On MOTION by Councilmember Ciraulo, seconded by Councilmember Fasching and CARRIED, the Minutes of the Adjourned and Regular Meetings of March 5, 1991 were APPROVED. It was MOVED by Councilmember Gilb, seconded by Councilmember Ciraulo and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be WAIVED. CITY ATTORNEY The City Attorney announced that, "the City Council met in a CLOSED SESSION this evening pursuant to Government Code Section 54956.9(a) to discuss the current lawsuit and pending claims regarding United States vs. Montrose and the Potlatch- Simpson claims", Consideration of an appeal to the Planning Commission's approval of Tentative Parcel Map 90-0l4, (Livingston-Graham, applicant) consolidating l18 M-l zoned lots into l3 lots; 12 lots along Clark Street and one lot which is a back lot having no street frontage (City of El Monte, appellant). Two opportunities for public testimony were held before the Planning Commission on Tentative Parcel Map 90-014. The first public hearing was opened on December ll, 1990. Based upon a request by the City of El Monte, this public hearing was continued until the Planning Commission's January 22 meeting when additional public testimony was received and the Commission approved the application. On February 1, 1991, the City of El Monte filed an appeal to the Planning Commission's decision. A request for continuance has been received from the appellant. It is staff's understanding that the applicant is agreeable to the continuance. 1 3/19/91 2. 2a. SR. CIT. COMSN. (Title III Grant Funds Applica- tion) (APPROVED) 01.20 - /(J 33:0069 Mayor Young declared the hearing OPEN. Marvin Cichv, City Attorney's Office, Valley Blvd., El Monte, requested continued until April 16, 1991. City of El Monte, l1333 that this matter be Richard Diaz, Law Firm of Diaz and Patterson, 5200 North !rwindale Avenue, Irwindale, stated, in part, that he represents the interests of the applicant, Livingston-Graham. Even though the parties do not necessarily agree that the issues that have been raised on appeal by the City of El Monte have any real relevance to this application, in the spirit of conciliation, a dialogue has been established. As a result of that' dialogue, they have reached a point whereby they can possibly resolve this matter before the next Council Meeting. They join in the request for continuance. 1 Upon advice of the City Attorney, it was MOVED by Councilmember Ciraulo, seconded by Councilmember Fasching and CARRIED on roll call vote as follows that the public hearing on the appeal of the Planning Commission's approval of Tentative Parcel Map 90-014 be CONTINUED to April 16, 1991. Councilmember Gilb stated that he was unhappy about these continuances. This has resulted in the waste of a great deal of staff and Council time. Extensive reports have been prepared. Councilmembers have spent time on the site and in studying the reports preparing to make a decision. Other agenda items have been postponed to make time for this hearing and at the last minute a continuance is requested. He will vote for this continuance, but if another request for continuance is made, he will definitely not vote for it. AYES: NOES: ABSENT: Councilmembers Ciraulo, None Councilmember Harbicht Fasching, Gilb ,and Young BOARDS AND COMMISSIONS For the past thirteen years, Arcadia Senior Services have received federal funds under the Older Americans Act to provide social services to older persons in Arcadia and Temple City. Senior Services would like to apply for these funds for the 1991/92 fiscal year. It was MOVED by Councilmember Gilb, seconded by Councilmember Fasching and CARRIED on roll call vote as follows that staff be AUTHORIZED to write and submit a proposal for funding for the Title III Grant Program in an amount of approximately $100,000 for Arcadia and Temple City services for 1991/92 and that the application reflect the fact that the new Senior Center will be available for next year's programs and services. 1 That fifty percent of the time of the Senior Citizens Supervisor, four percent of the time of the City Treasurer, the value of the office space and the value of the volunteers' time be provided as match. That staff be AUTHORIZED to enter into a contract for the 1991/92 fiscal year; and that the Director of Recreation be AUTHORIZED to sign the application and the contract. PHASE I ENVIRONMENTAL ASSESSMENT CONTRACT (233 N.First Ave.) (APPROVED) 06'60- ?.