Rev. Roger Sonnenberg, Our Saviour Lutheran Church Councilmember George Fasching PRESENT: Councilmembers Ciraulo, Fasching, Gilb, Harbicht and Young ABSENT: None .on MOTION by Councilmember Harbicht, seconded by Councilmember Ciraulo and GARRIED, the Minutes of the Regular Meeting and the Adjourned Regular Meeting (ARA Study Session) of May 15, 1990 were APPROVED. Councilmember Gilb ABSTAINED since he was not present at these meetings. It was MOVED by Councilmember Harbicht, seconded by Councilmember Gilb and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be WAIVED. CITY ATTORNEY The City Attorney announced that, "pursuant to Government Code Section 54956.9(a), the Arcadia Redevelopment Agency met in a CLOSED SESSION to discuss the current Los Angeles Superior Court eminent domain case entitled: Arcadia Redevelopment Agency vs. Zahir and Younaei". Public Hearing for consideration of Zone Change Z-90-001, from PR-3 (multiple-family zone with automobile parking,overlay)to C-2 D (general commercial zone with architectural design overlay)for the properties at 311-325 E. Live Oak Avenue, 2616 Third Avenue, area east of Third Avenue, west of Fourth Avenue and 26 to 44 feet south of the alley. Mayor Young declared the hearing OPEN in the event there was anyone present who wished to speak. No one came forward and the hearing was CONTINUED to July 3, 1990 to allow for adequate noticing of the public hearing. AUDIENCE PARTICIPATION Robvne Harrington, 1426 N. Edgemont Street, Hollywood, stated, in part that, she was present to request that the City Council put on the agenda a pet protection resolution, which almost every city in Los Angeles has signed, with the exception of Arcadia and several others. This resolution protects pets that are taken to the County Pound from being sold for animal research. This is not necessarily against animal research. Actually very few pets are used for this purpose; the laboratories generally prefer animals raised for this purpose. However, this resolution is needed to protect the companion animals that are occasionally released for research purposes. In reply to a question from Council, Mrs. Harrington agreed that it is better to humanely destroy the animals rather than release them for animal research .,. especially the companion animals who suffer much more in such a situation. Animals picked up in Arcadia are sent to the Baldwin Animal Shelter which is one of the few remaining shelters that sells animals for research purposes. The Pasadena Humane Society, for example, does not release animals for this purpose. Mrs. Harrington feels that residents should be able to take animals to the shelters with confidence that they will be- treated humanely. I BOARDS AND COMMISSIONS At the Council meeting of May 15, 1990, the City Council authorized the Library Board to have the City Librarian solicit proposals from library building consultants and architects for the purpose of completing a Library building program proposal. This process is necessary in order to complete the application for State funds provided under the California Library Construction and Renovation Act (Proposition 85). Since that time, the State Library has extended the time allowed to complete the application; they have also provided the opportunity for a pre-application process which would be available in July of 1990 and completed by mid-November 1990. This s=reening is primarily for those libraries which will not be implementing building projects if they do not receive Proposition 85 funds. However, it was indicated by the City Council and Library Board that they wish to proceed with developing a library building proposal whether or not State funds are obtained. Therefore, after reviewing all of the proposals received by the Library, the firm of Charles Walton Associates was considered the most suitable fo~ this purpose. I It was MOVED by Councilmember Gi1b, seconded by Mayor Young that the City of Arcadia contract with Charles Walton Associates for the purpose of preparing the Library building program proposal. Councilmember Fasching noted that this matter had been discussed at the previous Council meeting. The situation has changed somewhat in the interval; the deadline for receipt of the applications has been extended. He would like to hold this matter over until after the study session concerning long term projects to be held June 7, 1990. Councilmember Fasching then MOVED that this matter be held over until the June 19, 1990 Council meeting. Councilmember Gilb noted that the increased use of the Arcadia Library came about after Proposition 13 was in effect; County libraries closed and that -2- 6/5/90 I I 4b. Councilmember Harbicht noted that he is in favor of expanding the Library, but has no problem with holding the matter over to the June 19, 1990 meeting. Councilmember Ciraulo also noted that he has no problem with holding this matter over. At the last Council meeting he ~ecalled that Councilmembers had indicated they wished to pursue this matter whether or not grant funds were obtained. It was pointed out that tfte $55,000 would not be spent merely