MINUTES CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING DECEMBER 2l, 1993 The City Council and the Arcadia Redevelopment Agency met in a regular meeting on Tuesday, December 2l, 1993 at 7:30 p. m. in the'Arcadia City Hall Council Chamber. Rev. Judith McArtor, The Santa Anita Church Peter Daily, Chairman, Sister City Commission PRESENT: Councilmembers Fasching, Harbicht, Lojeski, Margett and Ciraulo None ABSENT: On MOTION by Mayor Pro tern Lojeski, seconded by Councilmember Margett and CARRIED, the minutes of the adjourned and regular meetings of December 7, 1993 were APPROVED. It was MOVED by Councilmember Margett, seconded by Councilmember Harbicht and CARRIED that ordinances and resolutions be read by title only and that the reading in full be WAIVED, PRESENTATIONS Peter Daily, Chairman, Sister City Commission stated that twelve months ago the citizens of Arcadia and the Sister City Commission were working at a feverish pace to get ready for Christmas and the arrival of the Koala Band from Newcastle, Australia on December 26. In conjunction with the Koala Band, Arcadia's Sister City in Newcastle, Australia recently received three honors from their National Sister City organization: 1993 National Award for the Best Youth Project; 1993 Award for Best Overall Program; and 1993 Award for Best Single Project. The three plaques were presented by Mr, Daily on behalf of the Sister City Commission to the Mayor and City Council, On behalf of the staff at the City Yard, Public Works Division, Dave Thompson presented a check to the City Council for the Child Health Council -at Christmas time. This donation was accepted with gratitude on behalf of the Council by Mayor Ciraulo AUDIENCE PARTICIPATION Johanna Hofer, 875 Monte Verde Drive, stated, in part, that she is present to address items 3a. and 6c. on this evening's agenda -- request to establish long term City/Agency loan and repayment agreement. It is her understanding that approval of these two items will enable redevelopment to continue into the year 2026, Redevelopment was never voted upon by the citizens of Arcadia. In fairness to the citizens of this community, Council should not approve these two ieems. She presented three questions to 1 l2/2l/93 2. 3. 3a. ROLL CALL 3b. ADJOURNMENT 35:0323 Council: l) Hypothetically speaking, would approval of these items permit the Arcadia Redevelopment Agency or the City to issue bonds or loans to Santa Anita race track interests? Councilmember Harbicht responded that Santa Anita is not in the redevelopment area. 2) Who would most likely benefit from said bonds or loans? Staff explained that what is being proposed is a means to assist the Redevelopment Agency in future years in its operations and funding. Legislation is pending which would prohibit the Agency from receiving loans for operations from the City, These are loans, not bonds or increased debt. There is ~lready an existing agreement between the Redevelopment Agency and the City for operational assistance; this agreement merely extends the lifetime of that agreement. This will provide the opportunity for financial assistance if needed in future years. 3) Mrs. Hofer inquired if the Councilmembers have read the I complete text of AB l290? Staff responded that Council is well aware of the intentions of AB 1290. The specificity of AB l290 is still being clarified by staff and Special Counsel for the , City Council, In response to further inquiry by Mrs. Hofer, Mayor Ciraulo responded that Council is satisfied with the legal advice they have received with regard to this matter. CITY COUNCIL RECESSED IN ORDER TO ACT AS THE ARCADIA REDEVELOPMENT AGENCY PRESENT: Agency Members Fasching, Harbicht, Loj eski, Margett and Ciraulo ABSENT: None On MOTION by Agency Member Lojeski, seconded by Agency Member Harbicht and CARRIED, the minutes of the meeting of December 7, 1993 were APPROVED. Recently signed legislation (AB 1290), effective January 1, 1994, will not permit the Arcadia Redevelopment Agency to establish debt (such as a bond issue or a City loan) after January l, 2004. By approval of a Loan Repayment Agreement, both the City and Agency will be able after January l, 2004 to enter into long term loans subject to City Council and Agency needs at that time. Approval of this Agreement is merely an enabling act which preserves the Agency's ability to cover administrative and project costs over the life of the Redevelopment plan. It was MOVED by Agency Member Lojeski, seconded by Agency Member Harbicht and CARRIED on roll call vote as follows that the Arcadia Redevelopment Agency APPROVE the Loan and Repayment Agreement, subject to minor modifications approved by the City/Agency Attorney, and to present said agreement to the Arcadia City Council for approval. I Agency Member Harbicht reiterated that there is no loan involved in this agreement. It is enabling legislation so that if, at some time in the future loans should be considered, the Agency and City would be able to enter into such agreements. " LOJESKI (World Cup USA 1994 Soccer Event - Banners) ()/~ -c) -.:oJ <> /'",' i,:? 