C!TY ATTORNEY CLOSED SESSION The City Attorney announced that the City Council and Redevelopment Agency met in a CLOSED SESSION pursuant to Government Code', Section 54956,9(a) to discuss the existing condemnation case of City v. Jackson or Rentype. Additionally, pursuant to the Ralph M. Brown Act Govern- ment Code Section 54956,8. the Agency and the City met in CLOSED SESSION to discuss potential acqUisition of property generally known as the Armory property. PUBLIC HEARING TA 87-3 (Fence & wall heights modi fi ed) (APPROVED) Ord i nance to be prepa red 29:0142 Th'e Planning Commi'sslon at its February 24, 1987 meeting voted 7 to 0' to recommend to the City Council approval of Text Amendment 87-2 amending Arcadia Municipal Code Section 9220.2 establishing a maximum size for accessory living quarters/guest house. On October 1, 1985 the City amended the accessory living quarters/guest house regulations to regulate len9th of stay, kitchens and number of rooms. The Planning Department feels the guest house regulations are still susceptible to abuse, particularly when such structures are very 1 arge. Councilmember Harbicht inquired about the distinction between guest houses and other buildings that might be on, a .property. Staff repl ied that it usually depended on what the applicant stated. Also a guest house may contain only up to 50% of floor space of main dwelling. There are other buildings that co~ld 'be used as guest houses... work~ shops, pool houses.. whatever' they may' be called. Councilmember Harbic mentioned that if the applica~t w~re going to construct a pool. house, for example, with a playroom, it'could then be considered a guest house. Staff replied that the applicant would state'what the purpose of the building would be. For different types of buildings, there are differ- ent setbacks, etc. Councilmember 'Harbicht said - then it just depends on what the applicant calls it. Staff replied that was true and also the City would have a record of what the intended use was to be. Councilmember Gilb inquired about buildings intended for cabana use, which may have kitchens and bathrooms and are legal. Staff replied they are limited to not having'a stove., Mayor Young inquired if a guest house could have a stove; Staff replied they could not. Mayor Young then declared the hearing open. No one desiring to be heard, the hearing was CLOSED on MOTION by Councilmember Lojeski, seconded by Councilmember Gilb and CARRIED. It'was MOVED by Councilmember Lojeski, seconded by Councilmember Harbicht and CARRIED on roll call vote as follows that the Text Amend- ment 87-2 be APPROVED as set forth in staff report dated March 17, 1987; that the Negative Declaration be approved and filed; find that the Text Amendment will not have a significant effect on the environment and direct staff to prepare the appropriate ordinance for introduction. AYES: NOES: ABSENT: Councilmembers 'Chandler, Gilb, Harbicht, Lojeski and Young None None The Planning Commission' at its February 24, 1987 meeting voted 7 to 0 to recommend to the City Council 'approval of Text Amendment 87-3 amendinq Arcadia Municipal Code Section 9292.2.3' to permit fence and wall heigh) along the rear and side property lines to be modified through the Administrative Modification procedure. The Planning Department recom- mends that walls requiring modifications along the rear and side prope lines be eligible for an Administrative Modification which requires a $48,00 'fee, plans and signatures of approval from all adjacent property owners. Thfs procedure usually takes seven to ten days to complete after filing the application. Modifications for walls within the front yard and along the street side of a corner lot would still be required to go before the Modification Committee. The R-M zone should b.e added to the Administrative Modifica- tion procedure since it is a single-family,zone. This should have been done when the R-M zone was established in 1977. None Th~ Planning Commission at its February 24, 1987 meeting voted 7 to 0 to recommend' to the City Council approval of Text Amendment 87-5 amending Arcadia Municipal Code Section 9283.8,3 with respect to fire- places and eaves. Prior to 1980 the R-l zone required a minimum side yard setback 0 f 3' 0" and the R-O zone a 5' 0" side yard setback. The code was amended so that the R-l and R-O zones now require 5' 0" and 10' 0" side yards respectively. When this amendment was made