Councilmember Lojeski \ PRESENT: Councilmembers Chandler, Gilb, Harbicht, Lojeski and Young ABSENT: None - On MOTION by Councilmember Gilb, seconded by Councilmember Harbicht and CARRIED, the Minutes of the adjourned ~nd regular meetings of September 16, 1986 were APPROVED. \ It was MOVED by Councilmember Lojeski, seconded by Councilmember Harbicht and CARRIED that all ordinances and reso,lutions be" read by title only and 'that the reading in full be waived. PRESENTATION Ms. Donna Woods, PTA Council President, expressed PTA appreciation to Mayor Young for proclaiming the month of October as Membership Month for the PTA. She urged all Arcadians to become members of the PTA and urged Councilmembers to join the PTA if they were not already members. PTA is celebrating its 90th birthday and is an elete membership of five million people. Applications were circulated. CITY ATTORNEY The City Attorney stated that, pursuant to the Ralph M. Brown Act, Section 54956.9(a), the City Council and the Redevelopment Agency met in CLOSED SESSION to confer with the special legal counsel for eminent domain proceedings in'the matter of Arcadia v. Bong. Appeal by Richard Virgin, Vice President of Virgin Roof Compary, of the Santa Anita Oaks Architectural Review Board's denial of roofing material (Celotex Dimensional III Fiberglass Shingles) at 284 Hacienda Drive.' The appeal was considered at the Planning Commission meeting of August 12, 1986, but the Commission was unable to obtain the four votes to make a decision and the matter was referred to the City Council. Staff report presented. Councilmember Lojeski requested an explanation of the permit process. Staff replied that on occasion permits are mailed back to the City, as happened in this instance. 10/7/86 -1- IN FAVOR OPPOSED 29:0023 Mayor Young declared the hearing open. , James Cross, 284 Hacienda Drive, stated, in part, that he had, not known about the requi rement to go to' the Arch i tectura 1 Revi ew Boa rd. The roof was put on before the permit was issued by the City. However, it is a hi gh-qua 1 i ty neutra 1 gray, fi re-proof roof and conforms to City; ordinances. The house is one of the first houses built in the' area and is a different type house than most of the others. The neutral gray roof looked well on the structure. Also the house is completely surrounded by trees and is not visible to neighbors or from the I street. It is neither excessive nor garish. Is compatible with the type of house which is a two story California house. It would , look strange to put a shake roof on such a building. The Architectural Review Board made no allowance for this or for the fact that the roof meets the City standards. The Board mentioned that it would lower property values and he has not seen any evidence of this. Council member Lojeski inquired if he had read the deed restrictions which mentioned requirement for an Architectural Review Board. Mr. Cross said perhaps he had many years ago but did not remember. He said he had owned the house 27 years.. Nancy Rose, 280 Hacienda Drive, stated, in part, that she is a neighbor and lives next door and that from her property she cannot see any part of Mr. Cross' roof.\. Does not think it is a detriment to the ,neighborhood. She had put a new roof on her house recently and knew what had to be gone through to get these approvals. The details were handled by the contractor. Generally, she is in agree- ment with the rules and regulations of the Review Board, but not in this case. The roof is fire-proof and cannot be'5een from the street or from her house. She also stated that the original contact for the roofing was made by Mrs. Cross who has since passed away. Mrs. Cross was probably not physically able to even think about the ARB review. Ms. Rose did not see any objection and had written a letter to the Planning Commission to this effect. Mrs. Rose said she did not feel it necessary for the roofing company to go to the added expense of a new roof. Councilmember Gilb said Council must still consider that the roof was put on without a City permit and that had Mr. Cross gone to the Building Department, he would have been advised to go through the ARB. Richard Virgin, President of Virgin Roof Company, stated, in part, that the problem was his in not taking out the permit prior to the job. Said they take out permits all the time and are familiar with the process. The ARB decision occurred after the fact. If the roof has to be replaced, hi s company will do it. He knows they I must have a permit. Frequently t~ey call in to the Building Division for an application, check to see that it is correctly filled in, but they do not wa it unt il it goes through the mail wh i ch coul d be several days) Mr. Virgin asked if there were a list of materials considered acceptable by ARB. Fred Jahnke, Chairman of the ARB, 11 Hacienda Drive, stated, in part, that he urged denial of this appeal, but that he is in full agree- ment with the comments of the City Attorney at the Planning Commission hearing that the fact that the roof was put on without a permit was irrelevant. It is not a matter of concern about the permit. 