REGULAR MEETING

The City Council and the Arcadia Redevelopment Agency met in
a regular meeting at 7:40 p. m., Tuesday, July 2, 1991 in the
Arcadia City Hall Council Chamber.

On MOTION by Councilmember Young, seconded by Councilmember
Ciraulo and CARRIED, Mayor Gilb was EXCUSED.
On MOTION by Councilmember Ciraulo, seconded by Councilmember
Young and CARRIED, the Minutes of the special, adjourned
and regular meetings of June 18, 1991 were APPROVED.
It was MOVED by Councilmember Young, seconded by Council-
member Ciraulo and CARRIED, that ordinances and resolutions
be read by title only and that the reading in full be waived.
CITY ATTORNEY
The City Attorney announced that, "the City Council met in a
CLOSED SESSION this evening pursuant to Goverrunent Code
Section 54957.6 to discuss compensation and fringe benefits
regarding the represented and unrepresented employees with the
City's designated representative".
PRESENTATION TO CITY COUNCIL FROM THE ARCADIA MUSIC CLUB
Jack Saelid, 821 Balboa Drive, stated, in part, that he is
present to report that the trip to Arcadia's Sister City,
Newcastle, New South Wales, Australia with the high school
performing group was extremely successful. He thanked the
Council for appointing him as their representative and he
brings greetings from Newcastle, together with some
presentations of books for the Library, after the Council has
seen them.
Bob Albee, 820 Camino Real Avenue, stated, in part, that the
travel group included 208 people, including the marching band
and the orchestra and they presented a fine image of Arcadia
youth. They were great ambassadors for the City. He also

presented a certificate to former Mayor Young thanking her for
her cooperation and help in the organization of this trip.
The presentations were accepted by Mayor Pro tem Harbicht on
behalf of the Council with appreciation and thanks to the
students who proved to be such fine ambassadors from Arcadia.
PRESENTATIONS TO OUTGOING BOARD AND COMMISSION MEMBERS
On behalf of the City Council, Mayor Pro tem Harbicht and
Councilmembers Fasching, Young and Ciraulo presented plaques
of appreciation for their distinguished service and
accomplishments during their terms to Doris Selmer (Library
Board); John Saunders (Sister City Commission); Karen
Benvenuto (Arcadia Beautiful Commission); Linda Daggett
(Arcadia Beautiful); and 'Jim Green (Arcadia Beautiful
Commission).

Mayor Pro tem Harbicht and Councilmembers Fasching, Ciraulo,
and Young, liaisons to the various Commissions and Boards,
then presented the incoming Commissioners and Library Trustee
with their credentials, a City pin and welcomed them to the
City family.
The Planning Director then presented a brief report to Council
concerning the earthquake which occurred at approximately 7: 43
a. m., June 28, 1991. He explained that the Emergency
Operation Center was activated for about half a day on Friday,
the day of the earthquake. Everything went smoothly and they
were able to handle all the incidents that arose. At about
12:30 p.m. the EOC was closed down because all the emergencies
had been taken care of. However, the reports of damage
continued to come into the Building and Planning Division.
While the Motel 6 was the only property previously identified
as having sustained maj or damage, there turned out to be
hundreds of damaged properties. The City accepted the offer
of help from the California Conservation Corps who distributed
notices to residents requesting reports of damage, if any.
The City Building Inspectors continued their inspections of
damaged areas and individual inspections of major and critical
facilities. Other Building Division employees manned the
telephones to take calls made by residents in response to
their receipt of the damage report forms. The reported damage
was loggea into the computer so the current damage situation
and inspection information was available. The CCC crews also
provided their observations of damage. It quickly became
evident that many chimneys had been damaged. The CCC and Fire
Department quickly removed those that presented extreme
hazard. On' Monday the CCC crews started helping with the
removal of broken portions of chimneys and garden wall masonry
after receipt of signed waiver of liability forms. This work
was performed at no cost to the residents.