the architectural features section of the code was not changed to reflect the increased side yards. Staff report presented. The increases are necessary in order for the classes and activities to continue on a self-supportin9 basis. The Recreation and Parks Commission recommended approval of the new fee schedule. Contract negotiation is set for March 12, and the proposal is due on April 2. I Agency staff has been negotiating with the owners of the Derby Restaurant to relocate their existing parking lot on the east side of Third Avenue on Huntington Drive to the area immediately north of the restaurant, Moving the parking lot to this location will result in the dislocation of eight Agency tenants and it is necessary to give 90 days notice to the affected tenants. ADVERTISE FOR BIDS JOB NO. 624 City Yard / 29:0145 Request of staff, dated March 17, 1987, to amend the Reciprocal Parking kease between the City of Arcadia/Arcadia Redevelopment Agency and Arcadia Medlcal Center, AYES: NOES: ABSENT: Chandler, Gilb, Harbicht, Lojeski and Young Members None None AUDIENCE PARTICIPATION Herb Flefcher, 175 West Lemon Avenue, spoke to the matter of increased automobile insurance rates and noted that the City of Gardena, where the rates are much higher, has approached Sacramento for permission to handle auto insurance itself. Mr, Fletcher did not suggest that the City go into the insurance business,' but it occurred to him that the City might consider going into the fire insurance business.., There are no guarantees as to incoming revenues .. sales tax losses can happen. In the 1980 census it was noted that there are 18,625 resi~ dences in Arcadia with an average value of $139,000.,. assuming insurance premiums are $450, per residence -- that is eight and one- half million dollars in premiums. The Fire Department gives a contin- uing report on losses so,the information is readily at hand. Arcadia spends a great deal of money to .maintain a fine Fire Department and are,by doing th,is, helping the fire insurance companies keep even more of the premiums, CoOnci1member Gilb interjected that he had heard that Foulger Ford was not going to leave Arcadia so that sales tax would not be lost. CONSENT ITEMS APPROVED the final map for a proposed 20 unit residential condominium (Tract No, 44536) at 417 - 421 Diamond Street. The developer is Rodine Development Inc. The staff report stated that before the final map is recorded all outstanding conditions of approval, as set forth in the report, shall be comp] i ed wi th, APPROVED the final map for a five lot subdivision at 147 - 159 East Las Flores and 2003 South Second Avenue (Tract No. 44959), The developer is the Chris Construction Company. All outstanding condi- tions must be complied with before the final map is recorded. Construction Company in the amount of $60,634.21. $82,000 was APPROPRIATED from State Gas Tax Funds to cover the cost of engineering, inspection, contingencies and the contract amount; all irre9ularities and/or informalities in the bid or bidding process were waived and the Mayor and City Clerk were AUTHORIZED to execute the contract in form approved by the City Attorney. APPROVED the Agreement for Services with Liebert, Cassidy and Frierson for labor relations legal services. This is a renewal of the agreement which expires at the end of March and would provide for twelve months of services beginning April 1, 1987. Staff report includes the histor'l ical cost data from 1978-79 to 1987-88. The sales tax is the number one revenue generator for the City, There are some significant amounts of sales tax that are not available to the City because of reporting errors, etc. Mr. Robert Hinderliter, 150 West First Street, Claremont, was present to'answer questions. Councilmember Harbicht stated in part, that he had read the proposal and understands that one of the functions will be to look for sales tax which the City should be.getting, but is no~ and inquired as to Mr. Hinderliter's experience with other cities, Mr. Hinderliter stated that the results had been variable, but his company had been able to find in excess of $500,000 to date'-- some misappropriated to other cities; some were new businesses moving into cities; and some were businesses which were not licensed. The State Board of Equalization does a fairly good job of allocating tax revenues, but it is possible that they are misSing some. Mr, Hinderliter currently has 31 cities