The City Council and the Arcadia Redevelopment Agency met in
a regular meeting at 7:40 p. m., Tuesday, November 17, 1992
in the Arcadia City Hall Council Chambers.

meeting (work session) of October 27, 1992 and the adjourned
and regular meetings of November 3, 1992 were APPROVED.
Councilman Harbicht was not present at the October 27, 1992
meeting.
It was MOVED by Councilman Lojeski, seconded by Councilman
Margett and CARRIED that ordinances and resolutions be
read by title only and that the reading in full be WAIVED.
PRESENTATIONS
Beth Wells. Sister City Commissioner, 2140 Canyon Road,
presented to Council a book entitled "Shadows in the Mist",
which had been sent to Arcadia by Michael O'Hagan, Member of
the Sister City Commission in Newcastle, Australia. This is
a beautiful volume depicting the Australian aboriginal mists
in story and painting. It is the understanding of the Sister
City Commission that this book will be kept in the Arcadia
Library. However, if, for any reason the Library does not
wish to house it there, it is requested that they notify the
Commission.
Mayor Fasching presented and read a proclamation declaring
that the City will join with the entire nation in honoring the
family structure by declaring the week of November 21 to
November 28, 1992 to be Arcadia Family Week. The proclamation
was then presented to Mr. Ron Rossiter.

Consideration of Zone Change 92-002 to rezone an 8.2 acre
portion of Santa Anita Race Track Parcel No. 949 from R-l
(Single-family Residential Zone) and S-l (Special Use) to C-
2D (General Commercial Zone with a Design Overlay). Approval
of Zone Change 92-002 is subject to the conditions of approval
set forth in the October 27, 1992 staff report. The
applicants, Hahn Company and Santa Anita Realty Enterprises,
Inc., are proposing to expand and renovate the existing Santa
Anita Fashion Park Mall at 400 South Baldwin Avenue. The
rezoning would allow the use of a portion of the existing race
track parking lot for expanded mall parking. The proposed
zoning of the 8.2 acre parcel is consistent with the existing
and proposed development of the site and conforms to the
general plan designation for the mall, which is commercial.
A Negative Declaration has been prepared for this project.
In reply to questions from Council, staff responded that, if I
the Zone Change is approved, the area will be part of an
overall single zone which will then be C-2D (General
Commercial Zone with a Design Overlay). Also, there will be
adequate parking available for the race track after a portion
of the existing race track parking lot is rezoned for expanded
mall parking, with the possible exception of one or two days
a year when the "Breeders' Cup" is run, for example
Mayor Fasching declared the hearing OPEN.
No one desiring to be heard, the hearing was CLOSED on MOTION
by Mayor Pro tem Ciraulo, seconded by Councilman Harbicht and
CARRIED.
It was then MOVED by Councilman Harbicht, seconded by
Councilman Lojeski and CARRIED on roll call vote as follows
to APPROVE Zone Change Z-92-002 subject to the conditions
as set forth in the October 27, 1992 staff report to the
Planning Commission; APPROVE and FILE the Negative
Declaration; FIND that the zone change will not have a
significant effect on the environment and DIRECT staff to
prepare the appropriate ordinance.

Consideration of Text Amendment 92-005, which proposes co
amend City Council Ordinance No. 1425 and Resolution No. 4185,
to revise the current boundaries where mall buildings are
permitted to be located at 400 South Baldwin Avenue. Approval
of T. A. 92-005 is subject to the conditions outlined in the
October 27, 1992 staff report. The applicants, Hahn Company
and Santa Anita Realty Enterprises, Inc., are proposing to
expand and renovate the existing Santa Anita Fashion Park Mall
at 400 South Baldwin Avenue. The proposed expansion requires
the aforementioned text amendment to allow development of a
new Nordstrom department store, since a portion of this
building would be located west of the current boundaries where
mall buildings are permitted. City Council Ordinance No. 1425
was adopted in 1971, and originally amended the Arcadia
Municipal Code to rezone the site for the development of the
Santa Anita Fashion Park regional shopping center mall. City
Council Resolution No. 4185 was also adopted in 1971, to
establish Architectural Design Zone Regulations for the
development of the mall. This resolution pertains to the
entire site, as described in Ordinance No. 1425. The proposed
expansion requires the following amendments to City Council
Ordinance No. 1425 and Resolution No. 4185: 1) That the
original legal description for Parcel 2 in Section 1.2 of

