PRESENTATIONS Mr. Alex Ingle, V. P. and Secretary-Treasurer, Santa Anita Operating Company, stated that under the auspices of Mr. Ray Rogers of the Oak Tree Racing Association, the Santa Anita Race Track will be the site of the 1993 Breeders' Cup racing event. Mr. Ray Rogers, Breeders' Cup Event Coordinator, continued that the Breeders' Cup racing event will take place on November 6, 1993. The Breeders' Cup was held at Santa Anita in 1986 and it was a tremendous day with 68,000 people present. The Breeders' Cup is generally thought of as the world championship of racing. The best horses from Europe and America will be racing. They expect sixty horses to come in from Europe. The program of seven races will be simulcast that day to thirty locations in California, and over forty-five out of state locations as well as Mexico and Canada. Surveys in Florida and Kentucky indicate that the Breeders' Cup results in a forty to sixty million dollar boost to local economies. It is estimated that the City will benefit in an approximate amount of $45,000; the State over $1.2 million dollars; other local goverrunents will also benefit. Salaries and benefits for the day are estimated at $400,000. Purse money will be $10.3 million. Over the years approximately 1 10/5/93 PRESENTATINS (Colt & Pony All Stars' Baseball Teams) l. PUBLIC HEARING CELLULAR TEL. 5 % UTIL, USERS TAX (APPROVED) D3~O _/.l() ORDINANCE NO, 1997 (INTRODUCED) 35:0265 30 - 35% of the purse money has been won by California horses, which is an advantage for local owners and trainers. Santa Anita expects that over 50,000 people will be in attendance on November 6, in addition there will be another ~stimated 40,000 Southern California satellite viewers. Mr, Rogers said that he greatly appreciates the cooperation of the City and its Police, and other departments. Mayor Ciraulo stated that the City is honored that the Breeders' Cup is going to be held in Arcadia and also extended his best wishes to Santa Anita for a very successful Oak Tree meet. Councilmember Fasching also said he is very excited about the Breeders' Cup, and volunteered his services as well as those of the other Councilmembers on November 6, to help out. Mayor Ciraulo introduced the Colt, Pony and Pony Thirteen Year Old All Stars baseball teams, their managers and coaches. The Council is proud of these All Stars and congratulates them on their successful season. The Mayor's Certificate of Commendation in recognition and appreciation of outstanding 'achievement was presented to each member of the teams, their managers and coaches. I Consideration of amending Section 2671 of the Arcadia Municipal Code to apply the 5% utilities users tax to cellular telephone access charges. In reply to questions from Council, the Finance Director replied that a number of other cities have such a utility tax on cellular phones; some at a higher rate and some at a lower rate than the proposed 5%. He estimates that the 5% utilities users tax, if applied to Arcadia cellular phone users, may generate approximately $60,000 per year to the City. Mayor Ciraulo declared the public hearing OPEN. Johanna Hofer, 875 Monte Verde Drive, stated, in part, that she opposes amending Section 2671 of the Arcadia Municipal Code to apply the utility tax to cellular access charges. She also thinks the utility tax should be lowered if not obliterated entirely. Non-citizens of this country should pay higher taxes when buying or selling property in this country as well as paying higher business license fees. The legality or illegality of this proposal should be examined. U. S. citizens should get special discounts and benefits while doing business in this country. She has presented this proposal to various local, state and national legislators. I In response to questions from Council, the City Attorney replied that legislation is currently pending concerning the application of a utility users tax on cellular phone usage. However, the City may extend the tax to cellular access charges. Councilmember Harbicht noted that this is just a matter of equity since other phone usage is taxed by the City. The 40th Invitational Band Review and field Show is to be presented in Arcadia on November 20, 1993. The Band Review is a qualifying event for the Pasadena Tournament of Roses Parade. The Committee has invited Bill Welsh, television commentator of the Rose Parade and Director of Special Events for Channel 11 to be the Grand Marshall of the Band Review. He invited members of the City Council to participate in the parade and sit at the reviewing stand during the parade. Johanna Hofer, 875 Monte Verde Drive, stated, in part, that she is sorry to see the National Guard leave Arcadia. She felt very safe with the presence of the National Guard, and feels that the City made a big mistake by allowing the Guard to leave because they could not afford the rental. She does not think this is the time for the City to build another building on that property. Mayor Pro tem Lojeski commented that the decision to move was that of the National Guard. The City acquired the property five years ago once it was made known that it was available. The City did not charge rental fees to the National Guard for the five years that the Guard had access to the property. Raul LoDez, Chief Executive Officer, Teamsters Local #396, stated, in part, that he is present to speak on behalf of the employees of Newco Waste Systems who may be affected by Council's decision with regard to Newco's contract renewal. If there is a negative decision, Newco employees will lose their jobs as well as the benefits which Newco provides. Newco is providing service to Arcadia at one of the lowest prevailing rates of any in the surrounding cities. Newco has employed individuals who are knowledgeable in the rubbish industry who are turning the company around financially. On behalf of the Newco employees, he requested that the Council continue to retain Newco as rubbish