The City .Council and the Arcadia Redevelopment Agency met in a
regular session, February 3, 1987 at 7:30 p. m. in the Arcadia
City Hall Council Chamber.

The attendance of Scout Troop No.3 with Scoutmaster Don Little
was acknowledged. The Scouts are working on their merit badges.

On MOTION by Counci1member Lojeski, seconded by Councilmember
Harbicht and CARRIED, the Minutes of the January 20, 1987
adjourned and regular meetings were APPROVED.
It was MOVED by Counci1member Harbicht, seconded by Counci1member
Lojeski and CARRIED that all ordinances and resolutions be read
by title only and that the reading in full be waived.
CITY ATTORNEY
The City Attorney announced that pursuant to Government Code
54956.9a the Council met in a CLOSED SESSION this evening to
discuss the existing personal injury case of Charles v. City of
Arcadia anq_~ ~9vnty~~6~ Angeles. Also pursuant to Govern-
ment Code~nc~'rri~ in CLOSED SESSION with its negotiators
to discuss potential acquisition of properties specifically relat-
ing to the Derby Motel. Also at the conclusion of this meeting,
the Council will be adjourning to a CLOSED SESSION, pursuant to
Government Code 54956.9(a) to discuss the existing law suit of
Arcadia and Rodeffer and Public Storage v. E1 Monte.
Council considered modification (M-87-7) to construct an industrial
development on a site containing 14,663 sq. ft., of lot area in lieu
of 15,000 sq. ft., and deletion of loading space on Lots 1637-1641
in the Chicago Park Tract (northeast corner of Goldring Road and
Varus Street). The applicant is Kenneth Elmore, owner. If approved,
the conditions were set set forth in the staff report dated February 3,
1987.

Mayor Young declared the hearing open and no one desiring to
be heard, the hearing was CLOSED on MOTION by Counci1member
Harbicht, seconded by Counci1member Lojeski and CARRIED.
It was MOVED by Counci1member Lojeski, seconded by Counci1-
member Harbicht and CARRIED on roll call vote as follows that
the development would secure an appropriate improvement, prevent
an unreasonable hardship or promote uniformity of development
and the modification be APPROVED subject to all conditions set
forth in the staff report.

CARRIED, the Minutes of the Meeting of January 20, 1987 were

Proposed Nissan/Agency land exchange which is a continued item
from January 20, 1987. Staff advised that the Agency's offer has
been presented to Bruce Low who would like to address Council:
Bruce Loll', 333 E. Huntington Drive, stated: "I have decided to
accept~e offer of the Redevelopment Agency. I feel it is a little
low, but I also feel that splitting hairs is something, that in good
faith -- that each of us as neighbors need not do and we have laid
out the terms to staff and that they will be accepted as stated
by the Redevelopment Agency and I hope. that you will accept this
as a gesture of the genuineness of the Low family with the City of
Arcadi a. Thank you very much."
No action at this time.

The Agency has acquired the land and improvements at 400 East I
Huntington Drive from Mr. and Mrs. Henry Comstock. Their tenants, -
Amir and Shirin La1ji, doing business as Andy's Burgers, have been
in negotiation'with the Agency for several months regarding the
Agency's relocation of their business on, in the absence of a suitable -
relocation site, the purchase of the business. The Aqency's Relocation
Consultant, Port & F10r, has been unable to locate available
property suitable for a fast food restaurant. The Agency is there-
fore purchasing the furniture/fixtures and equipment of the business.
The basic agreement, which the La1jis have accepted, calls for a
total payment of $100,000. Staff recommended approval and noted that
inventory is $5,000.

It was MOVED by Member Chandler, seconded by Member Harbicht and
CARRIED on roll call vote as follows to APPROVE the Agreement for
Purcha~e and Sale of Property and Settlement of Claims and
AUTHORIZE the Executive Director to make minor revisions subject
to approval of such by the Agency Attorney as to form and AUTHORIZE
the Executive Director to execute all documents related to the
purchase of Andy's Burgers consistent with this Agreement.