Ordinance No. 1425 be amended to reflect the proposed boundary
adjustments; and 2) That the "Exhibit to Resolution No. 4185"
(Design Overlay Site Plan) be amended to reflect the proposed
boundary adjustments.
Mayor Fasching declared the hearing OPEN.

Request from F. Macciola to be heard regarding Arcadia Women's
Club and neighborhood problems.
Frank Macciola, 2728 Caroline Way, Arcadia, owner of the
property at 113 Diamond Street, located east of the Arcadia
Women's Club. Mr. Macciola stated, in part, that for six
years he has had problems of late hours with loud noise and
music, etc., from renters of the Women's Club. When the
parties are over and people are walking to their cars, there
has been yelling, urinating on lawns, leaving bottles and cans
on lawns and curbs, revving car engines, car alarms,
arguments, sometimes fights. All of this wakes up residents
living up and down Diamond Street. He submitted a petition
signed by some of these residents and correspondence from his
tenant, Mr. Don Deitrick, as well as a police report listing
some of the complaints. The residents would like to see a
permanent solution to these problems. They would like the
City to change the Conditional Use Permit for the Women's Club
to the effect that the time for parties on Friday, Saturday,
and Sunday evenings would not exceed 7:00 p. m.
Don Deitrick, 113-A Diamond Street, stated, in part, that
he has resided at this location since 1988, and has lived in
Arcadia for nineteen years. He had always enjoyed residing
in Arcadia until his present experience on Diamond Street.
He reiterates Mr. Macciola's remarks that he is not
complaining about the Women's Club per se. He has no
objections to the continuance of the Club's weekday and
daytime activities. The problems seem to occur just on the
weekends. He is present to request the Council to help solve
the problems of disturbance and nuisance during late night
hours of the night caused by the parties for which the Women's
Club rents the premises. In February 1992 the
representatives of the Women's Club stated that they would
take affirmative action to correct the misbehavior of the
people using the facilities. However, there has been no
improvement. After a meeting on September 3D, 1992 the City
Attorney assured the neighbors that there would be no more
permits issued for weekend late night parties. This has not
been effective because of the appeal process. The permit's are
denied, but the applicants are granted the permit after they

