The City Council and the Arcadia Redevelopment Agency met in a
regular meeting on Tuesday, December 7, 1993, at 7:30 p. m. in
the Arcadia City Hall Council Chamber,

Organization Outstanding Teacher of the Year (Camino
Grove Elementary School)

ABSENT:
On MOTION by Mayor Pro tem Lojeski, seconded by Councilmember
Fasching and CARRIED, the minutes of the November 16, 1993
adjourned and regular meetings were APPROVED.
It was MOVED by Councilmember Harbicht, seconded by Mayor Pro tem
Lojeski and CARRIED that ordinances and resolutions be read by
title only and that the reading in full be WAIVED.
PRESENTATIONS
Mayor Ciraulo read a Proclamation: "WHEREAS Patricia Ann Pann
Baltz was selected Arcadia's Teacher of the Year in May 1992, and
WHEREAS she was subsequently selected as California Teacher of
the Year in October 1992, and WHEREAS on November 10, 1992 the
State Department of Education named her as the California
representative in the 1993 National Teacher Program, and WHEREAS
on November 19, 1993 the Walt Disney Companies presented the
American Teacher Awards, and honored Pann by naming her
outstanding teacher of 1993, and WHEREAS the distinction brings
honor to Camino Grove Elementary School, the Arcadia Unified
School District and the City of Arcadia." Mayor Ciraulo then
PROCLAIMED December 7, 1993 to be Pann Baltz Day, and on behalf
of the City Council congratulated her for these outstanding
accomplishments.
Mayor Ciraulo read a Proclamation: "WHEREAS March 7 is Arbor
Day in California, and WHEREAS the City of Arcadia is proud of
its street, park, City and private property trees, and recognizes
the importance of tree care with appreciation for their
contribution of a cleaner and healthier environment." Mayor
Ciraulo then PROCLAIMED March 7, 1994 as Arbor Day, and urged all
residents to observe this day by recognizing the importance of
trees in our lives.
Mayor Ciraulo read a statement: "On October 27-28, 1993 the
Arcadia Emergency Operations Center was activated as a
precautionary measure from the eastward movement of the Altadena
fire. All Police, Fire and Public Works crews were in place
ready to protect Arcadia while assisting Sierra Madre during the
long ordeal. Many employees worked around the clock either in

organizations who donated food and supplies for emergency
personnel." On behalf of the City Council, City staff and the
citizens of Arcadia, Mayor Ciraulo thanked the many businesses
and organizations for unselfish support during this emergency.
Fire Chief Gerald Gardner assisted the Mayor in distributing the
Certificates of Commendation to; Anita Oaks School; Arcadia Elks
Club; Arcadia Red Cross; Carl's Jr. Restaurant; Domino's Pizza;
Don Ricardo's Restaurant; Good News Travel; Marie Callendars
Restaurant; Olive Garden Restaurant; Pizza Hut; Post Alarms;
Santa Anita Race Track; Carmines Italian Restaurant; and Sizzler
Restaurant.
On behalf of the City Council, Mayor Ciraulo and Mayor Pro tern
Lojeski presented outgoing Planning Commissioner Emil Amato with
a plaque expressing appreciation for his dedicated service and
accomplishments during his term as a member of the Arcadia
Planning Commission. Mr. Amato was also presented with a
Proclamation from the Planning Commission expressing appreciation
for his service as Planning Commissioner.

BOARDS AND COMMISSIONS
Funds have been budgeted in the 1993-94 Capital Budget to be used
for the maintenance and improvement of facilities used by local
baseball leagues. The leagues have agreed to purchase all needed
materials and provide all necessary labor and equipment to
complete the various projects. The requests by the local youth
baseball leagues for funds and the renovations to be made are
outlined in detail in staff report dated December 7, 1993.
It was MOVED by Councilmember Harbicht, seconded by Mayor Pro
tem Lojeski and CARRIED on roll call vote as follows that the
requests for financial assistance by the National, Santa Anita,
Coast and West Arcadia Little Leagues and the Arcadia Pony/Colt
Baseball League be APPROVED; and that staff be DIRECTED to
distribute funds in the amount of $10,500 as outlined in staff
report dated December 7, 1993; the expenditures to be charged to
the Parks and Recreation Facilities Fund.

