MAY 5, 1987
The City Council met in a Special Session at 6:30 p. m., May 5,
1987 in the Arcadia City Hall Council Chamber for the purpose of
presentations by the Arca~ia Beautiful Commission to the winners
of the annual awards.

PF:ESENTATIONS
On behalf of the City Council, Mayor Gi1b commended members of
the Arcadia Beautiful for their efforts and accomplishments in
helping to make the City exemplary in that the homes and businesses
are all in good shape and everyone is very proud; also the members
of the City staff who try to persuade the owers of run down properties
to improve their homes.
Milton Imbody, Chairman of the Arcadia Beautiful Commission, intro-
duced Members of the Commission and also those of former Commissions
who were present. He explained the procedure of receiving nomina-
tions for an award, how the Commission views the yarious properties
and then the final selection of the winners. As a sidelight, Mr.
Imbody advised that at long last the fountain at the southwest
corner of Huntington Drive and Santa Anita Avenue will be re-
activated at 7:30 p. m., May 21 and invited all to attend the
ceremony.
Beth Costanza, Chairman of the Awards Committee, then introduced
those who received the awards and photographs of each home or
business were projected on a screen so everyone could see the
winner.

Young and CARRIED, the Minutes of the Adjourned and Regular Meetings
of April 21, 1987 were APPROVED.
It was MOVED by Counci1member Young, seconded by Counci1member Lojeski
and CARRIED that all Ordinances and Resolutions be read by title only
and that the reading in full be waived.
Mayor Gi1b welcomed the Boy Scout Troop No. 115, sponsored by the
Arcadia First Ward of the Church of Jesus Christ of the Latter Day
Saints, Scoutmaster Dr. Bruce Ballard and Assistant Scoutmasters,
Rcn Miller and Mike Ransom. Dr. Ballard introduced the Boy Scouts.
INFORMATIONAL PRESENTATION
Mrs. Mary Dougherty, 1110 Rodeo Road, invited all to attend an
Arcadia Schoolhouse Party at her home from 5:00 to 7:00 p. m., May 7,
in connection with a letter writing campaign sponsored by the PTA.
She then introduced Mrs. Joan Steinmeier, 5563 Hallowell Avenue,/who
ex>lained the purpose of the campaign and that she had learned while
attending a meeting in Sacramento that this year the Arcadia Schools
will have a shortfall of about $870,000 ... which amounts to 25 or
30 teaching positions. The letters will be directed to the Governor
of the State and will stress the need for school funding.
On behalf of the City Council, Mayor Gilb expressed deep appreciation
to Art Hershey, who was in the audience, on the assistance he gave
to the Senior Citizens' Picnic at the Santa Anita 'Race Track recently
... about 600 persons attended and the event was a great success
thanks to Mr. Hershey.
CITY ATTORNEY
The City Attorney announced that just prior to this meeting the City
Council and the Arcadia Redevelopment Agency recessed to a CLOSED
SESSION pursuant to Government Code Section 54956.8 to give instructions
to the City negotiator regarding the acquisition of certain properties
specifically the property in the area of the 600 block of East Live
Oak, known as Arcadia Muffler and to instruct the negotiator to
acquire this property from Jack Kawah~ta. Additionally the Council
and the Arcadia Redevelopment Agency will be adjournin9 to a CLOSED
SESSION at the conclusion of this evening's Regular Meeting pursuant
to Government Code 54956.8 to give instructions to the City negotiator
regarding ongoing negotiations concerning the so-called Nissan property
at 333 East Huntington Drive. We have been negotiating with the Lows
and their attorney, Jules Sanford and the Emkay property on the North
side area, otherwise known as the area of Third and Huntington Drive,
negotiating with Rex Smith.
It was noted for the record that the City is selling on Live Oak,
not buying.
This Text Amendment 87-6 has been initiated by the City in order
to clarify several existing Sections of the Arcadia Municipal Code
pertaining to sign regulations. It is felt that the proposed
amendments will facilitate the interpretation and application of
the regulations. A description of the intent of each of the
revisions is set forth in staff report to the Planning Commission
dated April 14, 1987. Mayor Gi1b inquired of staff about liquor
stores which sometimes seem to have their entire windows filled
with paper signs. Staff replied they could only have 25% of the
window area covered with signs; but could have 100% for a 30 day

The Planning Commission at its April 14, 1987 meeting voted 6 to 0
with one member absent to recommend to the City Council approval
of Text Amendment 87-7 amending and deleting Sections from the S-2
code which pertain to R-O and R-1 uses. Currently, there are two
properties within the City zoned S-2: the Arboretum and the County
Park. It is the opinion of staff and the Planning Commission that
residential uses are not appropriate in and do not conform to the
intent of the S-2 zone.
Mayor Gi1b declared the hearing open. No one desiring to be heard,

by Counci1member Lojeski and CARRIED.

