REGULAR MEETING
OCTOBER 22, 1991
The City Council and the Arcadia Redevelopment Agency met in
a regular meeting at 7:38 p. m., Tuesday, October 22, 1991 in
the Arcadia City Hall Council Chamber.

On MOTION by Councilmember Ciraulo, seconded by Mayor Pro tem
Harbicht and CARRIED, the Minutes of the Adj ourned and Regular
Meetings of October 8, 1991 were APPROVED. Councilmember
Young ABSTAINED, since she was not present at the October
8, 1991 meeting
It was MOVED by Mayor Pro tem Harbicht, seconded by Council-
member Young and CARRIED, that Ordinances and Resolutions
be read by title only and that the reading in full be WAIVED.
Mayor Gilb welcomed Members of Boy Scout Troop No, 176, Temple
City, and Boy Scout Troop No. 116, Arcadia, who were present
in the audience.
AUDIENCE PARTICIPATION
Lae1 Collins, 409 J Fairview Avenue, stated, in part, that
as a resident of Arcadia and on behalf of the people who make
films and commercials, she thinks that filming in the City of
Arcadia is a neat thing. A little inconvenience for something
that important should not matter. She thinks the notification
time should remain at three days.
She is present as a parent and concerned citizen to formally
request help from the City for the School District. She
realizes that the School Board is a separate entity. Mrs.
Collins is sorry the Council could not have been present at
the meeting of the Task Force at the First Avenue School the
previous day. The parents and students were begging five
people not to go through with their proposal to level First
Avenue School, level the other site and crowd the students
into the remaining schools. The citizens are asking for a
bond issue proposal. She and other parents are afraid that
three people are going to change the whole school system and
the face of the community for many, many years to come. The
answer they previously got from the City was that the City

cannot use the taxpayer money for the School District; but she
thinks the taxpayers would give their permission for the City
to help che schools. She also mentioned the funding for the
new Senior Center. It is wonderful to meet the needs of the
seniors, but if the school system is destroyed, it will not
do anyone any good.
Michael Walbrecht, California Film Commission, 6922 Hollywood
Blvd., Suite 600, Los Angeles, was present to address the
matter of the proposed ordinance requiring seven days notice
for filming in residential areas. He is aware that filming
companies can cause some disturbances and they would like to
make sure that, if there are any severe problems with any
particular shoot, the residents can feel free to come forward
and have something done about it. He had presented
Councilmembers a proposed activity sheet which the filming
company can fill out and hand out to the neighbors. This
would outline who will be filming and when, the number of
vehicles in the area, and who to call, both at the filming
company and the City, if there should be any problem. He
would like to see something like this used rather than have
the seven day notification proposal enacted.

Dennis Felman, 14942 Weindot Street, Van Nuys, 91405, stated,
in part, that he is a Member of the Association of Independent
Commercial Producers (AICP) and is on their Governmental
Affairs Committee and is also a location scout for television
commercials. A seven day permit process would effectively
eliminate 95% of television commercials being filmed in the
City of Arcadia. Corporate America and the advertising
agencies just do not give the filming companies seven days
lead time. He thinks the ordinance would actually have an
adverse impact to the City of Arcadia because rather than
having one or two trucks and 25-35 people filming commercials
for one day, there will be the larger movie crews of 125
people, with semi trucks parked up and down the street and
multiple day filming. The proposal is actually counter-
productive to what Council is trying to do,
Chandra Shah, Deputy Director, Los Angeles County Film Office,
6922 Hollywood Blvd., stated, in part, that their office
issues over 2500 filming permits a year; the majority of which
are in residential and business communities. Notification and
timing of notification are important, but more important is
the information that is included. Detailed information of
what is going to be taking place during the filming
activities, before the activity and after the activity is more
important. Their office provides parking information and any
special conditions on all notification forms. Also included
is a twenty-four hour pager service through the office to
mitigate any problems, The pager will be available and their
office is offering this service to the City voluntarily.
Anything else they can do, they would like to. They feel the
seven day notification period would not really solve the
problem.