~ I 33:0070 AUDIENCE PARTICIPATION Bob Burns, 801 Cynthia, Alhambra, representing the Swedlow Company, requested permission to address Council later in the meeting with regard to Consent Item 7g. This concerns the furniture purchase for the Senior Citizen Center. Council granted this permission. CITY COUNCIL RECESSED IN ORDER TO ACT AS THE ARCADIA REDEVELOPMENT AGENCY PRESENT: ABSENT: Agency Members Ciraulo, Fasching, Gilb, and Young Agency Member Harbicht On MOTION by Member Gilb, seconded by Member Ciraulo and CARRIED, Member Harbicht was EXCUSED. On MOTION by Member Ciraulo, seconded by Chairman Young and CARRIED, the Minutes of the meeting of March 5, 1991 were APPROVED. On February 22, 1991 the Agency solicited proposals for a Phase I Environmental Assessment for the property located at 233 N. First Avenue. The Agency is seeking to acquire this property as part of a possible rail transit station under consideration by the Los Angeles County Transit Commission or for other redevelopment purposes, and has made an offer to the owner contingent upon the site being free from hazardous waste or contamination. In light of today's environmental responsibilities and liabilities, staff recommends that the Agency authorize a Phase I Environmental Assessment prior to the final negotiations for the purchase of this property. Because the proposals, qualifications and cost of the three lower proposers are so close, staff recommends that the Agency select Diagnostic Engineering, Inc., an Arcadia firm, for this contract. Member Fasching inquired why this environmental assessment seems to be necessary for every property, and if staff could perform some of the assessments. Staff responded that 1) it is a standard thing in the business now to have this assessment done by qualified, independent contractors who will not just look at the records the public sector may have, but will also look at the records of the county, state and federal governments, including aerial photographs and oil company records, etc. and 2) it represents to the Agency that it has been diligent in the event there should be a problem later on; therefore, the assessment should be performed by qualified people. It was then MOVED by Member Gilb, seconded by Member Ciraulo and CARRIED on roll call vote as follows that the Arcadia Redevelopment Agency ENTER INTO a contract with Diagnostic Engineering, Inc. for a Phase I Environmental Assessment of 233 N. First Avenue in an amount not to exceed $2,800 ($2,300 plus $500 contingency), and AUTHORIZE the Executive Director to execute the contract, in form approved by Agency General Counsel. Second Avenue has requested that he receive an "all inclusive" buy-out payment of $54,000 for certain furniture and equipment from his business, in lieu of relocation. Port & Flor, the Agency's relocation consultant, and staff have estimated the cost of relocating Seven Seas to an Arcadia address to be around $52,000, with other possible additional costs of up to $5,000. (Details included in March 19, 1991 staff report.) It was MOVED by Member Fasching, seconded by Chairman Young and CARRIED on roll call vote as follows that the Arcadia Redevelopment Agency APPROVE the agreement for Purchase and Sale of Property and Settlement of Claims for Seven Seas Health Products Company for $54,000, plus an architectural services payment to Marilor Design Group, not to exceed $3,000, subject to minor revisions by Agency General Counsel, and AUTHORIZE the Executive Director to execute and implement this agreement. CITY COUNCIL RECONVENED CONSENT ITEMS PUBLIC HEARING SCHEDULED April 2, 1991 for consideration of Text Amendment 9l-002, amending the real estate signs in the R-M and R-O single-family zones and adding sign regulations to R-l zone (to be consistent with the R-O regulations). PUBLIC HEARING SCHEDULED April 2, 1991 for consideration of Text Amendment 91-003, amending the "H" High Rise Overlay zoning regulations, creating five special height overlay zones and adding regulations to require a Conditional Use Permit for any building which exceeds the height limits of the basic underlying zone. ACCEPTED the street, sewer and water systems for maintenance by the City, Tract No. 45966 ~ Derek Drive. Derek Drive is a cul-de-sac street located south of El Norte Avenue, between Ninth Avenue and Tenth Avenue. WAIVED non-compliance with the specific bid process of the City of Arcadia; APPROPRIATED an additional $35,804 from the Capital Outlay Fund and AUTHORIZED the purchase of a fire pumper from Pierce Manufacturing of Appleton, Wisconsin in the amount of $222,804, including sales tax. Said award based upon bids recently utilized by the Orange County Purchasing Department. ALL OF THE ABOVE CONSENT ITEMS WERE APPROVED ON MOTION BY COUNCILMEMBER GILB, SECONDED BY COUNCILMEMBER CIRAULO AND CARRIED ON ROLL CALL VOTE AS FOLLOWS: AYES: NOES: ABSENT: Councilmembers Ciraulo, None Councilmember Harbicht Fasching, Gilb and Young The Notice to Bidders 9091-22 for the purchase of furniture for the Senior Citizen Center and Recreation Department was mailed to sixteen vendors and appeared in the Arcadia Tribune on February 17, 1991. The lowest bid from S...edlo... contained unclear statements regarding the warranties ~hich were requested as part of the bid requirements. The ...arranties are inconsistent with warranties as