ADJOURNED REGULAR MEETING
SEPTEMBER 4, 1990
.The City Council and the Arcadia Redevelopment Agency met in
an Adjourned Regular meeting at 7:00 p. m., September 4, 1990,
in the Conference Room of the City Hall Council Chambers.

Councilmember Harbicht
It was MOVED by Councilmember Gilb, seconded by Counci1member
Ciraulo and CARRIED, that Councilmember Harbicht be EXCUSED.
Correspondence received from the City of Paramount urging
Arcadia's voting representative to the League of California
Cities September 6 meeting to vote in favor of a resolution
regarding Municipal Superfund Liability. As background
information, staff reported there are current lawsuits against
many of the cities who, years ago, had their trash hauled to
the landfill in Monterey Park; pollution has since been found
there and, as a consequence, there have been lawsuits back and
forth. The industries who have been held responsible for the
cost of cleaning up the pollution at the landfill have, in
turn, sued some of the cities, not just the operators and the
refuse haulers, but the cities who had their trash taken
there. The resolution is to support legislation that would
prohibit cities from being liable for their refuse operators
disposing of waste in various dumps. Staff recommended that
Council support this resolution. As Arcadia's representative,
Counci1member Gilb will vote in favor of the resolution at the
September 6 meeting.
Staff reported that the railroad bridge at Second Avenue and
Huntington Drive is currently being painted and the brick work
on the abutments will soon follow.
The City Manager requested a Closed Session before the Regular
Meeting this evening.
At 7:05 p. m., the Council ADJOURNED to the Closed Session.
The Adjourned Regular Meeting RECONVENED at 7:17 p. m.
Councilmember Fasching questioned the retention of Cal-Surance
as the City's insurance broker to develop and implement a
Section 125 . Flexible Benefit Plan at a cost of $1,000 per
month. He noted that the City would actually be paying Cal-
Surance $1,000 as a broker to sell the insurance to the City.
Further, since they have been the City's insurance broker
since 1983, has the City ever given any other broker the
opportunity to present a program? Staff explained that Cal-
Surance will be paid a commission as a
consultant/administrator and they will also take a commission
on the insurance that they sell. Further, no other brokers

were interested or could compete with this company. Arcadia
is with a consortium of cities who have gotten together to use
this broker/administrator/consultant and also the Pacific
Mutual insurance plan which was less expensive than anything
else on the market at that time. Further, in reference to the
Flexible Benefits Plan, in the end, the City will be with
Pacific Mutual as the on-going administrator of the new
program and as part of that, Pacific Mutual may recommend
various types of additional insurance benefits to the
employees that they may take advantage of ... at that time,
the City can select what is wanted in the package. In the
discussion it was noted that the City's health insurance costs
have risen dramatically because of our recent history with two
catastrophic illnesses and the resulting costs.
