M I NUT E S CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY ADJOURNED REGULAR MEETING (WORK SESSION) OCTOBER 27, 1992 The City Council and the Arcadia Redevelopment Agency met in an Adjourned Regular Meeting (Work Session) on Tuesday, October 27, 1992, at 5:30 p.m. in the Conference Room of the City Hall Council Chambers. PRESENT: ABSENT: Councilmen Ciraulo, Lojeski, Margett and Fasching Councilman Harbicht It was MOVED by Councilman Lojes\d, seconded by Councilman Margett and CARRIED to EXCUSE the absence of Councilman Harbicht. Also in attendance: Planning Commissioners Amato, Daggett, Hedlund, Huang and Clark. Steve Copenhaver, Economic Development Specialist ORAL COMMUNICATIONS None WORK SESSION ITEMS In response to Council's desire to establish a list of priority projects in the City, Council determined at their October 13, 1992 work session that their first priority would be economic development. As a result of this, the City Manager developed an Economic Development Priority outline and schedule. The outline includes suggestions of what the City Manager thought the Council/Agency might wish to do over the next several weeks to address the Economic Development Priority program, such as: A - Expansion at Santa Anita Fashion Park Mall, which the Planning Commission is currently addressing at their meeting this date; and B - Downtown Strategy and Design Considerations, on which the Council will begin discussion this date. In consideration of downtown revitalization, nine items were listed on the outline as: No.1 - Issues - Redevelopment Agency... where do we go from here; Commercial Rehabilitation Loan Program; Civic Center Refurbishment'; New Police Facility; Huntington Drive Improvement; Transit Center; Foulger Ford site ... what next?; Northwest Corner; Southwest Corner. Mr. Michael Freedman had been invited to attend this work session and address the Council on the subject of the "Fundamentals of Downtown Revitalization", No.2 on the outline prepared by the City Manager. This would be the first of a number of discussions to help the Council and staff develop Arcadia's plan for proceeding with the Economic Development Priority program. Also, scheduled on the outline as No.3., A tour of the redevelopment area with Dave Powell, the broker of record for the Northwest and Southwest Corner sites (Huntington Drive and Second Avenue) . 1 10/27/92 34:0350 No.4. - An Economic Marketplace Perspective to be presented by Mr. Steve Copenhaver sometime in the month of November. The City Manager introduced Michael Freedman, one of the owners of Freedman, Tung and Bottomley, San Francisco, to present the "Fundamentals of Downtown Revitalization". Before beginning the presentation, Mr. Freedman responded to Councilman Margett' s questions ... Mr. Freedman has been brought up-to-date with the history of the downtown and redevelopment areas and has taken a tour of the same. He has spoken with staff about these areas and .eviewed the maps to attain a sense of familiarity with the subject. Mr. Freedman related that he has not prepared any kind of recommendation since a thorough investigation of problems, liabilities and assets must be completed to provide specific .ecommendations to the Council. His firm is now working with the cities of Mountain View; Reno; Ames, Iowa; Phoenix, Ventura; and Pleasanton in the areas of downtown or district revitalization. Other projects have been completed in the Sacramento area around the capital; San Jose; Cuperintino; various other projects in Mountain View; Temecula, Cathedral City; and Yuba City. Their company process entails working with the community to find out ~hat the citizens want; from conceptuals to detailed concepts of an area; planning ~ork writing ordinances and design guidelines; writing specific plans down to the last ~ord; attendance at all public hearings, etcetera. The design project begins with community workshops and moves its way through detailed concepts on through design development, through to complete packages - all the way down to the nails and screws in the job. Also, the cost estimates, etcetera. On the planning side, -they usually take the lead coordinating the ci.culation, transportation and parking; infrastructure and financing and economic studies which are connected with a downtown area project. Mr. Freedman also stated in part, that he is one of three principals of his firm. Each principal manages their own proj ects in collaboration with the other two principals. The firm is seven years old... they are very narrowly specialized in downtown and district revitalization; shopping; street