to file the grant application because this prelimina~y work would have to be accomplished in any event. Mayor Young indicated that she did not mind waiting two weeks for this decision and withdrew her second to Councilmember Gilb's motion. Councilmember Fasching MOVED that the matter of the Library expansion be carried over to the June 19, 1990 Council meeting; this seconded by Councilmember Ciraulo and CARRIED on roll call vote as follows; AYES: NOES: ABSENT: Councilmembers Ciraulo, Councilmember Gilb None Fasching, Harbicht and Young It was MOVED by Councilmember Harbicht, seconded by Councilmember Fasching and CARRIED on roll call vote as follows that the gift from the Friends of the Libra~ in the amount of $14,800 be ACCEPTED and that a letter of thanks from the Mayor be sent to the Friends of the Library. At its May 10, 1990 meeting, the Personnel Board approved the REV. - CASHIER class specification modification for Cashier Account Clerk and ACCT. CLERK forwarded its recommendation to the Council fo~ action. These (APPROVED) modifications are outlined in staff report dated May 31,1990. 4c. 4d. O.j):J.O-/<J CLASS SPEC. - ~~ At its May 10, 1990 meeting, the Personnel Board approved the EMERGENCY class specification for Emergency Services Coordinator, and SERV. COORD. established this position a3 a full- time, mid-management (APPROVED) position in the Fire Department. These specifications are O.2~O-/O outlined in staff report dated May 31, 1990. 4e. P/l/l,[8/C!,.7 CLASS SPEC.MOD'N- At its May 10,1990 meeting, the Personnel Board proposed BLDG.TECH.;CODE modifications of five class specifications which represent the ENFORC.OFF.;BLDG. non-management positions in the Planning Department. These INSP.;ASST. & positions are Building Technician; Code Enforcement Officer; ASSOC.PLANNER Building Inspector; Assistant Planner and Associate Planner. I and the AYES: NOES: ABSENT: ABSTAIN: Members Ciraulo, Fasching, Harbicht and Young None None Member Gilb (Not present at the May 15, meetings.) 1990 Resolution No. ARA-159 set a hearing for this date on the commencement of eminent domain proceedings for the Atchison, Topeka and Santa Fe Railway Company properties. Pursuant to Resolution No. ARA-159 , staff has transmitted a notice of this hearing and the Agency's final offer to acquire the properties to the owners. Prior to setting the hearing, the Agency established just compensation and made an offer to the owners to acquire the properties for the full amount established as just compensation pursuant to Government Code Section 7267.2. Staff has conducted a full and adequate review of environmental impacts associated with this acquisition, pursuant to the California Environmental Quality Act of 1970, as amended. The Agency provided owner/tenant participation opportunities to the owners of the properties, pursuant to California Redevelopment Law and ARA Resolution No. ARA-10. In response to the Agency's query'that this is a "friendly condemnation", the Assistant City Manager for Economic Development reported that the formal condemnation process will take place at the request of the railroad in order to bring the matter before the courts. Moreover, the Atchison, Topeka and Santa Fe Railway Company has accepted the Agency's offer for the property. Chairman Young announced that the hearing was OPEN for the property owner and those claiming a'possessory interest in the properties. I No one desiring to be hea~d, the hearing was CLOSED. APPOINTMENTS (;(.!I!_ ~O 32:0127 California State Assembly Bill AB 265 requires that Redevelopment Agencies set aside 20% of their annual tax increment into a Housing Fund for low and moderate income housing (20% is estimated to be $326,000 in FY 1990-91). AB 265 permits the Agency to make findings that it is not able to set aside all or part of the 20% into the Low/Moderate Fund if existing Redevelopment Agency obligations, projects, programs or activities in'any fiscal year prior to FY 1996-97 do not permit such. Copy of Resolution No. ARA-160, if approved, to be forwa~ded to the State Department of Housing and Community Development within ten days after adoption. A brief discussion ensued with staff reminding the Agency that -State law requires the Agency to set aside 20% of its annual tax increment into the Housing Fund, and every year a deficit is accruing. This will end in 1996-97 when the Agency will no longer be able to defer these funds and will have to set aside the 20% and, in addition, make an effort to repay the deficit. Staff estimates the deficit could be around $4,000,000 in 1996-97 and the Agency could finance it over time. The Assistant City Manager for Economic Development then read the title of Resolution No. ARA-160; "A RESOLUTION OF THE ARCADIA REDEVELOPMENT AGENCY DECLARING THAT THE AGENCY IS UNABLE TO SET ASIDE 20% or less of its 1990-91 TAX INCREMENT FOR LOW/MODERATE INCOME HOUSING DUE TO EXISTING AGENCY OBLIGATIONS, PROGRAMS, PROJECTS AND ACTIVITIES". The coalition's recommendation will be brought before Council for final approval. AWARDED contract for purchase of 200 KW generator to Duthie Electric Service for