The City Council and the Arcadia Redevelopment Agency met in
a regular session at 7:45 p. m., December 18,1990 in the City
Hall Council Chamber.

On MOTION by Counci1member Gi1b, seconded by Counci1member
Ciraulo and CARRIED, the Minutes of the Adjourned and Regular
Meetings of December 4, 1990 were APPROVED.
It was MOVED by Counci1member Harbicht, seconded by
Counci1member Ciraulo and CARRIED that Ordinances and
Resolutions be read by title only and that the reading
in full be WAIVED, with the exception of Urgency
Ordinance No. 1928.
CITY ATTORNEY
The City Attorney announced that, "the City Council and
Arcadia Redevelopment Agency met in a CLOSED SESSION this
evening pursuant to Government Code Section 54956. 9(b) (1), due
to the opinion of the City Council based on legal advice that,
on existing facts and circumstances, it was necessary to
discuss a situation of significant exposure to litigation
against the City of Arcadia".
The Planning Commission, at its December 11, 1990 meeting,
adopted Planning Commission Resolution No. 1455 which
recommends approval of amending the General Plan Land Use
Designation from Single-family Residential (0-6 dwellings per
acre) to Multiple-family Residential (7+ dwelling units per
acre) for the properties at 44-50 Forest Avenue, 612-620 North
fi,st Avenue and 701-805 N9rth First Avenue. The existin.g R-
2 zoning of the property allows for single-family dwellings
and apartment units, but is not consistent with the existing
General Plan Land Use designation. The City cannot approve a
condominium form of ownership, although the buildings
themselves may be identical to an allowable apartment project.
Further, in order to develop condominiums, the State
Subdivision Map Act requires that a subdivision/condominium
be consistent with the City's General Plan. In reply to
a question from Mayor Young, staff replied that the area north

of the American Legion Hall, south of Foothill had previously
been changed to multiple-family designation General Plan Land
Use. The current zoning is R-2.
Mayor Young declared the hearing OPEN.
John Plount, Owner/Developer and Co-applicant with the City
of Arcadia Planning Department, was present to answer any
questions. He is developing property on the East side of
First Avenue and has plans to develop property on the West
side of Second Avenue. In reply to questions from
Councilmember Fasching, Mr. Plount replied that his engineer
and designer were working together to identify and maintain
everyone of the trees that can be maintained on the property.
He further replied that they planned to move ahead as soon as
possible and were optimistic about the future sales. In reply I
to a question from Councilmember Ciraulo, Mr. Plount stated
that they would like to proceed to develop the properties on
both the East and West sides of First Avenue beginning in the
latter part of the first quarter of 1991 and proceeding
through the year. Initially they were going to develop six
detached condominiums on the West side of First Avenue;
however, the scope is not defined at this time but they will
proceed to develop at least two of those houses shortly after
the desired approval. The nearby church will not be affected.
No one else desiring to be heard, the hearing was CLOSED on
MOTION by Councilmember Gilb, seconded by Councilmember
Ciraulo and CARRIED.
It was then MOVED by Councilmember Gilb, seconded by
Councilmember Harbicht and CARRIED on roll call vote as
follows that General Plan Change 90-001 be APPROVED; that the
Negative Declaration be APPROVED and FILED; and FIND that the
General Plan Change will not have a significant effect on the
environment and DIRECT the City Attorney to prepare the
appropriate ordinance.

This hearing has been scheduled pursuant to Section 9407 of
the Arcadia Municipal Code to allow the City Council to
determine whether a public nuisance exists and what action is
necessary to abate the nuisance on property located at 515 Las
Tunas Drive. As per the above mentioned Section, a "Notice
of Public Nuisance and Order to Abate" was mailed on November
27, 1990 to Alice Wang, owner of the property located at 515
Las Tunas Drive. A notice was also posted on the property on
the same day. The following violations have been cited on
the property: 1) Weeds and dead vegetation on the premises
and on the parkway; 2) OVergrown dry vegetation; 3) 'Lack of
adequate irrigation and overgrown vegetation which is out of
conformi ty with adj acent res idential properties; 4) All
trash, debris, discarded items (i. e. water heater,
appliances, etc.) shall be removed from the premises; 5)
Vehicles parked and stored on unpaved areas. The owner has
been cited six times and there has not been any significant
long term change on the site. Although some of the violations
can be handled through the abatement procedure, the problems
regarding lack of adequate irrigation and maintenance of
landscaping are not appropriate for the abatement procedure.
It is the Planning Department's opinion that on properties
where there are continued landscape maintenance problems, the
owners should be filed on for a misdemeanor and taken to

court. In reply to a question from Councilmember Harbicht,
staff responded that in a situation where there is overgrown
vegetation, a crew can be sent out to trim it, but planting
and maintaining a lawn is a different matter; if the property
were professionally landscaped, there is no way the City could
maintain it. Ongoing maintenance would more appropriately be
ordered by the courts.

