It was MOVED by Counci1member Harbicht, seconded by Counci1member Gi1b and CARRIED that all ordinances and resolutions be read by title only and that the reading in full be waived. The City Attorney announced that prior to this meeting, the City Council and the Redevelopment Agency met in a CLOSED SESSION pursuant to the Ralph M. Brown Act Government Code Section 54956.9(a) to confer with legal counsel regarding pending property damage case of Xochitl Godoy. PRESENTATION The Chief of Police explained the California Worker Award established in 1986 by Lt, Governor McCarthy which is to recognize persons who help solve problems that affect everyone. He introduced Mrs. Rave11e Kozak who is the recipient of the award this evening. She is a former Los Angeles County Deputy Sheriff and is involved with many citizen activities, including Parent Teachers Association, and has co- ordinated 100 Block Captains for the Neighborhood Watch Program. Chief Johnson introduced Estelle Lopez, Administrative Assistant from the Lt. Governor's Office who presented the California Workers Award to Mrs. Kozak with appreciation for the giving of her time and talents. The Commission further proposes that $87,000 be used to make improve- ment to city parks, including Baldwin StoCker, Eisenhower an_d Newcastle and that the remaining $42.000 be used in conjunction with the School District for improvements to the playfields of Longley Way and Dana Junior High Schools, In response to an inquiry by Councilmember Lojeski, staff advised that this has been discussed with the School District and it was indicated that they would support the School District projects and would assume the responsibility for the preparation of plans an~ specifications and to expend the funds in accordance with State' guidelines. The Agency at the November 18, 1986 nieeting requested that a time limit be established on Agency Design Reviews. The Agency's Design Review authority is established in the Redevelopment Plan, Sections 424-427, Agency Special Counsel advises that the Agency can establish a reasonable time limit under this authority. The City Zoning Ordinance establishes a one year time period for variances, modifica- tions and conditional use permits. The applicant is deemed to be in compliance with the one year requirement as long as plans have been approved and the building permit issued within the year. Agency staff recommends that the time period for the design review approval be the same as the last City approval on a project undergoing design review. This means that the actual time period could be slightly more or less than a year, but all parties would have a clear understanding of the deadline. The Assistant City Manager for Economic Redevelopment read the title of Resolution No. ARA-126, entitled: "A RESOLUTION OF THE ARCADIA REDEVELOPMENT AGENCY ESTABLISHING A TIME LIMIT ON AGENCY DESIGN REVIEWS" . It was then MOVED by Member Gi1b, seconded by Member Chandler and CARRIED on roll call vote as follows that Resolution No. ARA-126 be and it is hereby ADOPTED. AYES: NOES: ABSENT: Members Chandler, Gi1b, Harbicht, Lojeski and Young None None This proposed project was before the Agency for Design Review on July 15, 1986 at which time the applicant (George Dunaians) was, asked to treat the west facade in some way to enhance the appearance of the proposed commercial building at 129 E. Huntington Drive (former site of the Textile Center). The staff report indicates what re- habilitation steps are proposed. The applicant was commended on the new design. It was MOVED by Member Lojeski, seconded by Member Harbicht and CARRIED on roll call vote as follows that the Design Review be APPROVED as set forth in the plans received by the Agency, subject to the following conditions: That the State and City codes shall be satisfied (zoning, building and safety, etc.). Harbicht, Lojeski and Young None None Applicant Thomas Posen filed a modification request (M-86-164) for the construction of an industrial building on a site containing 8,000 sq. ft. of lot area in 1 i eu of 15,000 sq. ft. and for a ro' -0" front yard setback in lieu of 25'-0" at 129 E. La Porte Street. The site is currently vacant and zoned M-1. The project is to be a two story 4,000 sq. ft. industrial building ... eight parking spaces to be provided, seven in the rear and one in front. Four will be covered by a carport. Staff advised that the project will meet or exceed all code requirements except for the size of the lot and front yard setback. COUNCIL RECONVENED AUDIENCE PARTICIPATION C' -d' ~ c o c :Lloyd Sobel ,'420 S: B'everly Drive:Beverly Hills, referred to an agenda item relating to his request for a 15' easement in order to install a drainage channel and sewer line along the east property line of the Arcadia Water Division Longden Plant property. Mr. Sobel displayed a map of the subject area and pointed out locations involved. Mr. Sobel is developing 4 acres of land in the City of Monrovia with 51 homes ... townhouses. The project has been approved by Monrovia, however, there is the problem of drainage ... the property drains naturally from the north (Jeffries Street) down to the south.., elevation is 6' higher. Monrovia has asked him to design the project so it could be gravity flowed .,. both for surface and sewage ... the only way they can do that is to the south to Longden. Every other avenue has been explored including going across the church property in the area, They desire to leave the project knowing they have done the very best job they could and not feel they have left behind a potential future problem especially in a heavy rain storm, I Considerable discussion ensued with the Director of Public Works responding to concerns expressed by Council members ... the fact: that once the subdivision is completed, the homes will all have sprinkler systems and the water would create a grass swale .,. so during the year long there would be what could be called a swamp from the flow of 1212/86 -4- I 7. 