listed on the other bids received. The furniture to be manufactured by Kimball must be ordered by an authorized Kimball dealer in order to preserve the ten year warranty the manufacturer gives on the product. Swedlow is not an authorized Kimball dealer; they would be ordering through another dealer. Kimball has stated this will nullify and void the warranty from the factory. In reply to a question from Councilmember Fasching staff replied that Swedlow has submitted a letter to the Purchasing Department stating that they would stand by the same terms as the manufacturer's ...arranty. However, that was confusing because in the actual bid documents they specified 1 - 2 years; whereas some of the manufacturers had warranty periods that would have gone much beyond that. Therefore, staff is not sure exactly what the warranties are. Bob Burns, 801 Cynthia, Alhambra, representing Swedlow- Pasadena, stated, in part, that he is present to support S...edlow's position. Swedlow does stand behind the warranties extended by the manufacturers. S...edlow has been incorporated for thirty-five years. He ...ent on to enumerate many corporate and government entities in the area ...ith which they have done business and to ...hom they have extended warranties. He feels Swedlo... has submitted an accurate bid and has ans...ered the questions from the Purchasing Department concerning the warranties from the Kimball Company as well as the other companies involved. He asked that the bid be awarded to S...edlow or, if more time is needed for consideration, that the matter be delayed until the next meeting. 5 3/19/91 8. 8a. TREE PRESERVATION ORDINANCE (DRAFT TO COUNCIL May 7,1991) 33:0073 A representative from Svstem Source. Inc. was present to state that they are the recommended vendor as well as the lowest responsible bidder. They are manufacturers' representatives for all the lines listed in the bid. That means the manufacturers will stand behind the warranties because System Source, Inc. is the authorized distributor. The question came up wi th Swedlow because they are not a Kimball dealer; therefore, Kimball will not stand behind the warranty. System Source, Inc., as a company, will stand behind the warranties, but, more importantly, the manufacturer will also. They feel they are the most responsible bidder and request they be awarded the contract. The City Attorney interjected, for the record, "we are not stating that Swedlow is not a responsible bidder. Staff is saying that their bid was not necessarily responsive. No 'I finding is being made tonight that this company from Pasadena is not a responsible bidder. I wish to make that very clear for the record". In response to a question from Councilmember Fasching, Bob Burns, representing Swedlow, stated, in part, that Kimball has authorized representatives; Swedlow associates with other companies that can buy that type of equipment and provide it through Swedlow to the customer. In turn, other companies buy from Swedlow that cannot buy direct and Swedlow provides the furniture and extends warranties. They have the financial wherewithall to cover warranties. He also felt this was not a bid requirement. In response to a question from Councilmember Fasching, staff replied that if the information from Mr. Burns had been clearly stated in the bid proposal and included with that at the time they were due and opened, probably they would have chosen Swedlow; staff is concerned only with what the warranty is. Most of the information received from Swedlow has been after the fact; after the bids were opened. Based upon what was received at that time, System Source, Inc. provided specific information on the warranties which was not included with the Swedlow bid. Councilmember Fasching noted that for a difference of approximately $3,000 and the specific statements on the part of System Source with regard to the warranties and the absence of the same consideration from Swedlow, he would like to award the bid to System Source. It was then MOVED by Councilmember Fasching, seconded by Councilmember Gilb and CARRIED on roll call vote as follows to AWARD contract for the purchase of the furniture for the Senior Citizen Center and Recreation Department to System Source, Inc. in the amount of $185,042.66; and APPROVE allocation of $60,000.00 from the Park and Recreational Facility Fund (Senior Citizen Center account l07-400-5507- 8511) and $125,042.66 from the Facility Construction Fund (Senior Citizen Center account 303-400-5507-8511). I AYES: NOES: ABSENT: Councilmembers Ciraulo, Fasching, Gilb and Young None Councilmember Harbicht CITY MANAGER The City Council at its March 5, 1991 meeting reviewed and discussed the Planning Department's "Tree Preservation Report". The Council gave direction to staff to look into the identification and preservation of endangered species and other trees which are unique andlor indigenous