It was the consensus of Council that consideration of the
recommendation from the Senior Citizens' Commission for
authorization to submit a proposal for a congregate meals program
at the Arcadia Community Center be CONTINUED to the December 21,
1993 City Council Adjourned Regular Meeting, at which time a
meeting with the Senior Citizens' Commission and the ad hoc
Committee will be conducted.

AUDIENCE PARTICIPATION
Christina Madrid, City of Azusa Councilmember, candidate for
election to the AQMD Board, was present to request Council's
support in the upcoming election. Ms. Madrid is an attorney and
former Parole Agent with the California Youth Authority
Department of Corrections. The next meeting of the California
League of Cities is January 6, 1994. Ms. Madrid needs the
support of two-thirds of the cities as well as two-thirds of the
population.

Councilmember Fasching requested that the City Manager extend an
invitation to Ms. Nell Sata, also a candidate for election to the
AQMD Board, to address the Council at the December 21, 1993

PROF. SERVICES Consideration of request to approve Professional Services
AGRMNT. DOWNTOWN Agreement to prepare an Environmental Impact Report for the
REVIT STREET SCAPE Downtown Revitalization Streetscape Project. In order to comply
(The Planning with the California Environmental Quality Act for review of
corp) potentially significant adverse impacts resulting from the
(APPROVED) implementation of the Streetscape phase of the Downtown
Revitalization Strategy and Program, Requests for Proposal were
forwarded to five pre-qualified environmental consulting firms.
Two firms submitted proposals. Following analysis of these
proposals, staff recommends The Planning Corporation to prepare
the Environmental Impact Report for the Streetscape proj ect.
Subsequent to receipt of the proposals, certain traffic
circulation and parking issues were raised by the public at the
November 22 Community Workshop. These issues require additional
analytical work by the consultant in order to ensure that all
potentially significant adverse environmental impacts are
reviewed. The consultant therefore came back with a more
detailed proposal which will still be consistent with the time
frame required to keep the project moving. This environmental
assessment assignment is only for the Streetscape component of
the Downtown Revitalization Stragegy and Program. Environmental
assessment of the Precise Plan is not included in this assignment
and will be prepared at a future date.

It was MOVED by Agency Member Fasching, seconded by Agency Member
Margett to AUTHORIZE the Executive Director to execute a
contract, approved by the Agency Attorney, with The Planning
Corporation for environmental consulting services for the
Streetscape component of the Downtown Revitalization Streetscape
Project in the amount of $36,500.
Agency Member ,Harbicht stated that he is not opposed to doing
this study. However, he is opposed to the fact that this study
is being done to determine whether or not these traffic
circulation and parking problems can be solved, and in the
meantime, the Agency is going ahead with the project design, and
spending a significant amount of money while the study is being
done. Member Harbicht feels that this study of what needs to be
done should be completed before going ahead with the project
design. He outlined in considerable detail his reasons for his
statement that the Agency is spending money on the wrong things
in its effort to revitalize the downtown business district. It
is his belief that the parking and traffic circulation problems
will be the death knell for the souths ide Huntington Drive
businesses and will severely hurt the northside Huntington Drive
businesses. Agency Member Harbicht also has many concerns about
the proposed increased population density in this area with the
proposed construction of condos and apartment structures. It
is his opinion that the Agency should proceed with this traffic
study, and put everything else on hold until it has been
completed.

Agency Member Fasching stated, in part, that Agency Member
Harbicht's remarks reflected the thinking of past City Councils
which were unwilling to spend money to improve the City, help the
business district, improve the City Hall buildings, utilize
cablecasting for Council meetings, etc. Agency Member Fasching
said that the traffic circulation and parking problems can be
solved; that only a few complaints have been received from
business people in the area. Many years have passed during which
little was done to revitalize the downtown business district, and
he thinks now is the time to proceed with the design project as
quickly as possible.

