Desterhaft, Arcadia Presbyterian Church Councilmember Joseph C, Ciraulo PRESENT: Couneilmembers Ciraulo, Fasching, Gilb, Harbicht and Young ABSENT: None On MOTION by Councilmember Gilb, seconded by Councilmember Harbicht and CARRIED, the Minutes of the Budget Study of May 29, 1990 and the adjourned and regular meetings of June 5, 1990 were APPROVED, It was MOVED by Councilmember Harbicht, seconded by Council- member Ciraulo and CARRIED that Ordinances and Resolutions be read by title only and that the reading in full be WAIVED, CITY ATTORNEY The City Attorney announced that, "the City Council and Redevelopment Agency met in CLOSED SESSION this evening pursuant to Government Code Section 54956.9(a) to discuss two lawsuits: Arcadia Redevelopment Agency vs, Kiewit and the lawsuit of Aranda and Meyers vs. the City of Arcadia". -~ The City Council has previously been provided the proposed Budget for IT 1990-91, Subsequent to its preparatio~, additional funding requests had been received: 1) The Finance Department requested an additional $9,000 for a permanent part-time employee as an Account Clerk I; 2) Colen & Lee, the City's third party workers' compensation administrator, have requested contract renewal and a rate increase for the 1990- 91 fiscal year; 3) the Sister City Commission requested an additional $300; and 4) the Chamber of Commerce requested an additional $20,000. ,In reply to Councilmember Gilb' s question, staff replied that at the Budget Review Session the requests were included in the Budget documents for the other special groups, 1. e., Juvenile Diversion, Parent Alert, etcetera, Mayor Young declared the hearing OPEN. 6/19/90 -1- Chamber of Commerce Request 32:0141 Scott Downie, 1104 Rancho Road, presented and'read a letter to the Council in which he enumerated many items about which he had questions, including, but not limited to, the amount of money received as a result of the City's participation in the seizure of narcotics; what this money will be used for; if the Poliee Department is to be expanded; if part of these funds will be budgeted for a new Police building; if part will be used for education against drugs; if the new Senior Citizen building is on construction schedule; if it is on budget; if lavish furnishings will be included; costs of the quarterly Newsletter; has publishing the Newsletter monthly been considered; is it cost effective; can it be upgraded. Also there were questions concerning the City utility tax, The City Manager responded that these questions could more easily be answered by the respective Department heads, i, e., the Chief of Police, Planning Director, Assistant to 'the City Manager and the Finance Director. Councilmember Gilb noted that the Councilmembers had received copies of Mr, Downie's questions fifteen minutes prior to this meeting and also that there had been extensive discussions held on the proposed budget at a special meeting May 29, 1990 which had been open to the public. Councilmember Fasching noted that the Council is interested in ways to communicate more quickly with the residents, The City Attorney noted that a public hearing was an occasion for citizens to address their concerns to the Council; not a forum for directing questions to the Council, I Eloise Ward, President, Arcadia Chamber of Commerce, stated, in part, that she is present tonight to request an increase in the FY 1990-91 budget for the Chamber in the amount of $20,000, this primarily for the purposes of re-roofing the Chamber building and replacing part-time office staff personnel, This brings the total request to $60,000, In reply to a question from Counci1member Gilb, Ms. Ward replied the Chamber is acting upon several strategies aimed at increasing membership, She also responded that the Chamber has reduced the rent for the Arcadia Tournament of Roses Association; the Association is, however, supplying some voluntary labor to help the Chamber. No one else desiring to be heard, the hearing was CLOSED on MOTION by Councilmember Harbicht, seconded by Councilmember Fasching and CARRIED. Councilmember Harbicht noted that the staff recommendation was that the Chamber request be left at $40,000, but that the City undertake to re-roof the Chamber building. Also, water and landscaping service are provided by the City, so there are increases granted other than the cash portion, He would like to see Council adopt the City Manager's recommendations and leave the cash contribution at $40,000. Counci1member Fasching agreed with staff report, He suggested that the Chamber might be able to raise some money by having mixers or 1 social events in the patio area, which had at one time be~n canvas covered, and rent that area out. Councilmember Gilb remarked there would be problems with insurance. Kel Mason, Executive Vice President, Chamber of Commerce, 146 South Noble Place, Azusa, stated that the Chamber has not had any such events in the patio area for a long time. Also, that all Chamber events are covered by insurance wherever they are held, Events that have been held at the Chamber have been held privately in the Board Room, nothing has ever been for sale or anything like that involved in there, He would be very concerned about the matter of selling beverages, The Chamber takes out an ABC license on every mixer. 