Republican Convention in San
Oiego last week and talked with a candidate for State Controller,
Tom McClintock. Mr. McClintock said that with regard to
finances, the State of California is in de facto receivership.
The legislature has glossed over and balanced budgets to the
extent that it is unrealistic. Last year the State could not come
close to balancing the budget, and went to foreign financiers to
be able to have a stop gap measure to avoid calamity. The
international consortium of bankers dictated the terms so as to
trigger the necessary cuts in the budget so that they could loan
the money. The Republican legislators Councilmember Margett
talked to sounded as though this is a great thing because it is
the only thing that will really bring the legislature into focus
to know how serious the problem is. Also, budgets in the past
always required that as they were proposed, they would be
submitted, and the legislature would pass that particular budget.
However, actually they can propose one budget and then pass
another budget. Councilmember Margett thought that was
outstanding to tell everybody in the State what the budget is and
then change it at the last moment. Also, he learned that for the
last two years when the State was short of funds it merely rolled
over the amount of the deficit into the next year's budget.

decreased, the budget was bloated with debt from the past. Mr.
McClintock said that the legislature, by constitutional
requirements, can only borrow up to $300,000 without going to the
people for approval. They circumvent this in many different ways.
One of the ways that he thought was extraordinary was, i. e. by
placing items on the prison system operating budget that would
call for floating revenue bonds. Therefore the operating budget
has to pay funds out of the penal institution's budget to take
care of those particular bonds. There is a tremendous influx of
expenditures for the prison system, which is bloated because of
the bonds they have to pay that the taxpayer has not really
approved of. Mr. McClintock recommended that we need to have a
genuine balanced budget requirement for the ;-ate of California.

spending limit passed in 1976 or 1979 has been circumvented to
a great degree. Former Governor Dukemej ian insisted that the
State should have reserves of 3% of the budget. There are no
reserves. Mr. McClintock painted a very dreary picture as to
where the State is with regard to its finances.

Mayor Pro tern Chang has had complaints that there is not enough
street lighting, particularly at cross streets with stop signs.
He would like staff to look into installation of street lights
at cross roads where there are no red lights.
Mayor Pro tern Chang also received a letter from the President of
the Rancho Santa Anita Homeowners' Association concerning the
sound wall construction along the 210 Freeway. He would like
staff to look into this matter by contacting Caltrans.
Mayor Pro tern Chang visited the Fire Department Dispatch Center
and thought it was very impressive, with state of the art
equipment and efficient personnel. After his tour of the
Dispatch Center, he feels very secure and would like to have
other Arcadia citizens have the same feeling.
Mayor Pro tern Chang had also attended the Elks dinner and
expressed his appreciation for the generous contributions to the
Arcadia Fire and Police Departments.
Councilmember Kuhn said that she is a member of the
Transportation Committee of the Council of Governments, but since
she was unable to attend the last meeting because of time
conflict with the Council meeting, Arcadia was represented by
staff member Dave Feinberg. There was a discussion of the
Metropolitan Transit Authority long range plan and there will be
more such discussions in the future. The Committee also voted
to hire a transportation expert to assist the Committee for a six
month period. Also, at the Governing Board Meeting of the
Council of Governments, Nell Soto was elected to be the new
representative to the Air Quality Management District. If she
had not been present at that first meeting, they would have
passed a motion requiring all regional shopping centers and
special event areas to submit ride share plans. Ms. Soto asked
that a special task force be set in place to study the issue,
which was agreed to. Councilmember Kuhn would very much like to
see Arcadia represented on this task force because this could
have significant impact on Fashion Park and Santa Anita race
track.
PUBLIC HEARING
The City Council at its August 16, 1994 meeting continued its
consideration of the public nuisance abatement case for the
property at 533 Valido Road for thirty days in order to allow the
property owner, Mr. Mary Card and/or her attorney, Ms. Jennifer
Peters, to submit a report to the City outlining what action and
schedule should be proposed to bring the house and property into
City code compliance. As of this date, no report has been
submitted to the City. On September 1, the Community Oevelopment

