Consideration of increasing the Planning Division fees and Building. Division fees. The Planning Department is recommending that the fees charged for processing the various Planning applications and Building Permit fees be increased approximately 5 1/2%, Mayor Fasching declared the hearing OPEN. The revised charges are necessary to defray the City of Arcadia's expenditures and costs incurred in the permitting and inspection process. PUBLIC HEARING APPLICATION FOR BINGO GAMES (Arcadia Royale Retirement Hotel) (APPROVED) 03~() -..:tel 34:0203 levels of coverage have not resulted in prohibitive premium rates. It was MOVED by Councilman Harbicht, seconded by Councilman Lojeski and CARRIED on roll call vote as follows that Resolution No. 5677 be and it is hereby ADOPTED. AYES: NOES: ABSENT: Councilmen Ciraulo, Harbicht, Lojeski and Fasching None Councilman Margett Consideration of an application for a permit to play Bingo games at Arcadia Royale Retirement Hotel, 607 W. Duarte Road. The request is to permit recreational Bingo games for the residents and their guests. The Police, Fire and Building Departments have no objection to the issuance of the permit. Beckv Pike, Business License Officer, stated that the Arcadia Municipal Code allows for any bona fide senior citizen organization to be issued a permit to hold Bingo games. In reply to a question from Councilman Harbicht, there is no charge for a permit if the games are for recreational purposes; if they are to be fund raisers, a business license fee is required. In reply to a question from Councilman Lojeski, the Business License Officer replied that she, together with a representative from the Police Department, occasionally check to see that Bingo games are being conducted according to the terms of the permit. Also, a financial statement is required when the permit is renewed. In reply to a question from Mayor Fasching, the Business License Officer noted that the request is for Bingo games to be played four times a week; the Municipal Code permits games to be played only one time a week, Mayor Fasching sees no reasons why people living in a retirement hotel, as in this instance, should not be permitted to have Bingo games more than once a week. The City Attorney replied that the permit requirement of Bingo games being played only once a week can be changed by amending the ordinance if Council wishes to do so. Mayor Fasching declared the hearing OPEN. -Ira Ritchie, Administrator, Arcadia Royale Retirement Hotel, 10527 Key West, Temple City, stated, in part, that she was not aware of the restriction of having Bingo games only once a week. The Residents' Council at the retirement hotel requested that the games be held three or four times a week. Betty Stroman, Resident, Arcadia Royale, 607 W. Duarte Road, stated that, although she does not play Bingo herself, other residents enjoy it very much and she hopes Council will approve their request. Silvia Klitzner, Resident, Arcadia Royale, 607 W. Duarte Road, stated that Council should realize that many of the residents at this hotel are lonely, and some just remain in their rooms most of the time. They look forward to the Bingo games because it is a group activity and gives them something to do. Please allow the games four times a week. No one else MOTION by Ciraulo and desiring to be heard, the hearing was CLOSED on Councilman Harbicht, seconded by Mayor Pro tem CARRIED. PUBLIC HEARING URBAN WATER SHORTAGE CONTINGENCY PLAN (APPROVED) tl%~2f~_:',: 34:0204 It was then MOVED by Councilman Harbicht, seconded by Councilman Lojeski and CARRIED that the request for a Bingo permit to Arcadia Royale Retirement Hotel for recreational Bingo games to be conducted in accordance with the Arcadia Municipal Code regulations be APPROVED. Staff was DIRECTED to prepare an amendment to the Municipal Code, separating recreational Bingo games from fund raising Bingo games, and increasing the allowed frequency of recreational Bingo. On June 5, 1992 the City contracted with Interstate Field Services, Inc. to do general clean up of the property and fencing of the property at 300 East Sycamore Avenue, Arcadia. This was done in accordance with Resolution No, 5657 "declaring a public nuisance and ordering the rehabilitation of real property located at 300 East Sycamore Avenue, Arcadia, California, owned by Huei Lee (B & S Pacific and North American Investment)". This was done at the City's expense. On June 22 a Notice of Equalization of Assessment for General Property Clean Up was mailed by certified and regular mail to the owners of said property advising them of this hearing which was scheduled for the purpose of "correcting, modifying or confirming" the costs of $875. to clean up said property and to assess the cost against the property. I In reply to a question from Councilmember Harbicht regarding recovery of administrative costs, the City Attorney responded that amendments have been provided regarding enforcement of related costs. It is necessary to ascertain whether or not these were in effect when this property was