Donna Butler, City of Arcadia Planning Department stated, in
reply to questions from Councilmember Ciraulo that somebody
has been living on the property for some time. There is no
sprinkler system; there is a hose that looks fairly new. Some
of the vegetation has been cut down, but there is no grass at
all in front of' the premises; the property has not been
maintained at all. There have been plans in plan check but
they have expired. The problem is that the City cannot force
people under the property maintenance ordinance to continue
maintenance. The nuisance abatement ordinance does not
provide the answer to the on-going maintenance issue either.
This is a constant problem that has been going on for two
years, The previous citations have been ignored. The City
Attorney noted that there have not as yet been any legal
citations in court, which would be in the form of a criminal
complaint. The City has given them notice and office
hearings have been conducted. The problem is that, with
regard to removing nuisance conditions, that is something the
City can do under abatement; but the affirmative act of
policing it by becoming, in effect, their gardner, putting in
irrigation, etc., is beyond the abatement process, If a
criminal complaint is filed and they plead guilty or are found
guilty then the Court will order them to do this as a
condition of probation. The complaint will probably be filed
within a week. Council's action tonight, if approved, will
be to abate and remove the conditions that the City can
correct through City staff or contractors.
Mayor Young declared the hearing OPEN.
Sen Sun~, 832 Padilla Street, San Gabriel, stated, in part,
that he is speaking for his sister-in-law who is the owner of
the property at 515 Las Tunas Drive. Mrs. Wang cannot handle
this problem, He stated they have been working on the area
there for ten days. They have started the irrigation and
purchased plants and seeds and they will take care of the
property regularly, They would like to have two to three
weeks to accomplish this. They'have rented a container to
take care of the trash; and they have made arrangements to
junk the two cars. Mayor Young noted that if Council passes
the Resolution tonight it would mean that the property has to
be maintained from now on. They will have thirty days to take
care of it accordinag to the resolution. .

No one else desiring to be heard, the hearing was CLOSED on
MOTION by Councilmember Harbicht, seconded by Councilmember
Gilb and CARRIED,
Councilmember Harbicht felt the resolution should be passed
with the 30 days incorporated therein; and that an action in
court should be filed, This situation affects the quality of
life of the surrounding neighbors and has been on-going for
three years, The City has been tolerant, The Court will
require that the property be maintained and if not, they will
be in contempt of court and there will be an automatic fine.
It was the consensus of Council that the public hearing be
REOPENED.
Councilmember Fasching called the attention of Mrs. Wang and
Mr. Sung to the pictures of this property, Also that in view
of the time that this problem has existed, and in

consideration of the' neighborhood and City standards in
general, that this cannot continue. A lot of work has to be
done. According to the Resolution, they have thirty days but
the City can file suit tomorrow. Mr. Sung agreed to resolve
the problem within;the next two weeks.
The hearing was then CLOSED on MOTION by Councilmember
Harbicht, seconded by Councilmember Gilb and CARRIED.
The City Attorney explained the steps whereby the City would
file a complaint in court to assure the rehabilitation and
ongoing maintenance of this property.
Councilmember Fasching then MOVED to ADOPT Resolution No.
5562: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, DECLARING A PUBLIC NUISANCE AND ORDERING
THE REHABILITATION OF REAL PROPERTY LOCATED AT 515 LAS TUNAS
DRIVE, ARCADIA, CALIFORNIA, AND PLACING A LIEN AGAINST THE
PROPERTY, IF ABATEMENT AT CITY EXPENSE IS REQUIRED". This was
seconded by Councilmember Harbicht and CARRIED on roll call
vote as follows:

In reply to a question from Councilmember Fasching, the City
Attorney explained in part that even if the owner puts the
property in acceptable condition within two weeks, dismissal
of the complaint depends upon assurance that they will keep
the property in good condition. If there is some doubt
remaining the City will hold fast on the criminal case and
insist, as a condition of sentencing after a plea is entered,
that the judge keep the owner on probation, which can be done
for a twenty-four month period. This is probably what the
City will endeavor to do in this case. Councilmember Harbicht
said he did not have any confidence at all that the owner
would keep the property in proper condition and that the City
should move ahead with the criminal complaint. Councilmember
Ciraulo agreed that they have had every opportunity to improve
the property and have not done so.
Consideration of a request from Joseph Takieddine on behalf
of the property owner, Ann Durandette, for a Building Code
Variance to permit a 4' -0" side yard setback in lieu of 5' -0"
required for an existing, recently constructed, aluminum
screened patio enclosure at 914 West Fairview Avenue. The
structural plans for the patio enclosure were approved and a
building permit issued on May 10, 1990. The plans consisted
of a copy of a set of standard plans, entitled "Screen
Enclosures" and a site plan. Details of the proposed patio
enclosure and the completed structure are set forth in the
December 18, 1990 staff report, On June 6, 1990 the final
inspection of the patio enclosure was made by a City inspector
who found that the structure was not built in accordance with
the approved plans, that it was built too close to the side
property line. On June 7, 1990 the Chief Building Official
contacted the contractor, Mr. Robert Hurth, informing him of
the problem. Mr. Hurth stated he would contact the property
owner and resolve the matter. In response to questions
from Councilmember Harbicht, staff responded that both the
wall and the overhang are problems; they both encroach one
foot beyond where they should be, and that the property line
is one foot beyond the fence.

Ann Durandette, 914 W. Fairview Avenue, #10, stated, in part,
that she had assumed that the contractor had build the patio
enclosure in accordance with the approved plans. After the
structure was built, this problem came up. Mayor Young noted
that the plans had been approved by City Hall based upon the
measurements given. Mrs. Durandette explained that if the
structure has to be altered, she will have a room that is 6'
x 13'. Councilmember Harbicht noted that it will actually be
l'x 13' because it has been determined that the fence is one
foot on her side of the property line. Councilmember Fasching
noted that what seems to be most offensive is the overhang of
the roof. Councilmember Harbicht noted that it would be
necessary to have a one hour firewall if it is within four
feet of the property line. In reply to a question from
Councilmember Harbicht, Mrs. Durandette stated that the
contractor is aware of this problem. To her knowledge at that
time, the contractor had done his job.
Josetlh Takieddine, Civil Engineer, 17758 Willard 'Street,
Reseda, stated, in part, that he is present to speak on behalf
of his client, Ann Durandette. Upon examining the plans, he
is of the opinion that the Planning Department approved the
plans without enough information on the plan. There was an
apparent discrepancy in the information given in the plans.
It is his opinion that the problem is with the roof rather
than with the wall; the plans do not show a two foot definite
eave width of the roof. He reiterated that the Planning
Department should have asked for more definite information on
the plans.
No one else desiring to be heard, the hearing was CLOSED on
MOTION by Councilmember Gilb, seconded by Councilmember
Fasching and CARRIED.
Councilmember Gilb said he believed when plans are drawn which
do not meet the requirements, they should be corrected.
However in this case, he feels this lady is the victim of the
builder, and he would like to see Council work out some kind
of variance for this one foot discrepancy. Councilmember
Harbicht said in part that when plans come to the City
submitted with measurements, it is assumed that these
measurements are correct. The City has not deviated from
normal practice. He does not think this mistake was
intentional. He would also like to grant a variance.
Councilmember Ciraulo felt that to cut back the overhang at
this point would serve no purpose. If a variance is to be
granted he would leave the patio enclosure the .way it is; he
is sympathetic with the granting of the variance.
It was then MOVED by Councilmember Gilb, seconded by
Councilmember Harbicht and CARRIED on roll call vote as
follows that Council APPROVE a variance to permit a four foot
sideyard setback in lieu of a five foot setback at 914 West
Fairview Avenue, Unit No 10.