Sandra MacIntosh, 1530 A1amitas, Unit B, Monrovia, stated, in
part, that she has been with the Security Bank in Arcadia
since it was built, she has her own location company (Perfect
Locations), and is the District Chairman for the Verdugo
District of the California Federation "of Women's Clubs. She
thinks one aspect that has been forgotten in these discussions
is that of the trickle down effect to the economy in the City
provided by the filming companies. This money includes not
only what the homeowner makes, but what local businesses make.
For instance, on a one-day Levi commercial shoot in Arcadia,
the filming company spent nearly $1,000 at the local
merchants, not including that spent with the homeowner. She
itemized these costs. She explained the time constraints she
has in making notifications and obtaining the necessary

res idents' signatures under the three day requirement, and
pointed out that this would be impossible under a seven day
requirement.
Peter Lee, 1225 W. Huntington Drive, stated, in part, that he
is an' architect and is working on a four unit townhouse
project. He has a problem in that they are unable to finish
on time. The time for the plan check has expired and the City
has told them it will be necessary to start again and pay an
addi tiona1 $4,348.46 for a new plan check fee. This is a
hardship for his client. He is present to ask Council's help
in this matter. In reply to a question from staff, Mr. Lee
said a request for extension was filed after the receipt of
the City's expiration notice. Mayor Gi1b instructed Mr. Lee
to go to the Planning and 8uilding Department the following
day and the Chief 8uilding Official will look into the matter
for him.

On MOTION by Member Harbicht, seconded by-Member Ciraulo and
CARRIED, the minutes of the Meeting of October B, 1991 were
APPROVED. Member Young ABSTAINED since she was not present
at the October 8, 1991 meeting.
The current Arcon/Schaefer 8rothers (A/S8) Exclusive Right to
Negotiate (ERN) with the Redevelopment Agency expires on
October 31, 1991. As a result of A/S8's request for a phased
project and the Agency's consideration of that request, and
the ensuing delay in Disposition and Development Agreement
negotiations, A/S8 and Agency staff will be unable to meet the
current schedule. A/S8 has requested a three month extension
to the ERN. If the proposed Amendment No, 5 to the A/S8 ERN
is approved, the performance dates contained in the ERN
Schedule of Performance would be extended three months to
January 31, 1991. Additionally, A/S8 will be required to
either extend or replace their existing Letter of Credit
through April 15, 1992. All other terms and conditions of the
ERN remain unchanged.
In reply to a question from Member Harbicht, staff stated that
the Agency has received the $5,953, which was the subject of
discussion at the last Agency meeting, The Letter of Credit
was to have been provided last Friday. It was received today.
A/S8 are now current with their administrative
responsibilities. As a result, staff intends to meet with
A/S8 tomorrow to begin formal negotiations for the DDA.
It was MOVED by Member Harbicht, seconded by Member Fasching
and CARRIED on roll call vote as follows that the Arcadia
Redeve 10pment Agency APPROVE Amendment No. 5 to the A/S8
Exclusive Right to Negotiate, subject to minor revisions
approved by the Executive Director and Agency Counsel.

AWARDED contract in the amount of $12,000 to Hickman
Mechanical, Inc. for seismic repair and retrofit of Police
Department buildings - Job No. 520. Funds available from the
Capital Outlay Fund in the amount of $55,000 to cover the cost
of engineering, construction, inspection and contingencies.
All informalities in the bid or bidding process to be WAIVED
and the Mayor and City Clerk AUTHORIZED to execute a contract
in a form approved by the City Attorney.