10/7/86 -2- >~ 29:0024 ',\, ~... '. 1) The Santa Anita Oaks Homeowners' Association fonned the Architectural Review Board over a year ago. It was w,ell publicized. It was referred to in the quarterly newsletter sent to all the residents. A meeting was held and at that me~ting they talked about trees, roofs and setbacks. Also described three types of roof which would be acceptable. '\ ' 2) He did not feel that it was a difficult approval method. Many of the requests for approval go through preapproved. The Building Division has a list of the roofing materials which are acceptable. The fact that Mr. Cross' roof is largely hidden by hedges and trees is not relevant to the question because hedges can be trimmed or cut down and trees can be trimmed back. -'; ~{.: \,~j ~ I 3) Mr. Jahnke referred to a similar case which came before Council some time ago ... that of Mrs. Hart's roof at 805 Coronado. ~ The same wording was used then in the resolutiGn with which the BGard wGrked with Mr. CrosiS' roofing matter. They, did not change the bas i c substance of the reSG 1 ution; . '...J, (., 4) There are 420 hGmes in the subject area and only nine have glass cGmposition roofs; tWG .of these are under CGntention and one .other ... there is anGther which is being replaced acceptable rGofing material. This is abGut 1.5% which, in .opinion, is a non-compatible situatiGn. fiber- this .one with an the BGard's 5) Mr. Jahnke continued, in part, that the Board did not agree with the suggested findings which were befGre CGuncil from the City staff. The BGard denied the request because, in its GpiniGn, compGsition rOGfs affect property ,values which the vast majGrity qf the homes have and because it is nGt compatible with the rGofin~ in their area. He read specific sectiGns of the resolutiGn (NG. 5290) setting forth the pGwers and duties .of the BGard in reviewing these requests. He specifically referred tG the section containing the wGrds, "excessive, garish and substantially unrelated to the neighborhoGd "(Section 16(a) ). These were to be avoided by the BGard. He felt the BGard follGwed exactly what the City Council meant in the resolutiGn. Mr. Jahnke also urged CGuncil to review the sectiGns tG which he referred ... SectiGns 6 and 7 and Section l6(a) and asked Council to consider this case the same as .others which, have been before that body. I' DiscussiGn continued on the variGUs types of roofing material... and in response to an inquiry by Councilmember Harbicht, Mr. Jahnke said three types are approved ... Spanish tile, wood shingles and Cal-Shake... all fire-proGf. Anything other than the use of.these materials goes before the Board for review. Councilmember Harbicht felt all data relating tG acceptable roofing should-be distributed tG the hGmeowners. Mr. Jahnke said that a newsletter gGes Gut tG all members autGmatically and this will be brGught before the Board for cGnsidera- tiGn. Richard Parker, 315 Arbolada, stated, in part, that he is a member of the Santa Anita Oaks Homeowners' Association ... that the Architectural Review Board is an important part of the Association. Denial of the Board's unanimous vote for denial would undermine the Board's authority, as well as other architectural review boards in the City. He asked Council to uphold,the Board. ,. 10/7/86 -3- ,,'7_ IN REBUTTAL 29:0025 James Cross, reiterated that his roof was not excessive, garish or incompatible ... that some of the points raised were contrary to the advice of the City Attorney. He stated that his house had been built such a long time ago and this type of home is not constructed in the area any longer. To be compatible, perhaps he should tear down his house and build a different one with another type of roofing material. He did not intend to do this. Councilmember Chandler said he had looked at the roof and did not think it garish and wondered if the composition roaf had been placed over th~ old wood shingles. Mr. Cross said he did !not know. Richard Virgin asked if this appeal is denied does that mean that the Architectural Review Board cannot at a future date reverse the decision and allow fiberglass roofing. The City Attorney advised that the City Council cannot make a