cleaned up. If the Code amendment preceded the clean up, the costs will be added. Councilman Harbicht said that, since the City charges certain fees, i, e., for appeals to the Planning Commission, City Council, etc., it is reasonable to recover the costs involved in staff time. staff trips to the site, Council public hearings, etc. with regard to public nuisance cases. Councilman Lojeski noted that the neighbors are very pleased that this property has been cleaned up. The clean up was a trememdous job and well worth the $875.00. The City Attorney noted that he is looking into another procedure to bring before Council involving enforcement of civil penalties which will allow the City to recoup all enforcement costs and, in some cases, preclude the need for a nuisance problem public hearing. I It was then MOVED by Councilman Harbicht, seconded by Councilman Lojeski and CARRIED that City Council sitting as a Board of Equalization, DIRECT the Director of Finance to send a bill to the property owner for the $875,00' assessment. Any bills unpaid at the end of thirty (30) days to be referred to the Director of Finance for collection per Section 9406,5, 9406.6 and/or 9406.9 of the Arcadia Municipal Code. California Assembly Bill 11 requires each urban water supplier and public agency to submit an amendment to its Urban Water Management Plan by adding an Urban Water Shortage Contingency Plan, The Plan had been submitted to Council previously, and 4 7/7/92 I I RESOLUTION NO. 5681 (ADOPTED) V~IO_S=-~ 6. (Activity Leader I & Activity Leader II) (APPROVED) O;J.~/9 34:0205 the Water Division Manager briefly reviewed the primary aims of the plan. Mayor Fasching declared the hearing OPEN. No one desiring to be heard, the hearing was CLOSED on MOTION by Mayor Pro tem Ciraulo, seconded by Councilman Lojeski and CARRIED. The Public Works Director presented and read the title of Resolution No. 5681: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA ADOPTING THE URBAN WATER SHORTAGE CONTINGENCY PLAN". It was MOVED by Mayor Pro tem Ciraulo, seconded by Councilman Lojeski and CARRIED that Resolution No. 5681 be and it is hereby ADOPTED, A staff report regarding the consideration of entrance fees and/or increased security for Wilderness Park has been prepared by the Director of Recreation and presented to Council. The public hearing is to be CONTINUED TO AUGUST 4, 1992. The City Attorney stated this is not a legally required public hearing, however Council can direct that it be noticed if they wish. This item was brought to Council by the President of the Home Owners' Association. It is not known whether or not he is acting on behalf of all the homeowners in that association. Perhaps the President of the Association should be responsible for notifying the members about this public hearing. The Mayor also requested that mention of the public hearing be made in the local newspaper. Mayor Fasching declared the hearing OPEN. Elmer Black, 2236 N. Highland Oaks Drive, stated, in part, that he is the resident next to the entrance to the park and he is opposed to construction of a toll booth at that location and the charging of fees. He does not think that the people who live in that immediate area and who will be most affected by these proposals are even aware of these proceedings. He feels that if there is to be a public hearing, people should be duly notified by the governmental body holding the hearing. He does not think there are any significant problems with the park. Perhaps there are some undesirables, but the problem could be corrected in a lesser way. It was the opinion of the Council that all members of the Highland Oaks Homeowners' Association should be notified of the August 4, 1992 public hearing and also that there should be a press release. It was MOVED by Councilman Harbicht, seconded by Mayor Pro tem Ciraulo and CARRIED to CONTINUE the public hearing to August 4, 1992. BOARDS AND COMMISSIONS At its June 11, 1992 meeting, the Personnel Board reviewed and approved the proposed specifications for establishment of part-time job classifications for Activity Leader I and Activity Leader II in the Recreation Department, and forwarded its recommendation to the City Council for review and consideration. 5 7/7/92 8. 9. 10. lOa. MINUTE APPROVAL (June 16,1992) (APPROVED) 34:0206 It was MOVED by Councilman Harbicht, seconded by Councilman Lojeski and CARRIED that the classifications of Activity Leader I (Class #5033) and Activity Leader II (Class #5032) be ESTABLISHED in the Recreation Department, AUDIENCE PARTICIPATION Richard Wi~htman, 224 E. Floral, Scout Master, was present with several members of the Boy Scout Troop to observe the Council proceedings. Mayor Fasching welcomed them. Sheldon Bull, 1145 Rancho Road, stated, in part, that he is present to inform the Council of the problems he and his neighbors are encountering because of the overpopulation of I peacocks in their area. The birds are noisy, and are a nuisance; eating the flowers, perching in the trees; defecating on the lawns and driveways, etc, He