The City Council met in a regular meeting at 7;30 p, m,. Tuesday,
February 16, 1993 in the Arcadia City Hall Council Chambers,

On MOTION by Councilman Lojeski, seconded by Councilman Margett
and CARRIED, the minutes of the adjourned regular meeting (work
session) of January 26, 1993 and the adjourned and regular
meetings of February 2, 1993 were APPROVED.
It was MOVED by Mayor Pro tem Ciraulo, seconded by Councilman
Harbicht and CARRIED that ordinances and resolutions be read by
title only and that the reading in full be WAIVED,
PRESENTATION
Members of the Arcadia Sister City Commission, Tom Romano. Robert
Westfall, Beverly Street, Peter Daily, Jerre Lean and Beth Wells,
presented a check for $2,500 to the City Council which the
Council had given to the Commission as seed money co hosc the
Newcastle, New South Wales Koala Band which visited Arcadia in
Deqember and January. While the group was in Arcadia, they were
entertained by the Sister City Commission, the citizens and the
host families, Tom Romano expresed appreciation of the Council's
action in advancing this money to the Commission,

The City Attorney announced that, "the City Council met in a
CLOSED SESSION this evening pursuant to Government Code Section
54956,9(c) to discuss a situation of potential litigation based
on various facts and circumstances'that made it necessary to go
into a closed session to consider whether we were going to
initiate litigation". For the benefit of those present and the
television audience, the City Attorney gave a brief review and
explanation of the provisions of the Ralph M, Brown Act

$98,598.43, Said award based upon the Los Angeles County
contract T-337, Funds for the purchase of the seven vehicles are
budgeted in the Equipment Replacement Fund FY 1992-93, in the
amount of $l22, 500.00. Appropriation also includes necessary
accessories - sirens, light bars, etc.

Consideration of a request for removal of a City parkway tree at
2050 Canyon Road. Considerable discussion ensued among Council
with regard to the request from Mr. & Mrs. Robert Murphy that
they be allowed to'remove a City Italian Stone 'Pine tree because
the roots of the tree are damaging their driveway. City policy
regarding tree roots is that the City assumes no responsibility
on private property for root pruning/removal or for damage caused
by roots, The Public Works Director r.oted that a root barrcer
could be used which would control the problem for five or ten

years at a cost of approximately $700. The cost to remove the
tree and replace it would be approximately $2,600. This tree is
approximately fifty years old, and there are many such trees in
that area. Staff suggested an arborist could be contacted to
look at the tree and give a professional opinion, Councilman
Margett felt that if a decision should be made to trim the roots,
it would be important to make sure this did not weaken the tree,
possibly causing it to fall in the event of a high wind,
Councilman Lojeski said the property owner should be informed of
alternatives to removing the tree such as trimming or controlling
the roots. In his opinion, Co~ncil does not need to change the
City's policy, Council should consider each such request to
remove a tree on a case-by-case basis. Councilman Harbicht noted
that the property owner does not need City permission to control
the roots on his private property.
It was MOVED by Councilman Harbicht, seconded by Councilman
Lojeski and CARRIED on roll call vote as follows to give the
homeowner at 2050 Canyon Road permission to remove the Italian
Stone Pine tree at his own expense on the condition that it be
replaced with a tree that is acceptable to the City. and that the
City Engineer be DIRECTED to send the homeowner information on
alternatives such as root barriers.
Mayor Fasching felt an arborist should look at the tree and
provide advice. This is a serious situation of trees which were
planted in that area forty years ago. Other property owners on
that street may want to remove trees and the neighborhood will
look bare. He does not want to give permission to take the tree
out until he receives the complete story and a complete program
is worked out.