The City of Arcadia initiated this zone change from R-1 (sing1e-
family residential) to S-2 (Public Purpose) for the property at
260 West Huntington Drive. The subject site is currently developed
with the California Armory National Guard.The Planning Commission I
at its April 14, 1987 meeting voted 6 to 0 with one member absent
to recommend approval of a zone cha~ge to S-2. It was the consensus
of the Commission that the zone change would bring the zoni~g into
consjstency with the general plan designation of Public Facilities
and would establish the ArmorY as a legal conforming use.
Mayor Gi1b declared the hearing open. No one desiring to be heard,
the hearing was CLOSED on MOTION by Counci1member Chandler, seconded
by Counci1member Young and CARRIED.

Property owners on Golden West Avenue from Naomi Avenue to the
South City limit have petitioned for an improvement district
to construct the curb, gutter and driveway aprons on Golden West
, Avenue from Naomi Avenue to the South City 1imi~s. Total cost to
be $14,000: the City's share to be $6,000 which could be funded
from State Gas Tax Funds; the property owner's share to be $8,000.
Property owners will be able to pay their assessments in cash at
the termin~tion of the work and confirmation of the assessment. If
any property owner does not desire to pay for the work in cash, the
cost of the construction shall constitute a special assessment
against the property and shall be a lien against the property under
the previsions of the Improvement Act of 1911.
Mayor Gi1b declared the hearing open. No one desiring to be heard,

Consideration of a request by the Library Board of Trustees to
accept the gift of $16,000 to the Library from the Friends of the
Library.

Mayor Gi1b requested that a letter of appreciation be written and
forwarded to the Friends of the Library.
AUDIENCE PARTICIPATION
Beth Costanza, 1155 Arcadia Avenue, No.4, spoke to her concerns
and those of her neighbors about the parking situation on Alta
Street and presented to the Council a petition signed by herself
and her neighbors requesting that Council give consideration to
this problem especially of the businesses on the South side of
Huntington Drive between Second and Santa Anita. She noted that
customers of these businesses also complain about the difficulties
they experience in finding parking.
For the past five years it was thought that the City has been
considering some way to help provide additional parking facilities,
but now condominiums are going in on Alta Street which, of course,
will only add to the overall problem. She reminded Council that
the parking on Second Avenue is only for two hour parking. She has
17 parking spaces with her busiress, but that is not adequate ..,
some of her customers park on the street and she, herself, sometimes
has to park on the street. She hoped the City could come up with

some suggestions to provide more parking and not allow so many
condominiums in that specific area ... the City should look ahead
5 - 10 - 15 years when considering the parking problems.
Also, the City seems to be granting a number of lot splits ...
Arcadia will end up like Temple City in this regard. She also
mentioned that Monrovia and Temple City both have placed moratoriums
on condominiums.

AWARDED the contract for the resurfacing of various sty'pets
to the low bidder, Industrial Asphalt in the amount of $191,128.54
for the resurfacing.of various streets, Job No. 621. The amount of
$225,000 to be appropriated from State Gas Tax and Federal Section
2126 Funds to cover the cost of construction, engineering, inspection,
contingencies and contract amount; that all informalities in the bid
or bidding process be waived; and that the Mayor and City Clerk be
AUTHORIZED to execute a contract in form approved by the City
Attorney.
AWARDED the contract for the installation of ten energy-efficient
lights and underconduit in the first alley South of Huntington Drive
from Santa Anita Avenue to Second Avenue, Job No. 623 to the low
bidder, A. E. C. Eagle Rock in the amount of $28,000.00. The amount
of $35,000 to be appropriated from the 1986 Community Development
Block Grant Funds; that any informalities in the bid or bidding
process be waived; and that the Mayor and City Clerk be AUTHORIZED
to execute a contract in form approved by the City Attorney.

