The City Council and the Arcadia Redevelopment Agency met in
a regular session at 7:40 p. m., November 20, 1990 in the City
Hall Council Chamber.

On MOTION by Counci1member Ciraulo, seconded by Counci1member
Fasching and CARRIED, the Minutes of the Adj ourned and Regular
Meetings of November 6, 1990 were APPROVED. Counci1members
Gi1b and Harbicht ABSTAINED since they were not present at the
November 6, 1990 meeting.
It was MOVED by Counci1member Ciraulo, seconded by Council.
member Gi1b and CARRIED, that Ordinances and Resolutions
be read by title only and that the reading in full be WAIVED.
Mayor Young introduced members of Boy Scout Troop No, 140
present in the audience this evening.
PRESENTATION
Mayor Young presented a Proclamation declaring the week of
November 18 . 25, 1990 as Arcadia Family Week to Mrs. Le Anne
Hutchings, Southern California Coordinator for the Great
American Family Program. Mrs. Hutchings accepted the
proclamation with appreciation and noted that Arcadia Mayors
have issued such a proclamation now for the past twelve years
and they are deeply grateful for this cooperation. Mrs.
Hutchings also announced that copies of the proclamation would
be distributed to the church, community and school officials
present tonight.
CITY ATTORNEY
The City Attorney announced that, "pursuant to Government Code
Section 54956.9(a) the City Council met this evening in a
CLOSED SESSION to discuss the current law suit of Brkich vs,
City of Arcadia".
Scott Sullivan, representing the Arcadia Music Club, was
present to say that the 37th West Arcadia Annual Band Review
was held the preceding Saturday. Over 10,000 students from

various high schools participated. He and the Music Club
together with Rick McGrath, co-chairman with Scott Sullivan,
thanked the City of Arcadia, the Police and Fire Departments
for their fantastic support,
The Planning Commission at its November 13, 1990 meeting voted
5 to 0 to adopt Resolution No. 1447 recommending to the City
Council approval of the Revised General Plan for the City of
Arcadia with some specific changes. The Revised General Plan
contains the Land Use; Circulation; Housing; Open Space and
Conservation; Parks and Recreation; Safety and Noise Elements.
It also includes a discussion of the City's Spheres of
Influence. There have been several amendments to the General
Plan since it was adopted in 1972; however there have been no
major revisions to any of the elements with the exception of
the Housing element which was amended in 1981. The "Public
Facilities" and "Community Design" elements which were set
forth in the 1972 General Plan are no longer required elements
and have been incorporated into the revised "Land Use
Element". The "Scenic Highways" element is also no longer
required and has been eliminated because there are no
designated scenic highways within the City. Each element of
the General Plan sets forth objectives, policies and action
programs. The action programs are not detailed regulations
and are not law. Action programs are implemented as a result
of changes to the zoning regulations, subdivision regulations,
etc. The General Plan, zoning and subdivision regulations all
deal with the private uses of land. The General Plan,
however, sets forth only broad categories for general areas
of the City. The City's zoning ordinance, the official zoning
map and the subdivision regulations are specific and detailed
legislation which are intended to carry out the general
provisions set forth in the General Plan.

The Revised General Plan achieves the following: 1) It
r.educes the number of separate elements by incorporating
common issues into one document; 2) It presents each element
in a common format; 3) It updates the contents of the
previously adopted elements and of the Housing Element,
amended in 1981; and 4) It achieves a general plan that in
written statements and illustrations communicates to the
community the City Council policies on future development
within Arcadia. The Planning Commission's recommendations are
outlined in detail in staff report dated November 20, 1990.
The public's comments are also detailed in this staff report.
As required by State law, a copy of the approved Housing
Element will be forwarded to the State Department of Housing
and Community Development upon adoption by the City Council.
A Negative Declaration has been prepared for the Revised
General Plan.

Mayor Young declared the hearing open.
Alvin A1be, 458 W. Palm Drive, stated, in part, that he is in
favor of adoption of the Revised General Plan by Council and
feels that it is a good idea that it has been updated and
that it should be updated at least once a year. He suggested
it should be noted in the General Plan that the City has
sufficient population and an overall statement that the City
Council intends to discourage continuing growth.
It was then MOVED by Councilmember Harbicht, seconded by
Mayor Young and CARRIED that the public hearing be CLOSED.

