President Melvyn Reeves, Arcadia Stake, Church of Jesus Christ of Latter Day Saints Councilman Dennis A. Lojeski PRESENT: Councilmen Ciraulo, Harbicht, Fasching. Lojeski and Fasching None ABSENT: MINUTE On MOTION by Mayor Pro tem Ciraulo, seconded by Councilman APPROVAL Lojeski and CARRIED, the minutes of the October 10, 1992 Work (Oct.lO,1992)Session were APPROVED; the minutes of the October l3, 1992 Work (Oct.l3,l992)Session were APPROVED as corrected; and the minutes of the (Oct.20,1992)October 20, 1992 Adjourned and Regular Meetings were APPROVED. (APPROVED) 0'-/ ?(J_7-;: It was MOVED by Councilman Lojeski. seconded by Mayor Pro tern Ciraulo, and CARRIED that ordinances and resolutions be read by title only and that the reading in full be WAIVED. PRESENTATION Mayor Fasching read a proclamation proclaiming the week of November 15 21, 1992 as American Education Week and to encourage the citizens to recognize the importance of education to the community and to the nation. The proclamation was presented to Mr. Gary Southworth. The City Clerk administered the Oath of Office to incoming Sister City Commissioner, Robert Westfall. Mayor Pro tem Ciraulo presented Mr. Westfall his credentials, a City pin, and welcomed him to the City family. Consideration of establish1ng a service charge for the release of stored or impounded vehicles. Each year the Police Department impounds and/or stores approximately 800 vehicles. These vehicles are stored for many reasons, as set forth in the October 12, 1992 staff report. The Chief of Police suggested that Council adopt a service charge for the release of impounded and stored vehicles. The imposition of this fee will alIow for partial cost recovery when a person reclaims his vehicle. In general, the necessity for police personnel to store the vehicle is the result of the improper, and/or unlawful conduct of the 1 11/3/92 RESOLUTION NO. 5698 (ADOPTED) 2. PUBLIC HEARING TEXT. The storage, processing and later release of the vehicle is a significant imposition upon the time and resources of the Department. Persons would be exempt from release fees in those instances where they have been victimized. The fee amount is recommended to be $30. This fee is independent of, and in addition to, the fees charged by the contract towing agency and is strictly intended to be user directed. In reply to a question from Councilman Loj eski, Police Chief Johnson said that the $30 fee would generate approximately $20,OOO/year. The Police Department tried to keep the fee on the low side; recommendation for a higher fee may be appropriate in the future. Mayor Fasching declared the hearing OPEN. I No one desiring to be heard, the hearing was CLOSED on MOTION by Councilman Lojeski, seconded by Councilman Harbicht and CARRIED. The City Attorney presented and read the title of Resolution No. 5698: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ESTABLISHING A SERVICE CHARGE FOR RELEASE OF STORED OR IMPOUNDED VEHICLES". It was MOVED by Councilman Harbicht, seconded by Councilman Margett and CARRIED on roll call vo~e as follows that Resolution No. 5698 be and it is hereby ADOPTED. AYES: Councilmen Ciraulo, Harbicht, Lojeski, Margett and Fasching None None NOES: ABSENT: Consideration of a text amendment to the City's Plumbing Code, adding a water efficient landscape ordinance. As a result of the State's water shortage, in 1990 the State adopted Assembly Bill 325 which directed the State Department of Water Resources to develop a model water efficient landscape ordinance. A model ordinance was drafted by a committee representing builders, government interests, and landscape professionals. The State model ordinance will automatically go into effect on January 1, 1993 in all jurisdictions that do not adopt their own local ordinance. Any local ordinance must be consistent with the State's requirements. A draft of a City ordinance, which has been amended slightly from the State's model ordinance, has been prepared by staff. The regulations will apply to all public agency projects, all new and rehabilitated landscaping for private developments that require plumbing permit for any irrigation system, and developer installed landscaping for new single family and new multiple family projects. The regulations do not