commitment for the Architectural Review Board ... that each case must be considered on its own merit ... Mr. Virgin felt that some decision should be made as to whether or not fiberglass shingles would be acceptable in the future. It concerns him as he is a roofing contractor. Councilmember Chandler said that is what Councilmember Harbicht referred to previously and he (Councilmember Chandler) would not anticipate any changes. .' No one else desiring to be heard, the hearing was CLOSED on MOTION by Councilmember Harbicht, seconded by Councilmember Lojeski and CARRIED. I Councilmember Harbicht stated, in part, that it shouid not impact Council's decision one way or the other just because the roof is already on ... it should not be said that, since the roof is on, it will be such a pr.oblem to remove it ... at the same time, it shoul~ not be" said they went ahead and put it on without following the ' proper procedure, so therefore they should be punished. That should not be a consideration. As to whether or not the person (Virgin Roof Company or Mr. Cross) knew about the requirement to go before the Architectural Review Board -- had procedure been followed, they would have been advised that it was part of the permit process ... that is not the consideration. The Board considers aesthetics in making its decisions and the ordinance grants the right of appeal of its decision which means that Councils, too, can consider aesthetics. Councilmember Harbicht continued, in part, that he favors such Boards and his tendency is to support them, but he did not think Council necessarily has to rubber stamp what the Boards say because, then, why would there be the right of appeal. He felt it incumbent upon Council to review each appeal and make a decision and that each decision does not necessarily set a precedent for any other decision... the right of appeal is important to everyone. He felt it clear that the materials are inconsistent and incompatible with the other materials in the area covered by the Architectural Review Board. The question is ... is there anything unique about this situation that would make it an acceptable thing to do in spite of the fact that it would be, in general, unacceptable... that to him is the crux-... is this a special situation that should be considered. He has looked at the property and the material on the roof and did not find anything unique about this particular home and would be in favor" of denying the appeal. ! Councilmember Gilb agreed with Councilmember Harbicht .., that he had asked Mr. Virgin if he knew the requirement for going through the permit process was to establish the methods of the City of Arcadia. (ADOPTED) . ,{:,. 0'" , ()e.,-lt- . ~.," 29:0026 Counci1member Chandler expressed empathy for Mr. Cross ... there are some mitigating circumstances in this case, but he would vote for denial and give Mr. Virgin the opportunity to show that he has a quality company by going to the Architectural Review Board. He would vote for denial of the appeal. A MOTION was then made by Councilmember Chandler, seconded by Councilmember Harbicht and CARRIED on roll call vote as follows that the appeal be DENIED; find that tne roofing material is excessive, garish and substantially unrelated to the neighborhood; that the appearance of the roofing would be detrimental to the use and enjoy- ment and value of adjacent property and neighborhood because of its color and texture; that the decision for denial of the Santa Anita Oaks Homeowners' Association be UPHELD ' AYES: NOES: ABSENT: Council members Chandler, Gi1b, Harbicht, Lojeski and Young None None The Planning Department is recommending that the fees charged for processing the various Planning applications with the exception of the R-2 and R-3 modifications be increased 5.7%. This increase corresponds to the overall increase in the 1986-87 City Budget. It was also recommended that the fees for the Building 'Division,with the exception of the application for a building variance, be increased 5.7%. It was noted in the staff report dated October 7, 1986 that the variance fee is proposed to be increased 75% from $130.57 to $230.00. This increase would reflect the actual costs involved in processing the request. In response to an inquiry by Councilmember Harbicht, staff said the costs of handling these requests have increased to this extent. Mayor Young declared the hearing open and Dan Querrey, 379 W. Lemon and 347 W. Longden Avenues, was opposed to'the proposed increases and said, in part, that he is building his new home at 347 W. Longden Avenue and that he has spent $1,800 in fees before ground was broken. He felt that residents should pay