contacted his neighbors by mailing out between 700-800 cards and received 143 responses in favor of doing something about the peacocks, and a few opposed, He presented the cards to Council. He requested that the birds be removed and/or returned to the Arboretum. In response to questions'from Mayor Fasching, the Assistant to the City Manager stated that he had been informed that the Arboretum has found a person to relocate the peacocks because they have an overpopulation problem also. SOUTHWEST & NORTHWEST CORNER SITES (Marketing Proposal) (APPROVED) OG60-7</( ()6'J () z c.f {, 34:0207 Agency Special Counsel, Janice Miyahira informed Agency staff that settlement has been reached on the Eminent Domain cases of Franco and Cordova. Complete compensation to Franco is $289,654.51, and to Cordova is $266,154,52. Having previously deposited $212,00 with the Court for Franco, and $210,000 for Cordova, the Agency currently owes $77,772.51 to Franco, and $56,374.32 to Cordova. It was MOVED by Member Lojeski, seconded by Member Harbicht and CARRIED on roll call vote as follows that the Agency APPROVE the purchase of 156 E, Santa Clara Street (Franco) and of l57.E. Session on June 24, 1992, the Agency directed staff to prepare and return with draft Requests for Proposals for both the Southwest Corner Site and the Northwest Corner Site (Huntington Drive and Second Avenue). The Agency was particularly interested in reviewing the proposed desired uses for the properties and any other development related issues. The respective desired uses and development constraints are outlined in detail. in staff report dated July 7, 1992. There are three components in this report: 1) the Request for Proposals for the Southwest Corner; 2) the Request for Proposals for the Northwest Corner; and 3) a Request for Proposal for exclusive listing (commercial brokerage services) to market the two sites. Staff pointed out that if the Southwest and Northwest Corner RFPs and the exclusive listing RFP are acceptable, staff will forward them to the brokerage firms listed in the July 7, 1992 staff report immediately. However, because of the time needed for broker reply, staff analysis of proposals, broker selection, contract execution and broker advertising, staff does not anticipate wide publicity on the properties until probably September. If the Agency in the meantime wishes to advertise the availability of the properties without a broker commission, staff has set forth in Attachment 4 to the above mentioned report, an interim marketing program estimated to cost approximately $4,600. However, if the Agency should be successful in marketing the sites, it will save the brokerage fee. Considerable discussion ensued among the Agency Members as to the best course to follow to market these two sites. Chairman Fasching felt the Agency should aggressively market the sites by sending the Request For Proposal to the brokers, and in the meantime, staff should market the sites as outlined in Attachment 4. Member 'Ciraulo agreed. Referring to the interim marketing plan, Member Harbicht felt that staff marketing in the publications listed is a long shot and the Agency may be wasting the $4,600 such marketing will cost. Referring to the interim marketing plans, he would be in favor of No. 5 only on this plan to send letters and flyers to the Agency Developer list at a cost of $290,00. It was MOVED by Member Ciraulo, seconded by Chairman Fasching and CARRIED that the Agency AUTHORIZE staff to solicit proposals from the nine commercial brokers listed in staff report of July 7, 1992, using the Southwest and Northwest Corner RFP' s as shown in Attachments Nos. 1 and 2 and the Exclusive listing RFP of said report, 7 7/7/92 10f. AYES NOES: ABSENT: Members Ciraulo, Member Harbicht Member Margett Lojeski and Fasching Consideration of proposed "Arcadia Redevelopment Agency Concept for a Commercial Revitalization Program in Downtown Arcadia". The Concept has been modeled in part on the City's Commercial Rehabilitation Program of 1987, and on successful programs in other cities. If this Concept is acceptable, staff will forward copies to the Arcadia Chamber of Commerce and the Arcadia Business Association for their review and comment. Staff will encourage the Arcadia Business Association to include its membership in the review process. Chairman Fasching stated that he would like to see this program move ahead quickly, and proposed that these organizations develop a task force to sell the program. Member Harbicht stated that he felt the last program was actually very successful; more than twenty businesses were improved. It was not his understanding that there would be a task force to try to sell the program; he thinks that would be the wrong way to go. Staff should do this. Chairman Fasching noted that would involve a great deal of staff time. He suggested that perhaps there could be a group of six peop; 3 through the Chamber of Commerce who could be provided brochure or kit, together with the names of the property a:.d business owners, and the Agency