OCTOBER 6, 1992
The City Council and the Arcadia Redevelopment Agency met in
a regular meeting on Tuesday, October 6, 1992 at 1:30 p. m.
in the Arcadia City Hall Council Chambers.

On MOTION by Mayor Pro tem Ciraulo, seconded by Councilmember
Lojeski and CARRIED on roll call vote as follows, the minutes
of the study session, adjourned and regular meetings of
September 1, 1992 and the adjourned and regular meetings of
September 22, 1992 were APPROVED. Councilmember Harbicht
ABSTAINED from voting on the September 22, 1992 minutes since
he was not present at that meeting.
It was MOVED by Councilmember Lojeski, seconded by
Mayor pro tem Ciraulo, and CARRIED that ordinances and
resolutions be read by title only and that the reading
in full be WAIVED.
PRESENTATION
G. Michael Allison, Chairman of the Arcadia Festival of Bands,
noted that the West Arcadia Band Review has been an important
event in this community for almos t forty years. The high
school bands appear in the parade by invitation only. This
year the event is to be expanded to include a pancake
breakfast sponsored by. the Lions Club, and an invitational
field show in addition to the street show. Mr. Allison
presented invitations for these events, and then introduced
the Members of the Executive Planning Committee present in the
audience tonight.
PRESENTATION
Andy Krueger, President of the San Gabriel Valley Water
Association, stated that the Association was created in 1955
and has a membership of 15 cities. Arcadia was one of the
original cities, making it a charter member of the

organization. Along with the 15 cities, there are 48 water
agencies and firms that are concerned with the production of
water from the main San Gabriel Ground Water Basin, and the
protection of this invaluable resource. More than a million
people rely on the water from the Basin. Unfortunately, parts
of the basin have become contaminated with volatile organic
compounds. His purpose tonight is to thank the City Council
for its co-active support in the joint effort to obtain
legislation to establish an Agency to clean up the basin.
Senate Bill 1619 authored by Senator Russell has been signed
by Governor Wilson and will become law January 1, 1993. This
legislation creates the San Gabriel Basin Water Quality
Authority, and prescribes the duties and financing powers of
the Agency necessary to coordinate an effective clean-up
program. Without the support of the cities in the San Gabriel
Valley, the legislation could not have become a reality. To I
show appreciation, the Association prepared a plaque to
express gratitude "to the City Council in appreciation for
outstanding efforts to support the successful passage of
Senate Bill 1679, landmark legislation to clean up the ground
water contamination in the main San Gabriel Basin presented
by the San Gabriel Valley Water Association".
Consideration of an appeal of the Planning Commission's denial
of MP 92-004, for a proposed 3-unit project at 21-23 El Dorado
Street (Jubany Architecture, appellant). The Planning
Commission at its August 25, 1992 meeting voted 4 to 1 to deny
the applicant's request for modifications (Case No. MP 92-004)
to construct a 3-unit apartment building on a ~O foot wide lot
at 21-23 El Dorado Street. The staff feels that the
requested modifications as outlined in the staff report, are
reasonable requests and typical of those modifications for a
three unit development on a 50' wide lot.
Mayor Fasching declared the hearing OPEN.
Kent Lindlev, 300 Leda Lane, stated, in part, that he owns
property at 14 El Dorado and is speaking against the appeal.
He believes that the requests for modifications are excessive,
both in number and in the size of the modifications. They
have asked for variances on three sides of the property. If
it is allowed, it will give this structure a squeezed-in look
that is not the best look for the neighborhood. If this
request is approved, he feels it will be followed by similar
requests from other property owners. The builders have made
no effort to modify their requests since they were heard and
rejected by the Planning Commission. He urges Council to deny
the appeal.
Councilmember Harbicht noted that Council has had a policy for
several years of granting these minor variances on 50'lots.
This is a situation in which, if Council did not grant these
variances, few of these lots would be developed. Two lots
would then be consolidated. Eight units can be built on two I
lots. By granting the modifications requested, the
development is limited to three units per lot, or a total of
six when two lots are ceveloped individually; in effect, less
density is being promoted. The Planning Commission and the
Council have discussed this on numerous occasions. It has
been Council's direction to the Planning Commission for
several years now that this is the kind of development Council
is looking for.
No one else desiring to be heard, the hearing was CLOSED on
MOTION by Councilmember Harbicht, seconded by Councilmember
Lojeski and CARRIED.
Councilmember Harbicht noted that this matter is not a
question of the size of the units being built: no matter what
size the units might be, only three could be developed on that

size lot and meet the City's Building Code. The reason that
the Code is not changed is because the requests for
modifications which the Planning Commission and the Council
see give occasion for negotiation and opportunity to have some
influence on the overall appearance of the development. This
has resulted in some very nice looking developments. The
Council has been consistent in this regard.
It was then MOVED by Councilmember Harbicht, seconded by
Councilmember Lojeski and CARRIED on roll call vote as follows
that Council FINDS that the request would secure an
appropriate improvement, and promote uniformity of development
based on the fact that Council has approved similar requests,
and APPROVES the appeal of MP 92-004, subject to the
conditions of approval set forth in the August 25, 1992
report.