the purchase of Or an Model 200KWDFBD generator for the City Yard in the amount of $39,485.37. Funds for the purchase of this generator were approved by the City Council at the February 20, 1990 meeting in the amount of $45,000. The funds are available from the Water Fund. I AWARDED contract for purchase of 100 KW generator to Del Rey Diesel & Electric for the purchase of Oran Model 100KWDGDB for the Water Division in the amount of $23,657.94. Funds for the purchase of the 100 KW generator were approved by the City Council at the February 20, 1990 meeting in the amount of $25,000. The funds are available from the Wate~ Fund. Harbicht as the County Sanitation AWARDED contract in the amount of $98,356 to Lytle Roofing Company, Inc., 2948 East Walnut Street, Pasadena, CA.for re- roofing of Police Bldg. RESOLUTION NO. 5534 (ADOPTED) 0,'.<(:,-',) ./30 h/1r rC-1/u - Q \~'\' 32:0l29 A study was made of the existing water billing system to determine the computer program changes necessary to permit printed messages and consumer's water use percentage change on water bills. Several meetings were held between the Finance Department and Water Division to discuss the programming modifications and estimated costs for four alternatives available to the City. The results of this study are set forth in detail in staff report dated June 5, 1990. Considerable discussion ensued with regard to this proposal. It was determined that the desired alternative would involve purchasing a complete new computer software system. This together with expenses for other items such as staff time; paper stock; envelopes; increased postage; stuffer/folder machine, etc; resulted in an estimated initial cost of $96,000; recurring annual cost of $24,000. It was determined that the benefits resulting from changes in the water billing system were not warranted in view of the costs involved. It was then MOVED by Councilmember Gilb, seconded by Councilmember Harbicht and CARRIED on roll call vote as follows that the proposal to change the City water billing system be TABLED. AYES: Councilmembers Ciraulo, Fasching, Gilb, Harbicht and Young None None NOES: ABSENT: CITY ATTORNEY The City Attorney presented for adoption and read the title of Ordinance No. 1923: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION 6415.4 OF THE ARCADIA MUNICIPAL CODE REGARDING PROMOTIONAL ENTERTAINMENT EVENTS - PARKING LOTS (DISTANCE TO RESIDENTIAL PROPERTY. PERMIT REQUIRED)". The City Attorney noted that he added the clarifying language as requested by Councilmember Harbicht at the last Council meeting to require that approval of only one person of adult status at each dwelling would be enough; and that could be waived also for good cause. This to reflect the intent of the Council. It was then MOVED by Councilmember Harbicht, seconded by Councilmember Ciraulo and CARRIED on roll call vote as follows that Ordinance No, 1923 be and it is hereby ADOPTED. Also, with regard to conservation, it has been found over the years that the best way to accomplish this is to raise the rates; that consistently works. This has happened also with the gas company and the Edison company. Councilmember Gilb inquired if it were true that if sufficient income is not generated within the Water ~ivision, it results in higher rates. Councilmember Harbicht agreed. In response to a question from Councilmember Fasching, the City Manager stated each year the Water Division takes a look at what the City needs to provide for the operation of the water system, as well as to provide prudent reserves for any emergencies or repairs that we foresee in the future. The statement in the Resolution is saying that the City believes that this is the right rate to maintain those for the next year. The rate of increase for the past several years has been 10%; this year the rate is 9%, since it was felt that less money was required; the rates can be lowered as well as raised. I AYES: Councilmembers Ciraulo, Fasching, Gilb, Harbicht and Young None None NOES: ABSENT: MATTERS FROM STAFF None MATTERS FROM ELECTED OFFICIALS Noted that it was his impression that the trash pickup company still did not have any company to take the yard waste and that, although it is picked up separately from other trash, it is still going into the landfills. Staff replied this was true, and that there were experimental programs to use this waste as a spread layer over the dumps; however, this takes only a small portion of yard waste. Picking up this yard waste separately is an added expense; certainly the refuse operator would probably like to get rid of this system and have the yard waste picked up in the normal 60 or 90 gallon containers furnished by the company; that, however, would mean that the residents would probably have the rates doubled to do so; household refuse is much less in most homes in Arcadia than yard waste. The new contractor knew that he would have to furnish what is basically a free pickup of yard waste until the contract is up and possibly something new will be negotiated. Councilmember Harbicht noted that something needs to be done to create a market for