Councilman Harbicht initiated a discussion among Councilmembers
as to the value of continuing the Council work sessions. He
noted his problems with the work sessions: l) City Council

sessions are now telecast to the citizens. The work sessions by
contrast are almost private meetings. Technically, they are not
in violation of the Brown Act, but they are held in the
Conference Room; members of the citizenry do not attend, A lot
~ work is being done in these work sessions. and what finally
- appears at the regular Council meeting is merely an item on the
consent calendar, For example, at the last Council meeting, the
matter of the Fire/Police dispatch system was addressed as a
consent calendar item, but it had previously been discussed at
four work sessions, Information about such a high cost and
public safety item is important to the community, 2) Council is
spending a lot of time studying what he considers to be routine
matters, This wastes both Council and staff time, 3) Council is
not addressing matters in a timely fashion; many items are being
delayed until they can be considered at a work session. He
listed some examples, Councilman Harbicht would like to see
Council cancel the automatic work sessions and call such sessions
only when there is a need for wide ranging discussion and
exchange of ideas,
Councilman Margett agreed with some of Councilman Harbicht's
points. but thought that the necessity of making quicker
decisions in the Council meetings means that a particul'. issue
would be shortchanged, Perhaps a criteria should be es lished
for items to be considered at a work session. He woul, _ike to
continue the work sessions, but perhaps limit them to one issue
per session.
Mayor Pro tern Ciraulo said there is a great deal of value in
discussing one or two items at great length in a work session in
preparation for a Council meeting. Also, it gives opportunity
for interaction and an in-depth look at the issues prior to
making a decision. He agrees that less important items need not
be presented at a work session, He would like to see the work
sessions continue to be held every other week, but that they
should be limited to one or two items.
Councilman Lojeski shares concerns on both sides of the
discussion. He agrees that many of the staff reports can be read
prior to the Council meeting, and a decision made at the meeting,
thus eliminating the need for discussion at a work session, He
agrees with the idea of setting some strict parameters for
subject matter and discussions at the work sessions,
Mayor Fasching disagrees with Councilman Harbicht's suggestions,
He feels the discussion of subject matter at the work sessions
has been very profitable to him in fulfilling his roll as
Councilman. The responsibilities and the projects planned to be
accomplished for the City take a lot of study and consideration,
He feels that those elected should be willing to put in the time,
However, a time limit should be put on the work sessions. Based
on input from Councilmen, the City Manager brings the items that
need special attention to a work session. Not every item can
be discussed at length at a Council meeting. Work sessions are
public meetings, attended by the press and listed in the
newspapers, and they are invaluable and important to
Councilmembers in fulfilling their positions in the City.
It was the consensus of Council that each Councilmember give his
thoughts to the City Manager as to what kind of items should be
discussed, and how often work sessiOns should be held. The City
Manager will then return to Council with his recommendations.
Councilman Lojeski suggested that the Public Works Director might
like to contact John Provine at the Arboretum. This person is
an expert on trees and perhaps he could be contacted with regard
to some of the questions raised about trees.
Mayor Fasching referred to the Clinton Administration short term
spending plan for local infrastructure projects, and inquired if

Mayor Fasching. in reference to the proposed joint City/Caltrans
soundwall project on the west bound Route 210 Freeway in Arcadia,
stated that the project is to be submitted by Caltrans on or
before June 30. 1993 for consideration in the last two years
(l999-2000) of the seven year STIP cycle beginning in 1994,
However, Caltrans will be trying to get additional money and, if
possible, the project may be considered earlier,
"I would like to close the meeting tonight in memory of a dear
departed friend, Most of us here on the Council knew Bob Crumley
who was born in Los Angeles in 1926 and passed away January 25,
1993 in Arcadia, Bob was for many years an account manager for
Western Airlines and Delta. He retired several years ago from
that position. Bob is survived by his wife. Margaret Margo
Crumley of San Oimas; daughters. Susan Crumley and Sandra
Kalomiris; a brother, Dennis Crumley; and granddaughters,
Stephanie Crumley and Kelly Kalomiris, Bob was a wonderful man
and I know he went through a very tough time for a couple of
years before he passed on, But all the time when he really was
in bad shape, Bob always had a smile on his face, He was never
down, he always tried to stay up. He will be sadly missed and
I close the meeting tonight in his honor,"
