On MOTION by Mayor Pro tem Lojeski, seconded by Councilmember Fasching and CARRIED, the minutes of the special, adjourned and regular meetings of September 7, 1993 were APPROVED. Councilmember Margett abstained since he was not present at that meeting. It was MOVED by Mayor Pro tem Lojeski, seconded by Councilmember Margett and CARRIED that ordinances and resolutions be read by title only and that the reading in full be WAIVED. PRESENTATIONS In honor of Gordon Maddock's 20th anniversary as founder and owner of Baldwin Realty Company, Mayor Ciraulo presented Mr. Maddock with a proclamation commending this achievement. The proclamation listed also Mr. Maddock's 20 year involvement with the Arcadia Chamber of Commerce for which he will soon lead the Chamber as president. Also noted were his many community activities such as Little League, Cub Scouts, the Arcadia Education Foundation; Arcadia High School Alumni Association and the Arcadia Tournament of Roses. Mayor Ciraulo proclaimed September 21, 1993 as Gordon Maddock/Baldwin Realty Day and offered congratulations on behalf of the City Council. Mayor Ciraulo read the following proclamation: "WHEREAS Lions International have as their motto, 'We Serve' and acknowledging that they do this primarily in the field of eye and blind care, with particular concern for local community activities; and WHEREAS each year the Arcadia Lions Club conducts its annual White Cane Days drive to raise funds that are used throughout the year for many community activities; and WHEREAS aside from their work with the blind and the deaf, they provide financial support to the Arcadia Health Care Council, the Campership Program, the Red Cross and scholarships for Arcadia High School seniors; now therefore, I, Joseph C. PUBLIC HEARING MC 93-035 (1030 S.Sixth Avenue) (APPEAL DENIED) () ,'ifQ . ,) ,;"' 35:0249 Mayor Ciraulo then presented the proclamation to Lions Club President, David Teigen on behalf of the City Council. Mayor Ciraulo presented and read a proclamation honoring Police Chief Neal Johnson for his 37 years with the Arcadia Police Department which included the past eight years as Chief of Police. His involvement in community activities with special emphasis on Boy Scouts programs was commended, in particular, Chief Johnson's involvement as Chairman of the Security and Fire Departments of the National Boy Scout Jamboree held in the State of Virginia this year. Mayor Ciraulo proclaimed September 21, 1993 to be Neal Johnson Day, and, on behalf of the City Council lauded Chief Johnson for his exemplary efforts to promote not only the safety of Arcadia, but the safety and wellbeing of the participants of such an important and prestigious national event. I Mayor Ciraulo announced: "Once every ten years fire departments are rated on a Class I to X basis by the Insurance Services Office through a detailed survey on fire protection to determine the official fire insurance classifications. For years Arcadia had been rated a Class II department, which is exceptional on the rating scale, The Fire Department staff has aggressively pursued the hope of being upgraded to a Class I. On August 1, 1993, Arcadia became one of sixteen Class I cities in the nation. That is quite an achievement, A distinction that makes a long- time dream a reality. The Class I rating results in lower fire insurance premiums, and translates to the City's commitment to provide the highest level of fire protection possible to the residents and businesses of Arcadia, The new superior rating reflects the programs, personnel, equipment and training which have been approved by the City Council, and sets Arcadia apart from other communities. Arcadia citizens -- all of us -- can be proud to be served by a Fire Department with such an impressive distinction." Mayor Ciraulo then presented a plaque to Fire Chief Gardner and City Manager Don Duckworth in recognition of the Fire Department achieving the distinction of Class I status, August 1, 1993, on behalf of the City Council. The City Attorney announced that there will be no scheduled hearing this evening concerning an appeal to the City Council of the Business License Review Board's decision concerning the Sports rock Cafe, specifically the application from Mr. DeSilva. Mr. DeSilva is no longer a party of interest with regard to that business enterprise and the appeal would be moot, Persons wishing to speak about this matter may do so at the time reserved for audience participation. Consideration of an appeal of the Planning Commission's denial of a request to construct an 800 square foot detached four-car garage on a lot with two