appeal. He would like to see the Council prohibit late night
activity at the Women's Club.
Councilman Harbicht noted that the result of not granting the
permit and going through the appeal process is that the City
can then put restrictions on the permit, which normally would
not be possible. Mr. Deitrick responded that the parties go
on beyond 10:00 p. m.; sometimes as late as 1:00 a. m.
Sometimes a Friday night decorating event becomes a pre-party
party which results in disturbances. Councilman Harbicht
responded that the City is not ignoring the problem; it is not
giving a permit for parties to continue until 1:00 a. m. At
the present time the entertainment must stop at 10:00 p. m.
and the premises be cleared by 11:00 p. m. The City Attorney
noted that I because of previous contractual arrangements.
there are still a few remaining permits that will allow the 1
parties to go until 11:00 p. m. The new requirement is that
the entertainment end at 10:00 p. m. The City has
jurisdiction only over the entertainment. Mayor Fasching
noted that this is not a public hearing. The City Attorney
stated, in part, that the new conditions and new management
approach can continue to be monitored and the results brought
back to the Council with, perhaps, some recommendations, and
at that time a public hearing could be scheduled if Council
so desires.
Mr. Macciola continued that the residents were under the
impression that the permits were going to be denied. But
there are events scheduled into March which have permits to
extend the parties to 11:00 p. m. Councilman Harbicht noted
that some of these events are wedding receptions which can not
be planned a few days in advance. These events that are
approved to 11:00 p.m. are those that were planned and
approved before the procedure was revised; they were set up
months ago. Those that have received recent permits must end
the entertainment at 10:00 p. m. and vacate the premises at
11:00 p. m. Mr. Macciola reiterated that there is an ongoing
problem. Councilman Harbicht said he is very much in sympathy
with this situation, and the Council is trying to address the
problem.
Floretta K. Lauber, 1225 Oaklawn Road, stated, in part, that
she is a thirty-two year member of the Women's Club and a past
president, and wishes to show the other side of the coin. The
Women's Club has been active in Arcadia since 1914. The Club
house was built in 1930 and has been a lovely community asset
for sixty-two years. Many, many lovely family affairs have
been held there, as well as school proj ects, speakers bureaus,
etc. The Club has a proud history of community service. As
far as the noise is concerned, she experiences more
disturbance in her own neighborhood with teen parties that get
out of hand. These things happen. But, all things
considered, the record of the Women's Club is pretty good.
The potential renters are all personally and thoroughly
interviewed, and are given a long list of restrictions. This
is a beautiful facility; beautifully furnished and maintained.
The Club cannot afford to lose this investment. If things
were really as rowdy and as bad as the claims, the Club house
would not be in the good condition that it is. She does not
believe there have been many complaints until they were
rounded'up by Mr. Deitrick. She points out that the problems
began when Mr. Macciola crowded three units on a fifty foot
wide lot with four modifications. 1) He asked for a narrower
driveway; 2) only a five foot setback in lieu of ten feet from
the street; 3) smaller parking spaces; and 4) the one that
causes a lot of problems - - at his request the five foot
landscape area between the buildings was deleted. It appears
that Mr. Macciola wants the best of both worlds by pushing his
building to the property line of an existing historic building

which as been conducting such events for many years. This is
similar to residents who purchase homes near the airport and
then demand that the airport be closed down or flights
curtailed. She suggests that Mr. Macciola be realistic and
honest about that front unit, and give the next potential
renter a reduction in the rent and, in turn, the Club will
continue to monitor the activities and abide by the City Code.
The Club is a good neighbor; empty most of the time during the
week except for Wednesday. It is not rented every weekend and
there are seldom multiple rental nights on a weekend. Other
similar facilities are usually booked on Friday, Saturday and
Sunday. The building and landscape are beautifully
maintained; the community can be proud of them. There have
been no complaints from January through August of this year.
In September there were two problems. The Board of Directors
has hired another security guard and purchased a decibel
meter. This is a big expense out of the rental fee, but the
Club wants to comply. The harassment from Mr. Deitrick has
continued. Mrs. Lauber quoted from the last three Police
reports which showed that, after investigation of Mr.
Deitrick's complaints, no problems of any kind had been
observed. It would appear that nothing will appease Mr.
Deitrick. The Club has offered Mrs. Deitrick a membership in
the Club; offered Mr. Deitrick a job assisting the security
guard; tried to make them a part of the solution to the
problem. Each time a meeting was set up, Mr. Deitrick
cancelled.
Mrs. Lauber continued, and stated, in part, the Women's Club
cannot payoff its indebtedness without the revenue from these
wedding parties. To impose this discriminating and
inequitable restriction that the City Attorney has thrust upon
the Club without consulting the members is unfair. Demanding
that the brides or their representatives appear before the
License Committee and appeal the City Attorney's decisions,
forcing them to sign the most restrictive application she has
ever seen is unfair. The signing of this document has caused
cancellations, tears and threats of lawsuits against the Club.
If these restrictions continue, it will force the closure of
the Women's Club House, and it would be criminal to have to
sell this historic building and replace it with a commercial
endeavor. Perhaps Mr. Macciola and Mr. Deitrick would prefer
a fast food neighbor. Mrs. Lauber requests that Council
allow the wedding festivities to continue until 11:00 p. m.
only on the weekends. This is not a late hour by anyone's
standards; the bridal parties pay a great deal of money for
this important night in their lives. She requests the removal
of the automatic denial of all requests. There should be very
few problems now that they have another security guard and a
decibel meter. The last three police reports verify that
these solutions are working.
Marjorie Elliott, President, Women's Club, 535 W. Duarte Road,
#3, stated, in part, that the Club cannot exist without the
weekend rentals. The Club at 324 South First Avenue is
located in a commercial zone on commercial property. They
differ from other businesses operations in that all profits
go to charitable purposes. The constant harassment by the
complainants have caused the City Attorney, perhaps in his
frustration, to make rulings that make it impossible to
operate the Club, and thus it will be necessary to close it.
Before the Whittier earthquake, the club house was free of any
financial obligations. After the earthquake, the club house
was closed for seven months for repairs. The only institution
that would lend the money was the SBA, and only because the
damage was caused by the earthquake. The club house was
redecorated and refurnished. Then the retrofitting ordinance
was passed by the Council. They secured a private loan which
doubled the financial obligations. Operating at a normal

