Duckworth PRESENT: Councilmen Ciraulo, Harbicht, Lojeski, Margettand Fasching None ABSENT: On MOTION by Councilman Loj eski, seconded by Councilman Margett and CARRIED, the minutes of the Work Session of November 10, 1992 and the Adjourned Regular Meeting of November 17, 1992 were APPROVED. It was MOVED by Councilman Harbicht, seconded by Mayor Pro tem Ciraulo and CARRIED that ordinances and resolutions be read by title only and that the reading in full be WAIVED. PRESENTATION Mayor Fasching introduced the Arcadia Girls 2 Allstars Soccer team and their coaches. The girls on this team are the Tri- County Champions - - Los Angeles, San Bernardino, and Riverside Counties, Winning this championship has been no small accomplishment, and the Council is proud of them. The Mayor's Certificate of Commendation in recognition and appreciation of outstanding achievement was presented to each member of the teams and their coaches. Consideration of an extension of the moratorium imposed by the Urgency Ordinance No. 1980 adopted October 27, 1992, which imposed a moratorium on all land use authority, permits, licenses and entertainment permits that authorize karaoke and karaoke television as a permitted or ancillary use and activity in the City of Arcadia; directing a study; and declaring an urgency requiring the moratorium. The Planning Director presented for introduction and adoption and read in its entirety Ordinance No. 1983: "AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, IMPOSING A TEMPORARY MORATORIUM ON ALL LAND USE AUTHORITY, PERMITS, LICENSES AND ENTERTAINMENT PERMITS THAT AUTHORIZE KARAOKE AND KARAOKE TELEVISION AS A PERMITTED OR ANCILLARY USE AND ACTIVITY IN THE CITY OF ARCADIA DIRECTING 1 12/1/92 J~:OJ80 A STUDY; AND DECLARING AN URGENCY REQUIRING THE MORATORIUM OF 10 MONTHS AND 15 DAYS (4 VOTES REQUIRED)". Mayor Fasching declared the public hearing OPEN, Doris Fer~uson, 1161 W, Duarte Road, owner of the 100 to 1 Club, stated, in part, that she has had karaoke in her club for some time and has had no problems connected with it. She has never found the need to hire a security guard. The karaoke has been very successful. Her customers enjoy it and it is a lot of fun. It sounds to her as if karaoke is being penalized instead of the problem. The City Attorney noted that Mrs. Ferguson's club will not be affected by this interim ordinance because she had the karaoke in her club before the introduction of the ordinance. If the urgency ordinance is adopted tonight, a study will be conducted, and a new City ordinance will be introduced at a later date, The Mayor noted that there have been problems in this City and other cities. The interim ordinance will give the Council and staff the time necessary to analyze the whole situation. I John Wu, 35 East Alta Street, stated, in part, that he is present to make a recommendation following a meeting of the Chinese Association. They understand the problems the City is endeavoring to solve with regard to the karaoke clubs. One of the recommendations is that private rooms not be made available at karaoke clubs. Another recommendation is that alcohol be banned, One of the reasons Arcadia has seen an increase in the number of permit requests for karaoke clubs is because many of the surrounding cities do not allow alcohol at the karaoke clubs. In some instances, the karaoke clubs have been attracting the wrong kind of people, many of them coming to Arcadia from other nearby cities. No one else desiring to be heard, the hearing was CLOSED on MOTION by Councilman Harbicht, seconded by Councilman Lojeski and CARRIED, In reply to a question from Councilman Margett, the City Attorney said that karaoke use at a private party or by a private social club would not be banned specifically by this interim moratorium ordinance, However, such entertainment events are controlled by the Business License Officer and, therefore, a permit for this type of entertainment would have to be obtained from that office and it could be denied under this ordinance, The real concern here is to control the regular business type of operation, Councilman Margett asked Council to consider allowing a one-time request for karaoke entertainment on an individual basis which would be approved by the Business License Officer, This ordinance is written with a strong prohibition against any entertainment license or permits and would include such parties at the Elks Club, Women's Club, Arcadia House, etc. This can be amended if Council so desires, At the present time the prohibition is very inclusive, In reply to a question from Councilman 1 Harbicht, the City Attorney responded tha~ the permit requirement does not apply to events held in private residences. Also, a permit may be required if there will be dancing, but if there is no dancing involved, a permit may not be necessary. Mayor Pro tem Ciraulo thought the ordinance as written is pretty inclusive and covers the points Council is concerned abouc. He would like to see it remain as it is. Councilman Margett noted that many of the Asian organizations have their own karaoke and screens that they bring to various locations. He has seen them at the Community Center. His question is whether this should be excluded; and his feeling would be to exclude them. Mayor Fasching noted that ~he reason the ordinance was written was to control the commercial applications of karaoke; not to establish another permit level 2 12/1/92 I 1 2. 