AUDIENCE PARTICIPATION
David Czamanske, 115 Park Avenue, South Pasadena, introduced
himself and informed Council of his candidacy for the office
of a Member of the Board of Directors of Division 2 of the
Upper San Gabriel Valley Municipal Water District, which
includes the communities of Arcadia, Monrovia, San Gabriel,
South Pasadena, and portions of the unincorporated Los Angeles
County to the east and west of the City of Arcadia. He
understands that a request for endorsement for a candidate for
this office was considered at the September 22, 1992 Council
meeting, but that Council decided not to take any action. He
respects the Council's decision. He does not think it to be
desirable for City Councils to engage in the process of
endorsing candidates for legislative bodies of other
jurisdictions. However, in the event the Council will further
consider this possibility, he would like to tell his reasons
for running for office: Mr. Czamanske outlined the serious
and pressing problems facing the Upper San Gabriel Valley
Municipal Water District in its efforts to supply water to the
San Gabriel Valley, and his objectives and proposals to deal
with such problems. He also outlined his qualifications in
areas of education, experience and dedication for Council's
consideration in the event a decision is made to endorse a
candidate for this office.

Consideration of request of C. Hawkins Christmas Tree Co., to
lease 146-110 E. Huntington Drive (Southwest Corner Site) for
the sale of Christmas trees.
George Bickel, stated, in part, that he has just purchased
Hawkins' Christmas Tree Co., although he has been involved
with the company for the last ten years with regard to a
trucking company. In order to help the schools, they would
be willing to make a donation of $2.00 of the sale of each
tree, to the School Bond Committee.
Chairman Fasching noted that this is a way in which the City
can help the School Bond Committee in their forthcoming school
financing bond which will come up next April. At the end of
the Christmas season, Mr. Bickel or his representative will
be here to present a check to Mr. Albe and the School Bond
Committee. The PTA and the Bond Committee will support this
particular Chris tmas Tree lot in the sale of those trees.
Chairman Fasching recommended that the upcoming City
Newsletter include an article concerning the cooperation
between Mr. Bickel and the School Bond Committee. Member
Harbicht thanked Mr. Bickel for his generous offer.

In reply to questions from Member Lojeski, staff responded
that sales would be made from one lot only, and that all
provisions set forth by the Fire Marshal will be complied
with. Member Lojeski would like to be informed about the
business license status at the lot on the northeast corner of
Sunset Blvd. and Huntington Drive.
It was then MOVED by Member Harbicht, seconded by Member
Loj eski and CARRIED that the Arcadia Redevelopment Agency
AUTHORIZE and DIRECT the Executive Director to execute the
Agreement between the Agency and George Bickel, dba C.
Hawkins' Christmas Tree Co.
Consideration of Design Review for 2 E. La Porte Street (Gary
Richter) which will consist of rehabilitating two corrugated
metal buildings and providing landscaping along La Porte
Street.
The Agency Members agreed that this will be a significant
improvement of that corner.
It was MOVED by Member Harbicht, seconded by Member Ciraulo
and CARRIED that the Arcadia Redevelopment Agency APPROVE the
Design Review for 2 E. La Port Street, subject to the
departmental conditions outlined in staff report dated October
6, 1992.
Consideration of request for approval of Sixth Modification
Agreement for the Souths ide (Gribble) Project. The developer
of the Southside Project (Stanley W. Gribble) would like to
modify the provisions of his loan with First Interstate Bank.
As the Agency has been asked to do in the past, and as a
condition for approval of Mr. Gribble's current loan
modification, First Interstate requires that the Agency
reaffirm its second position to the First Interstate Deed of
Trust and consent to this Sixth Modification Agreement. The
Agreement has been reviewed by Agency Special Counsel and by
the Agency Attorney. All parties including First Interstate
Bank, Mr. Gribble, and Agency Special Counsel and the City
Attorney accept the Agreement.