35:0324 CITY COUNCIL RECONVENED MATTERS FROM ELECTED OFFICIALS Councilmember Fasching stated that, with regard to AB 939 and mandates for waste disposal, the Waste Management Board in Sacramento had considered allowing credits for green waste disposal for landfill cover, Councilmember Fasching went to Sacramento last week on behalf of twenty-eight cities, and presented a proclamation requesting that lOO% credit for green waste disposal be granted against AB 939 requirements, At the conclusion of that meeting, the Waste Management Board granted all cities in the state only 7% credit for green waste disposal for landfill coverage, Mayor Pro tem Lojeski noted that last week he, together with Councilmember Fasching and Alex McIntyre, visited the neighboring cities of Yorba Linda and Cerritos to view their installations and procedures for cablecasting. It is his understanding that Alex McIntyre plans to bring more cablecasting information to an upcoming meeting in January. In the meantime, he strongly encourages those councilmembers who did not go on this tour to go and take a look at these installations, and to look at possibilities to provide the citizens of Arcadia a much better product. Councilmember Fasching stated, in part, that they were impressed ,with the progress Yorba Linda and Cerritos have made, and the quality of their cablecasting on the governmental access channel, It is very professional. He has asked Alex McIntyre to put together another quick trip for the benefit of the other councilmembers. In reply to a question from Councilmember Margett, Councilmember Fasching replied that they had looked at the council chambers in these two cities, and found that they are outfitted with microphones for transmission and taping each council meeting. Also each council chamber had five cameras permanently mounted. The bright, glaring lights have been eliminated because they have adequate light with their equipment. They have a control room which has monitors, recording equipment, etc. On council meeting nights they bring in John Risk and Associates for $250 to do all the technical work of transmitting. Other than those nights, a staff person or trainee handles the transmissions which are on tape. Also, at the time the council meeting takes place, they make five tapes. The next morning the tapes are delivered to the councilmembers so that they can review the tape and, if they wish, make it available to other people who may wish to see it. They use the government access channel to transmit other programs of interest to the residents, They have the capability of editing tapes down to the point where they are of particular interest to just their city. Councilmember Fasching said this is the wave of the future, and we are in the dark ages as far as our telecasting is concerned. We are way behind, but we can certainly catch up. Mayor Pro tem Lojeski referred to an article in the December 9, 1993 City Council Newsletter regarding the World Cup USA 1994 soccer events to be held during May and June in Pasadena. Requests have been received for permission to use promotion sites to advertise the events, Arcadiars Municipal Code precludes the use of commercial banners. Since this event will be taking place in Pasadena, he hopes that Arcadia will receive some of the overflow of people coming to the valley in our hotels and business districts. He would like to look into the possibility of allowing the banners for this one - time event. The Ci ty Attorney said Council could direct staff to prepare the appropriate amendment, and it could be legally sustainable as a one-time event with some special findings. Council has the ability to approve or refuse the banners to be displayed, which is built into the Arcadia Municipal Code. It was the consensus of the Councilmembers that staff prepare an appropriate ordinance for their consideration. Mayor Pro tem Lojeski noted that the City Water Division received an energy award from the Edison company because the Division participated in the Electric Motors Program. The Water Division replaced a 700 hp natural gas internal combustion engine with a 600 hp electric motor which eliminates over 8,000 pounds per year air pollution. So far the City has received over $65,000 