2a. JOB CLASS. He feels this restriction should be limited to commercial establishments. Councilman Margett agreed, but pointed out that this ordinance includes all organizations. The City Attorney noted that Council may want to exclude from the ordinance non. commercial type entertainment permit reques ts which are reques ted on an occas ional bas is, The addition of this exclusionary language will give the Licensing Officer the discretion she needs to apply this ordinance in the manner desired by the Council. It was MOVED by Councilman Harbicht, seconded by Councilman Margett and CARRIED to insert exclusionary language in Ordinance 1983 with regard to non-commercial type entertainment for which a permit is requested on an occasional basis. Margett and Fasching None None NOES: ABSENT: BOARDS AND COMMISSIONS At its November 12, 1992 meeting, the Personnel Board reviewed and approved the proposed revisions of Police Department classifications of Building Maintenance Worker (Class #2126), Communications Technician (Class #2180), Parking Control Specialist (Class #2123), and Police Clerk (Class #2124), and establishment of the classification of Crossing Guard (Class #2183) and Police Cadet (Class #2181), The November 13, 1992 staff report details the requirements of each position. It was MOVED by Councilman Lojeski, seconded by Councilman Harbicht and CARRIED to APPROVE the revision of Police Department classifications of Building Maintenance Worker (Class #2126), Communications Technician (Class #2180), Parking Control Specialist (Class #2123), and Police Clerk (Class #2124), and to APPROVE the establishment of the classifications of Crossing Guard (Class #2183) and Police Cadet (Class #2181). Funds have been budgeted in the 1992-93 Capital Budget to be used for the maintenance and improvement of facilities used by local baseball leagues. The leagues have agreed to purchase all needed materials and provide all necessary labor and equipment tn complete the various projects. All proofs of purchase wil_ be made available to the City, The requests by the local youth baseball leagues for funds and the renovations to be made are outlined in detail in staff report dated December 1, 1992. It was MOVED by Councilman Harbicht, seconded by Mayor Pro tern Ciraulo and CARRIED on roll call vote as follows that the requests for financial assistance by the local youth baseball leagues be APPROVED and that staff be DIRECTED to distribute funds as outlined in staff report dated December 1, 1992. AYES: Councilmen Ciraulo, Harbicht, Loj eski, Margett and Fasching None None NOES: ABSENT: AUDIENCE PARTICIPATION I Lael Collins, 409 J Fairview Avenue, stated, in part, that she is inviting Mayor Fasching and the City Council, as well as the concerned people in the audience tonight, to attend the School Board public hearing to'be held Tuesday, December 8, 1992 at 7: 30 p. m. at the Holly Avenue School Auditorium. This meeting concerns the possible reconfiguration of the schools, It is now proposed to take the sixth grade out of the elementary and move it up to the middle school -- sixth, seventh and eighth grades in the middle school; eliminate the junior high school and bring the freshmen to the high school, Many of the parents are concerned about bringing the fourteen year olds into this new environment because there are certain problems here in the Arcadia schools. She would like to see the seventh, eighth and ninth grades stay in the junior high school. A lot of parents do not want their sixth graders in with the seventh and eighth graders. If it is decided to do this, it will mean a lot of changes, The parents would like to see more communication between the City and the School Board. She suggested a liaison person who could work between the two groups. Member Harbicht ABSTAINED since he was not present at the October 20, 1992 meeting, I California Redevelopment Law (Health and Safety Code Section 33080) requires that all redevelopment agencies file an annual fiscal and activity report with the California Department of Housing and Community Development within six months of the end of the fiscal year. This report to be approved by the City Council prior to transmittal to the State Department of Housing and Community Development. If) 34:0383 presented to authorization Department of the Arcadia City Council