6/19/90 -2- Medicare Billing Increase I Workers' Compo Administration (Colen & Lee) I 32:0142 The City Attorney stated in reply to Mayor Young's comment that alcoholic beverages are prohibited on City 'property, that he did not think that applies to proprietary-type purposes; he does not recall seeing such an ordinance, but will check. In reply to questions from Councilmember Harbicht, the Interim Finance Director, stated that the City's current status with the Medicare Program is that of a Non-Participating Provider, With regard to ambulance billing, i,e., the City did not enter into an agreement to accept assignment for all services provided to Medicare patients. With recent legislation, beginning September 1, 1990, Participating and Non- Participating Providers will now be required to submit claims directly to Medicare for Medicare beneficiaries, or may be subject to a civil monetary penalty of up of $2,000 for each violation, Wi th this new change, the volume of Medicare billing will increase substantially and a part time person will be needed to assist in billing Medicare, Also, because of this change, Medicare billing will go up from 210 to 1140 for ambulance bills, The amount of returns involved in filing for Medicare payment for 1140 claims is approximately $102,600. This is based on a conservative estimate of $90,00 per approved claim. If the City does not bill Medicare, it faces a loss of over $100,000, plus there is an additional fine for every time it is not done, if the patient requests that it be done. The City of Arcadia operates a self-funded ~orkers' compensation program and requires the services of a competent third party administrator to handle the day to day operations of the City's system. Colen & Lee have successfully guided the City's complex workers' compensation program since 1985. They also assure that the City maintains compliance with the requirements of workers' compensation law. The City currently budgets $27,300 for this third party administration of its workers' compensation program with Colen & Lee, The City has received a request to increase that fee up to $60,900 (123% increase), mostly due to the requirements of the workers' compensation reform act and in part to the increasing claims of the City of Arcadia. Councilmenber Harbieht noted that Council is looking at a significant increase with this request. He is curious about the reason for the expected f~fty-some percent increase in elaims, Alex Mclntvre, Assistant to the City Manager then introduced Garv Lee, of Colen & Lee who stated that as of this date the City has incurred over one hundred claims for the past fiscal year, There are a lot of reasons why, A lot has to do with employees' awareness of the system, increase in advertising by attorney firms, etc., encouraging people to file claims. The new law has new notice requirements by which people must be advised of their rights and benefits and this has encouraged people to pursue claims, These people are all City employees, There was major legislative reform last year in September which took effect January 1 of this year, and as a result of that reform, there are more stringent reporting and administration requirements which require Colen & Lee to file approximately twice as much paper work, Also the deadline times have been shortened, This resulted in a staff increase of 60% Patti Blum, 235 Hillgreen Place, stated, in part, that, speaking as an employer, under new Workers' Comp. regulations, if an employee reports an injury requiring, perhaps, only a bandaide and this is not reported, and the employee later files a claim, the employer can be fined $1000, Employees are aware of these regulations. 6/19/90 -3- Sister City Comsn. Councilmember Gilb noted that the $300 increase for the Sister City Commission is to cover increased dues and registration fees, etc, at international cities meetings; the members pay their own travel expenses. AYES: Councilmembers Ciraulo, Fasching, Gilb, Harbicht and Young None None NOES: ABSENT: BOARDS AND COMMISSIONS At the meeting of May 15, 1990 the City Council authorized the Library Board to have the City Librarian solicit proposals from library building consultants and architects for the purpose of completing a library building program proposal, This process is necessary in order to complete the application for State funds provided under the California Library Construction and Renovation Bond Act (Proposition 85), After reviewing the proposals received by the Library, the firm of Charles Walton Associates was considered the most suitable for this purpose, They have had experience in designing libraries and have a library consultant on their staff. Kent Ross, Head Librarian, replied to a question from Councilmember Fasching that the money being requested here was not just for the purpose of filing the application with the State; this work is necessary to start the process of the addition to the Library, This is a study to determine the I best alternative as far as the kind of addition or structure, and the best possible solution to the Library's current shortcomings, This would have to be done whether or not the Library applied for the funds from the State, At that time the City Council would either approve or disapprove of the proposals. AYES: Councilmembers Ciraulo, Fasching, Gilb, Harbicht and Young None None NOES: ABSENT: AUDIENCE PARTICIPATION Tom LeVeoue, 250 West Huntington Drive, representing the Police Relief Association, Also present were Corky Nicholson, representing the Arcadia Miscellaneous Employees, Dave McVey and Randy Carter, Public Works,and Dave Hutchinson from the Arcadia Firefighters' Association. Officer LeVeque stated they are here tonight representing the 291 employees, bo~h active and retired, using the City medical coverage under the indemnity plan, In the past two calendar years, the employees have suffered a 64% increase in the medical insurance premiums. On the average, this amounts to a $220 increase in deduction from pay checks on a monthly basis, They do not feel that the non-management employees should be solely 1 responsible for this very large increase and many cannot afford it, The largest percentage of the increase has been applied to those employees receiving family coverage, In addition to trying to support the family, these personnel are faced with the entire 64% increase, The reason for appearance here tonight, representing the respective employee groups, is simply to ensure that Council is aware of the impact that this increase has had upon the employees and that they are fearful 1 . 6/19/90 -6- I 1 '-- 4. 5. Scott Downie, 1104 Rancho Road, stated, in part, with regard to the Workman's Compensation Program and the Medical Billing, perhaps the City should check with neighboring cities to find out how they are coping with this situation. Perhaps there could be some type of consolidated billing, Also he congratulated City Manager George Watts on his election as President of the San Gabriel Valley City Managers' Association. Perhaps there could be some input regarding these problems from that organization, too. The City Manager replied that there are forces in effect that cities or even groups of cities can do very little about. Rising medical costs are a factor; some abuse of the system is another, The City Attorney noted that the whole Workers' Comprehensive system could be turned around by the legislature. Ed Zareh, 1051 Catalpa Road, stated, in part, that he is present to inform Council, in case they are not aware of it, that Caltrans is having a meeting with regard to the new lane to be added to the 210 Freeway from Pasadena to Sunflower, The meeting is July 19, 1990 in Glendora, Caltrans would like to have input from the area. He distributed copies of the agenda to Council. He wondered what statements Council might have for Caltrans, Since we have tried for so long to get on the list for future construction of sound walls, perhaps this is another opportunity to communicate this to Caltrans, The City Manager noted that his office had received a notice of the meeting and intended to so inform Council this week, The City will send a representative to attend. Mr. Zareh reviewed the past efforts of his committee and the City to convince Caltrans to move ahead with the construction of sound walls. CITY COUNCIL RECESSED IN ORDER TO ACT AS THE ARCADIA REDEVELOPMENT AGENCY PRESENT: Agency Members Ciraulo, Fasching, Gilb, Harbicht and Young ABSENT: None On MOTION by Member Harbicht, seconded by Member Gilb and CARRIED the minutes of the meeting of June 5, 1990 were APPROVED. On September 5, 1989, the Agency authorized and directed staff to begin negotiating the acquisition of the property located at 154 E. Huntington Drive, The Agency and owners were unable to come to an agreement and the Agency therefore adopted a Resolution of Necessity on November 7, 1989, The Agency's lawsuit was riled on December 16, 1989. However, the Agency and owners continued to negotiate and recently reached ag,<eement concerning the property, The agreed price is $54,'>,000 ($40.00/sq, ft.) and is within the Agency's established negotiating range, It was then MOVED by Member Gilb, seconded by Member Fasching and CARRIED on roll call vote as follows that the Arcadia Re~evelopment Agency accept the Zahir/younaei asking price of $5~,OOO for the property located at 154 E. Huntington Drive and authorize and direct the Executive Director to execute all documents necessary to finalize the transaction. W.O. 689 - Robert Brkich Construction) C9/~--9o W e (n \'~ 32:0147 NOES: None ABSENT: None On May 7, 1990, the Agency solicited requests for bids for an asbestos survey of Agency owned properties within the Northwest and Southwest Corner Project Sites, In response to the RFP, the Agency has received five asbestos survey proposals, These are summarized in staff report dated May 1, 1990, Asbestos surveys are now a required part of any demolition planned within the S.C ,A.Q.M,D,' s jurisdiction, If asbestos is found, the proposed demolition specifications must include instructions for handling and processing the asbestos during the elearance process, The Agency's Phase I Envirorunental Assessment, done by McLaren Envirorunental Consultants, indicates that a number of properties within the Southwest and Northwest Corner Sites may have asbestos which will need to be abated as part of the site clearance, The proposals are in two sections; 1) Sampling/Testing/Report and Specification Preparation, and 2) Asbestos Abatement Monitoring. I It was then MOVED by Member Fasching, seconded by Member Gilb and CARRIED on roll call vote as follows that the Arcadia Redevelopment Agency enter into a contract