design; commercial district revitalization; mixed use; master plans, and new towns. Three-fourths of the firm's work is done in downtown revitalization and 80% of that is for small to medium size cities in major metropolitan areas similar to Los Angeles. Mr. Freedman then presented through slides, graphs, and lecture, the "Fundamentals of Downtown Revitalization", developed by his firm, to the Council and the Planning Commission. At the conclusion of the presentation, Council and the audience expressed their appreciation for this comprehensive revitalization program. Mayor Fasching then called a three minute RECESS. The work session RECONVENED at 8:25 p. m. 2. URGENCY ORD. NO. 1980 (Karaoke Entertain- ment Mora- torium) (ADOPTED) 01 'CiO -,U) . -J /'; Consideration of an urgency ordinance to place a moratorium on Karaoke Studio use and regulatory steps. The October 14, 1992 staff report stated in part, that Karaoke Television (KTV)-is a relatively new form of entertainment within the City, having its own unique characteristics, which in some cases includes the use of private rooms to conduct the entertainment. 2 10/27/92 I I I I ~ 3. CHRISTMAS BANNERS (APPROVED) O/,>r.J-JS;:J 34:0351 In all of the premises in the City which currently have Karaoke, customers are allowed to purchase alcoholic beverages or there is a license authorizing the sale and/or consumption of such beverages. At present, there are no Municipal Code provisions to directly regulate Karaoke Television uses. As background, staff reported that on October 20, 1991, a shooting took place at the Szechwan Restaurant on Santa Anita Avenue, which was believed to be gang related. The Szechwan has Karaoke entertainment. Further, in August, 1992, three person were killed in a traffic accident at Huntington Drive and Holly Avenue ... these persons had been drinking at the Szechwan prior to the collision. The Police Department has very reliable information that some Karaoke establishments are violating alcoholic beverage control laws. The Tokyo Wako Restaurant was recently cited for sales of alcoholic beverages to a minor. This location also has Karaoke entertainment. The staff report noted that there are at least five Karaoke facilities currently operating within the City. Staff research has shown that other law enforcement agencies who have dealt with Karaoke entertainment locations have documented continual problems with alcohol violations, prostitution, gang congregation and disturbance. It is the recommendation of the Police Department that municipal code and/or conditional use permit restrictions be drafted to deal with Karaoke Television entertainment, and an urgency ordinance adopted placing a moratorium on the operation of any new Karaoke establishments in the City. The moratorium will allow time for the police, the City Attorney, and the Planning Department to study this issue and prepare possible zoning proposals and related regulatory provisions regarding use of property for Karaoke. Following discussion, the Director of Planning presented and read in full the text of Ordinance No. 1980: "AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, IMPOSING A MORATORIUM ON ALL LAND USE AUTHORITY, PERMITS, LICENSES AND ENTERTAINMENT PERMITS THAT AUTHORIZE KARAOKE AND KARAOKE TELEVISION AS A PERMITTED OR ANCILLARY USE AND ACTIVITY IN THE CITY OF ARCADIA; DIRECTING A STUDY; AND DECLARING AN URGENCY REQUIRING THE MORATORIUM. (4 VOTES REQUIRED)" It was MOVED by Councilman Lojeski, seconded by Mayor Pro tem Ciraulo and CARRIED on roll call vote as follows, that URGENCY ORDINANCE NO. 1980 be and it is hereby INTRODUCED and ADOPTED. AYES: NOES: ABSENT: Councilmen Ciraulo, Lojeski, Margett and Fasching None Councilman Harbicht Consideration of Mayor Fasching's recommendation to promote the spirit of the Christmas season by the installation and display of 150 Christmas banners throughout the City (Continued from October 20, 1992). The banners will be hung at 92 locations which are used to hang the American flags, with 58 additional banners and poles to be mounted as well. The Chamber of Commerce solicited bids for the project, according to Mayor Fasching. Five companies responded. The best proposal was submitted by Foley Advertising and Design, Inc., for a three-year program whereby they will manufacture the banners and install them each year, complete with brackets. The banners would be displayed for approximately one month during the Christmas season; taken down by Foley; cleaned and stored by them until the next year. The cost for this three-year program is $32,252. Of this amount, $8,252 will be