for approval and to transmit the report to the California Housing and Community Development. In response to questions from Member Margett, the Assistant Manager for Economic Development reviewed California Assembly Bill AB265 which requires that Redevelopment Agencies set aside 20% of their annual tax increment into a Housing Fund for low and moderate income housing. AB265 permits the Agency to make findings that it is not able to set aside all or part of the 20% into the Low/Moderate Income Housing Fund if existing Redevelopment Agency obligations, projects, programs or activities in any fiscal year prior to FY 1996-97 do not permit such. Every year a deficit is accruing in this Housing Fund. This will end in 1996 when the Agency will no longer be able to defer these funds and will have to set aside the 20% and, in addition, make an effort to repay the deficit. The present obligation is approximately $2,218,000 owned to the Low/Moderate Housing Fund; by 1996 it is estimated to be approximately $4,000,000. The Agency has adopted an interim financing plan which is required by law whereby the Agency contemplates setting aside 25% per cent of the annual tax increment. The additional 5% will make up the deficit of roughly $4,000,000 by the end of the project which is 2026. That is the interim financing plan; the final plan will be outlined and brought to the Agency in 1996-97. By 1996 the law requires that 20% of annual tax increment be set aside for low/moderate income housing, in addition to making up the deficit. Member Margett requested that the City Manager take this low/moderate income housing requirement into consideration with regard to the Downtown Revitalization Program now under way, In reply to a question from Chairman Fasching, the Assistant City Manager for Economic Development replied that during the budget crisis in Sacramento, the State legislature put forth proposals to take money from the low/moderate income fund and direct it to education. The final plan now takes roughly 16% of the 1990-91 tax increment fund and puts the money into an education fund. Staff also explained that the property at the Southwest Corner of First Avenue and St. Joseph Street was acquired by the Agency as a potential site for the light rail trans1t station. In the event the property should not be needed for this purpose, it will be used for redevelopment purposes at some future date. ORDINANCE NO. 1981 (INTRODUCED) o ~b- t.l - ,( () 34:0384 Considerable discussion ensued among the Councilmen concerning the results of the Library Project Architect Selection Committee meeting on November 18, 1992, the presentations of the three architectural firms, and the selection of the firm of Charles Walton Associates as the one to recommend to the City Council for this project, The Planning Director stated that the plan is to go out to bid by December 1993 and actually have the project under construction by late February 1994, and completed by February 1995. The architect has looked at the draft of the proposed agreement and staff hopes to have an agreement on the next Council agenda. APPROVED "Designation of Applicant's Agent Resolution", designating an authorized representative to execute documents necessary to obtain financial assistance under the Emergency Assistance Act of 1988. I AWARDED contract in the amount of $48,263,00 to Golden Bear Arborist, Inc., for the 1992-93 tree maintenance program on various streets. Job No. 537; WAIVED any informalities in the bid or bidding process, and AUTHORIZED the Mayor and City Clerk to execute a contract in a form approved by the City Attorney. AWARDED contract in the amount of $261,300 to Eidemiller Electric, Inc., for the installation of Supervisory Control And Data Acquisition (SCADA) System - Job No. 692; WAIVED any informalities in the bid or bidding process, and AUTHORIZED the Mayor and City to execute a contract in a form approved by the City Attorney. Live Oak Avenue, This CUP reduces the alley access width from twenty feet to fifteen feet. Staff replied that this alleyway has been utilized for many years by the general public and small businesses to the east of the market. Originally, Ralphs planned to close the alley to this traffic to give more room to trucks parked at their loading docks off 7 12/1/92 HARBICHT (Significant Actions Re. However, now the alley access width will be reduced from twenty feet to fifteen feet which will allow room for the trucks in the loading dock area. Also, the parking lot is to be reconfigured and landscaping will be added. Councilman Margett inquired of the City Attorney if Ralphs market could legally close the alley as they had originally planned to do. For many years people have been crossing the Ralphs parking lot to gain access to the alley. Although the parking lot is their property, it has been used as an access to the alley for a number of years, The