Councilmember Harbicht commented, in part, that generally he
is in agreement with the Planning Commission recommendations
of changes to the Revised General Plan with the exception of
that of rezoning commercial zones to residential. He would
b~ willing to include the other suggestions. Also perhaps in
the Goals and Ob1ectives section some statement could be
included to the effect that the Council's goal is to stabilize
the population and to discourage growth as a guiding statement
in terms of considerations of rezoning, etc. In response to
a question from Counci1member Gi1b, staff replied that the
suggestion to rezone commercial to residential was made by
Planning Commissioner Hedlund, as an example, with regard to
the President's Square site, which has been vacant the past
couple of years. Counci1member Gi1b was not in favor of this
suggestion. Further, he would support Counci1member
Harbicht's thought to stabilize growth, and to remove from the
Goals section the rezoning of commercial areas to residential.
Counci1member Ciraulo and Mayor Young agreed with
Counci1member Harbicht's suggestions. Mayor Young does not
want to rezone anything to residential. Counci1member Fasching
agreed and noted that the suggestion that construction be
harmonious and compatible in size and design with existing
houses in the area has been an ongoing concern of the Council.
The items regarding the School District perhaps should be
e~p10red by Council. As to the construction of an auditorium
on the Armory site, he is not sure that is necessarily the
place for an auditorium ... he thinks of the auditorium issue
as related to our school children. Further, Counci1member
Fasching feels that an outstanding job has been done on this
Revised General Plan.
It was then MOVED by Councilmember Harbicht, seconded by
Counci1member Gi1b and CARRIED on roll call vote as follows
that staff be DIRECTED to prepare a Resolution setting forth
Council's findings and recommendations for adoption at the
City Council Meeting of December 4, 1990. This to include the
recommendations of the Planning Commission with the exception
of those mentioned and with the addition of the goal to
stabilize population.

Counci1member Harbicht commended the Planning staff and
Planning Commission for a very nice job on a difficult task.
This hearing has been scheduled pursuant to Section 9407 of
the Arcadia Municipal Code to allow the City Council to
determine whether a public nuisance exists and what action is
necessary to abate the nuisance on property located at 415-
417 South Second Avenue. As per the Secti'on 9407, a "Notice
of Public Nuisance and Order to Abate" was mailed on October
30, 1990 to Chris Vance, responsible person, for the property
located at 415-417 South Second Avenue. A notice was also
posted on the property on the same day. Staff report dated
November 20, 1990 lists in detail the violations cited on the
property and details the history dating from August, 1988 of
the efforts of the City to abate these violations. Staff
noted the report lists as a violation on the property, that
thre is a vehicle parked and stored on an unpaved area
(gravel). This statement is incorrect the area in
question is paved.

Chris Vance, 417 South Second Avenue, stated in part in
reference to his eight page letter which had been presented
to the Counci1members on this date. He noted that some of the
items outlined in the letter are important enough to him to
go to court over. With regard to the question of landscape
maintenance, he feels that conformity has some constitutional
questions he does not intend to concrete - over his
property. Also, he feels there are extreme health and safety
violations occurring in the City which the City has not tried
to abate. Apparently this is done only upon receipt of
complaints. He is in agreement with Items 1, 2, and 3, page
4 of the staff report dated November 20, 1990. He will not
agree to the landscape maintenance issue as far as the
conformity business he believes this to be a
Constitutional issue that should be explored.