MemQer Lojeski inquired how the Agency intended to dispose of the
fixtures. Staff replied it will be auctioned by those who handle
restaurant fixtures, probably around February 23.
Staff referred to the appraisal contract with Alan Weirick
of property north of the Arcadia Nissan property. In view of
the acceptance by Bruce Low of the Agency's offer on said
property, staff would like authority to pay Mr. Weirick for
the work he has done ... he has visited the site and has performed
some initial work. Staff recommended to be authorized to pay Mr.
Weirick his hourly rate and have him cease work.

CARRIED on roll call vote as follows that Mr. Weirick be paid
$1,000 for the appraisal work at 333 E. Huntington Drive.

Staff report presented on the bids for relocation of the
continuation high school from 8 South Third Avenue and rehabili-
tation. Staff explained there are essentially two contracts
proposed -- one is to lift the school and move it to its permanent
p1ace at Arcadia High School; the second is to prepare foundations
for the school and come back when the school is in place and fit it
down and put the ramps back. The bids for the relocation came in
at $55,000 with a 10% contingency that is $60,500. The bid for the
rehabil itation and the foundations which was $36,975 came iln with
10% contingency $40,673 for a total of $101,173.
Member Harbicht questioned if he had not read that the schools agreed
to do some of the work that is worth about $14,000. Staff replied
that the schools have agreed to do that work. A formal written
agreement from the school s has not been recei ved, but they have
agreed that they will take care of this work, which is work that
originally the Agency thought it would have to do.

CARRIED on roll call vote as follows that the Arcadia Redevelopment
Agency' contract with Three 0 Services to relocate the Continuation
High School Build.ing at a cost not to exceed $60,500; and AUTHORIZE
the Agency Executive Director to execute an agreement with Three 0
Services, in form approved by Agency General Counsel; and that the
Agency contract with B. K. Wheeler Construction Company to rehabili-
tate the Continuation High School Building at a cost not to exceed
$40,673; and AUTHORIZE the Agency Executive Director to execute
an agreement with B. K. Wheeler Construction Company, in form
approved by the Agency General Counsel.

Member Lojeski remarked in regard to this item that he had been
talking with School Board Member Spuck last evening.and:'reca11ed at
the last meeting there was a young man who represented Arcadia
High School and was concerned with the lack of parking for students.
This proposed space for the Continuation High School temporary
structure is going to take out some additional parking. Chairman
Young stated that she had talked to the Superintendent of Schools
last week and apparently in doing this, they plan to restripe the
parking lot for more efficiency and will gain some extra parking
spaces.

The Agency adjourned to a CLOSED SESSION at the end of this
meeting.
CITY COUNCIL RECONVENED
AUDIENCE PARTICIPATION
Herb Fletcher, 175 W. Lemon Avenue, asked the City Council to not
move hastily to redevelop land north of Huntington Drive as he had
noticed from the newspaper that there is a good possibility of losing
some automobile agencies along with about $200,000 in sales tax
revenue. There is little land remaining and once it is gone, it is
gone forever. He suggested that perhaps the Council should consider
covering the entire area with automobile agencies ... perhaps a parking
structure that could be financed with a bond issue and then endea~or
to obtain car agencies. He would like to make sure that the City gets
the best possible development on the last remaining land which the
City owns.

SCHEDULED a public hearing for February 17, 1987 for consideration of
Text Amendment 87-1, adding regulations to the Arcadia Municipal
Code which would. establish architectural/Design Review criteria and
procedures applicable to projects located within the City's Mu1tip1e-
Family Residential, Commercial and Industrial zones.
SCHEDULED a public hearing for February 17, 1987 for consideration
of variance requested' by Mr. and Mrs. David A. Sapio, 2146 Highland
Oaks Drive (who are building a swimming pool) to delete fencing along
the rear of their property adjacent to the Santa Anita Spreading BaSinl
where there is a steep embankment.
APPROVED Final Map 44170 for a proposed 10-unit condominium project
at 1018 Arcadia Avenue (Franklin Yu, owner/developer), subject to the
condition that before the Final Map is recorded, all outstanding
conditions of approval as set forth by the Public Works Department
shall be complied with.
RATIFIED Planning Commission Resolution No. 1330 setting forth
findings of fact and determining the conditions in which an instant
printing business would be permitted in a C-O Professional Office Zone.