City Attorney responded that the question would be determined in the courts, There could very well be a ruling that this access should continue to be available for public use as an easement as it has been for a long time. However, under the existing CUP which provides for access to the alley, the situation seems to be settled to the satisfaction of all parties. I Councilman Harbicht commented that often a good portion of the meetings are frequently taken up with matters that are relatively unimportant, while more important matters pass by almost unnoticed, He would like to note that Ordinances No. 1981 and 1982, which were introduced this evening and will be on the agenda for final adoption at the next meeting, are probably two of the most significant things that have happened in the last several months, if not the last several years to this Council. This is paving the way for Nordstroms to come into the mall. This will probably help ensure the economic health of this City. The introduction of these two ordinances took about two minutes, When the mall was originally proposed, there were meeting, after meeting, after meeting, and it even required a vote of the residents, This has been quite a contrast. He feels this is a significant action. Mayor Pro tern Ciraulo inquired about the trucks he has seen parked on the northwest corner redevelopment property, Staff responded that the trucks belong to a contractor who is working on a City project on Second Avenue. They have secured permission from the City to park their trucks there and have secured the necessary insurance. Mayor Pro tern Ciraulo referred to a letter from the Sister City Commission inquiring if Council would be interested in declaring January 6, 1993 as Australia Day and flying the Australian flag when the Koala Band is visiting from Newcastle. After discussion among Councilmembers, it was the consensus that this action would be appropriate and directed staff to prepare the announcement and documents. Mayor Fasching referred to a letter concerning a meeting of the San Gabriel Valley Commerce and Cities Consortium which had been held November 18 at the Santa Fe International office in Alhambra. During this meeting comments and suggestions were made which he would like to bring to the attention of the City Manager with the suggestion that they be looked at with regard to future action and activities on the part of the City. He reviewed some points in the letter such as streamlining of City Planning/Building permit process; simplification of the CUP process; education of the Planning Commission and Council on the importance of ~ime; establishment of an experienced, high level, knowledgeable contact who can quickly answer questions. Some of these suggestions could help expedite and establish more functional, workable, streamlined procedures of City Government and should be looked into. The City Manager replied these points will be incorporated into a comprehensive economic and business review which will be coming out in the next couple of weeks. This will be reviewed by all departments. Those items that don't require Council action will be followed up. Mayor 1 8 12/1/92 1 1 LOJESKI (In Memory of Edwin U. "I would like to adjourn tonight's meeting in memory of a former resident and one that I would consider to be a real leader in Arcadia, He was a co-founder of Hinshaws Department Store. Edwin U. Caron, Sr. passed away last Monday night of natural causes in a Boise, Idaho hospital. He was 82 years of age. The businessman and active community leader lived in Arcadia for 37 years from 1952 to 1989. In 1989, he returned to his native Idaho for health reasons along with his wife of 59 years, Verna. Beginning his retail career at age 11 as a cash-boy, Caron eventually opened the Arcadia Hinshaws in 1952 and the Whittier store in 1953. He served as vice- president and general merchandising manager for several years and then he became chairman, president and chief executive officer, He retired as chairman of the board in 1989, His civic involvements included the Rotary Club, serving as Rotary International Paul Harris Fellow, He also received the Alton Scott Community Service Award. He was a two-term president of the West Arcadia Business Professionals Association and President of the San Gabriel Valley chapter of the AID charity. He also served on the boards of several community organizations, including the Arcadia Tournament of Roses, the Salvation Army, and the forerunner to the United Way's Community Chest. Ed is survived by his wife; two sons and daughter-in-laws; a sister; six grandchildren and two great grandchildren. Funeral services were held last Friday and Saturday in Boise. I think that it is very anticlimactic that he passed away shortly after the store that he founded closed in Arcadia. He was a true friend and respected neighbor. I am sorry to see him pass away.