favor of doing the traffic study.
California Redevelopment Law (Health and Safety Code Section
33080) requires that all redevelopment agencies file an annual
fiscal and housing activity report with the Legislative Body
(City Council), the California Department of Housing and
Community Development (HCD) and the State Controller within six
months of the end of the fiscal year. Since this document is to
report on Agency status for Fiscal Year 1992-93, the information
provided within it represents Agency activities as they existed
as of June 30, 1993. Upon approval by the City Council, the
report will be submitted to the State Department of Housing and
Community Development and the State Controller. Staff report of
December 7, 1993 sets forth complete details.
In response to questions from Member Margett, the Assistant City
Manager/Community Development Director reviewed the California
Redevelopment Housing laws and the future responsibility of the
Arcadia Redevelopment Agency wi th regard to providing
low/moderate income housing. He also stated that the Agency will
develop a housing strategy during this fiscal year into the
coming fiscal year which will combine an update of the City
Housing Element and State redevelopment requirements concerning
the provision of low/moderate income housing.
It was MOVED by Agency Member Lojeski, seconded by Agency Member
Fasching and CARRIED on roll call vote as follows that the
Arcadia Redevelopment Agency recommend APPROVAL of the IT 1992-
93 Report to the State Department of Housing and Community
Development and the State Controller, and present said report to
the Arcadia City Council for approval and authorization to
transmit the report to the State Department of Housing and
Community Development and the State Controller.

shoppers at the mall. There is a Police substation at the mall,
and security patrols in the parking areas have been effective.
Councilmember Margett referred to the November 24 letter written
by the Public Works Director with regard to tree root damage to
sidewalks. He inquired if some of the block grant money could
be used to repair such damage. Staff responded that such funds
for low and moderate income housing improvement might be
available for such use in 1994, and could be considered for
inclusion in that budget. There are only so many dollars
available and other priorities have been approved for this year.
Councilmember Margett said citizens should know about this
possibility for future consideration.
In response to a question from Councilmember Margett about the
new diamond lanes on the 210 freeway, Councilmember Fasching
replied that the eastbound lane is now open and the westbound
lane will open later this month. Councilmember Margett suggested
a letter expressing appreciation be written to Jerry Baxter,
Caltrans Chief Engineer in this district. Council still has the
sound barrier to consider and must stay in contact.
In response to questions from Councilmember Margett, staff
replied that there is nothing more that the City can do at this
point to promote the relocation of the Bluth water tanks which
are an eyesore on the hills to the north. It is now incumbent
upon the private parties involved to work with the City of
Monrovia to make specific arrangements that would result in the
movement of the tanks. Monrovia can do nothing until the private
parties involved come to some agreement.
Councilmember Margett requested a staff report outlining the
procedure by which business license fees are determined. Some
business licenses cost very little while others cost a large
amount. This does not seem to be equitable. He would like to
take a look at this matter from a fairness standpoint.
Councilmember Margett noted that he had been contacted by
potential candidates for the City Council who questioned the $200
per month rate of pay for City Councilmembers which has been in
effect since 1969. He would like to see the report which Council
had seen a few months ago detailing the amount of payment for
councilmembers in surrounding cities. Perhaps an ad hoc
committee could be formed to review the City Council's salaries
and consider whether or not there should be an increase.

The City Attorney stated no action can be taken tonight other
than staff direction. Also their are legal limits. to these
amounts set forth in the City Charter. In order to go beyond a
certain limit the matter would have to be submitted to a vote of
the people. The City Attorney will update this information for
Councilmember Margett.
Councilmember Fasching suggested that Councilmember Margett study
the staff report, make a proposal and put the question on the
Council agenda for open discussion.

Mayor Pro tem Lojeski commented on reports he has had of poor
reception of the cablecasts of the Council meetings. He has
received complaints and this seems to be a widespread problem.
He understands from staff that even the reception on the monitor
in the conference room next door is poor.

City Clerk June Alford announced that the municipal election for
the City of Arcadia is scheduled for April 12, 1994 for three
members of the City Council. Nomination papers will be issued
at the office of the City Clerk beginning Monday, December 20,
1993 and continuing to January 14, 1994. All nomination papers
must be filed by 5:00 p. m., January 14, 1994. In the event an
incumbent does not file, the filing date will be extended to
January 19 for candidates other than the incumbents. Election
information or voter registration forms may be obtained from the
Office of the City Clerk. For this particular election, voter
registration will close on March 14, 29 days prior to the
election. Citizens of the United States who are at least eighteen
years of age and reside in the City of Arcadia may register to
vote at this election on April 12. 1994.
In response to a question from Councilmember Harbicht, that he
is an incumbent, the City Clerk and City Attorney explained that
the nomination period will not be automatically extended to
January 19th, because he will not be eligible to file.
Councilmember Harbicht is completing his second four year term,
and according to Arcadia's City Charter, he is ineligible to seek
reelection at this time. Councilmember Harbicht requested that
the City Attorney look into the matter.
CONSENT ITEMS
APPROVED Final Map of Tract No. 51339 for an 8-unit residential
condominium at 121-125 Genoa Street (Yes Engineering & Technology
Corp.) . Approval is on the condition that before the map is
recorded, all outstanding conditions of approval shall be
complied with to the satisfaction of the Director of Public
Works.