in incentive and rebates. The City's appreciation should be extended to the Water Division for putting together that program. II Mayor Pro tem Loj eski wished all the, citizens of Arcadia happy holidays and a prosperous new year, Mayor Ciraulo, on behalf of the City Council and City Clerk, wished the City employees and staff and citizens of Arcadia a Merry Christmas and a happy holiday season. City Clerk June Alford announced that nominations opened yesterday for three members to the Arcadia City Council. The election will occur April 12, 1994. Nomination papers were issued to nine persons, No one has filed yet. The period for nominations and filing extends to January l4, 1994. If an eligible incumbent does not file, that period will be extended to January 19, 1994, for other than incumbents. The City Clerk read the names of those persons who have taken nomination papers: Sheng Chang, Charles Chivetta, Joseph C, Ciraulo, George Fasching, Ruth V. Gilb, Celia Kalm, Barbara D. Kuhn, Karen E. To~er, and Mary B. Young, The City Clerk wished everyone a Merry Christmas and reminded everyone not to forget the Person for whom we are celebrating Christmas. CONSENT ITEMS It was MOVED by Mayor Pro tem Lojeski, seconded by Councilmember Fasching and CARRIED on roll call vote as follows to APPROVE plans and specifications for the subject projects in the form of a combined project, which involves the rehabilitation of a sewer main at 1925 Tulip Lane, and remodeling the base of a sewer manhole in front of 55 No. Golden West AVenue - Job No, 538A. The total estimated cost of the project is $26,400 and is to be funded by the Sewer System Service Fund as approved in the 1993- 94 Capital Improvement Program. The City Clerk is AUTHORIZED to advertise for bids, II AYES: Councilmembers Fasching, Harbicht, Loj eski, Margett and Ciraulo None None NOES: ABSENT: Councilmember Fasching stated that he has had telephone calls from the o~er of the property at 2248 Highland Oaks Drive, adjacent to Wilderness park regarding unauthorized persons crossing her property and climbing the fence into Wilderness Park. She has had seve tal confrontations with such persons and has had to resort to calling the Police Department, Staff noted that any fence higher than 6 feet on private property requires 4 12/21/93 I I 6c. Resources) (APPROVED) 07.j(J_70 35:0326 a modification approval. Councilmember Fasching would like to see this fence constructed as quickly as possible. It was MOVED by Councilmember Fasching, seconded by Councilmember Margett and CARRIED on roll call vote as follows to DIRECT staff to have the existing 5 foot high fence of approximately 52 feet in length at 2248 Highland Oaks Drive replaced with an 8 foot high chain link fence for a cost of approximately $1,500; DIRECT staff to maintain the 8 foot high fence in a state of good repair once the fence is installed if illegal access to the park through the fence continues to be a problem; and DIRECT staff to obtain a right-of-entry and hold harmless agreement approved by the City Attorney, ,and executed by the property owner prior to any work being done on private property. AYES: Councilmembers Fasching, Harbicht, Loj eski, Margett and Ciraulo None None NOES: ABSENT: It was MOVED by Councilmember Margett, seconded by Mayor Pro tem Lojeski and CARRIED on roll call vote as follows to APPROVE the long term City/Redevelopment Agency Loan and Repayment Agreement, subject to minor modifications approved by the City/Agency Attorney. AYES: Councilmembers Fasching, Harbicht, Loj eski, Margett and Ciraulo None None NOES: ABSENT: The City Council previously approved the conceptual design for the expansion and remodel of the City's Library, and authorized staff to initiate construction plans and specifications. The project has an estimated construction cost of $4.9 million. As a part of the overall project budget, project/construction management was identified as a related cost. This service, as proposed by the firm of Construction Management Resources (CMR) , will cost $156,482. Considerable discussion ensued among Councilmembers. Councilmember Fasching felt this was too much money to spend for these services. Councilmember Harbicht said he thought it to be essential to hire a management firm and it might even save money in the long run. The City Manager noted that this firm will coordinate all aspects of design and construction. Councilmember Fasching pointed out that this function is being performed by a staff member for the new fire station construction. It was MOVED by Mayor Pro tem Lojeski, seconded by Councilmember Harbicht and CARRIED on roll call vote as follows to APPROVE the staff/Library