less in fees and permits than the commercial builders who really ,come into the City to build and merely make a profit ... that as a taxpayer of the City, he should pay less. The City Attorney advised that this wou~d not be legal as the Calif- ornia Government Code doesn't separate the costs. CITY COUNCIL RECONVENED AUDIENCE PARTICIPATION Dave Thomas, 930 Anderson Way, San Gabriel, stated, in part, that ~Company, the Tahoe Tree Co., had obtained a permit to sell Christmas trees on a' lot at the SW corner of Santa Anita and Foothill Blvd. He would like to add to the application a request for p~rmission to sell pumpkins between October 20 - 31. Mayor Young inquired if the pumpkins would be just 'dumped on the ground Or would there b~-a trailer on the premises? Mr. Thomas said that the pumpkins,would be spread out on the ground so people could look and make their selections and there would be a trailer on the grounds for the individual who would be there to sell and to guard at night. I Mayor Young also said she was concerned because of the 'nearby residentia area. Counci1member Lojeski said he had the same concern. Mr. Thomas said he would manage and monitor the parking matter. Council- member Harbicht said the question is not Christmas trees, but . pumpkins. Mr. Thomas said they would sell pumpkins from about October 20 to October 31 and would start selling Christmas trees about December 1. Mr. Thomas said that during the intervening month (November),' theY would be clearing the lot for the Christmas trees and putting in;the lighting facilities for the holiday season. Park- ing will be on site. In response to a question, the City Attorney said they could direct staff to allow sale of pumpkins along with Christmas trees under the same ordinance or they could allow it this evening. Mayor Young was concerned for the residents and inquired what if the residents appeal. The City Attorhey said there is no appeal process. Discussion held on the adoption of an ordinance to legitimize the sale of pumpkins. Whereupon it was MOVED by Councilmember Chandler, seconded by Councilmember Gilb and CARRIED on roll call vote as follows that the sale of pumpkins be permitted along with the sale of Christmas trees by the Tahoe Tree Company at the northwest corner of Santa Anita and Foothill; and further that staff be directed to prepare an ordinance to allow the sale of pumpkins to be brought back to Council at a future date. Longden, spoke to the matter of the recent trash pickup increase in charges by Best Disposal. Thought the increase was'excessive. He owns three properties in the City and now pays a total of $1,788.48 a year for trash pickup. He also owns an apartment building in'Monrovia and pays only $192.00 a year. If his three trash bins were in Monrovia, it would be $556.00. He does business in nine 'other cities and does not pay as much as he does in Arcadia. Inquired if this contract with Best Disposal were put out to bid. Mayor Young explained that the original contract with Best Disposal was put out to bid, but they had the right under the contract to request an incre,se; they had done so and Council had approved it. Best had proven that their expenses, particularly liability insurance and dumping fees, had increased sufficiently to warrant an increase. She advised also that rates in Monrovia and Bradbury were going up. , , Councilmember Lojeski explained the background in awarding the contract to Best about four years ago. It had gone to bid and included in the contract was the fact that Best could request increases if sufficient reasons were presented. This had been done and the increases were approved. Councilmember Lojeski also has the bin service and agreed that the increase is high. Mr..QuerreY'continued, in part, that he had to bring back his bin himself and pick up rubbish left in the street recently. Councilmember Gilb explained that that was when the dump closed at 4:00 p. m. and Best had to travel miles further to dump and could not bring the trucks back in time to have the bins taken into the back yards. Councilmember Gilb also asked Mr. Querrey if his costs had increased in his business. Mr. .Ouerrey replied that they had. Councilmember Harbicht stated, in part, that he was not in favor of this specific increase although he was in favor of an'increase ... the mix of rates in Arcadia is different from other cities ... every city is unique '" the rate for the can pickup which is the majority of Best piCkup service has been below that of other cities. The method of determining trash pickup rates is very complex... that sometimes certain services may have to be subsidized by others. It was not fair to