AWARDED contract in the amount of $28,036.75 to Micrapoint
Equipment Corporation for an imaging juke box sub-system to be
attached to the Police Department ImageScan system. This
purchase qualifies for funds which are available under the
Federal requirements of using Asset Seizure Funds.

ACCEPTED the project and AUTHORIZED final payment to be made to
Valverde Construction, Inc. in accordance with the contract
documents for installation of 12" waterline, fire hydrants and
appurtenances on Baldwin Avenue from Live Oak Avenue to Palm
Drive - W. O. 691. The final contract amount of $254,575 was
funded from the Water Facilities Replacement Fund. Ten percent
(10%) retention payment becomes due and payable 35 days after
Council acceptance upon completion of all corrections of record.

Angeles Home Improvement Program, and it was then MOVED by
Councilmember Fasching, seconded by Councilmember Margett and

provide low-interest funds to qualified homeowners; and DIRECT

The City Council had expressed a desire to have additional local
newspaper coverage and a Public Information Plan made available;
therefore, at the City Council Work Session of October 26, 1993,
a draft Public Information Plan was presented for Council's
review. The Plan sets forth a Mission Statement to accomplish
the goals of better community relations, and the promotion of
programs and projects within the City. Staff outlined steps to
be taken to improve communication through 1) the Ombudsman role
of personal assistance to residents and businesses; 2) the
development of a Speaker's Bureau to "market" the City to
community organizations, service groups and schools; 3) the
water bill inserts; and 4) the inclusion of City articles in the
Chamber of Commerce Newsletter. The December 7, 1993 staff
report fully details the program.
A brief discussion ensued. Councilmember Margett noted that
staff had previously indicated it would be possible for residents

The City of Arcadia provides street sweeping services out of the
Public Works Department for the City's commercial and residential
streets. Recently, to create more efficiencies and effect a
budget savings, the sweeping of commercial routes in the City was
reduced from six times weekly to twice weekly resulting in the
elimination of one sweeper operator position. The 1993-94 cost
for street sweeping 24,696 curb miles is estimated to be
$404,000. In an attempt to continuously better City operations,
staff has explored alternatives to providing in-house street
sweeping services. A common practice is to contract the service
to a private provider. Another approach developed was to expand
our service area to include another jurisdiction. Believing that
both approaches needed exploration, the cities of Monrovia and
Arcadia discussed the advantages of joining together to pursue
street sweeping services. Monrovia is interested in contracting
out its street sweeping. Unique to this proposal is that Arcadia
is interested in competing to provide the service to ourselves
as well as the contract for Monrovia. The City of Arcadia would
then be both bidder and solicitor in the bidding process.
Currently, Arcadia has a similar relationship with Monrovia
through the Fire dispatch system. In July, 1993, the City
Council authorized Arcadia to provide fire dispatch service to
Monrovia. Both agencies realize service and cost benefits to
this arrangement. The staff of both cities, Arcadia and
Monrovia, have worked diligently to develop a mutually
satisfactory bid document. Protections are built into the
document to assure quality control over a provider with standards
articulated. As designed, the City Public Works Department will
bid against the private sector to retain the service. Once the
bid document is advertised, Arcadia staff will formally respond

efficiently provide the service to Monrovia while generating
revenues to the City of Arcadia.

Staff noted that the City Attorney cautioned that the City
providing the service (Arcadia) to another jurisdiction must
demonstrate a public purpose and benefit to Arcadia to avoid
violation of the gift of public funds requirement. Additional
details are set forth in the December 7, 1993 staff report.

Considerable discussion ensued following the staff report.
Councilmember Fasching had strong reservations of the ethics of
the proposed plan to solicit bids from the private sector and at
the same time submit Arcadia's bids for the street sweeping
contract. Councilmember Harbicht stated, in part, that there is
no comparison to the Fire dispatch agreement with Monrovia which
will utilize Arcadia's under-utilized dispatch system, and the
proposal under discussion to sweep Monrovia's streets which would
mean Arcadia would have to purchase additional street sweepers
and hire more staff to sweep Monrovia streets. He is not
interested in expanding Arcadia's staff and building up Arcadia's
bureaucracy to do what Monrovia could do for their own city. He
would be very interested to see how much it would cost the City
to have the private sector sweep the streets of Arcadia.