Building Advisory Committee recommendation to retain the services of Construction Management Resources for the Library Project/Construction Management services at a cost of $l56,482; and AUTHORIZED the City Manager or designee to execute the professional services agreement for these services. In response to questions from Councilmember Margett, Lisa Saks, Construction Management Resources, stated, in part, that over the three year period of time under discussion, their firm will oversee the project from the design portion all the way to construction. The project will require the engineers and contractors on their staff who will be looking at various aspects of the project to make sure that document quality is exemplary. This will also help during the construction phase, She outlined her personal qualifications and those of the firm, and stated that the firm has worked on library reconstruction and renovation 5 l2/2l/93 7. 7a. Councilmember Fasching said there is another way to do this and reiterated that the cost for the project management was too high. Councilmember Margett agreed that it seems like a lot of money, but thought this might help keep the project within budget, AYES: Councilmembers Harbicht, Lojeski, Margett and Ciraulo Councilmember Fasching (for reasons so stated) None NOES: ABSENT: CITY ATTORNEY The City Attorney presented and read the title of Ordinance No. 1999: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING CERTAIN SECTIONS OF DIVISION 1 AND 2 OF PART 2, CHAPTER 2, ARTICLE III REGARDING PRIMA FACIE SPEED LIMITS". It was MOVED by Councilmember Harbicht, seconded by Councilmember Margett and CARRIED on roll call vote as follows that Ordinance No. 1999 be and it is hereby ADOPTED. Mayor Pro tern Lojeski did not agree with the speed limit G~~increase, particularly on ~f'~~n~~a Drive, because of schools \r located on or adjacent to that street. Mayor Ciraulo agreed, and noted that since the speed limits are reviewed every five years, it is conceivable that the speed limits in the City will keep increasing. Staff explained that the prima facie speed limit within a school zone is twenty-five miles an hour at any time that students are present, Police Captain Sandona stated that the City has to legally justify the speed limit in order to be able to enforce that limit by the use of radar and defend it in court. Councilmember Harbicht said that traffic is already moving on these streets at these speeds, and there has been no increase in the accident rate, so this speed must be safe for these particular streets. Setting an unreasonable low speed limit constitutes a "speed trap" and is the reason the State has passed these regulations. He does not that feel that Council would be justified in removing the radar enforcement tool from the Police Department. 8. HARBICHT IN MEMORY OF OWEN VAN BUSKIRK AYES: Councilmembers Fasching, Harbicht, Margett and Ciraulo Mayor Pro tern Lojeski None NOES: ABSENT: MATTERS FROM STAFF None Councilmember Harbicht adjourned the meeting in memory of Owen Van Buskirk. "Owen Van Buskirk was a long-time resident of Arcadia and had recently moved to Carlsbad and, unfortunately, died a short time ago. Van, as he is known to his friends, worked here in the Arcadia School District. He came here in 1958 as Assistant Superintendent, and held that position for twenty- three years, and was retired in 1981. During his thirty- five year period in Arcadia, Van was active in community activities, serving as President of the Arcadia Rotary Club, and three of the members of this Council were in the program then. He also served as a Member of the Arcadia Rose Tournament Association and on the Board of Directors of the Arcadia Welfare and Thrift Shop. Owen's wife, Marian, died in 1976, and he married Nancy several year~ later, He is survive" by Nancy, his two children and 6 12/21/93 ,I II I I HARBICHT IN MEMORY OF DALE ALLEN 9. Services were held at the Church of the Good Shepherd in Arcadia, We are going to miss Owen -- a fine member of our community and our school district. I am going to close this meeting in his memory," "I would also like to close the meeting in memory of Dale Allen, Dale passed away either Sunday night or Monday morning. Dale was on our Senior Citizens' Commission for years, and he dedicated a number of years of his life to making our Senior Center a reality, way back in the early study phases, and up until the time when it was approved by the Council, eventually becoming our Community Center, but designated as a Senior Center during the day time. I am glad that Dale lived to see that come to fruition and to enjoy the use of it for a couple of years.