Pasadena for the removal of contaminated soil at City facilities
in the amount of $30,565; the bid ~rocess was waived and $39,678
was appropriated from the Capital Improvement Fund to proceed with
Phase 2 of this project; and the Mayor and City Clerk were

Report submitted regarding the roofing materials which would be
acceptable to the Homeowner Association Architectural Review Boards.
There have been several instances where homeowners have sought
approval for the installation of Heavy Fiberglass Shingle (Composition)
roofing materials which have a Class A rating. In almost all cases
the Architectural Review Boards did not approve the Heavy Fiber-
glass Shingle ~oofing material and the homeowners subsequently
selected alternative roofing materials which were significantly
more expensive and less fire resistive. The Planning Department
has received comments from homeowners regarding the significant
cost differential between Heavy Fiberglass Shingle and other
roofing materials which have been accepted by the Architectural
Review Boards. Letters requesting cost estimates have been sent
,to twenty-one roofing companies in the area; only two responded.
Despite the lack of response, the significant cost differential is
apparent.
After a brief discussion, it was the consensus of Council thst more
information was required and it was MOVED by Councilmember Chandler,
seconded by Councilmember Young and CARRIED that staff continue study
with residents and roofers and report back to Council July 21, 1987.
The owners of Woodland'~ Archery a~d Taxidermy have requested
permission to conduct a parking lot promotional entertainment
event on May 29 - 31, 1987. The business is located at 26 E.
Hunt.ington Drive. Section 6415.4 of the Arcadia Municipal Code
applies an absolute prohibition if the event is to occur within
100 feet of any residentially zoned property. This would apply to
the Woodland's request. This is a request to Council to permit a
one-time waiver of the distance requirements to the application
filed by Woodland's Archery.
Scott Woodland, 26 E. Huntington Drive said he understood that
~event would be monitored by the Business License Department
and that in the event of any problems, it would be terminated
inmediately.
It was then MOVED by Councilmember Young, seconded by Councilmember
Lojeski and CARRIED on roll call vote as follows that the distance
requirements for promotional events be waived on a one-time only
basis for the Woodland promotion. working with stipulations in
report dated April 30. 1987.

MATTERS FROM STAFF
Called attention to the April 30 Newsletter - Item No.5 -
Memorandum from the City Attorney regarding Assembly Bill 937
concerning concurrent sale of alcohol and gasoline. He felt
the City Attorney has presented a good case for the City of
Arcadia opposing this legislation even though it appears that
the City would be exempted from its provision; that it will make
things much more difficult for other cities to be able to control
these types of sales by using a Conditional Use Permit process
rather than an outright ban.
It was MOVED by Mayor Gilb, seconded by Councilmember Young and
CARRIED on roll call vote as follows that a letter be transmitted
to the League of Cities and Legislators to register concern and
recommending their disapproval of this legislation.

Referred to Item No.4 in the April 23 Newsletter'on the Gann
appropriation limitation and commended the City Manager's response
as set forth in his letter. The City Manager explained that the
City had a request from the Chairman of the Assembly Revenue and
Taxation Committee which is looking into the subject of the Gann
appropriation limit. The State is now feeling the crunch of the
Gann limitation as well as most cities and school districts. The
City of Arcadia is now creeping closer to the Gann limit. It will
definitely affect the City in two years, possibly next year. The
Chairman was asking for input from the cities ... what effect it
has had; if we reach our limit; what to do to offset its provisions.
Answer was prepared and sent to the Assemblyman. Basically, reply
stated that it puts an unnecessary burden on cities because it
bears no rational relationship to the true costs of local govern-
ment.

With regard to April 30 Newsletter -- the correspondence from the
Board of Supervisors regarding the Brown Act which has been placed
on local governments and they are asking that the State Le9islature
impose on itself the same requirement and are asking for support.
The State Legislature has their meetings by themselves and then
decides how our meetings should be run. They should be run by the
same rules. This is our endorsement of the Supervisors' complaint.
It was then MOVED by Mayor Gilb, seconded by Councilmember Lojeski

Supervisor's complaint and send a letter to the State Legislature
to this effect.

MATTERS FROM ELECTED OFFICIALS
Had spoken to a Councilman from Sierra Madre and he had said that
he thought Sierra Madre and Arcadia could get together on paving
Orange Grove Blvd. from Michillinda to Baldwin. She responded to
him that we would be glad to pay half of it, since they cannot
afford to do it all.