The number of telephone calls to the Building Department to
report damage was tremendous. On Monday the Building
Inspectors continued damage assessment inspections and
monitoring of the CCC crews. Two inspectors accompanied two
Federal Emergency Management and State Office of Emergency
Se~ices survey teams for two days. These teams were
surveying damage to private property. An additional Inspector
accompanied the third survey team today on inspection of
damage to public and non-profit structures. These surveys are
a prerequisite to the Governor's declaration of a disaster
area and subsequent availability of recovery assistance. The
public's assistance in identifying and reporting damage helped
immensely in providing early quantitative information for
emergency reporting. Without the public's help, the estimates
would be millions of dollars low. The City has received
additional help in inspections from the City of Whittier. The
Council has been provided a copy of the City's notice which
sets forth City policy with respect to chimney repairs. This
information needed to be out as soon as possible so when
repaired, the chimneys will be safe for the future and not
just cosmetically repaired. The services of the CCC will also
be available for a short time and at no cost. As of noon
today the total of 66 non-residential sites have sustained a
total damage of approximately 4.5 million dollars; 346
residential sites have sustained a total damage of
approximately 1.5 million; City facilities have been estimated
to have sustained damage of approximately $200,000.
Mayor Pro tem Harbicht commented that over the past two or
three years, the Arcadia City Council has, made a maj or
investment in disaster preparedness. It has sent all
department heads and many other employees to seminars for
training for disaster preparedness. The City has had two mock
disasters where the Emergency Operations Center has been set
up. Most of the Councilmembers were at the EOC and it was
amazing how smoothly it was working. The money spent has been
money well spent. He hopes there will never be a major
disaster but the citizens can feel confident that this City
is as prepared as any city, and probably more than most, for
a major disaster. The assessment report just given
demonstrates that. On behalf of the Council, he would like
to say a hearty "well done" to the staff; they really ,came
through in trying circumstances and now things are going
extremely well.
In the pre-meeting, Council decided to deviate from the agenda
to consider Item ge. at this time. Item ge. is an Interim
Urgency Ordinance concerning tree preservation. After this
consideration, Council will revert to the agenda. Staff
reported that at the last City Council meeting, Council
directed staff to prepare an Urgency Ordinance for the
protection of oak trees and certain other indigenous trees.
This is contained in Ordinance No. 1945. The reading in full
as well as four votes from Council are required for adoption
of this Ordinance. The Ordinance would be in effect for 45
days. If adopted, staff would probably take steps immediately
to extend it, in the event that a permanent ordinance is not
adopted in that period. Mayor Pro tem Harbicht questioned the
City Attorney as to the relevancy of a portion of Section 4a.
Misdemeanor, whi<.;i', states, "Each person shall be guilty of a
separate offense for each and every day during any portion of
which any violation of any provision of the Interim Urgency
Ordinance is committed, continued, or permitted by such person
and shall be punishable accordingly." Mayor Pro tem Harbicht
noted that the subject is a specific action, that is, removing
a tree. The City Attorney replied it would not be relevant in
most cases because this ordinance involves removing trees, but
he saw no, harm in having it included in the ordinance.
Discussion ensued among Council as to how the res'idents were

to be informed about this Urgency Ordinance. Suggestions
included a general mailing, inclusion of an announcement with
the water bills, and publicity in the local newspapers.
The City Attorney presented and read in its entirety Urgency
Ordinance No. 1945: "AN INTERIM URGENCY ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, IMPOSING A
MORATORIUM ON TREE REMOVAL AND DESTRUCTION IN THE CITY OF
ARCADIA, AND PROHIBITING SUCH ACTION, SUBJECT TO CERTAIN
SPECIFICATIONS, EXCEPTIONS AND MODIFICATION REQUIREMENTS".
(FOUR VOTES REQUIRED)
It was then MOVED by Councilmember Ciraulo, seconded by
Councilmember Young and CARRIED on roll call vote as follows