compare rates with other cities ... there are other things to be taken into consideration. Council member Harbicht requested that this item be withdrawn for discussion. He felt that the $35,200 was too high a cost for a preliminary design when apparently no agreement of any kind has been reached with the City of Sierra Madre with regard to their portion of the engineering and improvement of Orange Grove Avenue. Counci1- member Lojeski said he had attende~ a meeting regarding placing of curbs and gutters and elimination of some of the trees. Sierra Madre representatives cited lack of money and low priority for Orange'Grove Avenue. Staff stated that they thought that if they had specific figures to discuss with Sierra Madre representatives, perhaps they would have some way to go ahead with the plans. Mayor Young said there was some talk about Arcadia providing a loan to Sierra Madre which would be paid back in installments. It was suggested that perhaps City personnel could give a guesstimate about costs. Suggest- ion was also made that the County be contacted regarding the possibility of obtaining some funds -- at least for the preliminary engineering. Mayor Young said that apparently Supervisors Schabarum and Antonovich have not been contacted. Councilmember Gilb volunteered to get in touch with Supervisor Schabarum and discuss the matter. Staff suggested that perhaps a letter could be written to Supervisor Schabarum with a copy to Supervisor Antonovich describing the situation especially if we could show specific costs. Previously such funds have been expended on wheelchair ramps. Councilmember Harbicht said he did not think wheelchair ramps accomplished much and expressed concern that they allowed bicycles to be on the sidewalks. It was felt that the information distributed by Best was not adequate and did not convey the exact way in which the rate increase was granted by Council. Staff explained a conversation it had with an employee of Best in endeavoring.to obtain what the Company was telling the residents as to the reasons for Best requesting an increase and the subsequent action by Council. Considerable number of complaints had been received by the City due to the increase and it was felt that the residents deserved a better explanation ... that someone should be informed how to handle the complaints and inquiries about the rate i ncrea se. Contents of the letter were discussed and it was the consensus of a majority of Council that such a communication should be made stronger, but directed only to the Company not to the residents. During this consideration, staff noted that Best is required to list rates once a year and have done so through the City Newsletter. It costs about $1,400. and the last publication cost is overdue. Council- member Lojeski said it is a real problem and will not go away. Mayor Young felt the residents should be informed by a letter from Best. It was agreed that a meeting with Mr. Cheney of Best be arranged. 10/7/86 -11- 10. Staff advised that the variance on the Rancho Nursery will be before Council November 4 ... steps which have been or will be taken in connection with the nursery at 622 E. Live Oak Avenue were detailed '" insurance has been received which the City Attorney advised is adequate and the lack of sewer facilities is going to be changed. Staff explained that the Arcadia Redevelopment Plan is not consistent with the General Plan and that is the reason for the communication concerning this. Eventually a hearing will be necessary on an amendment. The material Council received is for information only at this time. Advised that at the recent Los Angeles County Sanitation District meeting there was discussion about the trash dumps. The Puente Hills Dump is now closing every day between 1 :00 and 2:00 p. m. and the Spadra Dump is closing at 11 :00 a. m., as they have reached their quota. They are endeavoring to work it out so they can remain open on Saturday mornings so they will have ,space for the normal dumping. Trash is a real problem. I Adjourned in memory of James Wallin, 75, a former Arcadian who was active in civic affairs, died Wednesday in La Verne. He was the founding president of the Arcadia Tournament of Roses Association and was for two years its president and was also active in the Arcadia Rotary Club. He served twice as president of the Chamber of Commerce in 1964 and in 1965. He was also active in leading tax override initiatives to provide Arcadia schools with additional money. He was chairman of the organiza~ tion, Taxpayers for Fashion Park. He was an insurance broker with the firm, Huntington Associates on Wheeler Avenue in Arcadia. 10/7/86 -12-