apply to homeowner provided landscaping at single family and multiple family projects and any landscape project with a total landscape area of less than 2500 square feet. In order to provide the required plan checking and auditing, the City will have to have the plans. and subsequent audits performed by qualified private consultants. I In response to a question from Councilman Harbicht, staff replied that the State mandated ordinance will become law in Arcadia in the event that Arcadia does not pass an ordinance. Staff has added wording which has to do with the mechanism for collection of fees, and description of the manner in which plans would be handled by the City when submitted for review. Councilman Harbicht commented that such an ordinance will place a tremendous burden on the builder, developer or homeowner who has to comply with these landscaping regulations. The regulations are so complicated that they will require the 2 11/3/92 I I 3. 4. 34:0358 services of a professional consultant to help with the calculations, etc. He feels this ordinance was passed as a result of a temporary water shortage, but will have far-reaching and long lasting consequences, as well as be the cause of great expense. He wondered if there might be some means of writing this ordinance so that it would be less onerous to the residents. Mayor Fasching declared the hearing OPEN. Tom Crosbv, 601 South Old Ranch Road, stated, in part, that he is present to voice the same concerns that Councilman Harbicht mentioned. Namely, that a large percentage of the homeowners as well as developers, in the City would be affected by this proposed ordinance since any landscaping, irrigation or sprinkler system installation on any property with a total landscape area of 2500 square feet or more would requir~ compliance with such regulations. He suggested that the penalty phase might be addressed in an effort to ease the hardship for the homeowners. No one else desiring to be heard, the hearing was CLOSED on MOTION by Councilman Harbicht, seconded by Mayor pro tem Ciraulo and CARRIED. After considerable discussion among the Council, it was the consensus to direct staff to return to Council with an ordinance which would comply with the State mandated rules, but which would endeavor to make these regulations l~ss onerous, particularly for the homeowners, and to be as least burdensome as possible. PUBLIC PUBLIC HEARING SCHEDULED for November l7, 1992 for consideration HEARING of Zone Change 92-002 to rezone an 8.2 acre portion of Santa SCHEDULED Anita Race Track Parcel No. 949 from R-l (Single-Family (Nov.17,l992) Residential zone) and S-l (Special Use) to C-2D (General ().rfi~. PO Commercial Zone with a Design Overlay). The applicants are proposing to expand and renovate the existing Santa Anita Fashion Park Mall at 400 E. Baldwin Avenue. The rezoning would allow the use of a portion of the existing race track parking lot for expanded mall parking (The Hahn Company and Santa Anita Realty Ent., owners/developers of the site). 4b. Roofing - Wilderness Park) iJ7~()-IO PUBLIC HEARING SCHEDULED for November l7, 1992 for consideration of Text Amendment 92-005 to City Ordinance No. l425 and Resolution No. 4l85, to revise the current boundaries where mall buildings are permitted to be located on the site. This text amendment is required to allow development of a new Nordstrom's building (The Hahn Company and Santa Anita Realty Ent., owners/developers of the site). APPROVED Management Plan (Exhibit A), Revised Rules (Exhibit B). and Policies for Wilderness Park (Exhibit C) set forth in staff report dated November 3, 1992. $9,000 to be ALLOCATED to the Recreation Nature Account from the unappropriated reserve in the general fund, in order to accomplish the security increases as outlined. AWARDED contract for the roofing of the Nature Center at Wilderness Park to Temple Roofing Company in the amount of $8,950.00. This to include removal and disposal of the old 3 11/3/92 4e. Councilman Lojeski stated in regard to this item that, since the contractor is donating free delivery of the materials and free labor to install the new roof as a good will gesture to the City, that a thank you response from the Council would be appropriate. APPROVED Santa Anita Spring Classic