raised by donations from the private sector, leaving a balance of $24,000 to be paid by the City, or $8,000 per year for three years. Mayor Fasching reported the $8,252 would be contributed by the Chino Bank, Santa Anita Race Track, 3 10/27/92 4. CALTRANS UPDATE 5. LOJESKI (Workshop) 34:0352 the Methodist Hospital, Chamber of Commerce, Arcadia Firefighters Association, Van's, K.B. Construction, Global Travel and several other businesses in town. In a discussion of the appropriate motion, the City Attorney commented that, as previously discussed, if the Council so desires, some Arcadia Redevelopment Agency funds may be applied to the City's portion of the cost. These redevelopment funds would be in proportion to the number of banners to be displayed in the redevelopment area. Further, this item could be ratified by the Redevelopment Agency at another meeting when the Agency is in session. It was MOVED by Councilman Margett, seconded by Mayor Fasching and CARRIED on roll call vote as follows to WAIVE the City purchasing ordinance and AUTHORIZE the appropriation of City and I Redevelopment funds in the amount of $24,000, to apply to a three year contract to Foley Advertising and Design, Inc., for a total contract cost of $32,252, to provide Christmas banners, subject to approval by the City Attorney of all contract and required docwnentation. AYES: NOES: ABSENT: Councilmen Ciraulo, Margett and Fasching Councilman Lojeski (For reasons stated below) Councilman Harbicht Councilman Lojeski stated in part that he has a little problem with the way this project was bid, basically, giving credibility to an outside agency, the Chamber of Commerce ... he is sure they did a very fine job but this kind of goes against the City's typical way of bidding various things like this ... Councilman Lojeski did not think that this project was appropriate this particular year because of the economic times we are in. Mayor Fasching reported that the meeting with Caltrans officials that he and Councilman Margett and the City Engineer attended was very cordial and favorable. No definitive answers were received, however. (This in reference to Caltrans reimbursement to the City for soundwall construction costs borne by the City.) Councilmen Lojeski and Margett also met with Caltrans officials and established an open line of communication which, hopefully, will produce good results, Councilman Lojeski reported. ITEMS FROM COUNCIL MEMBERS Councilman Loj eski expressed his appreciation for tonight's workshop in revitalization, stating in part that this is his ninth year on the Council and he has found this workshop to be probably the most enlightening experience he has had on this Council. He is anxious to pursue this revitalization program further, and go to work. Moreover, he likes the idea of involving the community in this process this concept is already in operation now in the committee formed to review the architect's proposals for the expansion of the City Library. I Councilman Margett agreed with Councilman Loj eski' s remarks. Mayor Pro tem Ciraulo asked "What is our next step in this process ... here do we do from here?" Mayor Fasching expressed his support for the City Manager and said that he would give a lot of credit to our new City Manager, who has taken hold of the vision and those things that this Council wants to do. Mayor Fasching said he would like to go on record as saying that City Manger Don Duckworh has done an outstanding job in giving the Council guidance and putting everything in the right perspective. The City Manager stated in part that this is a ... "it takes a lot of us working together". with Michael Freedman tomorrow to ~iscuss some staff team effort Staff will meet of the details of 4 10/27/92 /J I I 34:0353 this revitalization program. This will be a good growth experience for some of the staff so that staff can better support the Gouncil in the direction the Council wants to take. The City Manager then related some steps to be taken soon such as the redevelopment area tour with Dave Powell; the presentation of the economic marketplace by Steve Copenhaver; possibly a meeting with the Redevelopment Director for the City of Brea, Sue Georgino ... Brea has gone through a similar kind of a revitalization process. After these kinds of things are accomplished, then Council can decide what they feel is comfortable to do. Further, Michael Freec1man can prepare some recommendations and thoughts in writing for staff and Council in the meantime, and then Council could decide the best course of action to take in developing this economic development priority.