ACCEPTED project and AUTHORIZED final payment to Mark Lockwood
Construction for Eisenhower Memorial Park Renovation - Job No.
665. Ten percent (10%) retention payment becomes due and
payable 35 days after the recordation of Notice of Completion
and will only be released by the Director of Public Works on
completion of all corrections of record. The final contact
amount of $51,645.74 was funded by a State Grant ($34,475) and
the Park and Recreation Facilities Fund ($17,170.74).
APPROVED request for temporary street closure for a block
party - Claridge Street from 360 feet north of Sierra Madre
Boulevard to the end on November 2, 1991 from 2:00 p.m. until
7:00 p.m. Permission subject to conditions set forth in staff
report from the Public Works Director dated October 22, 1991.
AUTHORIZED staff to accelerate the crane replacement schedule
from the 1995-96 Capital Improvement Program to 1991-92 fiscal
year for replacement of vehicle No. 41-1 with a truck-mounted
10 ton, 46 foot boom crane, and APPROVED appropriation of
$75,000 from the Equipment Replacement Fund, AUTHORIZED staff
to solicit bids for a 10-ton crane.
APPROVED forty-five (45) days extended Leave of Absence
without pay, October 18 through December 1, 1991 for Christine
Camano, Typist Clerk II, City Clerk's Office.

APPROVED Final Map of Tract 48678 for a twenty (20) unit
residential condominium project at 841-847 Fairview Avenue on
behalf of Jennifer Shia (owner/developer of the site).
Approval on condition that all outstanding conditions of
approval, as outlined in Public Works Department report dated
December 21, 1989 shall be complied with to the satisfaction
of the Director of Public Works.
AUTHORIZED refund of filming fee of $90 paid by Monique Breen
for a student filming project. This provided for under
Arcadia Municipal Code Section 6616.10.

APPROVED request from the Arcadia Music Club to host the West
Arcadia Band Review and Field Competition at Arcadia High
School November 23, 1991. Arrangements have been made with
the police Department to secure necessary Police personnel,
and the proper paperwork and insurance binders have been
issued to properly cover the City.
APPROVED request from the Chief of Police to create two video
productions of the members, staff, and operations of the
Arcadia Police Department and its interaction with the
community to be used as a public relations tool. AUTHORIZED
payment of $22,000 to Winters Productions with funds from the
Asset Seizure Account.

The decision regarding a public hearing for consideration of
Underground District No. 13 - Second Avenue from Huntington
Drive to La Porte Street had been postponed for the receipt
of a report from the Public Works Director. The Public Works
Director presented a report on two alternatives: 1)
Distribution Lines Only and 2) Distribution and Transmission
Lines. Alternative 2) includes two alternatives: A)
Undergrounding of all utilities on Second Avenue from
Huntington Drive to La Porte Street ("guesstimated" cost is
$800,000); B) Undergrounding of all utilities on Second Avenue
from A1ta to La Porte ("guesstimated" cost is $1,000,000).
Staff's opinion is that, of these latter two alternatives,
alternative B) is probably the most desirable because it
involves the removal of the poles at the Northwest Corner
Project site and the Southwest Corner Project site. Should
the Council wish to proceed with the undergrounding of
distribution lines only (the proposed project), it is
recommended that a public hearing be scheduled for November
19, 1991. Should the Council wish to cancel the
under grounding of distribution lines; and desire to proceed
with the undergrounding of distribution and transmission
lines, it is recommend that Altrnative B) (A1ta to La Porte)
be approved and that the Council authorize staff to proceed
with this project. Proceed means going forward with design
and budgeting by Edison, so that the project can be brought
back to the Council in early to mid-1993 for a public hearing.
In answer to a question from Counci1member Young, staff
replied that if distribution lines only are undergrounded,
only four poles will be removed. Mayor Pro tem Harbicht is
not in favor of under grounding the transmission lines because
of the cost. He does not then see a lot of reason for
undergrounding the distribution lines since the transmission
line poles would still be there, He would like to find a
better project. The Public Works Director noted that it would
be a cleaner project even with just the distribution lines
undergrounded. In reply to a question from Counci1member
Young, the Assistant Manager for Economic Development
explained that there are two poles on the Northwest Corner
Project that may have to be relocated by the developer and
that could be quite expensive.