to the area, and potential penalties. The March 19, 1991 staff report details the recommendations and research as requested. ()<l30-GO 1f-~c fh..,3:1t..di.;A 6 3/19/91 33:0074 Considerable discussion ensued among Council with regard to which species of trees are to be preserved and possible penalties if they are not preserved. In reply to Councilmember Gilb's question, staff responded it was their suggestion that the Engelmann Oak (because it is an endangered species) be preserved wherever it is located, but that other trees be preserved in front yards and on street side yards on corner lots. Also, it was suggested that a consultant, perhaps someone from the Arboretum, would be needed, in many instances, to correctly identify the trees. I Councilmember Ciraulo stated in part that the ordinance should be flexible enough to allow property owners to remove trees subject to the replacement with another tree of reasonable size, etcetera. Further, the ordinance should be reasonable in its application. He would be in favor of a tree preservation ordinance for all trees which exceed a specific diameter, with the exception of the oak trees which could be under a separate ordinance in order to address both the maintenance and preservation of the oaks. Councilmember Fasching noted that the primary purpose of a tree ordinance is to preserve the City as it is now. His concern is that builders are the biggest offenders ... they tear down old houses and build new houses. The private citizen would possibly only remove a tree when building on an addi tional room or adding a swimming pool. He is also in favor of an ordinance that would protect all trees based upon size that would apply to front and side yards. Mayor Young agreed. Councilmember Gilb expressed concern about enforcement of such an ordinance which would pertain to all trees in the City in either front or side yards. What would the penalty be? He can understand an ordinance for the preservation of the Englemann oak and other large trees... Moreover, if the City has an ordinance that cannot be enforced, it is better not to have the ordinance at all. Mayor Young noted that the Arcadia Beautiful Commission recommends that a tree ordinance state, "mature trees more than ten feet tall and more than four inches in diameter measured three and one-half feet above ground". Other Councilmembers thought this would be too stringent. Councilmember Gilb felt that he could not support this. Mayor Young suggested, as direction to staff, that endangered trees, regardless of where the tree is located on a lot, should be singled out for preservation wherever possible. Further, a required replacement for indigenous trees should be considered. The replacement trees could be limited to a box tree of a minimum size. Common trees that are fast growing would not have to be included in the ordinance, she felt. I Councilmember Fasching, referring to concerns for enforcement of an ordinance, suggested that those who apply for a building permit should be fully informed of the tree protection ordinance. Councilmember Gilb added, that when a developer violates the ordinance during construction or cuts down trees that are not on the plans, the project could be red tagged and construction immediately discontinued, until the builder appears before Council for permission to proceed or whatever Council's decision may be. Mayor Young agreed. Councilmember Fasching agreed and noted that as much as 90% of the enforcement of the ordinance will occur over the counter in the Planning Department. In connection with the fine for violation of the ordinance, staff noted that a provision of the City Charter allows a maximum fine of $500. Councilmember Gilb thought perhaps this 7 3/l9/9l 8b. Counci1member' Fasching suggested the Charter could be amended to increase the fine to $3,000. The City Attorney advised that under State la..., it can only be increased to $1,000. The City Charter, Councilmember Ciraulo noted, also states the possibility of a jail sentence for a violation of a City ordinance. Councilmember Fasching indicated that it would be helpful if Council could have the report a week or two before that date for study. I Bob Henkel, Rancho Santa Anita Homeowners Association presented booklets to Council containing information regarding the preservation of the oak trees. Many communities located along the historic "Route 66" have identified its route through their city limits. The Arcadia Historical Society proposes a joint venture ...ith the City to place re-creations of the original "Route 66" signs at appropriate points within the City limits. It was MOVED by Councilmember Gi1b, seconded by Councilmember Ciraulo and CARRIED on roll call vote as follows that Council APPROVE the cost of the re-creations of the "Route 66" signs to be placed within the City limits. This to be coordinated by the Public Works Department.