Department sent a letter to Ms. Peters and Mrs. Card advising
them that a public hearing was scheduled for the September 20,
1994 meeting to determine what action should be taken on 533
Valido Road to abate the nuisance and attain code compliance,
including the option of demolishing the structure.
In order for the City to prepare the necessary recommendation for
City Council action, a contractor was hired by the City to
inspect the property, and prepare an assessment of the condition
of the house. The contractor completed his inspection on
September 12. The City has also received a preliminary bid on
the cost of demolishing the house (not including removal of the
items inside the house). Because the City had not heard from
Ms. Peters or Mrs. Card, on September 13, staff contacted Ms.
Peters, who advised the City Attorney that she no longer
represented Mrs. Card. Mrs. Card is not doing anything about the
property and is now without representation. Ms. Peters requested
that this matter be continued for thirty days to allow Mrs. Card
time to prepare for the hearing. In view of the time that has
already elapsed and the fairness of the City's approach to date,
staff does not concur that thirty days are necessary, however,
staff is recommending a continuance of fourteen days to October
4, 1994 to bring back a final report for Council on timing, legal
issues and protection for all parties involved.
Councilmember Lojeski stated that it is his opinion that enough
time has elapsed in considering how to accomplish the abatement
of this problem. It is time that Council gave some consideration
to the surrounding community which has had to live with this
problem for a long time now. He inquired of the City Attorney
as to whether the entire abatement procedure would have to be
started over again in the event Mrs. Card engages a new attorney.
The City Attorney responded this would not be required.
Councilmember Margett is concerned about protecting Mrs. Card's
property rights in this matter. He suggested that the City might
auction the property rather than tear it down because he is
concerned about ordering the demolition of private property. He
would like to determine whether or not Ms. Card has the capacity
to make these decisions for herself. He is concerned about the
neighbors, but the City has to balance everyone's rights. The
City Attorney responded that as far as staff has observed, Mrs.
Card is capable of acting on her own behalf, so no conservatory
can be appointed. Staff has been informed of this by Ms. Peters
and by social workers. The City cannot compel any kind of
psychological examination. There is nothing the City can do with
regard to determining her capacity unless a family member steps
forward to help.
Mayor Pro tem Chang inquired if Mrs. Card's family could not be
contacted in order to help the City with this matter. Staff
responded that they had attempted this, but the family refuses
to become involved.
Mayor Young declared the public hearing OPEN.
Tom Stevenson, 525 Valido Road, stated, in part, that his home
is next door to the property under discussion. It was three
years ago that the City first responded to the requests for help
from the neighbors, so this has been an on-going problcu.. Th~r~
has been no progress for three years. Actually, it was the Los
Angeles County Health Department that actually responded by
taking some action. There is concern about Mrs. Card's property
rights, and also concern about the rights of the surrounding
community, and the fact that they have not been served or
listened to or responded to on a timely basis. He is glad to
say that the City finally had exterminators come out and kill
the rats in the rat. infested house. However, there continue to
be open holes in the roof and probably the rats will return.
There are dead rats in the house. City staff wear masks when they