the yard waste, as well as for newspaper which is also collected separately. Perhaps the State could pass a law requiring the use of recycled newspaper. Councilmember Gilb commented that the problem is that there are only four recycling plants in the western United States; there is no market for it. A great deal of this newspaper is sent to Japan or China for recycling. Councilmember Harbicht noted that perhaps a resolution could be submitted for the League of California Cities conference that the League take a position in support of requiring mandatory use of newsprint. This might be a start; it has to be a joint effort; Arcadia can not do this alone. Councilmember Harbicht noted in this respect, he would like to see a report from the County Animal Control, outlining the numbers of Arcadia dogs picked up and later sold for research purposes. Also he would like to know what criteria is used to decide which animals will be sold for medical use. On June 16 there will be a special reception with regard to the Household Hazardous Waste Collection Day at Cal Poly, Pomona. She will be unable to attend and inquired if someone else would care to attend. The notice was from the Mayor of San Dimas. The reception will include a briefing and a tour of the event. Councilmember Gilb suggested one of the citizens attend, perhaps Ann Benson, who has indicated interest in such matters and even submitted a report on one such meeting. On June 19 in Long Beach there will be a christening of the Metro Blue Line Rail Transit vehicle that will be named after Arcadia. The invitation states, "in addition to Members of the City Council and other distinguished guests, please bring your own photographer to capture this historic event". She will try to attend, if no one else is available. "After the last meeting, 1 would like to, once again, adjourn the meeting in memory of one of our employees who passed away of cancer, Janet Nelson. She passed away on May 20, 1990, after a year-long battle with cancer; she was fifty-five. She was an employee of the City of Arcadia for seventeen years, where she advanced from a Clerk to Secretary to Personnel Technician to Administrative Assistant. She pursued her education through this entire period and in 1987 received her Bachelor's Degree. She is survived by five sons and two . grand~ons. . Services were held on May 22. It is a very sad occasion, once again, for us to close the meeting in honor of one of our employees.tt "Ray Brockus, who used to come to the Council meetings all the time, passed away May 24, 1990. He was actively involved in community activities since 1949. He was very interested in youth activities, as well as the senior citizen projects. Ray and I were involved in a service club called Active Club in 1949 to 1955 and then went into Twenty-Thirty and that's how we became acquainted. He was a member of the Arcadia American Legion, the Monrovia VFW, and the Alhambra Masonic Lodge. If you don't remember who Ray was, he was the one who used to come to the Council meeting with a cowboy hat on, carrying the oxygen tank because he had emphysema so bad. Funeral services were held on May 30, 1990. He is survived by his wife, Helen; two daughters and four grand children." "Harry Meskell passed away June 3, 1990. He lived up on North Michillinda Avenue right near where I live. Mr. Meskell was graduated from UCLA and active in the UCLA Alumni Association. He was forty years in the insurance business; he was the owner of the Rule Company in Pasadena and Chairman of the Board of Friar Tux Shop. He was a member of the Annadale Golf Club and the Jonathan Club. He is survived by his wife, Patricia Meskell; daughter, Karen Lee Goodwin; sons, Michael K. and -9- 6/5/90 -'1:~.. A?~: 32:0132 Steven B. Meskell; and six grandchildren. Services are tomorrow night at St. Rita's in Sierra Madre; the Vigil Service; and the Funeral Mass will be 10:00 a. m., Thursday. In lieu of flowers, donations may be made to the St. Rita School Endowment Fund. Besides being very involved with St.Rita's Men's Club, Mr. Meskell was involved with Rancho Santa Anita Property Owners' Association for many years and in the late 60's he and I were involved with the Board. He was one of the people who was very involved in getting Anoakia into the City of Arcadia when it was part of the County. We had to fight the Legislature in order to get that piece of property in the City. He was President of the Association one year; I served on the Board with him for about seven or eight years. He was very involved in our Property Owners' area. It's really quite a tragedy that he passed away and 1 heard 1 last Friday that he was taken off the support systems and died Saturday. I would like to close the meeting also in memory of Ray Brockus and Harry Meskell." YOUNG (In Memory of Dr. Philip Atta11a) "Dr. Philip Attla11a was born in Cairo, Egypt in 1928 and died on May 18, 1990. He was a long-time resident of Arcadia and served as a medical doctor locally. He served on our Senior Citizen Commission for two years. Services were held on May 23, 1990 at St. Anthony's Greek Orthodox Church.