H. R. Stokes, 1040 Hampton Road, was present to thank the
Council and the City Attorney for the preparation of this
ordinance. Because of the anticipated scheduling of the
hearings before the Planning Commission and City Council with
regard to a permanent ordinance, ,he would like to suggest that
the time period in the Urgency Ordinance be changed to 90
days. The City Attorney responded that if a 90 day period is
required, a request for extension will be presented. In this
case, Council is following a Government Code which requires
that the first period of the ordinance effectivensss be 45
days. The situation will be closely monitored.'
Consideration of increasing the Planning Division fees and
Building Division fees. The, Planning Department is
recommending that the fees charged for processing the various
Planning applications and Building Permit fees be increased
to correspond to the increase in the 1991-92 City Budget.
Mayor Pro tern Harbicht declared the hearing OPEN.

Consideration of increasing certain Public Works Department
fees, deposits, inspection charges, and amounts required to
reflect actual costs. At its June 4, 1991 meeting, Council
approved Ordinance No. 1940 providing for such increases. It
is staff's recommendation that in order to defray the City's
expenditures and costs incurred in the permitting and
inspection process, these charges should be revised annually.
Mayor Pro tem Harbicht declared the hearing OPEN.

On April 23, 1991 the City contracted with Duke's Landscaping
Service to do general clean up of the property at 130 East
Bonita Street including landscape maintenance, removal of
debris and hauling of debris to the dump. This was done
because of lack of action by the property owner over a period
of three years. Also, this was done in accordance 'with
Resolution No. 5500: "DECLARING A PUBLIC NUISANCE AND ORDERING
THE REHABILITATION OF REAL PROPERTY LOCATED AT 130 BONITA
STREET, ARCADIA, CALIFORNIA, OWNED BY MICHAEL AND BARBRA
GIDDEN, AT CITY'S EXPENSE AND PLACING A LIEN AGAINST THE
PROPERTY PURSUANT TO THE PROVISIONS OF THE ARCADIA MUNICIPAL
CODE". On June 17, 1991, a "Notice of Assessment for General
Property Clean Up" was mailed to Barbra Gidden, the current
owner of 130 East Bonita, advising her that a hearing has been
scheduled for tonight's Council meeting for the purpose of
"correcting, modifying or confirming" the costs of the
property clean up in the amount of $350.00 and assessing these
costs against the property.
The City Council sitting as a Board of Equalization may modify
or correct any assessment which, in its opinion, is excessive
or otherwise incorrect. If no corrections or modifications
are made, the assessment shall be deemed confirmed, and the
Council's decision shall be final and conclusive and the
assessment shall become a lien against the property and'shall
remain a lien until the assessment is paid.
A letter dated July 2, 1991 from the property owner, Barbra
Gidden, protesting the $350.00 cost had been presented to
Council and was referred to by the City Attorney. In response
to a question from Mayor Pro tem Harbicht, staff responded
that many contacts with the property owner had been made over
a three year period in an attempt to resolve the problem.
The City Attorney also noted that the case was extended more

Mayor Pro tem Harbicht pointed out that a large amount of
staff time has been necessary to accomplish this clean up, in
addition to the fee charged by the company which actually did
the work. He requested a report and recommendation from the
City Attorney as to the feasibility of amending the Code to
enable the City to include such staff costs in future
situations of this type.

Notice to Bidders 9091-27 for the complete removal and
disposal of asbestos-containing construction materials present
at the remaining five parcels on the Northwest Corner Site was
mailed to five vendors. The Bid Notice appeared in the
Arcadia Tribune on May 26, 1991. The Arcadia K~uevelopment
Agency needs to have the asbestos material removed from these
five buildings prior to proceeding with their demoltion.
It was MOVED by Member Young, seconded by Member Ciraulo and
CARRIED on roll call,vote as follows that the Agency AWARD a
contract to the low bidder, Environmental Control Systems,
Inc. in the amount of $19,892.00 plus a 10% contingency for
a total of $22,000.00 for removal of asbestos material from
five parcels on the Northwest Corner Site.