enter the house because of the smell. Two months ago, the
Newco Company placed a 25 foot dumpster next door - 10 feet from
Mr. Stevenson's bedroom window. The dumpster contains a couch,
plastic bags with unknown contents, tree limbs and eight weeks
worth of grass clippings. The dumpster has been there for eight
weeks and smells badly. The dumpster was provided at the
expense of the City apparently with the hope that Mrs. Card would
utilize it to move some of th~ things out of the house, but the
house is still full; Mary Card is not going to cooperate with
the City.
Mr. Stevenson presented a petition with twenty-nine signatures
from the surrounding neighbors which he read to the Council:
"Petition to the Arcadia City Council, dated September 16, 1994.
The Arcadia citizens identified on the following pages urgently
request that the Arcadia City Council take immediate action to
cause the repair or demolition of the residence located at 533
Valido Road, which has been identified by the City Council as a
public health and fire hazard, as well as a public nuisance. It
is our urgent request that the property owner of 533 Valido Road
be required to either repair the property by complying with all
applicable health and fire codes, as well as all appropriate
building, construction and safety codes without further delay or
that the City Council take immediate action to require that the
property be demolished as soon as possible".
Mr. Stevenson was glad to hear that on October 4, there will be
no more continuances. Last May, Council assured the residents
that within ninety days action would be taken. Ninety days was
a few months ago. Staff responded that the dumpster is to be
removed within the next week.
In response to questions from Councilmember Lojeski, Mr.
Stevenson said that Mrs. Card is on the premises quite a bit of
the time, although she does not stay overnight. In response
to questions from Councilmember Margett, Mr. Stevenson said it
was highly unlikely that any family members would be available
to assist in this situation.
No one else desiring to be heard, the public hearing was
CONTINUED to the October 4, 1994 City Council meeting on MOTION
by Councilmember Margett, seconded by Councilmember Kuhn and
CARRIED.
Councilmember Lojeski emphasized further that the City and
Council have been exceedingly generous in this whole situation,
and he would not like to see this carried on beyond the October
4, 1994 continuance. Councilmember Lojeski also emphasized that
he wants the trash bin moved off the property and that should be
part of the motion.

Consideration of the request for waiver of ARA Resolution No.
ARA-172 to permit a gun and jewelry shop in the Central
Redevelopment Project Area at 50 E. Huntington Drive.

Aramis Gulbevan. Sr., 12140 Ranchito Street, El Monte, stated,
in part, that he formerly operated a gunsmith/jewelry store at
602 E. Live Oak Avenue. He stated that the proposed new location
was formerly a jewelry store and that it has barred windows. He
plans to sell jewelry and guns, but most of his business involves
repairing and refitting guns.
Agency Member Lojeski explained how the Agency had in years past
developed the list of businesses they deemed to be inappropriate
for the redevelopment area. He did not feel this list should be
disregarded because of the present economic climate. Although
there are several such businesses in the area, most of them were
already in business there before Resolution ARA-172 was adopted.
It was MOVED by Agency Member Kuhn, seconded by Agency Member
Lojeski and CARRIED on roll call vote as follows to OENY the
request for a waiver from Resolution ARA-172 to permit a gun and
jewelry shop at 50 E. Huntington Drive in the Central
Redevelopment Project Area.
Agency Member Margett said that the Agency should make its
commitment to the redevelopment area to make it a desirable place
for businesses. Thus far, the Agency had done nothing to improve
that area, and yet has in place a long list of undesirable
businesses for this area. Agency Member Kuhn noted that this
proposed location is between two bars, Agency Member Loj eski
responded that staff is in the process of developing specific
guidelines for improvements in the redevelopment area as recently
directed by the Agency.

The City acquired title to .the Armory property at 260 W.
Huntington Drive from the State of California in May of 1988.
The Armory property is immediately adjacent to the Civic Center
complex and provides additional area into which future municipal
facility expansions could occur. Before any significant action
can be taken concerning the long term disposition of the Armory
(demolition or major alteration), existing asbestos in the Armory
buildings will need to be identified and removed by qualified
personnel. While the State has supplied a copy of their asbestos
survey for the Armory, it appears to be incomplete. This concern
is based upon staff's experience with other asbestos reports it
has received. The State report lists only materials found on
site which contain asbestos and does not include a comprehensive
list of all materials sampled and tested. Without an accounting
of all samples taken, the City may not be able to rely on the
State report as the basis of asbestos removal work. The Request
for Proposal (RFP) circulated July 11, 1994 contemplates a three
phased approach to the Armory asbestos work: Phase I
Assessment of the State report; Phase II - Asbestos Survey of
the Armory; Phase III - Asbestos Abatement. The City received
responses from Triangle Core of Consultants and ATC
Environmental, Inc. Triangle Core of Consultants is more cost
effective by $2,665.
Considerable discussion ensued among the Councilmembers.
Councilmember Lojeski expressed concern that the City had
acquired ownership of the property without having the State
perform the asbestos clean-up. He does not feel that the State
will ever reimburse the City for the cost of this clean-up. At
Council's request, staff reviewed the details of the purchase,