pace, using the club house on the weekends has enabled the
Club to make the payments. The 1992 operations have allowed
the Club to continue its philanthropies in this communi ty,
which Mrs. Elliott outlined. However, the restrictions placed
on the Club during the last few weeks will make it impossible
for the Club to meet its financial obligations. Regarding
the location of 133 E. Diamond -- it is built much too close
to the club house. There is only a narrow walk and a low
block wall between. There had originally been trees which
formed a sound barrier; they were removed in order to build
the block wall. It would have been better if the driveway had
been placed on the club house side. She requests that the
Club be permitted to resume normal operations on Saturday
nights at the Women's Club of Arcadia because extraordinary
precautions have been taken to prevent any future annoyance
to the residents. The Club is being discriminated against in
the application of the City of Arcadia regulations in relation
to other rental halls in the City.

Pat Huffman, 50 W. La Sierra Drive, stated, in part, that she
is speaking as a fifteen year member of the Arcadia Women's
Club, having served as the Arcadia Juniors President, and
currently serving as the S tate Pres ident for the General
Federation of Women's Clubs California Juniors of which the
local club is a part. The General Federation of Women's Clubs
is the largest and oldest non-denominational, non-partisan
women's volunteer service organization, having more than 8,500
clubs and approximately 350,000 members active in communities
across the United States, and 10 million members world-wide.
The Arcadia Women's Club has over five decades of community
service. The juniors have been sponsored by the Women's Club
of Arcadia who provide meeting space in their club house for
meetings and ways and means activities which provide support
for the community and charitable activities the Clubs are
involved with. In the last reporting year, the Arcadia
Juniors completed forty-seven service projects with over 600
service hours logged. These are difficult times for service
organizations. It seems ironic that when volunteers are most
needed, many service clubs find themselves fighting for their
very existence. The cost of keeping this building has been
tested by earthquake, the resultant refurbishing and loans,
the economy, loss of members, and now by someone who seems not
to be aware of how hard the members are working to do
something for others, and to earn the money to keep the
Women's Club of Arcadia alive. Without the income derived
from the rentals, upon which the Women's Club has depended for
over sixty years, the building will most probably be lost and
with it perhaps both clubs. Ms. Huffman asks that the
restrictions that are driving away the potential renters be
lifted.
Vir~inia Holtzer, 551 Fairview Avenue, Vice-President of the
Women's Club, stated, in part, that the Women's Club has taken
many positive steps to alleviate the problems that have arisen
in the past, as have been pointed out by Krs. Lauber. In
addition, the club is now using only the door on First Avenue
for entrance and exit, rather than the door on Diamond Street.
The windows on the east side of the building have been
secured, and the trash is now placed in the containers by the
security guard rather than the clean-up groups. All of these
steps have been taken in response to the complaints, and even
some that may be perceived. Also she would like to point out
that some complaints were received on nights when Arcadia
House had functions, but the Women's Club was dark with no one
present. In response to a question from Kayor Fasching, Mrs.
Holtzer replied that the second security guard waS hired
October 1, 1992.