7a. There is also a Little League Baseball Park located nearby among other things which would not be desirable for the City of Arcadia. Staff called it nuisance drainage on a day by day basis. Reference was made to a pumping system and Mr. Sobel said, in part, they would like to obviate'that ... it could break down during storms, too. THIS MATTER WAS CONSIDERED LATER IN THIS MEETING. SEE PAGE NO.6. Herb Fletcher, 175 W. Lemon Avenue, referred to an article in the Arcadia Tribune concerning the Planning Commission turning back a design for an apartment building. It seems one of the Commissioners has been wanting the Commission to pass on the aesthetics of projects coming before that body. . He felt that a developer or builder should know beforehand whether or not the aesthetics are acceptable .., before the building permit is issued for instance. The Planning Commission might be able to make itself available earlier in the process. Perhaps written guidelines would help. This would be more fair to the architect and owner. CONSENT _ITEMS SCHEDULED a public hearing for December 16, 1986 for consideration of a text amendment amending the Uniform Building Code regarding 0 security bars, metal grates and similar security devices in resjdentia1, commercial and industrial zones. Council received the results of bids for the purchase of 28 benches and, 20 waste containers. One bidder was disqualified because they refused to submit samples or allow a City representative to visit their plant and another bidder did not meet speCifications on the benches. Council AWARDED the purchase of the benches to Wausau Tile for a total of $12,670.52 and the purchase of the waste containers to Moore for a total of $8,094.00. The total from the CBDG Grant Fund is $20,764.52. All informalities or irregularities in the bids or bidding process were waived. APPROVED plans and specifications for Street Lighting Replacement Program, Job Nos. 616 and 617 and AUTHORIZED the City Clerk to ,advertise for bids. The estimated cost of the project is $201,569 which will be funded from CDBG funds. . o APPROVED request of Resde1 Engineering Corporation for. a permit, to install a privately owned conduit in the public right of way across Live Oak Avenue. The purpose of the conduit is to interconnect' computer and telephone facilities between the (two locations Permit to be granted subject to conditions listed in staff report dated December 2. 1986, 7e. I CITY MANAGER This is the item which was before Council (Page Nos. 4-5), with Mr. Sobel explaining this problem as far as drainage is concerned with his subdivision he is constructing in the City of Monrovia. Mr. Sobel is requesting a 15 Toot easement to install a drainage channel and sewer line. Staff had submitted a report to Council on this request wherein it was recommended that the request not be granted and reasons therefor were set forth in detail, Staff was of the opinion that if Council app'roved the request, it would be granting a very substantial property right, the detrimental effect of which cannot be assessed at this time. However, once it were granted, it would be a physical drainage channel and a physical encumb- rance on the property for all time ... and also there is no way of assessing the future detrimental effect on the value of the land. In discussing this further, Councilmember Gi1b said, in part, that Council's obligation is to the community and its citizens.. for instance, any future development of the land would be lost forever ... the City would be losing too many of its options 'in his opinion., He could not favor granting the request. . It was MOVED by Councilmember Chandler, seconded by Councilmember Gilb that the request for the easement be DENIED. Council member Harbicht stated, in part, that granting a surface easement essentially means that the use of the property is lost. He has discussed this with the developer and he would like to help developers put in their developments whether they are in Arcadia or out of the City, however, he agreed that the first obligation is to the citizens who, in effect, own the property. In essence, Council would be selling the property and his answer would be "no". He agreed that it would be giving up too much of a property right. Counci1member Lojeski agreed. He was concerned with the drainage problems which would eventually occur ... there would be the ditch into which somone could fall... and with restrictions on entering the channel there would always be an entrance problem ... there are too many negatives with no positives in granting the easement. Mayor Young agreed and spoke of the possibility of the channel becoming perfect for skateboarding. I 1212/B6 -6- I 8b. . COMMUN ITY DRUG ABUSE INFO. BOOKLET (APPROVED) 9. 