Counci1member Fasching referred to the previous Council
meeting, during which the proposal for the N1.I and SW Corner
Projects to replace wood poles with two steel poles for an
overhead transmission line was denied. It was suggested at
that time that undergrounding might be preferable; now the
estimated costs are available ($800,000 to $ 1,000,000 for
undergrounding of all utility lines). Staff agreed with
Counci1member Fasching's understanding that each district is
in a priority status as far as undergrounding of electrical
lines. Since this project would mean that other areas will
be further down the line for undergrounding, he is not in
favor of the project. Other projects will be penalized for
years to come for undergrounding these few lines.
In reply to a question from Councilmember Ciraulo regarding
numerous poles on'the Northwest Corner Project, the Assistant
Manager for Economic Development said the poles referred to
are the ones that are in the alley and abut the buildings to
the west of the site. Those connect Edison services to the
buildings. When and if a developer comes in, those
distribution lines would be undergrounded as part of the
development project and the alley would be vacated. It is not
part of the project the Public Works Director is referring to,
but a part of the overall development of the Northwest corner.

The City Attorney presented and read the title of Ordinance
No. 1951: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ARCADIA AMENDING DIVISION 6 OF CHAPTER 5, ARTICLE VI OF THE
ARCADIA MUNICIPAL CODE BY ADDING A SECTION 6616.11 CONCERNING
REGULATIONS FOR MOTION PICTURE FILMING - TIMING OF NOTICE TO
NEIGHBORHOOD".
A discussion ensued among Council regarding the requirement
in this Ordinance changing the present three day notification
to a seven day notification. Michael Wa1brecht, California
Film Commission, 6922 Hollywood Blvd., Los Angeles, stated in
reply to a question from Councilmember Ciraulo that the
summary sheet mentioned earlier would be delivered to the
residents by the filming Location Kanager at the time the
required permission signatures are obtained. At that time the
resident would know when the filming is to be done, number of
trucks on the site, etc, In reply to another question, he
reiterated that Ms, Shah, Los Angeles County Film Office, had
offered her 24-hour pager number to the Business License
Officer in the event problems should arise. Also, an Arcadia
Police Officer is usually present at the filming site and
complaints can be directed to that Officer. In reply to a
question from Counci1member Young, Mr. Wa1brecht stated that
filming of commercials is accomplished in one day about 50%
of the time; two days about 40% Becky Pike, Business License
Officer in reply to a question from Counci1member Fasching,
said that (although it has not happened before) if residents
call to say they have a problem with the filming scheduling,

she would then call the filming company and try to re-arrange

After further discussion among Councilmembers, the consensus
was that since the filming companies are making every effort
to be cooperative, and residents now have some recourse to
solve problems that might arise because of filming activities,
the present three day notification requirement is adequate.

Since this matter arose after publication of this meeting's

The City Manager stated that Governor Wilson is proposing
severe cutbacks in funding for the Department of Alcohol
Beverage Control. It is believed that the proposed reduction,
will result in the layoff of approximately 75% of the agents
and support staff within the Department, thereby severely
curtailing their enforcement capabilities. Staff believes
that this reduction in ABC staff will have a devastating
effect on local law enforcement. It is recommended that the
City of Arcadia adopt a resolution which calls upon the
Governor and the State Legislature to consider restoration of
funds to the Department of Alcohol Beverage Control.

The City Attorney presented and read the title of Resolution
No. 5626: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALLING FOR THE RESTORATION OF ADEQUATE FUNDING FOR
FISCAL YEAR 1991-92 AND THEREAFTER FOR THE STATE DEPARTMENT
OF ALCOHOL BEVERAGE CONTROL AND URGING THE GOVERNOR AND THE
STATE LEGISLATURE TO APPROVE FUNDING FOR THE ABC IN ORDER TO
CONTINUE ABC ENFORCEMENT AT LEAST AT PRESENT LEVELS".