Geor~ianna Wardell, 11 Woodland Lane, stated, in part, that
as a Member of the Arcadia Historical Society, she is
interested in the history of this area. Arcadia was
incorporated in 1903 and only twenty-seven years later, the
Women's club house was built. It is an excellent example of
the architecture of that time. Some examples of Arcadia
historical landmarks have been saved, i. e., Lucky Baldwin's
railway depot. Some have been lost, i. e., the Pony Express
Museum, because its importance to Arcadia was not realized.
She very much hopes that the City Council will not allow the
Arcadia Women's Club to be lost. It is an Arcadia landmark,
Elizabeth M. Watson, 158 East Arthur Avenue, stated, in part,
that she has been an Arcadia resident for twenty-eight years,
and for fifteen years was the manager of a major Arcadia bank.
The Arcadia Women's Club had large expenses as a result of
earthquake damage, and had to obtain a large loan which they
have been repaying diligently. If they should be put in a
position where they will be unable to rent the property and
obtain some income, they may have to close the Women's Club
and possibly sell it. The City of Arcadia needs a facility
like the Women's Club.
Garr Richmond. West Covina, stated, in part, that he has been
employed as security guard at the Women's Club, and reiterated
the steps taken to alleviate the problems, He has taken on
this challenge and he feels that the last two events have
produced no problems. He sees to it that people do not
congregate on the streets, and that they exit the building on
First Avenue rather than on Diamond Avenue. There is no
drinking outside. The person in charge of the music is warned
only once if the volume exceeds the decibel limit; the second
time the music is stopped. He contacts the person in charge
of the party and outlines the rules to be followed. He is
trying to help the Women's Club and also Mr. Deitrick. He has
made several attempts to speak with Mr. Deitrick, but has not
succeeded in this. He is willing to do anything possible to
help Mr. Deitrick and the other neighbors. Mr. Richmond is
employed by the Arcadia School District, and is interested in
the City of Arcadia. He feels that the Women's Club is
important to the City and would like to see it survive.
There have been no violations during the last two events which
proves their efforts are producing the desired results.
Mr. Macciola replied that he had been sitting in his vehicle
last Saturday evening at 10:50 p. m. to 11:27 p, m. and there
was noise from the persons vacating the club house.
Mayor Fasching noted that this portion of the meeting is only
for the purpose of hearing five minutes of comments from those
in the audience who wish to address the Council; not to get
into a controversy over this issue tonight. Council will make
a decision as to what it wishes to do in the future.
Councilman Harbicht thought that a fresh beginning is needed
in this situation. There is a real lack of compassion on both
sides. A suggestion has been made that Mr. Deitrick is
hypersensitive and is the cause of the problem. This year's
police reports don't necessarily bear this out; there have
been problems. However, in reading the last two police
reports, he sees that someone is looking for problems where
problems don't really exist. The City is trying to
accommodate both sides; trying to allow the Women's Club to
continue to operate; and trying to address some of these
concerns. The Women's Club at the present time seems to be
responsive to the problems -- sealing the windows, hiring a
second security guard, etc. There are two requests here.
One, that everything be closed at 7:00 p. m. -- he is not in
favor of this because there must be an opportunity to see if
the new measures are effective. Two, a request that the club

be allowed to remain open later as they have been in the past.
He is not in favor of this either, because they first have to
demonstrate that these problems are under control. If that,
in fact, is the case, then we may want to take another look
at it. He would like to wait and see how this works with the
significant changes made recently. He would also like to ask
both parties to have consideration for the other side. He
would like to see the matter continue as it is now, i. e.
closing off at 10:00 p. m., as opposed to 11:00 p. m., with
the exception of those to whom contractual obligation is for
11:00 p. m. closing.