l4th Anniversary 5K-lOK Run and Rollerblade Race to be held Sunday, December 13, 1992. The $1,664.00 estimated cost of policing the event will be borne by the Boy Scouts of America, San Gabriel Valley Council, and no costs to the City are anticipated. Insurance binders naming the City of Arcadia, its officials and employees in the amount of one million dollars have been arranged. CITY ATTORNEY The City Attorney presented and read the title of Ordinance No. 1979: "AN ORDINANCE OF THE CITY COu,NCIL OF THE CITY OF ARCADIA, CALIFORNIA, ADDING SECTION 4912.5 TO THE ARCADIA MUNICIPAL CODE REGARDING ALLOWANCE OF TEMPORARY DIRECTIONAL SIGNS ON CITY PARKWAYS AND MEDIANS.. It was MOVED by Councilman Margett, seconded by Mayor Pro tem Ciraulo. and CARRIED on roll call vote as follows that Ordinance No. 1979 be and it is hereby ADOPTED. Mayor Fasching expressed concern as to whether there is to be a limit to the number of signs that could be placed on the medians at anyone time, as well as control of the content of the signs. The City Attorney responded that the placing of the signs, as well as the numbers and the content, would be controlled by the permit process. The ordinance itself states that the issuance of the permit is subject to reasonable conditions. In the event these controls are not sufficient, staff will return to Council with an amended ordinance. Councilman Harbicht noted that permits will be issued only to non-profit organizations on a once-a-year basis. ADJOURNMENT (Nov.10,1992 5:30 p.m.) ATTEST: 34:0360 The City Attorney presented and read the title of Resolution No. 5702: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE APPLICATION FOR 1992-93 BICYCLE AND PEDESTRIAN FACILITIES FUNDS AUTHORIZED UNDER SB 821" It was MOVED by Councilman Lojeski, seconded by Councilman Harbicht and CARRIED on roll call vote as follows that Resolution No. 5702 be and it is hereby ADOPTED. AYES: Councilmen Ciraulo, Harbicht, Lojeski, Margett and Fasching None None NOES: ABSENT: MATTERS FROM STAFF None MATTERS FROM ELECTED OFFICIALS Councilman Margett suggested that congratulations should be in order for the ad hoc committee that worked out the details of the increased security at Wilderness Park. The cost for increased securi ty is being accomplished at less than that originally projected. He feels this has been an efficient and cooperative approach to government, and he would like to see this concept continued in the future. "Alderman Don Geddes, Councilman from our Sister City, Newcastle, Australia, died October 24, 1992 of a heart attack. He had undergone surgery nine weeks ago for stomach cancer, and had appeared to be recovering well. Don Geddes was the longest serving member of the Newcastle City Council, having served since 1977, and one of the region's best known individuals. He was an outstanding citizen who loved his community, and enjoyed the Sister City relationship with Arcadia. Among many other duties, he served as Controller of the Newcastle State Emergency Service, and took a leading role in the recovery following the 1989 earthquake. Don was an RAF Reserve Wing Commander. Judge Advocate and Defense Force Magistrate and President of the Newcastle Football League. He is survived by his wife, Maria and four children." "Mr. Mayor, I would also like to adjourn the meeting in memory of Philip J. Ciraulo. Philip Ciraulo was born on April 19, 1911 in Johnstown, Pennsylvania. and passed away on October 20, 1992. He was past President of the Sons of Italy in America, Fourth Degree Member of the Knights of Columbus, and President Emeritus of the Press and Radio Commission for the Grand Lodge of the Sons of Italy in America. He is survived by his wife, Silvia; two sons, Mayor Pro tem Joe Ciraulo, and Samuel Ciraulo; two brothers; two sisters; five grandchildren; and nine great grandchildren. The vigil services were held on Sunday, October 25 and the funeral was held on Monday, October 26, both at Holy Angels Church in Arcadia." At 8:35 p. m., the meeting ADJOURNED to 5:30 p. m., Tuesday, November 10, 1992 in the Conference Room of the Council Chamber to conduct the business of the Council and Redevelopment Agency, and any CLOSED SESSION necessary to discuss personnel, litigation and evaluation of properties. 11/3/92