with the low bidder, Tri-Angle Core of Consultants, Inc, , Huntington Beach for asbestos sampling, testing and monitoring services for the Northwest and Southwest Corner Projects. Said contract to be in a form and content approved by the Agency's' General Counsel, AYES: NOES: ABSENT: Members Ciraulo, Fasching, Gilb, Harbicht and Young None None The meeting adjourned to 7:00 p, m" July 3, 1990. CITY COUNCIL RECONVENED CONSENT ITEMS Councilmember Harbicht stated that he would like to have a discussion of Item 7a. Apparently there is a new State law which requires that the expiration date of a contractor's license must appear clearly on any bid submitted. Councilmember Harbicht inquired if the City could not just ask the contractor about the expiration date and make it into a valid bid. Staff replied that the information has to be written on the bid itself. One of the problems here is the fact that the bids are sealed; the only thing the City Clerk can do is remind the contractors of this requirement because the bids cannot be opened until the appointed time, Councilmember Harbicht inquired if, because the low bidder neglected to write the expiration date of the license, it will cost the City $13,000 to go to the next low bidder, Staff replied that was true, The City Attorney stated that this is probably a transitional problem, This new law became effective in January 1990 and the State Contracting Licensing Board, as far as he can determine, failed to get the word out to contractors. Now that contractors are recognizing this problem, and Arcadia is not the only city finding itself in this situation, they are becoming educated for their own benefit, The way the law is stated, it is a mandatory type of provision; the City could be penalized, No notice has been received that waivers will be allowed, The Public Works Department made contact with the Contracting Licensing Board, but received no good adviee on this matter. The Public Works Director noted that the other contractors could also take legal action if the bid were to be accepted without this expiration date requirement. The bid forms are being amended 1 6/19/90 -8- 32:0148 to show this as a requirement, Hopefully, this will not happen again, If the job were to be re-bid, the bids could possibly be higher. Councilmember Harbicht noted Council should go ahead and approve this and suggested a letter be written to the State representative, REJECTED low bid submitted by Kingdom and Sons and AWARDED contract in the amount of $155,375 to Robert Brkich Construction for Waterline Replacement Project - Michillinda Avenue from Foothill Boulevard to Orange Grove Avenue - W. 0, 689; all informalities in the bid or bidding process to be waived, and the Mayor and City Clerk AUTHORIZED to execute a contract in a form approved by the City Attorney. 7b. <? ,)~ '7 TEMP. The low bid submitted was found to be non-responsive and must be rejected as it does not comply with the State law regarding license statements required on public works bids. The second lowest bid submitted is 28% over the engineer's estimate. The difference between the low bid and second low bid is too great to justify an award, of the contract. MATTERS FROM ELECTED OFFICIALS Councilmember Fasching stated, in part, that he considers the Boards and Commissions and the people who serve on them to be very important to the City, He realizes that he knows very few of the people for whom he has resumes, Perhaps these reappointments are treated too casually. Perhaps some thought should be given to a personal interview, Mayor Young noted that it has been her experience in the past that consideration has been given to many things, i, e" how active they have been, attendance, etc, Those items were not pertinent this time, so there was nothing to discuss, Attendance, however, is not the only criteria, It was noted that the Councilmembers serve on the Boards and Commissions, too, and they get to know the members, Councilmember Fasching noted that he was comfortable with the Commission members appointed, but as he looked at the resumes of others, some of them havb very good credentials. Councilmember Gilb reiterated that Mrs, Hopp had excellent credentials and background for appointment to the Sister City Commission, Councilmember Fasching noted that perhaps Council should take a look at some of these other candidates, Perhaps Council should reevaluate its selection system, Mayor Young said she thought it has worked all right; there have been instances where people have had excellent resumes, but have not performed well on the Commissions. Councilmember GlIb noted that at one time, all potential Commission members were interviewed by Councilmembers; this was very time-consuming, Wished the City Manager a Happy Birthday. "I would like to close the meeting in memory of Donald George Ott, We used to see Mr, Ott every Christmas at the Police Department Christmas breakfast, He was the beloved father of Sergeant Donald L. Ott at the Analope Valley Station of the Sheriff's Department, He passed away at 7:00, Saturday, June 9 after a lengthy illness, Mr. Ott was an Arcadia policeman and became the Chief of Police in 1935, Actually he WaS the Chief of Police from March of 1935 to August of 1938 and then again from June of 1939 to August of 1942, He served the City -10- 6/19/90 1 ,I 11.