collector in the City of Arcadia. Mike Green, 1635 Perkins Drive, stated, in part, that he missed the meeting when the decision was made to close Wilderness Park on the weekends. He and his family miss the park because weekends are the only times they can enjoy it. He never saw any evidence of a problem at the park. This decision seems to have been made in accord with the wishes of a relatively small number of people, rather than in consideration of the wishes of all of the people in Arcadia. They are homeowners and that was their neighborhood park and now they can't use it. Jerrv Collins, Recreation Director stated that the present policy is that reservations are available for groups up to twelve persons and there is a $10 fee. Councilmembers Fasching and Margett indicated that they would be willing to have further discussion with Mr. Green. Brad Beck, 206 South Santa Anita Avenue, stated, in part, that he was present at the previous Council meeting to petition the City for a refund of money incurred in getting his car from impound after it was stolen. However he received a letter from the City Attorney denying his petition for refund. The City Attorney explained that the City had refunded the storage fee with the exception of one day's storage because there had been a delay on the part of the Police Department in notifying Mr. Beck that his car was impounded. However, Mr. Beck is still liable for the towing fee and the storage for one day because the 3 10/5/93 3, 4. 4a. MATTERS FROM ELECTED OFFICIALS ,ALFORD (Election Code Amendments) 1030-,:)0 I'?C( y' NSP MARGETT (Handgun Training) (Backflow Preventers) The City Clerk stated that Governor Wilson recently signed into law a bill (AB 1282) which legislates changes in the Election Code resulting in a major change in the time period for nominating candidates for the City Council. The next City election will be April 12, 1994. However, nominations for City Council will now open on Monday, December 20, 1993 at 8:00 a. m. at the City Clerk Office at City Hall. The nomination period extends to January 14, 1994, and will close promptly at 5:00 p.m. on that date. However, if an incumbent does not file, the nomination period will be extended to January 19, 1994, for candidates other than incumbents. I Councilmember Margett stated that he has heard comments from a number of residents indicating that they are encouraging their wives and daughters to obtain handguns for protection. It is their opinion that violent crime is completely out of control. This being the situation, Councilmember Margett wonders if it would be possible for the Police Department to provide some handgun training. He is concerned about untrained persons in possession of handguns. In reply to questions from Councilmember Margett, the Water Manager replied that work is in progress on an ordinance with regard to the recommendation regarding backflow preventers. Councilmember Margett noted that the Planning Department has developed criteria for an Architectural Review Board which will provide design review for single family dwellings, second story additions. alterations. ete. I to be presented at a hearing before the Planning Commission meeting October 12, 1993 at 7:30 p. m. It is important for those people who are concerned about this community to attend this hearing. Councilmember Margett would like to see flowers planted which would provide some color against the wall at the entrance to the City at Sunset Blvd. and Michillinda Blvd. Also he would like to see the weeds on the freeway on-ramps and off-ramps cleaned up. Councilmember Margett noted that senior citizens should be encouraged to receive and read the Senior Services Department publication, CONNECTION. This publication outlines a large number of activities available at the Senior Citizen Center. In reply to questions from Councilmember Margett, the City Manager said the insurance program consultant has provided a report. A first draft review of the report on health and liability insurance programs has been completed. More work on the report is needed, and it will be brought to Council in thirty to forty-five days. Councilmember Margett congratulated Councilmember Fasching on being elected to head the Transportation Committee for the San Gabriel Valley Association of Cities. Councilmember Margett noted that the Water Master and the Metropolitan Water District are ready to strike an agreement with regard to conjunctive use, which will use our basin as a recharge basin whereby water will be pumped into our basin under some guidelines given by the Water Master. This will provide more water in the basin and will be beneficial to the Metropolitan Water District and to the San Gabriel Valley. Councilmember Margett referred to Mr. Beck and his problem regarding his automobile, and a telephone call from Mrs. Pontello with regard to her problem in getting a driveway constructed. Both have commented negatively regarding their treatment by staff at City Hall. Council recently reached agreement with regard to a Council mission statement and a goal statement. This should be a real part of the actions taken in contacts with the citizens who are customers and taxpayers. If they are not taken care of, we are not living up to the mission statement or our goals. He would like to see this implemented. Councilmember Harbicht noted that the last newsletter had contained a list of the City's consultant services. He would like to see this list returned to Council to include the dollar amount paid to these each of these consultants. Councilmember Fasching reiterated his satisfaction that the Arcadia Fire Department has been awarded a Class I rating by the Insurance Services Office. This Class I rating will remain with the City for ten years and provides a great deal of prestige. This new superior rating reflects the programs. personnel, equipment, response time and training in the Fire Department, Mayor Pro tem Loj eski commented