non-conforming single-family dwellings in the R-l zone at 1030 South Sixth Avenue (MC 93-035). The Modification Committee denied the request at its July 27, 1993 meeting because the proposal exceeded the standard parking requirement in the R-l zone. The Planning Commission also denied the request at its August 24, 1993 meeting. I The subject site is a very deep lot consisting of two legal non- conforming single-family dwellings on an R-l zoned property. The two one-story dwellings each have attached garages. According to the applicant, the existing tenants use the attached garages for storage space and park their cars on the paved driveway in front of their homes on Sixth Avenue. The applicant would like to utilize some of the unoccupied rear yard space to construct a four-car garage and continue. to allow the tenants to use the present garage areas for storage space. City Code Section 929l.l.4.l5(c) allows modifications to legal non-conforming uses in the R-l zone for required parking facilities for the main dwelling. 2 9/21/93 ", 35:0250 Mayor Ciraulo declared the hearing OPEN. Cletus R. Verlato, 1509 Highland Oaks Drive stated, in part, that the garage he proposes to build is an improvemenc for the neighborhood. There are many non-conforming uses in the area. He has lived in Arcadia for many years and would not do anything to downgrade the area. When these houses were built, they were in compliance with the City Code. , Ann Roberts Verlato, 1509 Highland Oaks Drive stated, in part, that the 90 feet in the rear of the property is not used for any purpose at present. She feels that the proposed garage and nice landscaping in the area would be more attractive than a concrete slab parking area. I David Strinller, 1029 Encino Ave" stated, in part, that his backyard is adjacent to that of Mr. Verlato, He requests that Council continue to deny this appeal. He does not feel that Mr. Verlato's tenants will park in the proposed garage because it is not convenient for them. There is no way of knowing what use may be made of this garage, i. e., people working on autos. Mr. Verlato does not live on the premises so there is no way to police this use. Mr. Stringer requested that Council deny this 'appeal because the proposal leaves itself open to so many potential problems to the neighboring area. No one else desiring to be heard, the public hearing was CLOSED on MOTION by Mayor Pro tem Lojeski, seconded by Councilmember Fasching and CARRIED. Cletus R. Verlato, 1509 Highland Oaks Drive stated in rebuttal that his property is well cared for. The idea of an automobile repair shop is far fetched. The property under discussion is a large lot and the proposed garage will not be at the end of the property so it will not be too close to the neighbors on Encino Avenue. David Strinller, 1029 Encino Avenue, stated in answer to the rebuttal that although the front part of Mr. Verlato's property is well maintained, this is not true of the back portion of the lot, The trees are not trimmed. City employees at one time inspected the property and instructed Mr. Verlato to clear the weeds, or the City would do it at his expense. Also he mentioned that one of the vehicles currently parked in the driveway is a camper which, because of its size, would not be parked in the proposed garage anyway. Cletus R. Verlato, 1509 Highland Oaks Drive stated in rebuttal that he has never received a citation from the City. Six or seven years ago the Fire Department instructed him to have the weeds cleared from the back of the lot which he did promptly. I Discussion ensued among Councilmembers as to whether or not this proposed four-car garage would actually be an improvement in light of the fact that garages are presently available for the tenants. Mayor Pro tem Lojeski called attention to the property maintenance situation on the rear of this property, It was MOVED by Mayor Pro tem Lojeski, seconded by Councilmember Margett and CARRIED on roll call vote as follows to DENY the appeal, thus denying the application, and uphold the Planning Commission's action in overruling the appeal to the Modification Committee action and that, based on the evidence presented, that the requested modification of MC 93-035 will not secure an appropriate improvement, nor prevent an unreasonable hardship, nor promote uniformity of development. Requirement - Karaoke) (APPROVED) O,fro _ h J;- 3. 4. 