The City Attorney stated that he "would like to add that your
letter has been received and will be considered part of the
record for this evening's hearing".
Insoector Hutchinson, Arcadia Fire Department stated, in part,
that the most recent inspection of this property was done this
afternoon. There has been some work done, but from the Fire
Department's standpoint, not enough. The violations pointed
out in the staff report still exist. The main fire hazard has
to do with the combustibles stored in and around the property
and structure. The Fire Department would like to see the tree
cover and shrubbery cut back; there is also an abundance of
weeds around the house. If there should be a fire at this
property, the Fire Department is concerned about exposure to
other nearby properties.
Chris Vance, 417 South Second Avenue, responded that,
according to the City, all he has to do to satisfy this is to,
basically, screen this off. In reply to question from
Counci1member Fasching, Mr. Vance replied that most of the
belongings stored in the cartons mentioned were the property
of Eileen Stevens, who has had to move out of her own house
recently. He also noted that the truck was operable.
It was then MOVED by Counci1member Gi1b, seconded by
Counci1member Harbicht and CARRIED that the public hearing be
CLOSED.
Counci1member Gilb commented that this situation has not
gotten any better, There have been a lot of complaints about
this property. Further, Council had decided some time ago
that in order to get some action on some property maintenance
problems, this procedure would be the way Council would have
to do it.
Counci1member Gi1b then MOVED to ADOPT Resolution No. 5557,
"DECLARING A PUBLIC NUISANCE AND ORDERING THE REHABILITATION
OF REAL PROPERTY LOCATED AT 415-417 SOUTH SECOND AVENUE,

This gift to be used to purchase a copy machine for use by the
Library staff. This gift is accepted with the appreciation
of the City Council and a letter of commendation is to be sent
to the Friends of the Library.

Funds have been budgeted in the 1990-91 Capital Budget to be
used for the maintenance and improvement of facilities used
by local baseball leagues. The leagues have agreed to
purchase all needed materials and provide all necessary labor
and equipment to complete the various projects. In order to
help defray the costs of the improvements, the leagues have
made the following requests: National Little League - $1,700.
- Longden Ball Field; Santa Anita Little League - $1,700. -
Eisenhower Park; Coast Little League - $1,700. - Hugo Reid
Primary; Arcadia Pony/Colt Baseball, Inc. - $2,500. - Bonita
Park; West Arcadia Little League - $4,100. - Baldwin Stocker
and Longley Way, (This includes $2,400 originally budgeted for
Wilderness Park. Renovation of bleachers at Baldwin Stocker
is a priority item.)
It was MOVED by Counci1member Harbicht, seconded by
Counci1member Fasching and CARRIED on roll call vote as
follows that the requests by local baseball leagues for
financial assistance, outlined in detail in staff report dated
November 20, 1990, be APPROVED for a total amount of $11,700.

Bob Henkel, 1065 Singing Wood Drive, Chairman, Architectural
Review Board, Rancho Santa Anita Property Owners' Association,
stated, in part, that they have been asking the City to
consider a tree-saving ordinance. About a week and a half ago
six oak trees on one piece of property were lost. These
ranged in size from thirteen to thirty-six inches. These were
valuable trees -- two of them on the endangered species list.
We are in a fortunate area in that we do have all these oak
trees ... we should start preserving them instead of letting
people cut them down. The trees were all in very good
condition. This occurred on a Monday which was a City Hall
holiday. Apparently Don Crenshaw, the Architect, had told the
property owner what the requirements are with regard to these
trees; they were cut down anyway. He has been informed that
this same thing has happened in other areas.
In reply to a question from Councilmember Gilb, the City
Attorney said he has not seen all the ordinances that have
been developed to mitigate this problem, but probably they
would provide a series of different types of remedies, most
of which would probably fall short of putting the property
back in the state it was initially. There could be fines,
criminal penal ties, requirements, perhaps, for replanting,
replacement, etc. Mr. Henkel said that in San Marino they
have fines and replacement of like size. However, he
understands that a large oak tree only lives 10 - 15 years
after being moved, so smaller trees need to be replanted.

Rebecca Fisher, 553 E. Woodbury Road, A1tadena, representing
the California Native Plant Society, stated, in part, that
.this Society is involved in protecting native species. One
of the trees destroyed was an Engleman oak which is one of the 0
rarest oaks in California which they feel deserve special
status. The Society counted these oak trees about a year ago
and this is one of the largest and most significant
populations of Engleman Oaks in Los Angeles County, almost all
of them are located on private property. They try to
encourage the preservation of these trees. as well as
replanting. The City of Arcadia, in a sense, has a
responsibility to see that these trees are protected. The
trees live an average of 50 - 80 years. She left literature
about oak trees and ordinances involving them for Council.