In response to a question from Mayor Fasching, the City
Attorney replied that these restrictions and rules are imposed
by the Business License Officer, on recommendations made by
the Police Department and the City Attorney. The present
rules indicate ending entertainment at 10: 00 p. m., with
guests leaving by 11:00 p. m. Mr. Macciola reiterated that
he would like to see the closing time adjusted to 7:00 p. m.
Councilman Harbicht said the present hours, i. e., 10:00 and
11:00 p. m. may not make Mr. Macciola happy, but Council needs
to see if the new measures instituted by the Women's Club are
effective. Further discussion ensued. By general consensus,
Council agreed to take no further action at this tine. The
situation will be monitored to see if the measures implemented
by the Women's Club solve the problems. The City Attorney
advised that the status quo is being reviewed by the staff and
a report will be forthcoming to the Council.
BOARDS AND COMMISSIONS
The Sister City Commission requested Council to approve funds
in an amount not to exceed $500 for the purpose of dedicating
and installing a plaque at Newcastle Park in memory of
Newcastle Alderman Don Geddes. Alderman Geddes was a long
time friend of Arcadia, and was instrumental in building
relationships between Arcadia and Newcastle, Australia.
In response to questions from Council, Sister City
Commissioner Beth Wells, stated that the Koala Band from
Newcastle will be coming to Arcadia in time to participate in
the Tournament of Roses Parade on New Year's Day in Pasadena.
There is a possibility that Mrs. Maria Geddes will accompany
the group. Therefore, the Commission would like to plan to
unveil the plaque at the time of this visit. In accordance
with a suggestion from Council, Mrs. Wells volunteered to work
with City staff in order to accomplish this on time.

It was MOVED by Councilman Harbicht, seconded by Councilman
Margett and CARRIED that Council APPROVE allocation of funds
not to exceed $SOO for a plaque in memory of Newcastle
Alderman Don Geddes to be installed at Newcastle Park in
Arcadia.

Mountainous Single Family and Architectural Design) zoned
hillside area north and west of Canyon Road (not including
Wilderness Park) and 2) The R-l and D 10,000 (Second One-
Family 10,000 square foot and Architectural Design) zoned
hillside area west of Santa Anita Canyon Road.
AWARDED contract in the amount of $34,384.70 to Downey Ford
for the purchase of one 2 1/2 ton dump truck for the Water
Division. Funds for this purchase are available from the
Water Equipment Replacement Fund.
ACCEPTED for maintenance all public improvements within Tract
No. 48724, the Plount development on First Avenue and Haven
Avenue as well as the sanitary sewer and water system in the
private streets of Tract No. 48724. The private streets are
Country Oaks Drive, Country Oaks Lane, and Country Oaks
Circle.
RATIFIED the settlement of M. Grigry v. City of Arcadia and
AUTHORIZED payment in the amount of $75,000. Release
documents from the plaintiff have been received.
APPROVED the agreement for continued participation in the San
Gabriel Valley Employment Training Consortium with the law
firm of Liebert, Cassiidy & Frierson and DIRECTED the City
Manager to execute the agreement for a one year period
beginning September 1, 1992, at a cost of $1,545.
ALL OF THE ABOVE CONSENT ITEMS WERE APPROVED ON MOTION BY
COUNCILMAN LOJESKI, SECONDED BY COUNCILMAN HARBICHT AND
CARRIED ON ROLL CALL VOTE AS FOLLOWS:

The City Attorney presented and read the title of Resolution
No. 5704: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA NOMINATING ARCADIA COUNCILMAN ROBERT G.
MARGETT TO REPRESENT CITIES WITH WATER RIGHTS ON THE BOARD OF
THE SAN GABRIEL WATER QUALITY AUTHORITY" .
It was MOVED by Councilman Lojeski, seconded by Mayor Pro tem
Ciraulo and CARRIED that Resolution No. 5704 be and it is
hereby ADOPTED.
The City Attorney presented and outlined an Agreement with W.
Lawson Martin III to continue the public hearings to March
1993 for T.A. 92-006 and Z 92-003 regarding the residential
hillside single family zone. The purpose of this Agreement
is to allow continuation of the current moratorium during
ongoing discussions with Mr. Martin with regard to development
as it concerns the remaining hillside area.
It was MOVED by Councilman Margett, seconded by Councilman
Lojeski and CARRIED on roll call vote as follows that the