5. Sa. ROLL CALL 35:0251 Consideration of Text Amendment 93-004 to the Arcadia Municipal Code adding regulations governing karaoke uses including a requirement for a conditional use permit for all karaoke sing- along businesses. The proposed text amendment includes requirements for parking, hours of operation and specific regulations relating to the operation of a karaoke use, including prohibiting private rooms and the sale and consumption of alcoholic beverages in any business exclusively operated as a karaoke sing-along. The text amendment also recommends that karaoke and/or sing-along businesses be permitted in the C-2 or any less restrictive commercial zone only with an approved conditional use permit. Arcadia Police Chief Neal Johnson stated, in response to I questions from Councilmember Margett, that there have been incidences of shootings, fights, and illegal drinking at such facilities. Since many San Gabriel cities have restricted the karaoke clubs, the patrons all come to Arcadia. When the karaoke club has private rooms, it encourages gang attendance, which allows them to gather and plan criminal activities. Chief Johnson further stated there have been no problems in Arcadia with karaoke in an open room environment. Mayor Ciraulo declared the hearing OPEN, No one desiring to be heard, the hearing was CLOSED on MOTION by Mayor Pro tern Lojeski, seconded by Councilmember Fasching and CARRIED. It was then MOVED by Councilmember Fasching, seconded by Councilmember Margett and CARRIED on roll call vote as follows to APPROVE and FILE the Negative Declaration, and FIND that text amendment 93-004 governing karaoke uses including requiring a Conditional Use Permit for all karaoke sing-along businesses will not have a significant effect on the environment, and DIRECT staff to prepare the appropriate ordinance, AYES: NOES: ABSENT: Councilmembers Fasching, Lojeski, Margett and Ciraulo None Councilmember Harbicht AUDIENCE PARTICIPATION Brad Beck, 206-B South Santa Anita Avenue, stated, in part, that his car has been stolen from the street in front of his residence twice recently. The last time the car was stolen in June, it was abandoned about two blocks from his residence. The Police Department recovered the car and had it towed to the G & S impound lot in Irwindale, Because of confusion regarding the license number, he was not notified of this for four weeks. Because of this error on the part of the Police Department, he was charged $173 for towing and storage fees. After he I petitioned the Police Department, an adjustment was made in the storage charge in the amount of $91. He is present tonight to request reimbursement for the remaining towing charge of $82. After considerable discussion among Councilmembers, it was the consensus that this had been an error in the system as the result of the incorrect license number, and that this matter be resolved by the City Attorney and Police Chief. The meeting ADJOURNED to 5:30 p. m., September 28, 1993 CITY COUNCIL RECONVENED MATTERS FROM ELECTED OFFICIALS Councilmember Margett said that hopefully by next May the rehabilitation of Orange Grove Avenue will be started, and be finished by this time next year, This has been a long time coming, and he is optimistic that finally a solution has been reached. Councilmember Margett noted that Arcadia has received a No. 1 priority for the freeway sound wall construction for the year 1999 or 2000. The residents who have waited so long can now at least look forward to that date. He would like to suggest that some way be found to get Caltrans to clean off the weeds from the freeway on-ramps and off-ramps in Arcadia. Councilmember Margett referred to the correspondence in the Newsletter and the encouraging talk between the City of Monrovia, Mr. Pokrajac, Mr. Bluth and the City of Arcadia with regard to moving the water tanks on Mr. Bluth's tract above the City, He hopes that whoever is doing the engineering here will' not let this grow cold because this is important to the City. Everyone realizes that the tanks were misplaced to begin with, Staff noted that Arcadia has done everything it can to bring about the movement of th0ge tanks. It is hoped that these private parties and the City of Monrovia can bring this about, Monrovia seems ready to cooperate. Councilmember Margett noted that he sits on the Board of the San Gabriel Basin Water Quality Authority. The first step has been taken to remove contaminants and clean up the water in the San Gabriel basin. Arcadia is outside the plume; nevertheless we are participating with the San Gabriel Basin Water Quality Authority to be able to correct the contamination level, It is commendable that the Water Quality Authority recognized this problem years ago and realized that the San Gabriel Valley could not wait for federal funds to become available, An additional fifty to fifty- five cents will