PUBLIC HEARING SCHEDULED for July 16, 1991 for consideration
of Zone Change Z-9l-004, removing the "H" high rise overlay
from certain properties located in west Arcadia which are
currently zoned; C-2 H (general commercial with a high rise
overlay) and CoO DH (professional office with a design and
high rise overlay).
PUBLIC HEARING SCHEDULED for July 16, 1991 for consideration
of Zone Change Z-9l-005, a zone change from C-2 H (general
commercial with a high rise overlay) to C-2 H4 (maximum 4-

ACCEPTED project and AUTHORIZED final payment to Mark Lockwood
Construction for construction of emergency exit doors on
existing basement wall including stairwell, retaining walls,
roof structures and all appurtenant work - Job No. 663. Ten
percent (10%) retention payment becomes due and payable 35
days after the recordation of Council acceptance and will only
be released by the Director of Public Works on completion of
all corrections of record. The final contract amount of
$43,250.00 was funded entirely by Capital Outlay Funds.

APPROVED allocation of $50,000 from the Gas Tax Fund for the
purchase and installation of the remaining equipment necessary
to complete the modification of the master traffic signal
computer to VMS 330.
AWARDED contract for janitorial services for the Recreation
Department and Community Center to D H Maintenance in the
amount of $25,800.00 plus a 10% contingency of $2,580.00 to
cover the cost of special cleaning after major events for a
total of $28,380.00. Funds for this janitorial service are
budgeted in the General Fund for FY 1991-1992 in the amount
of $36,000.00
AUTHORIZED refund of a filming fee of $180.00 paid by Chi Stan
Yin for a student filming project. This provided for in
Arcadia Municipal Code Section 6616.10.

APPROVED revised service fees for third party administration
of the City's workers' compensation and liability programs
with Colen & Lee in amounts not to exceed $63,600 (workers'
compensation/$5,275 monthly) and $18,600 (liability
program/$1,550 monthly) for FY 1991-92, effective August 1,
1991.
APPROVED service agreement for $2,185 with Information for
Public Affairs, Inc. for a subscription to use the Citylink
telecommunications software package for FY 1991-1992. Funds
for the service were approved in the FY 1991-92 General City
budget.
APPROVED proposed changes in the City's health insurance
program outlined in staff report dated June 26, 1991 and
DIRECT staff to implement the modifications by August I, 1991.
ALL OF THE' ABOVE CONSENT ITEMS WERE APPROVED ON MOTION BY
COUNCILMEMBER YOUNG, SECONDED BY MAYOR PRO TEM HARBICHT AND

MATTERS FROM ELECTED OFFICIALS
"I would like to adjourn the meeting in memory of Roy Koons.
Roy Koons was born in Monrovia, California and came to work
for the City of Arcadia on April 23, 1984 as a maintenance
worker assigned to the Tree Crew. He excelled in this
position and requested a lateral transfer to the Traffic
Safety Crew in 1986 in order to expand his knowledge. A year
later in 1987, he was promoted to Foreman of the Traffic
Safety Crew. Roy died of a heart attack June 22, while
vacationing on Lake Powell in Utah. He was 49 years of age.
Services were h"ld at Live Oak Memorial Park on June 28.
During his seven years with the City, Roy continually enrolled
in various public works courses at Citrus College and the
University of California Riverside and completed thirty units.
He was always striving to excel in whatever job he was
assigned and completed each job in a professional manner. He
created a wonderful example for his subordinates and he will
be truly missed by all his fellow employees. Roy is survived
by his wife, two children and five grandchildren. He is going
to be missed by the City family and, of course, it is always
a tragedy when someone so young dies. So, we will adjourn
this meeting in memory of our late employee, Roy Koons".