Anita Property Owners' Association, stated, in part, that the
owners of the property under discussion are currently and have
been living in this Association area and should be aware of
the position on trees, and that permission is necessary to cut
them down. This information has gone out to every member of
the Association. The trees were very healthy and had been
maintained very well. She would like to see these trees
replaced with similar trees. Counci1member Gi1b noted that
a resolution had been passed in 1986 listing the trees that
could not be cut down without the permission of the
Architectural Board. Mrs. Draper said the Association has a
credibility problem if they tell one owner he cannot cut down
trees; while another cuts them down without permission. They
should have to replace a tree of the same species and the same
size, Counci1member Gi1b said there should be some kind of
penalty if they are pass a new ordinance.
Bud Kurwa, 1035 Singing Wood Drive, stated, in part, that he
is a relatively new owner of the property. The work was not
done by the architect. He was not aware of the information
sent out by Mrs. Draper. Nor was he aware that there were
ordinances against the cutting of the trees. He had been told
that the trees were replaceable. He apologizes for not going
to the Architectural Review Board and Council for permission
before doing the job. He will cooperate with what ever needs
to be done to replace them.
Scott Downie, 1104 Rancho Road, stated, in part, that he
wondered how many police would have to be hired to supervise
such an ordinance. Also the citizens would have to be told
about such an ordinance. He recently took down a tree that
had died. His surrounding neighbors probably did not know
that the tree had died and had to be taken down. By the time
Mrs. Draper had noticed this other incident, it was allover.
People have to be educated.

Lorraine Fricke, 836 Murietta Drive, stated, in part, that she
feels an ordinance should be bought in regarding the saving
of the trees. Last year the Arcadia Beautiful Commission
called in an Asian group that did not like the trees on their
properties. The Commission addressed the Chinese organization
and told them how the City and the Commission feel about the
trees. A notice was to have been put into the Chinese
newspaper to let them know about this. She does not know how
or if they have followed through on this.

At this point Council discussed measures that could be taken
to remedy this problem. It was them MOVED by Counci1member
Ciraulo, seconded by Councilmember Gilb and CARRIED by general
consent, that staff be DIRECTED to look into this matter, talk
to people at the Arboretum if necessary, and to Mrs. Fisher,
and draw up an ordinance taking into consideration all of
these different things and perhaps include some sort of a

penalty clause for Council's consideration. This could
perhaps be publicized in the Arcadia Tribune, Arcadia
Newsletter and by the home owner associations. Counci1member
Gilb said staff could get copies of ordinances from other
cities. Counci1member Fasching suggested a special mailing
outlining such a tree ordinance might be made to all the
residents. It was suggested that other trees than oak trees
be included. Staff replied this might mean different
ordinances. 'It was suggested that perhaps trees of a certain
diameter might be included. Staff to bring back a report.

AWARDED purchase order in the amount of $77,353.14 to Maurice
J. Sopp and Sons Chevrolet for the purchase of six police
patrol vehicles. The Purchasing Office has permission from
the County of Los Angeles and Sopp and Sons Chevrolet to
purchase vehicles from the County contract (Reference S-146),
which results in considerable savings to - the City,
APPOINTED Bill Kern as Trustee representing the City of
Arcadia on the San Gabriel Valley Mosquito Abatement District
Board of Trustees for period from January 2, 1991 to January

APPROVED and RATIFIED settlement of workers compensation case
involving recently retired employee, L. Wingenbach, in return
for a full Compromise and Release from Mr. Wingenbach.
Settlement in this case is in the amount of $41,720.
RESCIND. VACATE, and otherwise NULLIFY the City decision of
July 3, 1990 approving a Reclamation Plan for the Rodeffer
Quarry, subject to the following conditions: 1) The existing
certificate of deposit now on file with the City pursuant to
the City's action on the existing Reclamation Plan, shall
remain on file with the City as a guarantee that Rodeffer will
file a Reclamation Plan for the City's review and action
within one year of the date of November 15, 1990. Rodeffer
is to agree that the City is not barred from requiring
additional financial security with reference to conditioning
the proposed Reclamation Plan, or any other requirement
consistent with State SMARA Regulations; 2) That a
Reclamation Plan will be filed within one year as set forth
in #1 and that this process will be completed regardless of
whether or not a request. or permit to reclaim the site and/or
a conditional use permit is filed with the City and regardless
of whether any such permit process is completed; 3) The
City's recession action is subject to nullification and shall
be deemed of no force and effect if the State Mining and
Geology Board or any other State Agency or Department takes
any action contesting the City's recession action and these
terms and conditions; and 4) All quarry operations must cease
at the Rodeffer Quarry site until a new Reclamation Plan is
approved.