Arcadia Gateway Center Associates, Ltd. and AUTHORIZE the
Executive Director to execute all documents, subject to minor
modifications as to form by the City Attorney.
Consideration of the selection of a commercial real estate
broker for Agency properties. At the Agency's Study Session
on September 1, 1992, the Agency directed staff to return with
commercial real estate broker recommendations. Members
Lojeski and Ciraulo voiced a preference for Hayes & Company
because of their experience in redevelopment, and because they
may bring in some new developers since CB Commercial is
already marketing several properties in Arcadia. Member
Harbicht would be willing to agree to the selection of either
CB Commercial or Hayes & Co. Chairman Fasching agreed, but
felt a slight inclination toward Hayes & Co.
It was then MOVED by Member Loj eski, seconded by Member
Ciraulo and CARRIED that the Agency award an exclusive real
estate listing for the Northwest Corner and Southwest Corner
sites (Huntington Drive and Second Avenue) to Hayes & Co. and
AUTHORIZE the Executive Director to execute an agreement in
a form acceptable to the Agency General Counsel.
The meeting ADJOURNED to 6:30 p. m., October 13, 1992.
CITY COUNCIL RECONVENED
CONSENT ITEMS
AUTHORIZED the Mayor and City Clerk to execute a one year
contract, extendable to a maximum of five years by the City
Manager, with Superior Signal Service Corporation, in a form
approved by the City Attorney.
ACCEPTED the 1992-93 annual slurry seal program - Job No. 526,
by Pavement Coatings Co., the contractor, and AUTHORIZED final
payment to be made in accordance with the contract documents.
The work consisted of furnishing and application of emulsion-
aggregate Type II slurry with Latex on precleaned prepared
street pavement areas, and installation of traffic stripes and
pavement markings, as well as furnishing and application of
emulsion-aggregate Type I slurry with latex on the Chamber of
Commerce parking lot. Ten percent (10\) retention payment
becomes due and payable 35 days after the recordation of
Notice of Completion and will only be released by the Director
of Public Works on completion of all corrections of record.
Postponed to October 6,. 1992 City Council agenda. (Call for
bids for Installation of a SCADA System for Water Facilities.)
APPROVED the closure of Baldwin Avenue from Huntington Drive
to Longden Avenue, the residential area east of Baldwin south
of Duarte Road, north of Norman Avenue and west of Holly
Avenue, and Campus Drive by the Arcadia High School. The
closure in West Arcadia will be from 9:00 a.m. to
approximately 1:00 p. m., November 21, 1992. The closure of
Campus Drive will be from 1:00 a. m. to the close of the field
competition at approximately 11:00 p. m., November 21,1992.

display at Arcadia High School as part of the annual half-time
festivities at the Homecoming football game on October 16,
1992, subject to the conditions listed in staff report dated
September 29, 1992.

Mayor Fasching stated chat he is in favor of this Resolution,
and agrees that the former limit of $2,500. should be raised
because of the time that has passed and the change in economic
conditions. However, in conjunction with this, he would like
to see a summary report each month of all claims settled.
The City Attorney replied that instruction can be part of the
action tonight, and such reports will be provided to Council,

. I would like to adj ourn tonight's meeting in memory of a
long-time personal friend, Philip Lowell Gittings, who was
born March 8, 1942 and passed away August 22, 1992. Phil was
born at St. Luke's Hospital, Pasadena, and lived with his
mother, Ada and father, Myon on Forest Avenue, Arcadia. He
attended Highland Oaks, First Avenue and Arcadia High Schools.
He was a member of the graduating class of 1960 from Arcadia
High School. Phil served with a National Guard unit here in
Arcadia. and particularly spent time in service for his
country during the Watts Riots. In 1965 he received his
Associate of Science degree from Citrus College. He worked
for GTE for 29 years as a Forecasting Analyst. The last 3
years with GTE, he was the Administrator for Area Forecasting
where he was responsible for the compilation and analysis of
economic data throughout California. Phil worked as a
volunteer for the Junior Achievement Program, and for six
years was Chairman of the LaVerne City Parks and Recreation
Commission. He had many loves, baseball being one. He was
actively involved in the Azusa Pacific University sports
program. Arcadia High School, which he considered the best
high school in California, was truly one of his loves. He was
always very active with the Alumni Association, and was also
part of the 1960 Class Reunion Committee. He had a special
fondness for the '50's. He was into - the Olympics
particularly Olympic pin collecting. He was a very active
member of the Grace Baptist Church in Glendora where he and
his wife, Midge, were a part of the Pastoral Care Ministry,
making many hospital visits and sending out cards of
encouragement. After many years living in Glendora, Phil
moved recently to Arcadia. Unfortunately he passed away
leaving behind his two children, Julie 22, Brian 19, and his
wife, Midge (who was member of the graduating class of 1962
from Arcadia). So, appropriately tonight, I would like to
adjourn tonight's meeting in memory of Philip Lowell
Gittings. .
At 8:20 p. m., the meeting ADJOURNED to 9:00 a. m., Saturday,
October 10, 1992 at the Arcadia Community Center to conduct
the business of the Council, and any CLOSED SESSION necessary
to discuss personnel, litigation and evaluation of properties.