Mayor Gilb sent her a memo from the Southern California Association
of Governments regarding a meeting'about transportation policy.
She is not anxious to go to such a meeting, but is concerned
beca~se Pasadena, Rosemead and San Gabriel did not approve the
transportation plan which leaves Arcadia in the middle. She will
start going to the meetings. Mayor Gilb thanked her.
Regarding April 30 Newsletter -- Item No. 12 'regarding Federal
concern about gasoline powered lawn mowers and blowers. It is
possible they may offer help.

Received a letter from Tripolis, Greece which was translated by
Art Trigonis. She met this gentleman who wrote the letter last
summer when he was here at City Hall. Basically, they are asking
if we would have any way so that the Manager of the Orthopedic
Section of the Pan-Arcadia, Hospital in Tripolis may visit America
for further training. The letter to be referred to the Sister
City Commission. Chairman Trigonis could work it through the
hospital.

Mentioned that at the last Council meeting, Council voted approval
for signs for the Gribble Company and some small signs for the
Rowan Company as the leasing agency; this was then sent to the
Modification Committee. He wondered why this had been ,handled in
this manner and if the Council's approval in such matters was not
adequate. Staff replied that this was a circumstance where Gribble
was anxious to get the signs up quickly; therefore it was sent to
Council at which time it was conditionally approved on the condition
of Mopification Committee approval. In the event the Modification
Committee did ~ot'approve the size of the signs, they would have
had to be removed. The City Attorney will review and report for
future instances.

Called attention to the May 15 Hollywood Bowl rally - JUST SAY NO
TO DRUGS - 19 buses funded by the private sector will transport the
4th, 5th and 6th grade' students ; a 20th bus will take 3rd graders to
the Universal Ampitheatre for a different drug seminar. The Chamber
of Commerce obtained the buses for the drug program for the schools.
Said he had taken the liberty of scheduling June 2 as the date the
Youth Commissioners will be formally signed out and given their
certificates of appreciation. This will be an agenda item for that
date. The two events the Commission had planned: the trip to
Disneyland -- they had planned on 20 buses, but actually had only
10 - 15 buses; the All Ninth Grade Dance was cancelled for lack of
interest.

Last week she was part of a team from Arcadia who attended Attorney
General Van de Kamp's seminar on drugs -- a two day seminar. She
was pleased to learn that Arcadia was ahead of many other cities.
Picked up a lot of ideas which may take shape in the future. It
was interesting to note that alcohol is now the most frequently used
drug in all age groups and it is considered a drug and nicotine has
been added to the drug list. It is a problem that has to start at
the local level according to the main thrust of the Conference and,
basically, in the home.
Inquired about what happened with respect to Chantry Flats and the
Boy Scouts who wanted to know how to get in and out after hours.
Staff replied that the Forest Service had donated their gate that
they had had at the parking lot. Police Chief Johnson stated that
the gate had been installed (today) and that it will be locked start-
ing on May 15th. At that time the sweeps will be started. Signs
have been up for some time. If the Boy Scouts stay there over night,
they can get out because of the pack station people. After 10 or 11
at night, they will have to walk up unless they make special arrange-
ments. The pack station people have agreed to this.
Counci1member Lojeski adjourned the meeting in memory of a long-
standing friend of Arcadia, James F. P. Thomson who died suddenly
April 25, 1987 at the age of 84. A resident of Monrovia and a
retired engineer with Southern California Gas Company, he had been
Past Master of Arcadia Masonic Lodge, Member of Pasadena Scottjsh
Rite and the A1 Ma1aikah Shrine, Past-president of Arcadia High
Twelve Club and Patron of Eastern Star. He is survived by his
wife, Ruth; sons, Bruce and Richard; a daughter, Anne Prescott;
a brother, Dr. Charles Thomson; a sister, Agnes Holmes; and 10
grandchildren. Memoy'ia1 services were held April 28.
Council entered a CLOSED SESSION, reconvened and ADJOURNED at
9:15 p. m. to 7:00 p. m., May 19,1987 in the Conference Room
of the Council Chamber to conduct the business of the Council and
Agency and any Closed Session, if any, necessary to discuss personnel,
litigation matters and evaluation of properties.