AUTHORIZED staff to offer to lease 1,500 acre feet of water rights
in the East Unit of the Raymond Basin for Fiscal Year 1986-87 from
the City of Sierra Madre and AUTHORIZED the Mayor and City Clerk
to execute an Agreement in a form approved by the City Attorney
for said lease. Funds for the lease of 1,500 acre feet at $96.67 per
acre feet ($145,005) are available in the Water Fund.
APPROVED plans and specifications for the annual Concrete Gutter
Construction Program which includes the construction of concrete
gutters and miscellaneous curb, drive apron and asphalt concrete
patching on Forest Avenue (Second Avenue to Fifth Avenue), Fourth
Avenue (Duarte Road to Camino Real Avenue), Oakg1en cul-de-sac,
Colorado Boulevard (Santa Maria Road to 115' east of Santa Maria
Road) and AUTHORIZED the City Clerk to call for bids to be opened
March 10. The estimated cost of the project is $94,582 which will
be funded from State Gas Tax funds.

In addition to the CLOSED SESSION announcement made previously
regarding litigation, the Agency will also be discussing some
additional instruction to be given to Mr. Kinnahan regarding
acquisition of certain property.
MATTERS FROM STAFF
None
MATTERS FROM ELECTED OFFICIALS .
Reported on what transpired at the meetings of the Sound Wall
Committee. The consultant is going to each of the properties
to ascertain the distances from the freeway... there is no time
estimation... but at this point and time you go by Ca1trans'
rules. If it doesn't work, you try to change the rules ... he
felt the proposed approach is at least equitable for the time
being.
Had spoken with two residents (one near Santa Anita and Longden
and the other on La Cadena) concerning the security devices who
expressed the hope that the City Council would not initiate any
type of ordinance to prohibit the use of bars on the windows. Each
had experienced burglaries and desired to have the bars left on.
Spoke to the proposed rental of School property (Foothills Jr. High).
The applicant attended the School Board meeting when this was
considered. The Board was ready to proceed and did on a 4 to 1 '
vote. The applicant apparently has been negotiating with the
School since last September and was surprised to hear'of the
procedure he must follow with the City in order to hold church
services. This matter is on an hold situation.