with a five year lease-back to the National Guard, and eventual
possession of the property by the City. There was no knowledge
of an asbestos problem prior to June 1993 during the final walk-
through, prior to taking possession of the property. At that
time the City was informed verbally by State National Guard
officials that a survey had been done in 1989 which revealed the
presence of contaminated materials. At staff's request, a copy
of the survey was forwarded to the City. The asbestos in the
buildings is non-friable, and is not of any danger unless it is
broken into or tampered with, The City Attorney stated that
request has been made to the State for reimbursement of the cost
of this contract and the eventual cost of clean-up. If this is
denied, the City will enter into litigation to recover these
costs. Since the City has recently leased some of the space to
the Arcadia Unified School District, and although the City is
protected from liability by a lease clause, the clean-up should
be undertaken without too much delay.

City Manager to enter into an agreement, subject to City Attorney
approval, for asbestos removal management services for the
Arcadia National Guard Armory to Triangle Core of Consultants up
to an amount of $15,750 ($13,690 plus 15% for contingencies) and
DIRECT that staff endeavor to recover these costs from the State.

On Oecember 31, 1994, the City's three year contract with First
Interstate Bank to provide banking services for the City's active

CITY MANAGER
Vincent Folev, 1st Vice President and Chief Financial Officer,
Arcadia Tournament of Roses Association appeared at the September
6, 1994 City Council meeting to request financial assistance for
the Tournament of Roses Association. He is present tonight to
thank the City Manager for the report prepared by his office.
After a review of the report, the Tournament Executive Committee
felt that there is information that can be better presented to
the Council. Mr. Foley, on behalf of the Tournament Executive
Committee, requested that this item be continued to the October
18, 1994 City Council meeting.

The City Attorney announced that the City Council will enter a
CLOSED SESSION, "pursuant to Government Code Section 54957.6 for
conference with labor negot~ators Dan Cassidy and/or Gary Rogers
regarding unrepresented employees and AFSCME Local 22264, the
Arcadia Firefighters' Association, and Arcadia Police Relief
Association. "
Councilmember Margett adjourned the meeting "in memory of Kenneth
Otto. Ken was born in 1927 and passed away on September 2. He
was born and raised in Chicago and served in World War II. Upon
his discharge from the Navy, he became a police officer in
Chicago, and served in this capacity until he moved to California
in 1960. After his retirement from law enforcement, Ken moved
and began a career in the private sector, working for the 3M
Manufacturing Company for several years. Ken is survived by his
wife, Joan; daughters Linda and Cindy; and grandson, Blake. Ken
also has a special place in the hearts of the entire Margett
family as our son, Jim is married to the daughter, Linda. Ken
was a devoted family man whose memory will be cherished forever."
Councilmember Lojeski adjourned the meeting "in memory of a long-
standing friend of Arcadia . - a lady I first met when I was
thinking of running for City Council. She at that time was a
member of the Arcadians for Arcadia, a group that I know Mary
and Bob both remember very well. Barbara Regan was always there
and always asking the questions. Barbara had moved to the desert
communities, the Palm Springs area, I believe. It was noticed
in the newspaper that she had passed away. I don't have a lot
of information at all. She and her husband, Frank, owned the
Santa Anita Camera Shop, and were real participants in the
community. I know there are a lot of folks in this community
that had appreciated the Regans and what they have contributed
to the City of Arcadia. The City again has lost a very, very
fine member and a fine friend. I would like to adj ourn
tonight's meeting in memory of Barbara Regan."
At 9:16 p. m. the Council entered the CLOSED SESSION, RECONVENED
and ADJOURNED the regular meeting at 10:45 p. m. to Tuesday,
October 4, 1994 at 7:00 p. m. in the Council Chambers for a
regular meeting to conduct the business of the Council and the
Arcadia Redevelopment Agency and any Closed Session necessary to
discuss personnel, litigation matters and evaluation of
properties.