At the request of Councilmember Fasching, discussion ensued
among Council of staff report dated November 20, 1990 and the
various alternatives, advantages and disadvantages as well as
cost of each, in an effort to determine the most efficient and
economical method of graffiti abatement, Councilmember
Fasching felt he would rather augment City staff with two
additional employees for grafitti removal plus other
maintenance duties, as opposed to hiring an outside
contractor. Councilmember Harbicht said this is a blight_and
the City must act and should allocate the money to do so.
Councilmember Gilb noted the amounts of money that neighboring
cities are spending on this problem, Councilmembers agreed
that the problem will get worse and it must be addressed now.

It was then MOVED by Councilmember Harbicht, seconded by
Councilmember Gilb and CARRIED on roll call vote as follows
that Council AUTHORIZE staff to implement Alternative D (using
contractors hired by City through competitive bidding) (staff
report dated November 20, 1990); AUTHORIZE 100% of the cost
for graffiti abatement and removal to be incurred by the City;
and APPROPRIATE $20,000 from the Capital Outlay Fund for the
private property graffiti abatement program for the remainder
of Fiscal Year 1990-'91 to cover the cost of removal,
administration, inspection and contingencies.

At the request of Councilmember Fasching, discussion ensued
concerning possible methods of reducing commuter traffic on
Portola Drive. He is in agreement with staff recommendation
for directional arrows on Sunset Boulevard indicating that
traffic should proceed straight ahead. He suggested that a
sign indicating, "No Thru Traffic" be placed at the
intersection of Sunset Drive and Portola Drive, The City
Attorney noted that such signs are no longer approved by the
State and are therefore not legal, there are some liability
consequences. Although there is such a sign at the
intersection of Harvard Drive and Baldwin Avenue, it is not
enforced. Councilmember Harbicht said that perhaps Council
is over-reacting in this instance. Although the residents in
the area are concerned, in actuality the volume of traffic on
that, st,eet is low. He is in agreement with staff
recommendation.
It was then MOVED by Councilmember Harbicht, seconded by
Councilmember Gilb and CARRIED on roll call vote as follows
that staff be DIRECTED to implement Alternative 4 (staff
report dated November 30, 1990) at the Sunset/Portola
intersection as follows: 1) Continue the double yellow

present to suggest installation of a stop sign for westbound
traffic on Portola Drive at Cortez Road. Presently there is
a stop sign for eastbound traffic on Portola Drive, but none
on Cortez Road.

The City Attorney presented and read the title of Resolution
No. 5556: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA APPROVING AN AMENDMENT TO THE INDEPENDENT
CITIES RISK MANAGEMENT AUTHORITY JOINT POWERS AGREEMENT TO
PROVIDE FOR THE ADMITTANCE TO MEMBERSHIP OF THE CITIES OF
COSTA MESA, EL SEGUNDO, AND UPLAND AND DESIGNATING CITY
REPRESENTATIVES".
It was MOVED by Councilmember Gilb, seconded by Mayor Young
and CARRIED on roll call vote as follows that Resolution No.
5556 be and it is hereby ADOPTED.

Following a suggestion by Councilmember Gilb, Council agreed
that the first Council meeting in 1991 would be convened at
7:00 p. m., Wednesday, January 2, 1991.
At 9:07 p. m., the City Council ADJOURNED to 7:00 p. m.,
December 4, 1990 in the Conference Room of the Council
Chambers to conduct the business of the Council and Agency and
any Closed Session, if any, necessary to discuss personnel,
litigation and evaluation of properties.