Re. the Youth Commission, noted two of its proposed activities ...
the annual Disneyland trip to be on Friday April 4 ... and an all-
ninth-grade dance to be held at the High School May 2. The viability
of the Youth Commission had been discussed previously and it was brought
out that the senior representatives are heavily involved in just
actions of the student government at the high school, particularly
the executive council. The Junior High representatives are also
moderately involved with activities of their schools. The students
may come to Council Meetings to see government in action and he felt
it would be doing a great service to dissolve the Commission. The
present Commissioners would serve out their specific terms. - The
Council members were in agreement and a resolution to that effect
will be prepared and placed on a future agenda.
In response to a question, staff advised on the outcome of the
auction held by Tauber Arons of the remaining Bong equipment ...
about 80 persons attended the auction, the total taken was about
$62,000, the auctioneer takes 10% of that as their fee .., about
$4,000 in costs ... will probably net $52,000.
Referred to Counci1member Lojeski's remarks on the security bars
and said, in part, that the fact that someone -said they were
burgled twice and then put bars on the windows and haven't had a
problem since .., if a burg1er is going out to burgle someone and he
happens to pick a specific address and he is walking up the driveway
and sees bars on the windows, he doesn't think, "I guess I'll go home
and watch the Cosby show". He goes to another house. You don't
really reduce the burglaries. If you think about the effect of that --
people put bars up and they don't get burgled, but their neighbor
does. Whet is the neighbor going to do? Get bars up. Do you want a
barred community or not? That is really the -question. And the fact
that someone selfishly says, "I am not getting burgled anymore"
doesn't mean that we have solved any problems.
The only problem with that way of thinking is -- is it just like the
person who installs an alarm system and has a sign that says ABC
Alarm Company or guard dog on duty or whatever and "I may e,scape
from the burg1er who is going to burglarize my house and that
may be the deterrent, but that is going to drive him next door to
maybe burglarize my next door neighbor". I think we can draw analogies
like-that quite extensively.
Said he would not like to see Arcadia a barred community so to speak
like some others. However, as he drives around town, he doesn't
really notice them unless he is looking for them. There are homes
with bars. There are homes in Beverly Hills that are barred up --
on estates, etc. There are homes in Arcadia where people can get
behind hedges and cannot be seen by police or anybody else and some
of them have ornate bars. I think the assumption that a certain amount
of burglaries are going to occur in Arcadia no matter whether you put
bars up or not is not necessarily a good assumption. It seems to me
that if a person has been victimized and has gone to the trouble to
make a large investment to put the bars up and it has given them
peace of mind and it has given them what it takes for them to survive
emotionally, that it is pretty presumptive to make a law that says
they have to comecdown within a year. He could not see any equity
in that. I can see doing what the rule or an ordinance that dis-
courages the use of bars towards requiring permits so that at least
we can get the best possible looking and safest system out of
them. We talked about putting bars on the inside of industrial
buildings -- that is the worst place in the world to put them for
a fireman. We discussed firemen's safety. At least if they are on
the outside, the fireman knows what he is going into and they can
hook a tow truck uP.to them and yank them off or use their equipment.

It is actually ridiculous to put them on the inside of a building
and then require a sprinkler system, so it is no easy discussion to
in and out of, but there has got to be some midd1 e ground, 'from my
way of looking at it, if we are going to make some kind of an
ordinance about it. I don't buy the argument of "if my neighbor has
bars, then I am going to get burglarized'. I don't think that is
necessarily so. I think there are certain people who are known to
be better victims than'others -- women who live alone -- invalids --
people who are gone from home a lot -- burglars are not haphazard --
they don't just spin a ouija board -- if you notice police reports,
they tend to know what they are doing when they operate. They have
an expectation of what they are.going to get as well.

This is something we are going to have to study and Council is in
the process of doing that. I don't think we are going to settle it
tonight.

Asked who has jurisdiction over the school on a building that they
have or do they fa 11 under some"other category? Because they have
bars at the High School on the windows of the Students' Store and
the gym. It would be a tragedy if there were a fire in one of the
locker rooms with a bunch of students and everybody is crowding to
the door and they couldn't get out the window because of the bars
on the window.
In response to his question as to whether or not Cable TV had
changed channels, staff will send him a data sheet with this
infonnation.
Mayor Young adjourned the meeting in memory of Olive Moody, who
passed away suddenly on January 31, 1987. Mrs. Moody is survived by
her husband, Joe, four daughters, ten grandchildren and five great
grandchildren. Mrs. Moody was Personnel Director of Hinshaws
Department Store for many years. Active in the Church of the Good
Shepherd, Soroptomi st Internat i ona 1, and the Arcad i a Red Cross.
Counci1member Lojeski adjourned the meeting in memory of Paul
Ka1manovitz, who passed away recently in Tiburon, CA. Mr.
Ka1manovitz was owner of the Meier Brewing Company and was owner cf
property in Arcadia. He also served on the personal staff of President
Franklin D. Roosevelt, Publisher William Randolph Hearst and Louis
B. Mayer of MGM Studios. He was an avid supporter of Guide Dogs.
He emigrated to the United States in 1926 from Lodz, Poland and
was listed in the Forbes 400 list in 1985.

The meeting adjourned to a CLOSED SESSION, reconvened at 9:30 p. m.
and adjourned to 7 :00 p.m., February 17, 1987 in the Conference
Room to conduct the business of the Council and Agency and any
Closed Session necessary to discuss personnel, litigation matters
and evaluation of properties.