could get this task force to work in conjunction with the Agency instead of using staff time. Member Ciraulo did not feel that such a task force would be qualified to sell such a program, and this would only prolong the time it would take to start the program. It would be good to get input from these organizations, but staff should actually sell the program. I In response to questions, staff said they env~s~on starting by mailing or delivering a copy of the proposed concept draft to property and/or business owners. A transmittal letter could invite them to come to the Arcadia Business Association meeting and listen to a staff presentation and to obtain their comments, input, etc. If that is sufficient, staff will bring the information back to the Agency. If not, there may have to be more than one meeting. Funds can be made available to business owners as well as property owners, of course with the approval of the property owner. Chairman Fasching feels this I is getting to be very complicated. Staff noted that the original program had been very hard to sell the first time around; it involved a lot of going from door to door to convince the owners. It was MOVED by Member Lojeski, seconded by Member Harbicht and CARRIED that staff be DIRECTED to obtain comments on the proposed "Arcadia Redevelopment Agency Concept for a Commercial Revitalization Program in Downtown Arcadia" from the Arcadia Chamber of Commerce and the Arcadia Business Association. Consideration of alternatives for landscaping the northwest and southwest corners of Second Avenue/Huntington Drive intersection and the southwest corner of First Avenue/St, Joseph Street intersection. Melanie Lane is a cul-de-sac street located on the south side of Camino Real Avenue just east of Baldwin Avenue. ACCEPTED the five feet (5') dedication on Palm Drive for public right-of-way purposes; the thirty feet (30') dedication on Rosemarie Drive for public right-of-way purposes; and the one foot (1') control strip in fee simple shown as Lot 3, Tentative Parcel Map No. 91-006, Parcel Map No. 23064. AUTHORIZED staff to enter into an agreement with the City of Monrovia and/or Brown, Vence and Associates to provide assistance in retaining a qualified contractor to operate a commercial/industrial recycling program. ORDINANCE NO. 1971 (ADOPTED) OS'~O.. 5'0 34: 0211 for the acquisition and the cost to put up and take down the flags at locations shown in staff report dated July 7, 1992 on specific holidays to be determined by Council, Councilman Lojeski reminded Council that in 1984 flags were displayed in the City in honor of the Olympic events. At that time the brackets for the flags were placed on the poles by the City's Public Works Department and possibly are still in place. The hardware had been donated by the Los Angeles Olympic Committee, The flags were provided by the American Legion. The brackets were located on poles up and down Huntington Drive from Fifth Avenue to the race track; and Baldwin Avenue between Naomi Avenue and Huntington Drive. Police Chief Johnson stated that when the American Legion moved they took all the flag holders that were in the center of Huntington Drive down, and they sold all their flags and standards. The brackets from the Olympic Committee may still be in place. Councilman Lojeski would like to see something done about displaying the flag on certain holidays. Councilman Harbicht was concerned about the $10,000 cost of putting the flags up and taking them down again. They will be put up in the business districts on days when the businesses will probably be closed, This is a time for belt tightening. Mayor Fasching thought it would be well worth the $1600 to put the flags up and take them down each time to show some spirit in the City. Mayor Pro tem Ciraulo also liked the idea. He would favor displaying the flag on six or seven holidays. Council did not think that the Arcadia Business Association would be able to do this; and that the City should do it. In reply to questions from Council, the Public Works Director said that the flags could be stored at the Public Works yard. It was then MOVED by Mayor Fasching, seconded by Mayor Pro tem Ciraulo and CARRIED on roll call vote as follows to APPROVE this item and DIRECT staff to proceed with the purchase and installation of American flags on the six holidays which are starred in staff report dated July 7, 1992 plus Flag Day, and to reduce cost of installation of brackets where possible by use of brackets where they exist. MATTERS FROM ELECTED OFFICIALS Councilman Harbicht noted that the house which is located next door to Paco's Restaurant on Foothill is vacant; the back door is open; there is trash in the front yard, etc. He would like to see Property Maintenance check this house ~nd see if it is possible to secure the premises. Councilman Lojeski said he has received four telephone calls from people on a side street near Baldwin where City crews went out and opened up the visibility of the street sign and the stop sign. They thanked the Public Works Department for this.