be added to each water bill over a period of three to four years which hopefully will provide funds for this cleanup. Councilmember Fasching referred to the proposed video arcade in the southern area of the city, and the comments and letters thereon received from the residents. The applicant subsequently withdrew the application for this arcade. Councilmember Fasching suggested that the Planning Oepartment respond to those residents with this information. Mayor Pro tem Lojeski said he also hopes the rehabilitation of Orange Grove Avenue will now go ahead. Historically, the record has not been good. Perhaps with a change in the managership in Sierra Madre there will be better cooperation in the future. Mayor Pro tem Lojeski appreciated the efforts of the Public Works Department tree crews in trimming the bushes in the college 5 9/21/93 9a. RECLASSIFICA- A number of proposed salary increases and position audits TIONS & SALARY requested by the Executive Management Team have been analyzed by REVIEWS the Human Resources Department staff. Those requests upon which (Pub. Works, action is recommended are: Public Works Department - Parks Library & Superintendent Equity Adjustment; City Library - Circulation Recreation Supervisor to Librarian; and Recreation Department Class Depts.) Coordinator to Typist Clerk II. The salary and benefit increase (APPROVED) of $1,234; $1,215, and $1,376 respectively to become effective January 1994. Mayor Pro tem Lojeski noted that Pastor Summerell who provided the invocation for this evening's Council meeting is a young man who was raised here in Arcadia and attended Holly Avenue School. He has returned to Arcadia, and is a minister of a church. This speaks well for the background and the quality of life that we are blessed with here in Arcadia when fine, upstanding young people like this come back to us. CONSENT ITEMS WAIVED the formal bid process and AWARDED the contract for the purchase of the breathing apparatus and composite cylinders to Special T Fire Equipment Inc., in the amount of $28,777.18. I APPROVED the issuance of a permit for a public fireworks display at Arcadia High School as part of the annual half-time festivities at the Homecoming Football Game on October 29, 1993, subject to the conditions listed in staff report dated September 15, 1993. It is anticipated that this action will improve coordination among the operating divisions, support an environment that is sensitive to the development and business communities, and better promote citizen sensitivities on the part of City staff. The new Department will be made up of the economic development, planning, building and code enforcement functions, and be managed by a Community Development Oirector. Some of the benefits of creating a Community Development Department are outlined in the September 14, 1993 staff report. Considerable discussion ensued among Councilmembers regarding the classifications and salary ranges resulting from the proposed reorganization, At its July 8, 1993 meeting, the Human Resources Commission reviewed and approved the proposed classifications and forwarded its recommendation to the City Council for review and consideration. The City Attorney presented for introduction and read the title of Ordinance No. 1994: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING PART 5 OF CHAPTER 9, ARTICLE II OF THE ARCADIA MUNICIPAL CODE TO CREATE A COMMUNITY OEVELOPMENT DEPARTMENT WITH PLANNING, BUILDING AND ECONOMIC DEVELOPMENT DIVISIONS". The proposed salary range for the Human position is $4301 - 5228 per month. Staff presented a submittal from John Risk of Communications Support Group, This firm would be able to provide expert advice on the upgrade of the City Council chambers for cablecasting Council meetings. Mr, Risk's expertise includes engineering, acoustics, lighting and equipment purchase and installation. Additional information detailing the scope of the work related to the Council chambers is outlined in the September 15, 1993 staff report. The total cost for Mr. Risk's services would be $8,710, There are sufficient funds in the General Fund reserve to fund this project. Councilmember Fasching felt it to be important to have such expertise available to the City. It was MOVED by Councilmember Fasching, seconded by Councilmember Margett and CARRIED on roll call vote as follows to RETAIN the services of Communications Support Group to provide consulting services on the upgrade of the City Hall Chambers for the purpose of cablecasting 'Council meetings, The contract cost shall be an amount not to exceed $8,800 to be appropriated from the General Fund Reserve.