for which he is providing audit services, but some of them have not been with him long enough to identify results. Councilmember Gilb inqUired about Mr. Hinderliter receiving 15% of new revenues., would this pertain to the new sales taxes to be generated I under the redevelopment program? Mr. Hinderliter said he would have to get specific authorization from the City Manager before he would do any review of a company. . Staff called attention to a portion of the proposed contract pointing out the measure of performance to be the incremental growth in the local sales and use tax reported. Base sales tax amounts, inflationary growth and incremental growth determined by the City to be attributable to causes other than the work authorized in the agreement shall be deducted prior to calculating compensation, In response to Council- member Gilb's inquiry, Mr. Hinderliter said that he had data entry assistants, He did not require many assistants, Mayor Young inquired once he has a city as a client, how long is the service continued? Mr. Hinderliter replied that if a city elects to cancel the service, there is a 30 day cancellation notice, Councilmember Chandler inquired if he would operate like the IRS? LOJESKI LOJESKI LOJESKI GILB LOJESKI GILB ADJOURNMENT GILB 29:0148 MATTERS FROM STAFF None MATTERS FROM ELECTED OFFICIALS Inquired of staff how soon the cleaning up of the "junkyard" behind the Embassy Suites would be completed, He has noticed that there are still old tires and other debris on the property. Mayor Young said she had wanted to ask the same question. Staff replied that one bid 'had been awarded and the contract si9ned and the demol ition I firm notified and the property should be cleaned up within one week. Mayor Young asked if that would include all debris. Mayor Young said she was concerned about trespassing in that"she had seen youths in there. Councilmember Gilb said he was concerned about the property and also wanted to see it cleared 'as soon as possible and ~as also concerned about the youth activity there, Noted that persons had,been selling automobiles from the parking,lot of Ralph's Grocery at the corner of Live'Oak and Santa Anita. He noticed 12 cars parked in the prime parking spaces in front with FO~ I: SALE signs on them, with the hoods of the cars up and people appare~~ dealing for them, The City Attorney answered that the City is takir~~ steps to restrict it. Police Chief Johnson stated that a number of '!: citations had been issued at that property and the Police Department would continue to check on it. Noted that Councilmember Gilb is liaison with the Senion Citizens' Day Committee, Senior Citizens' Day will be April 28. He suggested; that members of the Youth Commission might be able to assist on that' partic~lar.day.. Perhaps Marc Mu~ller or Jerr~ Colli~s could suggese~ someth1ng 1n th1S regard, Councllmember Harb1cht sa1d he thought tli.i! Senior Citizens' Day was actually a Rotary Function, Councilmember Gilb said it was a joint function between the City and Rotary. MaYQr Young said the members of the Youth Commission perhaps could volunte~r, Noted that a publication from Newport Beach dated January 1 had re- ferred to smoke alarms and noted that R-2 apartment rental units had to have them before they could be rented. This is a state law and is being enforced. This is a law that is applicable in Arcadia as well. Suggested that perhaps something on this could be put in the Newsletter... also perhaps Board of Realtors could be alerted to this. Noted that on the previous Sunday at about 4:30 p.m. the traffic signals went out on Huntington Drive. The matter was taken care of promptly. He was impressed by the response time and the inimitable expertise with which the situation was handled. Inquired about the Orange Grove Avenue traffic enforcement. Said he had seen the week previously 37 cars waiting for stop signs at Orang~ Grove and Santa Margarita. Police Chief Johnson replied that the matter had been assigned.to the beat unit and that they were still patrolling it. Councilmember Gilb adjourned the meeting in memory of Jo Ann B. Carro'l'l, res i dent of Arcad i a who succumbed to cancer on March 8, 1987 at age 4'91. She is survived by. her husband Bill and their seven children, JeffreY, Richard, Laura, Colleen, Kathleen, Mark and Lisa; her mother, Louise' Baker of Reno, Nevada; and sisters, Sue Corano and Marylynne Tognoni, both of Reno, Nevada.