that .. thank you" letters are frequently received from citizens who have applied to our CDBG program. Citizens have been most appreciative, and it is nice to see these letters thanking our staff. Mayor Ciraulo commented that he has heard complaints regarding the long delays in completing construction in some instances. One construction site has remained at an incomplete stage now for four years. He would like staff to let Council know if there is some way to insure that construction is completed in a timely manner t or to require contractors to at least clean up the construction sites and perhaps provide some landscaping. Mayor Ciraulo also has received numerous complaints about the "for sale" automobiles parked day and night on the Pic & Save Store lot. It looks like a used car lot and he would like to see this situation corrected. Perhaps leaflets outlining the City regulations about "for sale" autos could be printed to be placed on windshields of such autos. I In reply to questions from Mayor Ciraulo, staff responded that dog licenses are now handled through the Pasadena Humane Society and can also be purchased at City Hall. The Pasadena Humane Society is expanding its facilities, and eventually will be able to do animal vaccinations as well. CONSENT ITEMS 7a. GEN, LICENSE Councilmember Fasching noted that Council had discussed the AGREEMENT - possible leasing of the Armory site for,a three year period. Economic Development and the Public Works Department have broken out the estimated costs for water, electrical, gas and landscaping. A significant amount is to be utilized to make the site functional for use; i. e., $4,500 for a new gate, the new driveway, and access way from the Police Department side. This represents a large portion of the cost. During the last study session the figure of $7,500 was discussed. The additional $1;000 was added for preparation for police use of the storage building. AUTHORIZATION At the August 10, 1993 work session, NEIlCO Waste Systems FOR FINANCIAL requested a two year extension to their current five year & PERFORMANCE Exclusive Residential Refuse Agreement with the City, and agreed REVIEW OF that NEIlCO would sustain the existing refuse rate charges. As NEIlCO WASTE part of the work session, NEIlCO presented a report justifying the SYSTEMS & renewal. Staff raised some questions concerning the requested RFP extension and presented the option of a performance review which OR would consist of an analysis of the existing waste diversion programs and the current diversion rate. Also suggested was an independent financial review of NEIlCO Waste Systems. NEWCO WASTE SYSTEMS CONTRACT (2 YEAR EXTENSION APPROVED) 08~()-f,O Councilmember Fasching commented that he is in favor of granting the two year extension of the NEIlCO contract. The staff report recommends that Council appropriate $22,100 to check NEIlCO Waste Disposal's financial records. Apparently there is concern that, in the event NEIlCO should be bankrupt, there would be no company to haul trash from Arcadia. When NEIlCO took over the bankrupt Best Disposal Company, the City Finance Director reviewed NEIlCO' s financial records. Nothing was found to suggest any financial conditions which might prohibit the company from performing up to the level of service expected by the City of Arcadia. The reference check suggested that in all areas, NEIlCO is a reliable and competent business. NEIlCO is currently in the last year of 7 10/5/93 9. 9a. ORDINANCE NO. 1991 (ADOPTED) t)1,;J.O-IC/ ()1,3rJ - ~O(. 2~.,2~;l - 35:0271 retiring the debt which was taken over from Best Disposal, so with a two year extension they will be in a much more profitable position. Councilmember Fasching does, not think there is any reason to suggest that NEWCO may became bankrupt. Arcadia has the second lowest trash pickup rate in this area, and NEWCO has done a good job for the City. In addition, the City does have the option to cancel the contract in the event NEWCO does not live up to its commitment to the City. He feels it would be a waste of taxpayers' funds to spend $22,100 for an inspection of NEWCO's financial records, especially since such a report was furnished by NEWCO to the City of Monrovia in June of this year. Councilmember Harbicht agreed that NEWCO has performed a good job in the City. He is not in agreement with staff, and is appalled by staff that a large amount of money be spent to look into I NEWCO's financial records when there is no indication that there is any problem. He is in favor of extending NEWCO's contract for another two years. Councilmember Margett essentially agreed with Councilmembers Fasching and Harbicht that NEWCO has been doing an excellent job in the City at very favorable rates. He concurs with the extension of the contract, and thinks the City should form a working partnership with NEWCO to make sure that the citizens of Arcadia are served. Mayor Pro tem Lojeski is not concerned about the financial state of the company. He could not support spending $22,100 for a financial audit. However, this is a changing industry, with recycling, diversion, etc., and he has some concerns about compliance with AB 939 regulations. He is not criticizing NEWCO's services or rates; he just wants to see that the citizens have the best service possible. Mayor Pro tem Lojeski did not see a reason against the bid process. There would be nothing to prevent NEWCO from coming in with their bid. Mayor Ciraulo agreed that it would be ridiculous to spend $22,100 for a financial audit. He does feel that Council has a responsibility to the citizens of Arcadia to go though the bid process. If NEWCO comes back with the best offer, they will have the contract. Councilmember Fasching believed that NEWCO has demonstrated cooperation with City staff in all areas of performance, and in effecting more recycling and waste reduction. He has full confidence that NEWCO's performance will come up to the City's expectations.