The City Attorney presented and read in full Ordinance No.
1928: "AN INTERIM URGENCY ORDINANCE OF THE CITY OF ARCADIA,
CALIFORNIA, IMPOSING A MORATORIUM ON DEVELOPMENT OF
UNDEVELOPED HILLSIDE AREAS".
Councilmember Ciraulo was concerned that this Ordinance is all
inclusive within the moratorium area with no areas overlooked
or considered to be undevelopable which might become
developable in the future. Staff replied that 'might be
possible, but not likely. Councilmember Harbicht noted that
what is before Council is not the ordinance, but a moratorium
in a specific area, the purpose of which is to give Council
time to study the ordinance for the purpose of changing it,
and when it is changed it will affect any hillside area.
Staff also noted that it is unlikely for development to occur
before adoption of a final ordinance because there is no
access to the areas not specifically outlined in the
moratorium. It is Councilmember Harbicht's hope that Council
will make the hillside ordinance more stringent than it is
now.
It was MOVED by Councilmember Ciraulo, seconded by
Councilmember Harbicht and CARRIED on roll call vote as
follows that Ordinance No. 1928 be and it is hereby ADOPTED;
arid DIRECT staff to study and prepare a report and schedule
a public hearing.

MATTERS FROM STAFF
The City Manager stated that information had been given to
Council earlier this evening concerning donations made to the
City by the H. N. and Frances C. Berger Foundation. This
Foundation now has its headquarters in Arcadia at the old
Campus Medical Building. They have generously donated $76,450
to the Arcadia Police Department; $78,900 to the Arcadia Fire
Department for various items that were unable to be included
in this year's budget due to revenue constraints. In addition
8 check in the amount of $5,000 has been received for the
"rcadia Library for things that were not within the budget.
These donations were ACCEPTED with Council's grateful thanks
by Mayor Young, who said there should be a Council
presentation of this thank you if that can be arranged.

MATTERS FROM ELECTED OFFICIALS
Wished everyone a Merry, Merry Christmas and a wonderful New
Year, to all Council and staff.
Councilmember Gilb stated that he intends to support
Transportation Commission Candidate, Bill Thomson from the
City of Pasadena. If it comes to a second round vote and Mr.
Thomson is not in the running, he will vote for the person
he feels will do the City of Arcadia the most good.

Mayor Young replied they will leave it to Councilmember Gilb
to vote for the best person available.
Councilmember Harbicht said he had received a telephone call
from Mr. Ron Morris, a teacher from Arcadia High School,
regarding the Constitution Team. They have again won first
place in the 22nd Congressional District and are now going to
Sacramento to compete for the State Championship. They have
done this every year for the past four or five years. The City
of Arcadia has supported this effort in the past with a $500
contribution. He would like to see the City do this again.
Following advice from the City Attorney, it was MOVED by
Councilmember Harbicht, seconded by Mayor Young and CARRIED
on roll call vote as follows that Council find that the matter
of a donation to the Arcadia High School Constitution Team
travel expenses is an urgent matter and the need for it arose
after the printing of the agenda.

Councilmember Harbicht referred to correspondence between Mr.
Bluth and the City Engineer regarding his development in
Whispering Pines. He would like to publicly express his
support as a City Councilman for the actions of the staff in
this matter; they are entirely in the right. He also thinks
that Mr. Bluth has to understand that there is one set of
standards in Arcadia and they are the same for any citizen.
If Mr. Bluth does not like Arcadia's standards, he can develop
elsewhere.
Councilmember Harbicht brought up for Council's consideration
the question of whether or not Council wants four foot high
solid walls in front yards. His answer is "no, we don't".
He has no problem with a four foot high wrought iron fence or
some sort of open fence, but he thinks a four foot high solid
wall is not in keeping with the ambience of Arcadia. Perhaps
Council should consider revising the ordinance that a wall
could only be, perhaps, thirty inches or three feet high and
that an open fence could be as high as four feet. Council has
already recognized that six feet fences are not allowed in
front yards, although they are permitted in back yards. He
would be interested in Council's feelings on this.
Councilmember Ciraulo said that, from an aesthetic view, this
is true and he would agree. Further discussion ensued of the
height restriction of solid walls allowed by Code in front
yards. Councilmember Harbicht stated, in part, that he would
like to see staff come back to Council with a modification of
the ordinance limiting the height of solid walls in front

Councilmember Fasching, seconded by Councilmember Harbicht and
CARRIED on roll call vote as follows that the MOTION to place
the matter of a special newsletter on the December 18, 1990
City Council agenda be WITHDRAWN. '