Councilmember Fasching requested a Closed Session at the
conclusion of this meeting to discuss the Arcon/Schaefer
negotiations.
The City Attorney announced that, "pursuant to Government Code
Section 54956.8 for purposes of giving direction to the
Agency's negotiator concerning the potential acquisition of
property and related terms regarding the South West Corner
Project (corner of Huntington and Second) in his negotiations
with W. Lortie and H. Schaefer."
Mayor Pro tem Harbicht opened a discussion of the School
District Task Force recommendations to the School Board and
stated, in part, that although the City Council does not have
jurisdiction over the Arcadia Board of Education, he believes
it.to be incumbent upon the City Council to at least express
an opinion to the School District as they are going into their
deliberations on this matter. Mayor Pro tem Harbicht is very
concerned about the recommendation to the School District to
sell off School District assets, in particular, the Santa
Anita School site and the recommendation to close First Avenue
Junior High School and lease the property. He inquired if the
rest of the Council would be interested in adopting a
resolution asking the School Board to seek another solution
and not sell the assets. Further, the School Board has held
public hearings and requested input from the public. As City
officials, Council should also contribute input to the Board
before they make their decisions, in particular, the issue of
selling pieces of property or long-term leases.
As the discussion continued, the suggestiorl of sending
individual letters to the School Board was considered. This
to allow each Counci1member to express their opinion on the
Task Force recommendations on an informal level.
Gouncilmember Fasching stressed that the School Board should
be given time to assimilate all the material and input from
the public. If he were to send a letter to the Board he would
.tell them that after they have had time to study the results
of their public hearings and have some conclusions, that
Council feels, as a body, it would be wise for Council to sit
down with them and discuss needs and see where the Council
could possibly be of benefit to them. He does not want to
disagree with any of the recommendations until they have had
time to tell the Council what their thinking is and then sit
down for a discussion, Additional exchange followed with
regard to individual letters to the Board from each
Gounci1member.
Mayor Pro tem Harbicht commented that he would rather see the
Council take some action on the matter, following which the
City Attorney advised if formal action were to be taken with
a vote, this would have to be an agenda item. Mayor Pro tem
Harbicht then requested that staff put a resolution on the
next agenda regarding the Task Force proposals and he. will
provide the wording to express Council's opposition to certain
elements of the Task Force recommendations to the Arcadia
Board of Education. He will name the elements in the

Counci1member Fasching commented also that he would like to
bring back a resolution that Council sit down and talk, at the
proper time, with the School Board about their evaluation of
the public hearings and consider how the City Council and the
School Board can do something about the School District's
problems. Staff commented that this does not have to be a
resolution. It could just be a motion and it would be
appreciated if Councilmember Fasching could put his request
in writing for the agenda.
Mayor Pro tem Harbicht raised an issue of concern to him by
citing the Agency's approval of the Arcon/Schaefer Brothers
proposed building at the South West Corner of Huntington Drive
and Second Avenue with respect to the window openings in the
walls of the building that abut residential property. There
is an ordinance which states that a commercial building may
not have these types of windows. Then the Arcon/Schaefer
Brothers project came before the Agency and the building was
preliminarily approved with windows that overlook a
residential area. His objection is to the ordinance that
prohibits windows in commercial buildings that abut
residential areas, and the fact that there may be an
inconsistency by allowing this building in the Redevelopment
area to have such, while other commercial building projects
are not allowed the same concession. Counci1member Ciraulo
reminded Council that anyone can apply for a modification for
windows and it would then be up to the Planning Commission to
grant the modification or not grant it. Mr. Kinnahan noted
that in a previous discussion on this issue, the Agency or
Council basically decided they wanted to retain the ordinance
prohibiting windows in. commercial buildings that abut
residential properties and deal with it on a case-by-case
basis. The Arcon/Schaefer Brothers plans then came before the
Planning Commission and were approved and the Agency basically
approved the plans in concept two weeks ago. The discussion
continued and Mayor Pro tem Harbicht commented that he feels
this law is wrong and should be eliminated. He does not
object to the Arcon/Schaefer Brothers building, but if the
City has this law then Council should be consistent.
Councilmembers Young and Fasching disagreed; they believe this
to be a good ordinance.

At 9:00 p.m. the Council entered a CLOSED SESSION, RECONVENED
AND ADJOURNED at 9:45 p.m. to 4:00 p.m, Thursday, October 24,
1991, in the Conference Room of the Council Chambers to a
Study Session regarding expansion of Santa Anita Fashion Park,
and any closed Session necessary to discuss personnel,
litigation and evaluation of properties.