9a. Donations are obtained by the organization from the business community and they provide the booklet for those businesses and the Arcadia Police Department. There would be no cost to the City. The,main.e1ement of the program is the booklet entitled, "No Reason for Tears", This is an overview of the drug problem with factual information for businesses, parents and the young people.. If the program were approved, solicitations by the organization. would begin in January 1~87. During the consideration, Councilmember Gilb stated, in part, that it appears to him that the number of books suggested to have printed would not cover the community as a whole ... but agreed it is a start. He would like the Police Chief to watch the progress of the program because, after all, the ones putting out the books are interested in making a profit. It was agreed that this could further.Council 's efforts in controlling the drug problem and it was MOVED by Councilmember Lojeski, seconded by Counci1member Chandler and CARRIED on roll ca1) vote as follows that the request to participate in the program be APPROVED. Staff replied that there seems to be a flurry of activity on the building, but they did not know when they would finish. Will i,nquire. Brought up the question of setbacks for fen~es around construction and asked if there is a time limit. Staff replied that with a valid permit there is a 180 day period which could be extended another 180 days. Counci1member Harbicht noted a couple of locations he had noticed with construction fences in place for a considerable period of time. Staff replied that the construction fences come down after .the final inspection by the City. Counci1member Gi1b inquired where the fences were. Counci1member Harbicht replied he had noticed the~ on Arbo1ada and Hampton Road. Counci1member Gi1b said that he thought that the house on Arbo1ada was for sale and the fence probably was to protect the property. Councilmember Harbicht said he did not want to waste City money by pursuing this matter too far; he had just noticed a couple of cases of abuse. Noted that on Thanksgiving Day one of his neighbor's gardeners was working and using a blower which was very disturbing. He wondered if gardeners could be kept from running the blowers on Christmas and Thanksgiving and possibily on Sundays. The gardeners also use the blowers on the yards of the rest homes in the community and start at 7:00 a, m. which again is very disturbing to the residents of these homes, He inquired if it 'were possible to do something ,about the blowers. The City Manager stated that apparently Los Angeles had a great deal of trouble trying to do this. He referred to a newspaper article which will be sent to the Council with the next Newsletter. Mayor Young said she has received numerous telephone calls from persons complaining about the blowers and noted that Beverly Hills had an..ordinance banning them. His suggestion was that the Homeowners Associa- tions could be contacted and the homeowners then could talk to their gardeners. Also that. the information could be transmitted to those homeowners who do not have homeowner associations be means of printing it in the Newsletter and in the Arcadia Tribune, The City Attorney suggested that it might be a good time to update the ordinance on blowers and will come back with an opinion. Councilmember'Lojeski said perhaps this could be combined with the business license process. Councilmember Harbicht said he thought voluntary compliance would be I best if it could be attained. Inquired about the status of the retirement hotel on the corner of Sunset and Michillinda, Staff replied that there had been no action but they understood the owners and builders had obtained new financing. The permit runs out in a few days and there should be some action by then. Noted that the water tanks next to the Kiewit property are an eyesore and wondered if perhaps the tops at least could be painted which would improve their appearance for those looking down from nearby buildings, Staff replied that this had come up before and as a result they had planted some trees which had helped the situation somewhat, but the tanks were too high to be completely hidden by the trees. Adjourned the meeting in menory of William Thomas Powell -- the father of one of our Recreation Commissioners. Mr, Powell was born in 1901 in Wales. He came to the U, S. A. in 1930 at the age of 29. He worked in Arizona for a period of time in a gold mine. He eventually came to Los Angeles and became President of the Energy Products Division of L.T.V. Corporation from which he retired in 1965. He passed away November 15, 1986 in Pasadena. He is survived by his beloved wife, Ethel; son, David, a resident here in Arcadia; daughter- in-law, Gerrie; son-in-law, David Hogue and a grandson, Tom. Adjourned the meeting in memory of John D. Bono, who passed away last evening at Arcadia Methodist Hospital. Mr. Bono was born in Rockville, Colorado June 4, 1912. He was in the produce business and was considered to be one of the grape specialists of California. He was one of the pioneers in the grape business. He retired from his business about two years ago. He has been a resident of the community with his family for many, many years. He was a great friend of the City's and a great supporter of many projects in the City. He is survived by his wife, Josephine; his son passed away a few years ago Services were held at Holy Angels Church on December 3, 1986. The family and the community will sorely miss him.