Councilmember Fasching commented that the City should be prepared
to be out-bid by the private sector if a lower bid comes in. If
the City can save money by contracting to the private sector, we
should not reject the bid.
Councilmember Margett stated, in part, that he agreed with some
of Councilmember Harbicht's comments that the City should not be
competing with the private sector. He believes that the approach
that Arcadia should take to look at government differently from
the standpoint of how Arcadia will increase revenues ... are we
going to cut services. If Arcadia is going to use a business
competitive approach, it should be within the City itself and
not to go out and compete against the private sector. The City
street department should be able to bid to the City for "X"
number of dollars. Further discussion ensued, and Mayor Ciraulo
commented that the Council should take some sort of action to
either move to approve the specifications or decide to move to
deny the staff request
It was MOVED by Councilmember Harbicht, seconded by Councilmember
Fasching to APPROVE staff recommendations: 1) APPROVE the
specifications for street sweeping services; 2) AUTHORIZE staff
to join the cities of Monrovia and Sierra Madre in advertising
for bids for joint and/or separate street sweeping services; 3)
AUTHORIZE staff to submit a bid for Arcadia street sweeping
services.
Considerable discussion ensued among Councilmembers.
Councilmembers Fasching, Harbicht and Margett voiced serious
concerns regarding the efficiency of having outside street
sweeping service; the fact that the City would be competing with
the private sector; how the bidding process would be handled,
especially in the event the City is not the low bidder, Council's
wish that firm cost estimates for the various alternatives be
provided for consideration, etc.
Following further discussion among Councilmembers, the MOTION AND
SECOND WERE WITHDRAWN by Councilmembers Harbicht and Fasching.
It was then MOVED by Councilmember Fasching, seconded by
Councilmember Harbicht to DENY the staff request; and DIRECT the
City Manager to provide additional information for further study
of the proposal.
Councilmember Margett commented that he liked the concept to have
staff use a business approach to try and get things done in the
City, and structure the concept so that staff can be business-
like and win in the bid process, etc.

Staff explained that this ordinance proposes that speed limits

Huntington Drive to forty (40) miles per hour; and Campus Drive
between Holly Avenue and Santa Anita Avenue to thirty-five (35)
miles per hour, an increase of five (5) miles in each instance.
Mayor Pro tern Lojeski expressed his concern that speed limits
seem to go up and up. He does not think that just because some
of the drivers exceed the speed limit, the City should increase
the limits. Staff responded that the State Vehicle Code and
Traffic Manual state that speed limits be set at or around,
preferably below, 85 percentile of the actual public speeds in
order to be enforceable by radar. The speed limit has to be
supportable in court. Councilmember Harbicht has no problem with
this law. The purpose of streets is to move traffic as quickly
as possible consistent with safety, so the law takes into account
all those things. The Campus Drive speed limit is lower (25
milesjhour) during school hours. Mayor Ciraulo does not agree
with continuously raising speed limits.

In response to questions from Councilmembers, Captain Rick
Sandona, Arcadia Police Department, stated, in part, that the
Ci ty has to go into court to defend the speed limi t which is
generated by standards set down by the California State Supreme
Court. The City has to legally justify the speed limit. A lower
speed limit could be posted, but it could not be supported in
court in the event of challenge. The school zone is a particular
exception at 25 miles/hour during school hours, school events -
- any time children are present.

The City Council requested an update on proposed Municipal Code
amendments to effect building sites with delayed construction.
Active utilization of the City's Property Maintenance Nuisance
Abatement Code should mitigate the problem in terms of
appearance. In extreme situations where there is little or no
cooperation, the City can, after a hearing and court order, enter
the property, perform the cleanup work or complete certain work,
and bill the owner. If not paid, it becomes a lien and is paid
through their property taxes. Existing provisions of the
Municipal Code are in place to implement this approach. There

To supplement the property maintenance approach, the following
is legally feasible: Amend the Municipal Code to require (1)
conditions to building permit renewals and extensions predicated
on cleanup and improvement of the site and/or a financial deposit
(bond, letter of credit) or other commitment to the City to
assure property maintenance In other words, impose a conditional
building permit; (2) not grant the building permit or extension
until the property is brought up to an acceptable standard.
